Property struggle rages on Doctor criticizes Spa City’s certificate policy By WENDY LIBERATORE

SARATOGA SPRINGS - A medical doctor who has been struggling for a year to get a certificate of occupancy for a building and detached garage on Church Street now wonders if he needs one. Superior Data Services of Brooklyn and Clifton Park, a title search company, issued a report on the property to Dr. Richard Bryan when he bought it last November, noting that the historically commercial property was built in 1957, nearly three decades before the city issued certificates of occupancy. Nick Coffaro, assistant vice president of sales and service at Superior Data, said that means the building, which housed numerous businesses including a law office, abike shop and an art gallery, is likely grandfathered in and does not need a certificate of occupancy. In general, he said, the only thing precluding it from being grandfathered in would be if the city changed the building’s tax classification, which is labeled “converted residence” in the title search document. A review of the city’s 2019 tax rolls also shows that its classification remains converted residence. The situation continues to frustrate Bryan, who bought 138-40 Church St. in November 2018 for $645,000. “It’s been bought and sold multiple times and never had a CO issued,” said Bryan, who said he was told by the city that he’d need a certificate of occupancy before he could use the property. “They turned a blind eye to it for so many years. Now I’m being held to a higher standard.” In an email late Wednesday afternoon, City Attorney Vincent DeLeonardis said Bryan will need a certificate of occupancy for 138 Church St. because “the work currently being performed at 138 will change the occupancy of the structure from its prior use, which will ultimately require a Certificate of Occupancy for that change in use.” The “change in use” DeLeonardis cited refers to Please see PROPERTY 20

World War II Veteran’s 100th Birthday CAPITAL DISTRICT - A Battle of the Bulge survivor will celebrate his 100th birthday during a Christmas Party sponsored by the Capital District Patriot Honor Flight from 1 to 4 p.m. Sunday, Dec. 1 at the Zaloga American Legion Post at 4 Everett Road Extension, Colonie. Bill Leunig served as a tech sergeant and an instrument repairman with the Army’s 285th Combat Engineers in the World War II battle. He earned three Bronze Star Medals, an American-African-Middle Eastern Service Medal, a Good Conduct Medal and a World War II Victory Medal. Rockin’ Rob Carson, a one-man band, will entertain during the party. Carson is a former Marine Band musician. Santa Claus (Bob Smith) and Uncle Sam (Fred Polnish) will also entertain. Saratoga National Historical Park Announces Winter Hours CAPITAL DISTRICT - Transition to winter hours of operation will begin at Saratoga National Historical Park on Sunday, December 1, 2019. Beginning December 1, the park’s tour road will be closed until April 1. Winter weather may cause an earlier closure or delay opening. Please check the park’s website or social media for updates. Coinciding with the tour road closure, the visitor center will be closed on Tuesdays from December 1 through April 1. COPS, COURTS AND FIRE CALLS Indictment follows farmers market case TROY — A city resident was indicted by a Rensselaer County grand jury for allegedly knocking down a 75-year-old woman at the Troy Waterfront Farmers Market on Oct. 12, according to court records. Naquan Ruiz, 29, who was paroled from state prison on Oct. 3 after serving a sentence of almost 7 years on drug and assault charges, faces charges of felony assault and misdemeanor assault, according to the Nov. 15 indictment. The felony charge is due to injuring the woman who was older than 65 and more than 10 years older than the defendant. Two men charged in Scotia Citgo heist SCOTIA — Scotia police charged two Amsterdam residents with a Nov. 6 armed robbery of the Citgo gas station on Sacandaga Road. Christopher I.
