METHODOLOGY

T

his list is excerpted from the 2013 edition of The Best Lawyers in America, the preeminent referral guide to the legal profession in the United States. Published since 1983, Best Lawyers lists attorneys in 124 specialties, representing all 50 states, who have been chosen through an exhaustive survey in which thousands of the nation’s top lawyers confidentially evaluate their professional peers. The 2013 edition of Best Lawyers is based on more than 3.9 million evaluations of lawyers by other lawyers. The method used to compile Best Lawyers remains unchanged since the first edition was compiled more than 25 years ago. Lawyers are chosen for inclusion based solely on the vote of their peers. Listings cannot be bought, and no purchase is required to be included. In this regard, Best Lawyers remains the gold standard of reliability and integrity in lawyer ratings. The nomination pool for the 2013 edition consisted of all lawyers whose names appeared in the previous edition of Best Lawyers, lawyers who were nominated since the previous survey, and new nominees solicited from listed attorneys. In general, lawyers were asked to vote only on nominees in their own specialty in their own jurisdiction. Lawyers in closely related specialties were asked to vote across specialties, as were lawyers in smaller jurisdictions. Where specialties are national or international in nature, lawyers were asked to vote nationally as well as locally. Voting lawyers were also given an opportunity to offer more detailed comments on nominees. Each year, half of the voting pool receives

fax or email ballots; the other half is polled by phone. Voting lawyers were provided this general guideline for determining if a nominee should be listed among “the best”: “If you had a close friend or relative who needed a real estate lawyer (for example), and you could not handle the case yourself, to whom would you refer them?” All votes and comments were solicited with a guarantee of confidentiality—a critical factor in the viability and validity of Best Lawyers surveys. To ensure the rigor of the selection process, lawyers were urged to use only their highest standards when voting, and to evaluate each nominee based only on his or her individual merits. The additional comments were used to make more accurate comparisons between voting patterns and weight votes accordingly. Best Lawyers uses various methodological tools to identify and correct for anomalies in both the nomination and voting process. Ultimately, of course, a lawyer’s inclusion is based on the subjective judgments of his or her fellow attorneys. While it is true that the lists may at times disproportionately reward visibility or popularity, the breadth of the survey, the candor of the respondents, and the sophistication of the polling methodology largely correct for any biases. For all these reasons, Best Lawyers lists continue to represent the most reliable, accurate and useful guide to the best lawyers in the United States available anywhere. Bringing Creativity Back to Law Throughout Utah

abian, Attorneys at Law is the kind of law firm whose work can literally be seen all around the community in which it operates. Just ask Diane Banks, an attorney in the firm’s real property group and recently named Real Estate Attorney of the Year at the 2013 Utah CCIM Business Excellence Awards. A number of the deals she has closed have changed the city’s horizons from local multi-family housing complexes, restaurants and retail spaces to the historic Walker Center. In the end, Banks and her colleagues in the group are not only helping clients achieve their business goals, they’re making a tangible impact on the Utah landscape. “I can drive through most parts of the city and see projects that I’ve been involved with in some way,” says Banks, who sometimes represents the city’s redevelopment agency in project areas. “There’s something really satisfying about being able to do that.” Banks’ singular achievements may be impressive, but she will be the first to say that the group doesn’t exist within a vacuum at Fabian. A lot of the work she does is made possible only with the contributions of other attorneys at the firm and their particular expertise. Likewise, some members of the real property group work in other areas as well. “I might need a tax attorney to help with certain aspects of a deal or need guidance on an environmental issue,” Banks says. “There are literally no walls here.” That sense of openness and communication—for the ultimate good of the client and their business interests—is just one of ways Fabian stands apart from other firms, says president Peter Billings, who also happens to work across several practice areas, including real property and complex litigation. “A lot of our work reaches several different areas of the firm,” he says. “It’s about knowing how to put together the best teams to help a client in the most effective and creative way possible. We always want to win, but we need to know what winning really means.” Indeed, creativity is a hallmark of Fabian, which was formed in 1919 as a partnership between two World War I veterans and has today grown into a firm some 51 attorneys strong that has expanded into Nevada and Washington, D.C. “It’s important for us to be able to think outside of the box,” says David Lyon, a veteran tax and estate-planning attorney who represents domestic and multinational corporations on their tax matters. “My clients would tell you that they’ve benefited because we are able to see opportunities where attorneys or firms with less breadth of experience wouldn’t. This ability to think across disciplines is very important.” But that’s not where the firm’s key differentiators begin and end. As much as Fabian’s real property group, for

example, works in the tangible, what really sets the firm apart—beyond its ingrained sense of flexibility—isn’t so easy to reach out and touch. “The difference is a set of intangible values, ideas and processes that one brings to the profession,” says Lyon. “We’re not selling a product; we deal in ideas and philosophies. It’s a sacred act to represent a client and we take that very seriously. We will work as hard as we need to until a matter is resolved.” That goes for any matter—and has been a hallmark of the firm since its early days. Founders Harold Fabian and Beverly Clendenin worked for nearly two decades (beginning in the mid-1920s) to help acquire the land that was to eventually become Grand Teton National Park, a nod to the tenaciousness that is still evident at the firm today. Attorneys also carry on the founders’ legacy for community service; Billings says the idea is to get attorneys to pursue their passions outside of the office and courtroom. “Whether it’s defending the poor or helping preserve the wilderness, we say go for it,” says Billings. “We think it lends a sense of balance to our work and helps us understand the world better. Allen adds: “The rewarding part of working in this practice area is that you have the opportunity to solve complicated problems for some very sophisticated clients. Also, it’s always interesting to dig into the different technologies and ideas that these companies and entrepreneurs have come up with.” n

Salt Lake City plaintiffs’ attorney Colin King is the person responsible for changing the way you open your soda bottles. King was a relatively young lawyer when he convinced a jury in 1988 to award his 83-year-old client $506,000 in compensatory and $10 million in punitive damages after the aluminum cap on the bottle of 7-Up she was trying to open flew off, striking her in the eye and causing vision damage. As a result of the litigation, the industry changed the bottle closures to plastic—saving countless consumers from potential injury. To this day, says King, the trial remains a highlight of a career that has spanned more than three decades and cases involving catastrophic personal injury, products liability and medical malpractice. The law, so to speak, is in King’s blood. “My father was a Harvard Law grad and was the guy that took everything that came in the door,” says King, a founder of Dewsnup, King & Olsen. “But I realized early on that what I liked best was doing contingent tort work, so I quickly gravitated in that direction.” He’s never looked back. IMMIGRATION LAW

Sandy is a Diplomat in the American College of Family Trial Lawyers, a Fellow in the American Academy of Matrimonial Lawyers (AAML) and a Fellow in the International Academy of Matrimonial Lawyers. He organized and is past president of the AAML Mountain States Chapter and is a member of the Board of Trustees of the AAML. He is currently a member of the Board of Editors of the Journal of the AAML. Sandy is a member of the ABA Family Law Section and has served as Domestic Tax Committee Chair and as a member of the Custody and Alimony Committees. He served as President of the Utah Section of Family Law and has been honored as Lawyer of the Year.

Hakeem Ishola has been practicing law since 1991. He graduated from the University of Utah College of Law in Salt Lake City, Utah, in 1991, where he was an editor on the Utah Law Review. He received his undergraduate degree from Troy State University. Hakeem is licensed to practice law in Texas and Utah. In 2010, Hakeem and fellow attorney, Aaron Tarin, formed Ishola Tarin, PLLC, where they lead a team of experienced attorneys and represent a wide range of clients from all over the world in immigration matters and criminal defense.
