In a decision dated 26 May 2010, the Workers Compensation Commission considered the application of Clause 3 of Part 18C of Schedule 6 of the Workers Compensation Act 1987 (‘WCA’) to a worker’s claim for lump sum compensation for permanent psychological impairment, where section 15 WCA deemed that the injury occurred on or after 1 January 2002, but the events that the disease was ‘due to’ occurred before 1 January 2002.
