A Jolt to Joint Tenancy:

WARNING SHOT TO SENIORS By Donald A. Hunsberger

As some senior citizens have learned, even long-standing basics of the law don’t withstand the needs of government agency to pay the costs of health care.

I

n California, the Department of Health Services (DHS) operates under a regulation that changes the common law character of joint tenancy. This regulation, known as 22 CCR 50960.12 [DHS 12], effectively overhauled the legal concept of the Right of Survivorship previously practiced under California Common Law. Under the Right of Survivorship, which existed in joint tenancy definitions before California even became a state, if a person owned property with a someone who was joint tenant instead of a tenant in common, the first person’s death caused the rights of that deceased in that property to die with him or her, making his or her interest pass to the other owner or owners instantly at the moment of his or her death with no requirement of a will, a trust, a deed, or probate. The death wiped out the ownership interest of the deceased joint tenant, and the interests of the other owner or owners immediately increased without any actions required on their parts. In other words, a one-half owner of a property who survived the death of a joint tenant would have expected to become the full owner of that property after the other joint tenant died, without any creditors having the ability to attack the property through the deceased’s estate unAUGUST 2015

less they had previously filed a lien against the property. The amazing thing is that DHS has published materials that make it appear that its one regulation is the “law of California,” which clearly it is not. It is a single rule of one solitary agency. Unfortunately, as often happens with illconceived laws, the effects of DHS 12 have reached beyond their intended consequences. Consider the impact on Robert, an 80+ year-old man who felt concern over the plight of a long-term friend, Harry. Harry had home problems, so Robert, who had a large debt-free home that was paid off, let Harry move into his home. The two widowers enjoyed the arrangement, since it meant that they both had someone to talk to in the morning. Robert wanted to avoid the cost of a will or a trust, so he found a computer program at a stationery store and printed out a new deed for his home which named Robert’s son Frank and Robert’s friend Harry as joint tenants with him on his property. Robert’s goal was to have his property automatically pass at the time of his death under Section 13050 of the Probate Code to both his friend Harry, and to his son Frank. Robert planned to have Harry own the home jointly with Frank as survivors after Robert died; the

next step was for Frank to receive the home by Right of Survivorship from Harry when Harry died. If Robert had talked to Harry about his plan, he would have learned that Harry had already started to feel the effects of Alzheimer’s disease, and would not outlive Robert. Harry spent two years in a long-term care center, sponsored by Medi-Cal, and died owing a significant sum to the state. After Harry’s death DHS filed a lien against Robert’s property (without his knowledge) for the funds spent on Harry’s stay at the center.

When Robert died his son Frank received the home by Right of Survivorship, subject to the lien from the state. The result did not affect the rights of the Nursing Home debtor, Harry; instead, it was the legal rights of the survivor Robert, which were violated. It is important to remember that Harry had never contributed financially to the cost of Robert’s home. In fact, he had never paid rent to Robert, and he had never paid any of the additional costs of running the household that came from his living with Robert. Robert’s generosity had been a wonderful impulse, but he should have asked an advisor about whether the step of putting his friend on his home as a joint tenant was the best way to help his friend. Joint tenancy has always carried multiple tax and control problems for estate planning that make it inefficient; the DHS 12 provisions that eliminate the effects of the Right of Survivorship make it far too dangerous to use for senior planning purposes. CoverLaw founder Jim Cover and his attorney wife Stefanie laugh at the plethora of attorney jokes they hear. In fact Jim has compiled a collection of more than 500 such jokes. “One of the biggest challenges we face as attorneys is to persuade people that, far from the image portrayed in lawyer jokes as greedy and over-aggressive shark-like manipulators, we are actually creative problem-solvers, defenders of liberty and indispensable in a healthy democracy.” said Jim.

Many of the jokes, like the shark joke, are actually propagated by some of the very attorneys that they make fun of.

“Shark” or “pit bull” attorney ads appear everywhere -- on television, magazines, direct-mail solicitation letters, the Internet, web sites and on billboards. They flood the marketplace, telling consumers “we’re tough and we’ll take on the insurance companies,” “we protect your rights and apologize to no one,” “we speak up for victims,” “we will fight for you,” and “put a fighter in your corner.” Tough-guy ads are used because of one of the common faulty perceptions about lawyers; that is that they need to be aggressive, unethical jerks or “pit bulls” to win. This is far from the truth. Tough-guy lawyers who misbehave in court often send a message to the jury that their clients are bad people too. Juries don’t like that. In a personal injury case, the plaintiff needs the jury to like them if they are to get a favorable verdict, not have disdain for them and their mean attorney. The best trial lawyers have the highest level of ethics, class, and good manners. “From my experience,” says Stefanie Cover, “the higher the caliber of the opposing attorney, the better their demeanor.” Prior to becoming an attorney Stefanie worked as an insurance adjuster and as a claims manager. She is a member of the distinguished American Board of Trial Advocates (ABOTA) and has 24 years of jury trial experience both defending cases on behalf of insurance companies and prosecuting personal injury claims on behalf of seriously injured people. “Contrary to what the tough-guy lawyers would have you believe, insurance companies are not intimidated by the hardline approach, nor by lawyers’ claims that the insurance companies will cave because of the attorney’s so called reputation to take even bad cases to trial. This is pure nonsense. Insurance companies want to resolve cases, and they do so more expeditiously when presented with supporting documentation, appropriate experts and a well prepared case by a skilled attorney.” says Cover.

Corp semi tractor-trailer collided with his pickup and trailer carrying his horse. Acme’s lawyer, in the course of cross-examining Mr. Smith at trial, asked: “When the police officer came to the scene of the accident and asked how you were, you said, ‘I feel fine,’ didn’t you?” Mr. Smith responded, “Well, yes.” Smith’s response was 100% accurate and 100% not the truth! Smith’s lawyer then redirected his examination: “Now, Mr. Smith, you claim that you were severely injured, so why did you say that you felt fine immediately after the accident?” Mr. Smith answered, “Well, as I was saying, I was driving on Route 66 in my pickup pulling my trailer with my horse in it when this huge semi-truck ran the stop sign and smacked my right side. My pickup and trailer were destroyed. I was thrown into one ditch and my horse was thrown into the other. I was hurting real bad and didn’t want to move. I could hear my horse moaning and groaning. I knew she was in terrible shape just by her groans. “Shortly after the accident an officer came on the scene. He could hear my horse moaning and groaning so he went over to her. After he looked at her, he took out his gun and shot her between the eyes. Then the officer came across the road with his gun in his hand and looked at me. He said, ‘Your horse was in such bad shape I had to shoot her. How are you feeling?’” “This joke, while obviously exaggerated, demonstrates one of the many reasons why you need a good trial attorney if you have a significant personal injury case.” says Jim Cover. “As the opening dialogue of the 1981 Paul Newman movie ‘Absence of Malice’ suggests ‘suppose you picked up this morning’s newspaper and your life was a front page headline... and everything they said was accurate... but none of it was true?’ ... without a good lawyer, you run the risk of a serious injustice.”

Lawyers are way too expensive! “I’m going to need a lawyer, a very, very good lawyer, an expensive lawyer. It could break us.” said Rusty Sabich played by Harrison Ford in the 1990 movie “Presumed Innocent.” This movie expresses the thoughts many people have about lawyers - that even when they are truly needed they cost too much. However, in the words of the famous oil well fighter Red Adair, “If you think it’s expensive to hire a professional, wait until you hire an amateur.” When it comes to legal representation, acting in pro per, that is without a lawyer, is usually the same as hiring an amateur. “For example, think about an elderly couple on vacation who are involved in an accident with a commercial vehicle that totals their family car.” says Jim Cover. “The driver of the commercial vehicle admits fault and offers to pay for any damages. The husband who was driving the car wasn’t hurt but his wife suffered a permanent injury to her arm. Very soon after the accident the insurance company tells them that it will take care of everything making the couple feel very secure. Then the offer comes. The insurance company offers the husband $3,000 to settle his claims (since he wasn’t injured) and $33,000 to settle the wife’s. The couple thinks ‘if we settle this ourselves we will save $12,000 in attorneys fees!’ But is this right? The truth is that over time the husband’s losses related to taking care of his wife will likely exceed the combined offer they made to them both. Because she has not stabilized, is still treating, and may have more surgeries, her medical expenses may exceed the $33,000 offer by a significant amount, possibly as much as a factor of 10. In the end, if the couple opts to settle rather than engage a skilled attorney they could lose $500,000 or more in proper compensation for their loss.” All of the jokes aside, it is important to select the best attorney for your particular issue. Are you one of the thousands of people in Orange County that bought an insurance plan from Assurant Health?

T

hey were a great option for those not utilizing Covered California and wanting a broad network. Notices were sent out in June that Assurant will be leaving the Health Insurance Marketplace in 2016 due to losses of 40-50 million in the first quarter of 2015. So that leaves many not knowing where to turn to make sure they obtain new coverage that allows them keep their existing doctors and hospitals, as well as having their medications in formulary and a comparable plan. This is what I specialize in and I’m here to help. Open enrollment is Nov. 1-Jan. 31st this year. December 15th is the cut-off for January 1st coverage.

Here are a few things to keep in mind: 1. Don’t be concerned about pre-existing conditions, the Affordable Care Act does not allow underwriting, the insurance companies must accept you “warts and all”. 2. Doctors will be doing some changes this Fall. If you want to keep your current doctors and favorite hospital make sure the updated provider networks are vetted this Fall. 3. Open enrollment is the time to change plans if the plan that you had in 2015 doesn’t meet your needs for 2016. Once 1/31/2016 is behind us, you will be locked into your plan for the year. In September the new plans, prices and players will be announced and the doctor’s networks will be in place. I will be scheduling appointments either in person or by phone for those that contact me to determine what company it is best to place you with and we’ll revisit your plan selection at that time. I’m predicting a busy September calendar, so contact me soon to schedule your appointment.

Transaction or Relationship Oriented:

Banks come in many shapes and sizes; they specialize and generalize; and, they are categorized as “community,” “regional,” and “national” in scope. There are “internet” banks, “bricks-and-mortar” banks, “consumer” banks and “business” banks. There are even banks “to big to fail.”

W

ith all these varied and usually undefined terms, the selection of the “right” bank can be confusing. So let’s simplify the decision. Putting aside the descriptions above, banks and bank services fall into two basic categories: transaction-oriented and relationship-oriented.

Transaction-oriented banks are banks that offer a range of banking services from which one chooses based on their perceived needs. These banks are good places to store, and from which to dispense, money. Their customer service focus is on the products offer and their customer’s utilization of them. Sometimes they feature high interest on accounts (especially CDs) to attract transactions. But, they often charge substantial fees for transactions in other accounts such as checking and money market. In short, transactional-oriented banks offer a collection of products, much like a store. Selecting the right ones is up to the customer. Relationship-oriented banks also offer a range of services but their focus is on the customer. The goal here is to get to know the customer and to structure a suite of banking services that

integrates with their cash management and lending requirements. The intended outcome is to save the customer time and money while providing efficient financial management. In this model, the bank and the banker are resources for the customer, an important part of their financial team. Here, the bank offers solutions to cash management and lending issues and helps implement them. Most businesses, regardless of size, prefer a relationship-oriented bank. Consumers do nicely with transaction-oriented banks because their needs are less complicated. If the relationship-oriented bank is a local bank that is involved in and gives back to the communities it serves, even better. Chances are that this relationship-oriented local bank will know the customer’s name and not treat them like a number. That last paragraph describes Partners Bank to a tee. Inner Workings of the Core By Nicole Howard and cara Fraser

You hear the term “core” tossed around loosely these days, but a closer look at what that actually means reveals a very nuanced and vital part of the human body.

E

ssentially the core is comprised of all the muscles that surround the entire trunk of the body, plus a unique muscle called the thoracic diaphragm. It’s located under the ribs, it helps with breathing, and doesn’t get nearly the credit it deserves. When used in conjunction with all of the core muscles it turns the human body into a powerhouse of efficiency and strength. All mammals have a diaphragm, but us humans is unique. A flat sheet of muscle, the diaphragm essentially pulls and pushes against the lungs causing them to expand and contract. It also separates the organs of the chest and belly so the lungs and heart can function properly in their own compartments.

In humans the thoracic diaphragm is attached only at the trunk, whereas in other animals it is attached to leg muscles. This design allows us to control our breathing unlike any other creature. For example, when a cheetah breathes its diaphragm is coordinated with its legs. The legs go forward, the air is expelled. The legs stretch back, air is taken in. The faster the cheetah runs the harder it breathes making it an amazing sprinter. But humans’ independent diaphragm gives us the ability to sprint, run long distances and swim all while controlling our breath.

Breathing, a natural reflex within the body, takes perfect coordination between the rib, abdominal, and spinal muscles. When in a relaxed breathing pattern, the ribs expand and a slight extension of the spine occurs. When exhaling the ribs contract down and a flexion of the spine happens. With proper core strength these actions can be controlled, making the trunk of the body very stable. When the trunk is stable the core is activated keeping the spine in a neutral position, allowing it to move correctly, more efficiently and with more power throughout the body.

Reverse Mortgage Purchase Downsizing for Retirement By Howard Platte, Golden Empire Mortgage, Inc

The recent Case Study below is about a client that we were able to help achieve her goals for retirement through implementing the use of the FHA insured reverse mortgage program. Many people are unaware of how a reverse mortgage can be used to purchase a new home rather than being used to stay in their present home. Such is the case with the beginning of this story. It is the end of the story that makes this such a great example of a Reverse Mortgage success. Kathy was a client that I have known for many years. I have helped her and various other members of her family to purchase and refinance many homes and investment properties over the years. But this time it was different.

THE IDEA

unaware of how we could use this method to purchase a home. Her Realtor had never heard of the program either. After another meeting with her and her Realtor we were able to give her a loan pre-approval based on this little known program. We explained that based on her particular

Kathy called inquiring about how she could possibly qualify to downsize to a less expensive home in anticipation of retirement. She was not quite ready for retirement but was anticipating doing so in the coming years. She had recently changed jobs and she was no longer comfortable with the idea of keeping up mortgage payments on her North Orange County home. The idea was to sell her present home and purchase a less expensive home with a smaller mortgage or none at all. She had a first mortgage of about $330,000 and a second mortgage of about $72,000. She had already secured a buyer who would pay her approximately $750,000 for the property. After all the expenses of sale were paid, Kathy was going to net about $310,000.

THE PROBLEM There were actually two problems standing between Kathy and her goals. The first was that with only $310,000 to purchase a new home her choices were very limited or almost impossible in Orange County. That amount of money would only buy a condominium in Orange County. She was accustomed to a single family home and wanted room for visiting family members. The second problem was that she didn’t want a mortgage payment. Although she was still working, she wanted her earnings to be used to build her savings for retirement.

THE SOLUTION After an initial meeting I suggested the FHA Reverse Mortgage Purchase program for Kathy. She was completely AUGUST 2015

qualifying situation she could buy a home with about 45% down and put have no monthly mortgage payment as long as she remained in the home and paid the taxes and insurance.

THE RESULT

Kathy was able to find a $482,000 single family home and put $232,000 as a down payment.* This new home required no monthly mortgage payments at all. She was able to then use the other $78,000 from the sale of her home to pay off all of her other debts. We also helped Kathy understand how to transfer her low proposition 13 taxes from her previous home to her new one.

THE BOTTOM LINE Our client was able to remain in a single family home, do so without any new mortgage payment, retain her old super low property tax basis and prepare herself for a much more comfortable retirement. We were able to work closely with her Realtor, the listing Realtor and her financial planner to understand how this could be achieved and how it was a win-win for all concerned. Then we followed through and executed the plan. Another great result accomplished by careful planning and a coordinated effort.

South County Magazine: What are foot orthotics and how do they work? Ivar Roth, DPM: Foot orthotics are much like glasses in that when you wear them, they will change the poor foot posture into normal or a much-improved position so that ergonomically the foot functions like it should. Once the foot works properly, the body responds. This means tired legs/ feet and inside knee discomfort, hip and lower back ache/pain improves or goes away If your child has flat feet, they HAVE a problem whether you are aware of it or not. South County Magazine: What conditions do custom orthotics help alleviate in children? Ivar Roth, DPM: Flat feet for sure, but also any complaint of tired legs or not wanting to participate in sports or if your child suffers from knee pain, hip pain and/or lower back pain.

For parents who want to help their child improve their performance in sports and avoid future problems, this new generation of orthotic is a must. If your child currently has orthotics, I would strongly recommend that you come in for an examination to see if the new generation orthotics will help them more. The VAST majority of children COULD use corrective orthotics to optimize their feet. Just as most kids need vision correction or orthodontics, the same holds true with feet.

South County Magazine: What are the benefits of custom orthotics vs. the prefabricated ones on the market?

Ivar Roth, DPM: Custom orthotics of the type I use are vastly different from prefabs. The foot is corrected to nearly 100% of correction and these orthotics are calibrated to the child’s weight and so act as if they are wearing springs in their shoes. South County Magazine: What should a parent look for in their child’s feet, gait, etc. to determine a possible need for orthotics? At what age? Ivar Roth, DPM: If your child has flat feet or a foot or feet that point outward or have ankles that are collapsing inward, they would benefit from these orthotics. When you’re feeling under the weather and need your prescription filled, there is something said for speedy service that is professional and above all: caring. Chances are, you’ve spent more time than you wanted to in the waiting room at your doctor’s office, you don’t feel well, and the last thing you want to do is stop somewhere else to fill your prescriptions.

A

ll of it is enough to make you want to call your mother to come take care of you. Well, that’s exactly what the folks at OC Pharmacy had in mind when they opened for business. “It’s about being family. It’s about offering and delivering a higher standard of care for our patients,” says MJ Kazemi, owner of San Juan Capistrano-based OC Pharmacy. “OC Pharmacy opened in August 2008 on the premise that patients are people, not prescriptions. Big drugstores pressure pharmacists and their staff to increase their daily prescription count. We’re not about that here. We want AUGUST 2015

people to feel welcome and comfortable when they walk in. Because we are so specialized in care, we make the time to listen to your needs and address any questions you might have. It’s also our duty to make sure you get a good deal for your medicine.” A traditional pharmacy can only dispense commercial drugs from large brand and generic drug companies (such as Pfizer, Teva, Greenstone, etc.) – referred to as “Big Pharma” in the industry. A compounding pharmacy, on the other hand, can dispense those commercial drugs in addition to creating customized doses and

combinations of drugs within a lab at the pharmacy. As an example of what a compounding pharmacy can do that a traditional pharmacy cannot: “A baby is born with organ failure. The doctor wants to prescribe a drug that doesn’t exist in a dose safe for newborns. MJ can take the tablet form of the prescribed medication and make it into a solution of a lower, baby-safe, dose. The next problem is that many medicines have a coating that masks the flavor of the medicine and helps with digestion. When these tablets are crushed, the nasty bitter flavor is exposed. Through trial and error (or the baby’s parents’ input), MJ can find out baby’s favorite flavor and create a pediatric dose of a medication in solution form. They can then provide a special pacifier that will deliver the flavored medication to baby without any fuss.” “Some patients suffer from painful conditions where their nerves “fire” too fast sending constant pain signals to the brain,” says MJ. “Most physicians will prescribe narcotics for the pain, but that doesn’t really address the problem. We can make a topical pain cream that both helps quell the pain and calm the nerves down so they aren’t firing so fast. With that type of compound we address the problem – the nerve – and over time the patient requires less pain medication - thereby avoiding oral nar-

cotic addiction. There are cases where patients will even self-taper from oral narcotics while using topical pain management compounds.” To create a particular pharmaceutical product to “fit the unique needs of each individual,” MJ combines and/or processes appropriate ingredients, according to a physician’s prescription, utilizing various tools in the compounding lab. This may be done for medically necessary reasons (i.e. changing the form of a medication from a solid pill to a liquid), to avoid a non-essential ingredient that a person may be allergic to, or to obtain a specific dose of a particular ingredient, or combination of ingredients, and dispensed in way that makes it easier for the patient to ingest or apply. The core of OC Pharmacy’s customer base runs the gamut from infants to seniors and everyone in between, for every imaginable ailment or disease condition that can be better treated with custom medications (compounds). “People going through menopause and andropause see magnificent benefits from bio-identical hormone replacement therapy (BHRT) compounds. Older folks with arthritis can find solace in our topical arthritis compounds. Diabetic patients can form painful open sores on their feet – sores that can heal much better with custom compounds

STATE OF THE INDUSTRY While compounding pharmacies offer patients the alternative of a more effective, customized medicine, the industry itself is currently in a state of upheaval and uncertainty, according to MJ. Many national chain pharmacies are owned by insurance companies who wield influence with politicians and drug companies. As a result, local, independent compounding pharmacies are finding it increasingly difficult to compete in an environment of unfair pricing and reimbursement practices, she says. “It’s imperative that patients who wish to have the option of customized medicine make their opinions known to their local representatives and state policy-makers or having the choice of using a compounding pharmacy may be another casualty in today’s ever-changing healthcare industry.”

Doctors don’t dole out the same diagnosis to everyone, nor do they recommend the same dose of a drug to every patient - so why should our medicine be standardized? designed to keep the wound clean and promote faster healing,” says MJ. “Fussy babies will take their medication with ease when it’s flavored and dispensed through our special baby-binky dispenser or baby bottle dispensing devices. Many young athletes who are hurt on the field can use topical pain compounds instead of taking oral narcotics (and potentially heal faster!). Men and women who suffer from sexual dysfunctions can use customized compounds to help them resolve things in the bedroom. “The possibilities are endless. The sky is the limit. We believe compounding is the way medicine should be. Doctors don’t dole out the same diagnosis to everyone, nor do they recommend the same dose of a drug to every patient - so why should our medicine be standardized?”

MEDICARE ENROLLMENT AND YOUR LOCAL PHARMACY Plans change every year, even the one you currently have. At the end of the process, the patient will know exactly how much they’ll be paying out of pocket for 2016, and the pharmacy will have the new Medicare insurance information, in addition to helpful information such as whether a patient will need to switch to an alternative drug to save money. These time savers let us work with the doctor months in advance to make sure the transition to 2016 is smooth for the patient, the doctor, and the pharmacy.” As an added bonus, OC Pharmacy is offering this Medicare enrollment service at no charge through year-end 2015.

Today, these specialists are fewer and far between. E

In the theatre, the turning of these seasons can tell us a lot: about theatres and their directors, venues and their audiences, experiences and their reception. ach theatre has its own procedures for sifting through all the possibilities for production, as well as its own unique set of criteria for selecting its season’s offerings – but there are similarities, too.

The artistic director(s) and their creative team must consider whether a particular play will satisfy their audience. Does the combined season provide variety, fun and some deeper thinking challenges? Are they choosing plays that are possible to produce within the venue? Are plays being chosen that the production team can actually execute (ie: Melodramas require a director who is familiar with that unique style). Do the plays appeal to and/or educate the audience we wish to attract? Is the play appropriate for the community in which it will be performed? Should we select a play to challenge our audience?

Will the audience have a preconceived picture of this play based on a recent touring production or movie? Is the play still timely or has a change in the mores or society in general made it dated? On the practical side we must consider do we have a balanced yearly production schedule? Have we planned a season of production dates to avoid conflict with other organizations event dates where possible? How many performances are planned per play?

Camino Real Playhouse has an advantage in that it has two stages. The Mainstage offers more mainstream productions with a general audience appeal while the black box theatre, Stage II, offers more new works and cutting edge themes. Mission Preservation Foundation’s Benefit Gala to Honor Wylie and Bette Aitkin Mission San Juan Capistrano’s 2015 Romance of the Mission benefit gala will be held on Friday, September 18 on the grounds of the historic San Juan landmark.

L

ongtime supporters Wylie and Bette Aitkin are the 2015 honorees and the live concert performance in the ruins of the Great Stone Church is entitled “That’s Life!,” a tribute to Frank Sinatra on his 100th birthday. The upcoming canonization of the Mission’s founder, Blessed Junipero Serra will be acknowledged and celebrated during the evening. Proceeds from the 2015 benefit gala will be directed toward the third and final phase of the Sala Preservation Project, an ongoing renewal effort of the Mission’s 18th century building to include the museum room build-out.

Wylie Aitkin was initially invited to serve on the board by Tony Moiso and the late Robert McDonough over a decade ago. During his tenure, the board oversaw significant conservation projects including the stabilization of the Great Stone Church ruins, conservation of the Serra Chapel, new interpretation and upgrades in the South and West Wing museum rooms, and The Gate House and Sala Preservation Projects.

Widely known for their extensive philanthropic involvement in Orange County, Bette and Wylie recently marked their 50th wedding anniversary by renewing their vows in the historic Serra Chapel.

“Bette and I are truly honored and humbled to be the 2015 Romance of the Mission honorees. In the year of Father Serra’s canonization, it causes reflection on how this iconic Mission has truly become “the jewel” which has positively touched so many lives,” said the couple upon accepting the recognition.
