Started by the Pittsburgh 9.12 Project, the Pennsylvania Liberty Alliance is an independent, non-partisan association dedicated to advancing individual liberty in the Commonwealth of Pennsylvania by promoting free markets, constitutionally limited government and fiscal responsibility.  We are advocates for neither a particular political party nor legislator, but instead focus on the well-being of all citizens of Pennsylvania. We review and evaluate legislation that we believe will affect liberty in our state. We share our results (the Liberty Bell Report) with other grassroots activists who we hope will help us impact our state legislators.

We will always provide links for you to read the bills yourself, but our Report will hopefully provide most of the information you will need to become familiar with the issue,

Our Liberty Bell Report provides a summary of the legislation along with the reasons why we support it. The Report also provides talking points when calling, emailing or faxing your legislators.

RIGHT TO WORK LEGISLATION Attached are our first Liberty Bell Reports for HB 50, 51, 52, & 53, all Right to Work legislation. Here are links to these bills HB 50, 51, 52 & 53. They were all referred to LABOR AND INDUSTRY Committee on APRIL 5, 2011. The Alliance believes that the concept of Right to Work has developed as a result of free

market principles. It protects individual freedom along with promotion of freedom of speech and association. We support all four of these bills, but would recommend pushing HB 51, HB 52 & HB 53 before HB 50 to garner support for this type of

legislation. We believe that the Right to Work should begin with public sector unions due to the direct impact on taxpayers.

Although we have been told that there will not be much action on these bills until the fall, it is important that legislators start hearing from citizens who want to see our state move towards a Right to Work state. We ask that you please read our reports and then call your representative soon (click this link to find your representative) to ask them to support and move these bills from the Labor and Industry standing committee for vote. You might say something like, “Representative X, I ask you to support the Right to Work bills, HB 50, 51, 52 & 53 to ensure workplace freedom in Pennsylvania. Since businesses are typically attracted to Right to Work states, I believe that these bills will increase employment in Pennsylvania. I also think that these bills protect workers from forced union membership and dues that are partially used to elect union-friendly politicians. I would appreciate it if you would support these bills in order to move them out of the Labor and Industry Committee and to a vote.” In the Reports, we have provided many other reasons to support these bills. You can use them to develop your own message because we want your message to be unique to you. We need your help. Please take a moment to make that call or send that mail or fax!

PLA LIBERTY REPORT FOR HB 50 Name of Legislation: Freedom of Employment Act The Pennsylvania Liberty Alliance supports this legislation as written, therefore, our vote is:

We believe this bill should be passed because it: •

Layman’s Summary: This bill would eliminate compulsory membership, payment of dues/fees or requirement of any assistance to any public or private organized labor organizations as a condition of employment. It also puts forth reasonable penalties for those who do not follow this law. Also, the employee organization has no obligation to represent any employee who chooses not to be a member of their organization. This legislation is written clearly and will have a high positive impact on liberty. We believe that the bill is constitutional.

Strengthens individuals and families by allowing them to have more power over their personal property (wages). Supports the right of freedom of association. Protects workers property and choice by blocking redistribution of their income to groups which do not properly represent their interests. Provides a work environment free of political pressure. Takes power away from a few and promotes individual liberty. Will likely (per other Right to Work state reports) create higher employment and wages thereby affecting almost all citizens.

PLA LIBERTY REPORT FOR HB 51, HB 52 Name of Legislation: Amending the Act of April 9, 1929 (P.L. 177 No. 175)

The Pennsylvania Liberty Alliance supports this legislation as written, therefore, our vote is:

YEA Layman’s Summary HB 51 is aimed at School Employees, HB 52 at State Employees. These bills remove the requirement for payment of an agency fee (fair share) to unions for those employees who choose not to join the union. This fee is usually not as much as full union dues. Also, the employee organization has no obligation to represent any employee who chooses not to be a member of their organization. Currently it is legal for workers to refuse to join a union, however, they must if required by a union, pay a fee (fair share, agency fee) for union’s services. Workers can petition their employers using the Beck Law to reimburse them the amount of money that is used for any activities beyond their services as employer representation. This bill removes all requirements of dues or fees for non-union workers. • This legislation is written clearly and will have a high positive impact on liberty. We believe that the bill is • constitutional. We believe this bill should be passed because it: • •

Gives personal freedom of association guaranteed by the First Amendment. Diminishes coercive power of exclusive public union’s bargaining bosses to use government

resources to perform their administration functions. Specifically, school districts act as payroll administrators for unions by deducting dues from teacher’s salaries along with transfer of these funds along with reports to the unions performing an administrative function at taxpayer’s expense. Gives employees control over contributions made to political causes. Provides a path towards a right to work environment due to less power and money to unions. Separates the payment of union dues from the worker’s employment requirement, thus freeing workers from participating in associations which do not represent their views.

PLA LIBERTY REPORT FOR HB 53 Name of Legislation: Repealing the Public Employee Fair Share Fee Law

The Pennsylvania Liberty Alliance supports this legislation as written, therefore, our vote is:

HB – 53 Layman’s Summary: This bill, aimed at local employees of local, city, county, municipal and township employees, prohibits payment of a fair share to the employee organization by a nonmember. The employee

YEA organization has no obligation to represent any employee who chooses not to be a member of their organization. This legislation is written clearly and will have a high positive impact on liberty. We believe that the bill is constitutional.

We believe this bill should be passed because it: •

Respects the right for workers to express their voices by not being forced to contribute to causes they do not believe in. As HB 51 and HB 52, lets the workers decide what to do with their wages which are their private property. They are not forced to pay these fees as a condition of employment

Suggested improvements to Right To Work Legislation • •

As suggested earlier, we believe that it would be wise to begin with the public sector organizations. Make all payroll deductions voluntary including taxes which would be the individual responsibility of each citizen. This would also give citizens an appreciation of the amount of dues, fees and taxes they pay.
