A) Regulations : Extract of the annexe to article R*351-1 General regulations controlling maritime fishing and commercial ports from the maritime ports code: The Harbour Master’s Office allocates a berth to each ship according to its length, draught, the nature of the cargo, the requirements relative to the port’s operation and specific rules and practices. The Harbour Master’s Office may prohibit ships from entering the port if they present a risk for security, health or the environment or for the conservation or appropriate operation of port infrastructure… No ship may enter the port or manoeuvre within it if it has not first received authorization from the port officers. The Harbour Master’s Office controls the entrance, stay and exit of all ships.. The Harbour Master’s Office commands and manages all movements. captains, owners and pilots of all ships must obey all of its orders and, themselves, take all steps necessary to avoid accidents when manoeuvring…. When entering and exiting the port, each ship must fly its national ensign in addition to the regulation signal flags. Upon arrival in the port, each captain or ship-owner must submit a written declaration to the Harbour Master’s Office, indicating the names of the ship, the captain, the owner, the manager, the shipping agent and the broker; the ship’s tonnage, its draught, its type of navigation, the nature of its cargo, the number of its passengers, its last port of call, its destination and the number of crew members, in accordance with the standard declaration in use within the port…
