‫ﺍﳊﺴﻦ ﺁﺗﻴﹰﺎ ﻣﻦ ﻗﺒﻞ ﺍﻟﺸﺮﻉ‪ .‬ﻭﻣﻦ ﻫﻨﺎ ﻛﺎﻥ ﺍﻟﻐﺪﺭ ﻗﺒﻴﺤﺎﹰ‪ ،‬ﻭﻛـﺎﻥ‬ ‫ﺍﻟﻮﻓﺎﺀ ﺣﺴﻨﺎﹰ‪ ،‬ﻭﻛﺎﻥ ﺍﻟﻔﺴﻖ ﻗﺒﻴﺤﺎﹰ‪ ،‬ﻭﻛﺎﻧﺖ ﺍﻟﺘﻘﻮﻯ ﺣﺴﻨﺔ‪ ،‬ﻭﻛﺎﻥ‬ ‫ﺍﳋﺮﻭﺝ ﻋﻠﻰ ﺍﻟﺪﻭﻟﺔ ﺍﻹﺳﻼﻣﻴﺔ ﻗﺒﻴﺤﺎﹰ‪ ،‬ﻭﻛﺎﻥ ﺗﺼﺤﻴﺢ ﺍﻋﻮﺟﺎﺟﻬـﺎ‬ ‫ﻼ ﺣﺴﻨﺎﹰ‪ ،‬ﻷ ﹼﻥ ﺍﻟﺸﺮﻉ ﺑﻴّﻦ ﺫﻟﻚ‪ .‬ﺃﻣﺎ ﺟﻌﻞ ﺍﻟـﺸﺮﻉ‬ ‫ﺇﺫﺍ ﺍﳓﺮﻓﺖ ﻓﻌ ﹰ‬ ‫ﻼ ﻋﻠﻰ ﻣﺎ ﺩ ﹼﻝ ﻋﻠﻴﻪ ﺍﻟﻌﻘﻞ ﻓﻬﻮ ﻳﻘﻀﻲ ﲜﻌﻞ ﺍﻟﻌﻘـﻞ ﺣﻜﻤـﹰﺎ ﰲ‬ ‫ﺩﻟﻴ ﹰ‬ ‫ﻼ ﻋﻠﻰ ﻣﺎ ﺩ ﹼﻝ‬ ‫ﺍﳊﺴﻦ ﻭﺍﻟﻘﺒﺢ‪ ،‬ﻭﻗﺪ ﺑﻴﻨّﺎ ﺑﻄﻼﻧﻪ‪ ،‬ﻭﺃﻣﺎ ﺟﻌﻞ ﺍﻟﻌﻘﻞ ﺩﻟﻴ ﹰ‬ ‫ﻼ ﻋﻠﻰ ﺍﳊﻜﻢ ﺍﻟﺸﺮﻋﻲ ﻣﻊ‬ ‫ﻋﻠﻴﻪ ﺍﻟﺸﺮﻉ ﻓﻬﻮ ﻳﻘﻀﻲ ﲜﻌﻞ ﺍﻟﻌﻘﻞ ﺩﻟﻴ ﹰ‬ ‫ﺃﻥ ﺍﳊﻜﻢ ﺍﻟﺸﺮﻋﻲ ﺩﻟﻴﻠﻪ ﺍﻟﻨﺺ ﻭﻟﻴﺲ ﺍﻟﻌﻘﻞ‪ ،‬ﻭﻣﻬﻤﺔ ﺍﻟﻌﻘﻞ ﻫﻲ ﻓﻬﻢ‬ ‫ﻼ ﻋﻠﻴﻪ‪ .‬ﻭﻣﻦ ﻫﻨﺎ ﻛﺎﻥ ﺍﳊﺴﻦ ﻭﺍﻟﻘﺒﺢ‬ ‫ﺍﳊﻜﻢ ﺍﻟﺸﺮﻋﻲ ﻻ ﺟﻌﻠﻪ ﺩﻟﻴ ﹰ‬ ‫ﺷﺮﻋﻴﲔ ﻓﻘﻂ ﻭﻟﻴﺴﺎ ﻋﻘﻠﻴﲔ‪.‬‬ ‫ﻭﺍﻟﻔﺮﻕ ﺑﲔ ﻭﺻﻒ ﺍﻷﻓﻌﺎﻝ ﺑﺎﳋﲑ ﻭﺍﻟﺸﺮ ﻭﺑﲔ ﻭﺻـﻔﻬﺎ‬ ‫ﺑﺎﳊﺴﻦ ﻭﺍﻟﻘﺒﺢ ﺃﻥ ﻭﺻﻔﻬﺎ ﺑﺎﳋﲑ ﻭﺍﻟﺸﺮ ﺇﻧّﻤﺎ ﻫﻮ ﻣﻦ ﺣﻴﺚ ﺃﺛﺮﻫـﺎ‬ ‫ﰲ ﻧﻈﺮ ﺍﻹﻧﺴﺎﻥ‪ ،‬ﻭﻣﻦ ﺣﻴﺚ ﺍﻹﻗﺪﺍﻡ ﻋﻠﻴﻬـﺎ ﻭﺍﻹﺣﺠـﺎﻡ ﻋﻨـﻬﺎ‪،‬‬ ‫ﻓﺎﻹﻧﺴﺎﻥ ﺃﻃﻠﻖ ﻋﻠﻰ ﻣﺎ ﻳﻀﺮﻩ ﺃﻭ ﻣﺎ ﻳﻜﺮﻫﻪ ﻣﻦ ﺍﻷﻓﻌﺎﻝ ﺑﺄﻧﻪ ﺷـﺮ‪،‬‬ ‫ﻭﺃﻃﻠﻖ ﻋﻠﻰ ﻣﺎ ﻳﻨﻔﻌﻪ ﻭﻣﺎ ﳛﺒﻪ ﻣﻦ ﺍﻷﻓﻌﺎﻝ ﺑﺄﻧﻪ ﺧﲑ ﻣﻦ ﺃﺛﺮ ﺫﻟـﻚ‬ ‫ﻋﻠﻴﻪ ﺑﻐﺾ ﺍﻟﻨﻈﺮ ﻋﻦ ﺍﳊﺴﻦ ﻭﺍﻟﻘﺒﺢ ﻓﺈﻧﻪ ﻟﻴﺲ ﻭﺍﺭﺩﹰﺍ ﻋﻨﺪﻩ ﰲ ﻫﺬﻩ‬ ‫ﺍﳊﺎﻟﺔ‪ ،‬ﻭﺑﻨﺎﺀ ﻋﻠﻰ ﻫﺬﻩ ﺍﻟﻨﻈﺮﺓ ﻳﻘﺪﻡ ﻋﻠﻰ ﺍﻟﻔﻌﻞ ﻭﳛﺠﻢ ﻋﻨﻪ‪ ،‬ﻓﺠﺎﺀ‬ ‫ﺍﻟﺘﺼﺤﻴﺢ ﳍﺬﻩ ﺍﻟﻨﻈﺮﺓ ﺑﺄﻥ ﺍﻟﻔﻌﻞ ﻻ ﻳﻘﺎﻝ ﺇﻧﻪ ﺧﲑ ﺃﻭ ﺷﺮ ﺣـﺴﺐ‬ ‫ﺍﻟﻜﺮﺍﻫﻴﺔ ﻭﺍﳊﺐ ﺃﻭ ﺍﻟﻨﻔﻊ ﻭﺍﻟﻀﺮ‪ ،‬ﻭﺇﻧّﻤﺎ ﻗﻴﺎﺱ ﻛﻮﻧﻪ ﺧﲑﹰﺍ ﺃﻭ ﺷـﺮﹰﺍ‬
