The law requires an athletic search for the truth. This quote from Vince Lombardi demonstrates that in any course of human conduct, whether sport, game, battle, or profession, there is a competitive aspect, a drive to excel, and an opportunity to win. But no one is guaranteed an outcome. As advocates, we just ask that rules and procedures apply equally to all parties. An appellate courtroom, with the countless positions, questions, rules, interpretations, and challenges, takes on the role of a mental . Great arguments and winning positions are framed equally by the mind as by the pen. Appellate advocacy takes commitment, an unwavering focus, to prepare for, and win, an appeal. Every minute spent in the courtroom translates into hours of preparation. Preparation is the difference between winning and losing and is the distinguishing mark of a passionate advocate. Robert L.
