In 2008,while imprisoned atFDC M iam i,M ovantwasdiagnosed with HepatitisC Infections,LiverCirrhosis,D iabetes,Throm bocytopenia,A scites,H ypertension,

Hyperlipidemia,ClzronicFatigue,and othercom plicationsassociateswith HepatitisC lnfection.M ovant'scondition lim ited his ability to engage in physicalactivity,and due to thatfact,while in prison,M ovantw as neverrequired to perform any w orking

duties.Atpresenttime thereare 300pagesofmedicaldocumentsissuedby the FederalBureau OfprisonsM edicalStaff,and m ore than 100 pagesofm edicalrecords issuedby M emorialHospital,Broward GeneralHospital,N ovaUniversity M edical Centerand physicians.Defendantsarefully awareoftheserecordsand have accessto a1lmedicalrecords. W hileincarcerated atFDC M iam i,M ovantdid nothaveany chargeslevied against him by any DHO,BOP,orany otherlegalauthority,andhiscustody rem ainedas Community Custody,untilhisreleaseon 01/03/2011.M ovantwasnotin thefederal

prison forany crim esthathecom mitted.He wasin thefederalprison dueto illegal actsagainsthim comm itted by thedefendants. A 11em ployeesofFD C M iam i,thatcam e in contactw ith this case,including

CounselorPrice,W arden and a11DHO Officers,stayed away from Dism asCharities asthey felttheincarceration washighly illegal.CounselorPriceattempted tocontact, on severaloccasions,by telephone,em ailand telefax,CCM D irectorCarlos

Rodriguez,whowould beresponsible forreturning aprisonerto federalprison,to no avail.U SPO stated thatthey found outaboutthe M ovantincarceration in January

2011when they havereceived a copy ofTheM otion FortheRetum Ofproperty,sent to them by theM ovant.Even today,BOP doesnotrecognizeany chargeslevied

againstTraianBujduveanu,byanyonewhileatDismasCharities,lnc.,orafterhewas removed from Dism asCharities,and incarcerated atM iamiFDC w ithoutany regards forhismedicalconditions,and untilthe end ofhissentence. Atthe tim etheincidenttook place,referring to thetelephonefound in theglove com partm entofthe vehicle,the Plaintiffw asin H om econinem ent,outside ofthe 7

jurisdictionofthehalfwayhouse,andhewaspresentatDismasCharitiesorhisweekly report.ConditionsAnd TermsOfHom eConfinem entdo notcontain or specify telephonesin theglovecompartmentofthe driven vehicle.ln facttheterm s and conditionsdo notm ention anything aboutcellulartelephones,orany kind of

phone,being used asa weapon orexistenceofaphonein theglovecompartm entofa vehicleparked outside. The decision to send the Plaintiffback to the federalprison w as notm ade by U SPO ,

CCM and/orComm unity Sanction Center.ln factUSPO hasstated thatDefendantsfailed to adviseUSPO within 48hours,ofthe M ovantincarceration,asrequired by Federal Bttreau ofPrisonsregulation.USPO found outaboutthe incarceration in January 2011, when they received acopy ofthe M otion ForTheRetllrnOfProperty,from theM ovant. Today thereareno existing reports,investigationsorchargesby theUS Federal Bureau O fprisons,U S M arshall,U SPO ,Com m unity SanctionsCenterorany other

legalentity,and noneoftheseagencies/bureauswhattogetinvolved orhearanything aboutDismasCharitiesortheDefendants,a11documentspointing tothefacthat Defendantsacted alone.Thoseactsand om issionsrepresentvery graveillegalacts which are againstthe Constittltion Of'The United States ofA m erica.W hatthe
