Co Investing in Property

First, though, let’s talk about the possible structure needed in order to co-invest in real estate. The IRA LLC and the co-investor would hold title to the property as “tenants in common�. Tenants in common titling is for properties where multiple owners own the one property, but have not entered into an official partnership.


IRA Real Estate Investing

Some with a typical Self Directed IRA Custodian have tried to use their IRA’s to invest in Real Estate but found the process expensive and cumbersome. Their Custodian needs to approve of all investments, sign all documents pertaining to the investments and handle all of the financial transactions, both deposits and the writing of checks.


Operating Agreement IRA LLC

Fortunately, the updates are easily done and don’t require any special forms or an attorney. If you need to make address changes (for the LLC or any of the Managers), or changes to the Registered Agent, you simply need to create an Addendum to the Operating Agreement (also called a Manager Resolution).


No Custodian Required

It’s nice not to have a custodian or a trustee. In a Solo 401(k), you are the plan administrator, so there is no requirement for a trustee. You just have to have an account at a bank. You are the plan administrator, so you make all the reporting; but there’s really no reporting to be done. Normally, the custodian takes care of all that.


Multi Member Check Book IRA LLC This article will be considerably shorter than the last one, for the simple reason that I laid a lot of groundwork out in my earlier post, and there’s no need to rehash it here. I suggest you glance through the earlier post before you read this one. Please note that I am assuming that the multi-member LLC did not incur any Unrelated Business Taxable Income.
