unavailing,andthePlaintiffnow seeksappropriaterelief9om theCourt.(ExhibitD ) 5.D iscovery isa stage ofthe proceedingsentirely separate and apal' tfrom trial.The idea isto encourage fulldisclosure ofa1lrelevantfactsand circum stances.Ruleshave been shaped to assure thateach party knowsalloftherelevantfactsand

circumstancessothatitcanbefullypresentedto thetrialjudge.

6.TheDefendants'positionsw ith respectto discovery in thiscase are contrary to the the spiritofthe FederalRule ofCivilProcedure 26.1.By failing reasonably to respond to M ovant'srequests,the Defendantsattemptto frustrateM ovant'seffortsto prepare fortrialand havecaused the M ovantto expend valuabletim e preparing its M otion to Compeland seeking altem ate m odesofproofwith respectto the m atters em braced by M ovant'sdiscovery. 7.By itsRequestForProduction OfDocum entsand lnterrogatories,the M ovantseeks to discovery the Defendants',am ong otherthings:directand indirectcontactswith executive,legislative and otherpublic officialsand employees ofthe Federal Goverm nentregarding,theissuesraised by the claim sin thiscase;theprotection Defendantshaverelied upon form any years,notto beinvestigated by the State and/or FederalGovernm ent;Defendantspersonalcontactwith em ployeesofthe State and FederalGovem m ent;the legaldocum entsissued by legalauthoritiesin thiscase;the abuse and discrim ination practiced by the defendants' ,priorlawsuitsagainst Defendantsfordiscrim ination and sim ilarillegalacts;receiving m oney forfavors, from the residentsby Defendantsand Dism asCharitiesemployees;evidence of com m unicationsbetween Plaintiffand D efendants;widespread corruption;nam esof a11Dism asCharitiesem ployeeswho haveparticipated orwerewitnessto the incidents' ,and otheraction regarding the issuesraised by the claim sordefensesin this law suit.

8.TheDefendants'responses,attachedasCompositeExhibit''C,''uniformlyobjected

to theabove Interrogatoriesand variously stated,in essence,thatthem atters soughtto be discovered by the Plaintiffwere overbroad and confusing,notreasonably calculated to lead to thediscovely ofadm issibleevidence,intended forharassm ent, personaland confidentialinform ation.The Defendants'responseswerein other particularsvague and evasive,and improperly limited pursuantto alleged claim sthat Plaintiffsrequestswere intended forharassment.

9.Logic dictatesand Fed.R.Civ.P.26.1.providesthatthe M ovantisentitled to discovery pertaining to the fullrange ofunprivileged m attersrelevantto the issues presented in the complaintand in the defensesasserted by the Defendants.By their

15.ln al1requestsforproduction ofdocum entsand lnterrogatoriesthe Defendants havem anaged to send copiesoffourdocum entsonly,one ofthem being Conditions O fHome Confm em ent,which doesnotm ention any telephoneviolation ofany kind, and threeotherhighly dubiousdocum ents,which areunderinvestigation by the M ovant.Tw o ofthesedocum entsare attached asan ExhibitCEE''forthe Court's Convenience. 16.ln aconversation w ith CCM Director,M r.CarlosRodriguez on September 12, 2011,9:30 A m ,he stated thatheisçtnotaware ofexistenceofthisdocum ent,that CCM M iam inevercharged the M ovantw ith any violation,thusan investigation was nevercarried outby the BOP,and a reportforviolation doesnotexistsince therewas no charge.''ThisCoul'tw illhave to ask the Defendantshow they have managed to obtain thisdubiousdocum entand from whom ,asthisrepresentsa criminalact.
