NOW COMES Defendant by and through counsel and hereby moves this Court, pursuant to Rule 45 to quash the Subpoena of Plaintiff Jeff Dunham dated July 22, 2010. Supporting his motion, Defendant Jamie Rosemary states as follows: 1. This is an action to quash a Subpoena requested by Plaintiff, Jeff Dunham. (“Jeff Dunham”), addressed to Defendant’s bank for it to produce and permit an inspection of: 1. Defendant’s Savings & Checking bank records for the past three years (2007-2010). 2. Initial Date Accounts were open for Jamie Rosemary. (Subpoena attached). WHEREFORE, for the reasons set forth, Defendant Jamie Rosemary respectfully requests this Honorable Court: (1) to quash the subpoena or, in the alternative to issue a protective order preventing Costal Federal Credit Union from disclosing his bank records; (2) that the Plaintiff be ordered to pay the Defendant reasonable attorney fees associated with the filing of this motion and other costs incurred by him due to her actions; (3) movant requests that this verified motion be treated as an Affidavit and (4) for such other and further relief to which the Defendant is entitled.
