Building: Dangerous Structures With a 140+ year history, Bryan has an old housing stock. Pro-active removal of dilapidated structures can lead to more aesthetically pleasing, safer neighborhoods, property value stabilization and/or improvement and private re-investment in older neighborhoods of the City. The City of Bryan, like many Texas cities, has an adopted a Dangerous Structures Ordinance which can be found in the Bryan Code of Ordinances Chapter 14. The Dangerous Structures Ordinance provides a just, equitable, and practicable method to protect the health and safety of the public where dilapidated structures can endanger the life, limb, health, morals, property, safety or welfare of the general public or occupants. Whenever a structure is reported to the City as being possibly dangerous, the Building Services and Fire Departments will make an initial site visit and attempt to contact the property owner for further investigation, to help determine if the structure is, in fact, dangerous. In determining if a structure is dangerous, the following criteria that are part of the adopted ordinance are being considered:

The building, structure, or any part thereof is liable to partially or fully collapse. The structure, or any part thereof, was constructed or maintained in violation of any provision of the City's building code, or any other applicable ordinance or law of the city, county, state or federal government.

The foundation or the vertical or horizontal supporting members are 25 percent or more damaged or deteriorated.

The structure has improperly distributed loads upon the structural members, or they have insufficient strength to be reasonably safe for the purpose used.

The structure, or any part thereof, has been damaged by fire, water, , wind, vandalism, or other cause to such an extent that it has become dangerous to the public health, safety, and welfare.

The structure is un-secured or does not have adequate light, ventilation, or sanitation facilities as required by the City's building and/or plumbing codes.

Whenever a structure is found to meet one or more of the criteria outlined in the ordinance, the City notifies the property owner and requests a time to meet and discuss repairs or solutions. When adequate response is not received, , the Chief Building Official can request a public hearing before the City’s Building and Standards Commission. The Commission is made up of 5 citizens of Bryan who are appointed by the City Council to hear and make determinations regarding unsafe structures. During 10 annual meetings, Commissioners review cases presented to them by City staff. At least 2 months before a Commission meeting, the property owner is formally notified in writing and asked to submit plans and estimates for repairs and

a timeline to complete repairs. A second meeting notice is mailed typically 5-6 weeks prior to the meeting. Following a public hearing, during which both the City and the property owners present their evidence, the Commission makes a determination whether or not the structure is unsafe and, if found unsafe, consider any and all available remedies, including, but not limited to, ordering repair or demolition, vacation of the property, securing the property, and/or shutting off public utilities. Since October 2010, the Building and Standards Commission has considered more than 200 properties. In about 90 percent of the cases, structures were found to be dangerous and too damaged to be feasible to repair. In about 60 percent of the cases where structures that were ordered to be demolished were then removed by property owners. The City Council has committed funds to engage a contractor to remove dangerous structures in those cases where a property owner fails to comply with the Commission’s order. Since October 2010, the City contracted to have over 40 dangerous structures removed from Bryan neighborhoods. Engineering: City of Bryan Capital Improvements Program or Plan (CIP) A Capital Improvements Plan (CIP) is a multi-year flexible plan outlining the goals and objectives regarding public facilities for the City of Bryan. This plan includes the development, modernization, or replacement of physical infrastructure facilities. For a project to be defined as a capital improvement project it must be at least $200,000 in cost, be nonrecurring, provide at least 5 years of benefit and be an addition to the City’s assets. Capital improvement projects can be roads, utilities, technology improvements, and municipal facilities. In 2008, the City of Bryan began developing a sustainable CIP process for the City. The process includes maintaining a project database, evaluating and ranking projects based on uniform criteria, fitting those projects into limited fiscal funds and self-evaluation of the process. The first 5 year CIP to use this process was adopted by the Bryan City Council on June 28, 2008. Since that time, four additional 5 year CIPs have been adopted on May 6, 2009, July 27, 2010, August 23, 2011 and most recently on September 10, 2013. In 2012 the Council approved a biennial CIP process that we currently follow where updates occur to the database of projects in the even fiscal years and a new CIP is proposed and adopted in odd fiscal years. Because of this change there was not an adoption of a CIP program in FY 12. The goal from the development of a 5-year CIP is a plan that outlines the projected infrastructure improvement needs of the city to assist in the planning and budgeting process. This plan will include a summary of the improvements, an estimated cost, a schedule for the improvements, and the source of funding for the project. The CIP will prioritize the identified projects into yearly plans based on functional and project categories. Because the city’s goals and resources are constantly changing, this plan is designed to be re-evaluated periodically to reaffirm or reprioritize the capital improvement projects. The prioritization of the eligible projects is done by a CIP ranking system. Each potential project must first be classified as a CIP project according to the definition above. If the above criteria are met, the project will be given areas of emphasis score, citizen survey/feedback score and a Page 2

financial, technical, and regulatory score. These scores will be combined, producing a CIP score for the project. Based on this CIP score the projects will be ranked and then assigned to a year for funding over the next five years. Projects having a higher CIP score are generally to be funded ahead of lower scoring projects but financial constraints may dictate otherwise (ie a top ranked project may exceed the available budget for a particular year and may be skipped over for another highly ranked project). by staff based on the available funding and project ranking. The schedules will determine where each project fits in the 5 year plan. This will be based on the priority of the project, funding availability and how it correlates with other CIP projects. The final CIP document will be produced based on the evaluation of the CIP Score, Project Type, Funding, and Schedule. This is an annual process that results in a new 5 year CIP forecast every 2 years. In this process the funding for the first 2 years is solidified and the remaining years are a projection of where we are headed and are less firm and could change with changing priorities. This CIP process gives staff consistent direction on projects on which to focus and keeps the City planning ahead for upcoming projects. Every other year, in an odd numbered fiscal year, the projects will be ranked and a new 5 year CIP will be prepared by staff, reviewed and approved by Council. In the even numbered fiscal years the database will be updated and public input documented and the self-evaluation of the process performed identifying any changes to be proposed to Council.

Project types competing for the funding will include streets and paving, sidewalks, facilities, parks and miscellaneous. The following types of projects are not included in this ranking system and are individually ranked on a technical basis following specified masterplans for each type of infrastructure: water, wastewater, electrical, storm water / drainage and traffic signals. Each year, funds for CIP projects will be limited based on the City’s financial status and bonding capabilities. Projects identified in the CIP may be funded by different sources. A few of the different funding options for the CIP include General Obligation (GO) Bonds, Revenue Bonds, Certificates of Obligation (COs), Direct Funding (cash), Cooperative Efforts and Grants. This event was a motivational demonstration for the students who were about to take the State of Texas STAR test. Carports, just like any other new building or structure (e.g., house, shed, carport, pergolas), are subject to building code requirements and minimum building setback requirements that the City has adopted. In most residential neighborhoods of Bryan, minimum building setbacks are as follows:

25-feet from the front property line;

By limiting the locations of buildings on a lot, minimum building setback regulations help reduce the danger of conflagration, ensure that there is adequate room for emergency access between and around the properties, provide access to utilities, and improve street visibility. Building setback requirements also help provide a minimum degree of open

space, privacy, space for maintenance on a home, predictability in development, and stability to a neighborhood. City staff can help you find out if there are any easements on your property that may interfere with the planned carport construction. These easements could be for public utilities, overhead electrical, or stormwater drainage. In some cases, a property survey prepared by a registered land surveyor may be required to help identify the remaining buildable area on your property where a carport could be installed. Before the carport can be built, you will need to apply for, and be granted, a building permit from the City of Bryan.
