If you think you will be selling your home this winter or early next spring take time now to photograph your yard, patio area, and outdoor living spaces so that the potential buyers can appreciate the landscaping that you have done. In Colorado we are blessed with lots of sunshine, a minimum of bugs, and fairly temperate weather. This means that decks, patios, and unheated porches can be used 8-9 months out of the year. Question: In June, the Supreme Court ruled against the Defense of Marriage Act. How will FHA and VA loans be impacted? Answer: Passed in 1996, the Defense of Marriage Act stated that as a matter of policy, the federal government would only recognize marriages between a man and a woman. As a result, the beneﬁts of more than 1,000 laws
favoring married couples were not available to same-sex couples, couples lawfully married within the states that recognized such unions. The Supreme Court decision for United States v. Windsor ruled that DOMA is unconstitutional. In terms of loans insured by the Federal Housing Authority and the Department of Veterans Affairs, the impact of the recent
landscape is barren it may be difﬁcult for a buyer to appreciate the landscaping that has been done, or how private the yard really is. Well done landscaping does add tremendously to value. If you take photos you can more easily demonstrate that value to both the buyers and the appraiser. Even when you live here, it is hard to remember how green and luxuriant it is here in the summer. I experienced this ﬁrst hand in mid April of one year when we left town for a week and when we returned everything had greened up and the trees had started to leaf out. What a startling difference! Yet in the summer time when it is all around us we just take it for granted. Whether you go to Target, Pottery Barn, or any of the home and
garden specialty stores you can see that there is a tremendous interest in creating wonderful spaces to be enjoyed both in and out doors. One of the fastest and most reasonable ways to create this appeal in your home is to plant some ﬂowers and do some basic landscaping. Fall is an excellent time to do this as most nurseries have sales to reduce inventory. Even if you start with smaller size plants that better ﬁt your budget, within a year or two they will grow. Take advantage of end of season sales to spruce up the landscape and/or buy furniture and fresh pillows to accessorizing your patio and yards. Many people extend the season into late fall and winter with outdoor ﬁre pits. By taking photos of your staged patio area now with the foliage in
full swing you can show how this area is truly an extension of the living space. Ideally you would keep a camera handy and take pictures throughout the season so that you can catch the different shrubs, trees, and ﬂowers blooming. In the fall you can catch the leaves changing color. You will enjoy these photos yourself through the winter and they would be excellent to have when you go to sell. DOMA Impact on Loans DOMA decision differs. The DOMA decision should cause no changes with FHA ﬁnancing. As HUD told my blog OurBroker.com last year, a rule called “Equal Access to Housing Regardless of Sexual Orientation or Gender Identity” became effective in March 2012. It prohibits lenders from considering sexual orientation and gender identity of loan applicants when processing applications.
Discrimination against applicants based on marital status was a prohibited even before the Equal Access rule. “Because an applicant’s marital status is irrelevant when it comes to FHA loans, whether a state recognizes same-sex marriage should not affect a lender’s loan decisions,” the HUD stated. The situation with VA mortgages is different and will likely change
after the June 2013 Supreme Court ruling.
