teve Yerrid has pretty much seen it all. For nearly four decades, Yerrid—a consummate trial lawyer who is both respected and revered in legal circles for his nationally recognized courtroom abilities—has handled some of the most important cases of our times, from BP oil spill litigation to a landmark lawsuit against Big Tobacco. In the latter, Yerrid and his team delivered the first ever blow to cigarette makers in the form of a record-breaking $17 billion settlement, which set a ground breaking precedent when the industry agreed to curb its marketing practices and pay for smoking-cessation campaigns across the country. The Big Tobacco case was nearly 20 years ago. But decade after decade, Yerrid and the other three attorneys at his boutique plaintiffs’ practice continue to deliver big—to workers catastrophically hurt at jobsites, to families of student athletes grappling with catastrophic losses, and to patients left devastated as a result of medical negligence. In fact, the firm is positioned to handle virtually any complex civil matter clients may bring to its door, says Yerrid, a former

amateur boxer whose extraordinary success in the courtroom has translated into some 250 verdicts and settlements of $1 million or more over the course of his storied career. But that doesn’t mean the firm takes on cases for the sake of money. In fact, Yerrid explains, it’s the opposite: Being selective means the firm can do the work that matters most, both to the individual plaintiff and society as a whole. “We try to make our work center on a worthy case, rather than money,” says Yerrid, a philanthropist whose family foundation has given millions for children’s charities, pediatric cancer research, and many other worthy causes over the past three decades. “Hopefully, our cases have an impact that goes beyond the individual dispute. Making a difference and helping as many people as we can…that’s what we’ve been about since day one.” And that’s what keeps Yerrid and his team going, even in the face of odds that can, at times, seem insurmountable. “In the courtroom, it’s win or lose. There’s no in between,” he says. “We have the ability to level the playing field, match up against the most powerful foes—and, hopefully, obtain real justice.”

Lisa Schneider leads the trusts and estates practice at the Florida law firm Gunster, and has had nearly three decades of experience counseling families and closely held business owners in wills, trusts and estates, and business succession planning matters. A well-established professional in the Palm Beach area, Schneider is originally from New York and started her career working in Manhattan as a commercial litigator. “I started as one of about 30 first-year associates at the firm,” Schneider recalls. “I had a number of attractive cases and clients—there were sports teams, filmmaking clients, and some very interesting matters—but I found myself most often either in a back room writing briefs or in court waiting for a hearing, only to have it be adjourned or have the opposing counsel not show up. After doing that for about a year, understanding that my role as a litigator would have eventually taken me to trial, I realized I didn’t see myself representing major corporations. It wasn’t personally satisfying to me.” Schneider’s office at her prior firm happened to be in the same area as the trusts and estates group. She got to know some of the trusts and estates lawyers and became very interested in joining their practice. New associates were rarely considered for trusts and estates work, but she pleaded her case with one of the senior trusts and estates partners, offering to leave voluntarily at the end of six months if things didn’t work out. Schneider convinced him to give her a shot, and she practiced trusts and estates law at the New York firm for more than six years before moving to Florida with her husband and joining Gunster’s team. It was a good move for her personally and for her practice, Schneider notes. She clearly enjoys her work and its many challenges and rewards. “I enjoy working with individuals and families, and being a counselor and a problem solver,” says Schneider. “Trusts and estates work is part psychology, part technical ability, and part ability to communicate clearly. When you put it all together, it makes for a very fulfilling and satisfying career. I enjoy what I do and hope to continue counseling clients for many years to come.” In addition to her practice, Schneider is co-chair of the Women’s Leadership Forum at Gunster and is a member of numerous professional and community organizations. She is a founding trustee of the Jewish Women’s Foundation, a social change organization for women, and a founding member of Impact the Palm Beaches, a local community organization geared to helping residents of North Palm Beach County by addressing health, family, education, and other related needs. She has been recognized by The Best Lawyers in America since 2007 in trusts and estates law and litigation – trusts and estates.

ome senior-level attorneys barely use technology, either out of concern over leaks or because they simply prefer to rely on the technical contributions of colleagues. But for Miami attorney Jorge Espinosa, who began his career programming computers, that would never do. As he was graduating from high school in the late 1970s, “the Apple II was just coming on the market, and I saved money for about a year and bought my own computer, and proceeded to teach myself how to program,” recalls Espinosa, now a partner with Espinosa Trueba Martinez, a boutique IP firm in Miami. It later led to a stint writing software programs for everything from calculating betting odds to helping the disco-era Bee Gees track the band’s finances. That early exposure to programming and its hands-on analytic approach later helped the Cuban immigrant carve out a specialty when he became a lawyer, which satisfied his grandmother, who always pushed him to enter a profession. He began by tackling software copyright cases, which led to litigation work in trademarks, design patents, and general patent cases. Over time, Espinosa has become an authority on intellectual property matters, handling cases in such areas as software infringement and counterfeit trade goods, and frequently speaking on IP topics. His familiarity with technology certainly helps. In presentations, he points to cases like one from 20 years ago involving the Los Angeles school district, which had to pay the software industry $300,000 for using unlicensed software. The district also had to spend $3 million on new licensed software. More recently, the explosion of cloud computing—a form of computing that depends on data being stored by third parties at some offsite location—opens a considerable additional frontier on IP issues, he notes. “Most cloud computing

is integrally related to IP,” he explains. “You’re dealing with ephemeral things— not property or building or cars. You’re dealing with data, and concepts, and ideas on the cloud. There are so many issues that go into putting your data in the cloud that you have to be careful when you negotiate cloud contracts. You have to think of everything from encryption to who’s going to own the code.” New European Union data privacy rules also mean that any U.S. companies that wants to operate in Europe must meet these more rigid standards. In addition, as he has noted in recent speeches, the EU has a new trademark registration system in which purely functional trademarks will no longer be good enough to pass muster. The field also continually evolves with the never-ending cat-and-mouse contest between businesses and patent trolls. “Interesting times,” he says.

Changes in South Florida’s Legal Market

Miami’s role as the gateway to Latin America and a major hub of international trade has made the region a particularly fertile place to practice intellectual property law, Espinosa says. “Unlike in the Northeast, where you have 300-attorney firms, most intellectual property work in South Florida is provided by boutique law firms. Your average boutique intellectual property firm in South Florida is anywhere from about four lawyers to 15 attorneys. And that’s the norm down here. But you’re starting to see more interest by national firms in coming to South Florida.” Happily, the volume of intellectual property cases coming through Florida has risen, he says, so there’s plenty of business for everyone. Espinosa began his legal career on the staff of the Florida attorney general, where he says he got a great background in writing appellate arguments, and

later moved to large international firms, where he honed his IP focus. He put up his own shingle in 2008, cofounding a firm with fellow University of Miami law graduate William Trueba, Jr. It recently merged with another small firm to form Espinosa Trueba Martinez. “We saw it as a chance to provide a deeper bench for our clients, a wider variety of experience in the IP field, and to be able to man more cases—whether it’s doing the registration, litigation or with preparation of agreements or documents related to IP matters.” The firm also represents clients with the U.S. Customs Service. In all, it has handled business in approximately 60 countries. “Our clients have been very appreciative of the additional resources,” he says. Like its predecessor, the merged firm remains focused on intellectual property. “We want to be very good at this particular area of the law, because it’s very complicated, and requires a special focus. In the next ten to fifteen years, I look forward to having the firm growing a little bit, but not too much,” he says. “We want to keep the cordial, amicable environment that we’ve always had at our firm. We don’t want to get so big that we begin losing touch with each other.”

Cuban Roots

America’s recent opening to Cuba now brings him full circle with his roots. As a youthful immigrant from Cuba—he came to the U.S. with his grandparents shortly before his seventh birthday, the same year Castro took power—Espinosa bonded with American popular culture early. “One of the first things I saw after I came here was an episode of the old Batman series on TV, and I gotta tell you: I knew I was in the right place,” he recalls with a chuckle. “And after that I saw Star Trek, and I was sold.” The family lived in Chicago, Boston and Pittsburgh before eventually settling in Miami, when Jorge was in high school. He returned to his native island recently, for only the second time since he left, and saw cause for both pessimism and optimism. “I was in Cuba visiting family and I was both depressed and impressed. Depressed because parts of the island looked like a war zone. But impressed because you saw Cubans typing messages in Wi-Fi hotspots, just like everywhere else in the world.” As old Cold War tensions continue to thaw, there may even be opportunities to develop business in Cuba, he says. “We’re hoping that if things continue to change, there will be more opportunity in the future to maybe start developing businesses and protecting legal rights on the island.”

Legal Déjà Vu Trial lawyer Steve Yerrid, a National Trial Lawyers Association Hall-of-Famer, again achieves institutional change in a case reminiscent of an earlier tragedy.

O

n February 7, 2014, the University of California football team was finishing up a strenuous early morning workout when Ted Agu, a walk-on defensive lineman, repeatedly collapsed. After his final collapse, Agu was transferred to a nearby hospital, where, at just 21 years old, he was pronounced dead. Initially, the Alameda County coroner’s office attributed Agu’s death to hypertrophic cardiomyopathy, a condition that impedes the heart from pumping blood. University officials meanwhile reported that the workout had been routine and that Agu had been helped as soon as he started struggling. But Agu’s teammates who had witnessed the tragic event came forward and told a different story. “Depositions proved that the workout was new, designed to push players to their edge and way beyond it,” says attorney Steve Yerrid, the lead lawyer representing Agu’s parents in their wrongful death lawsuit against the university. “Numerous players also testified that Ted had been visibly struggling for an extended period of time, and that team trainers and coaches failed to intervene or provide assistance until after his final, fatal collapse.” Indeed, the sworn testimony elicited in the case raised questions as to whether campus officials had provided the

coroner’s office with the complete police report, complete witness statements, accurate factual information, and medical records indicating Agu carried sickle cell trait—a blood disorder that can activate and cause death under prolonged and extreme exertion. “Cal doctors and coaches knew of Ted’s condition since his freshman year in 2010, and once the coroner’s office was informed of the real facts concerning the severity and length of Ted’s sickling symptoms, the County’s chief medical examiner changed the official cause of death from cardiac death to exercise collapse associated with sickle cell trait,” explains Yerrid, who relied on Tampa lawyer Jeff Murphy and well-known California attorney Brian Panish to meticulously prepare the case for trial. In early 2016, after numerous depositions, the university finally admitted liability in Agu’s death and exonerated him from any wrongdoing. While this resolution of fault did not establish the amount of damages, the University of California ultimately settled the litigation shortly before trial by agreeing to pay Agu’s parents $4.75 million. UC also guaranteed a number of health and safety reforms across all 11 of its campuses, and agreed to provide coaches, team doctors, and players with further education on sickle cell trait, its associated complications, and methods of prevention. “Monitoring players with sickle cell trait is a basic and essential safety requirement. We were astonished to learn that Cal’s head football trainer, Robbie Jackson, who ironically attended to Agu as he was dying, had a unique history that should have made him acutely aware of its dangers,” says Yerrid. Amazingly, six years before Agu’s death, Jackson, who was then a trainer at the University of Central Florida, had personally assisted Ereck Plancher, a 19-year-old UCF football player with sickle cell trait, when he collapsed during a workout. As in the Agu tragedy, the coaches and training staff failed

to intervene until Plancher was in the latter stages of sickling, resulting in his death minutes later. In 2011, as the lead attorney for Plancher’s family in their wrongful death jury trial, Yerrid, with a legal team that included his partner David Dickey and Tampa lawyers Jeff Murphy and J.D. Dowell, won a $10 million verdict against the UCF Athletics Association. But eight years after Plancher’s death, the appeals process remains ongoing and the Plancher family has yet to be compensated. “Despite our repeated overtures, UCF has chosen to protect its Ohio-based insurance company instead of the student athlete’s parents,” says Yerrid. “The insurance company, contracted and paid to provide $11 million in coverage, is clearly responsible for the damages in this horrific and unnecessary death case, but the insurance company has refused to pay, and the school has supported that decision. Frankly, the school’s conduct has been unconscionable, and I believe demonstrates an utter disregard for Ereck’s loss and the welfare of his parents.” Yerrid has a long history of seeking justice against powerful and well-moneyed defendants. Over his fourdecade career, he has won more than 250 verdicts and settlements of $1 million or more, including a $330 million verdict in 2009 that remains one of the nation’s largest wrongful death verdicts, and a $217 million verdict in 2006 that stands as the largest medical malpractice verdict in Florida’s history. Yerrid currently holds Tampa’s top five personal injury verdicts, all of which are $30 million-plus results (the most recent being a $64.5 million jury award for a man seriously injured in a building collapse, which was the largest verdict in Florida for 2015). Along with these precedent-setting results, Yerrid regularly battles large defense firms and corporate giants in challenging and socially significant cases of personal injury, wrongful death, medical negligence, premises liability, and products liability. Murphy, who worked with Yerrid on the Plancher and Agu cases, calls him “easily the best trial lawyer I have seen in my career.” And Yankees owner, the late George Steinbrenner, a longtime friend and client, once noted, “If I were in a foxhole I’d want Steve Yerrid right next to me.” Yerrid is currently part of a Florida team of trial lawyers representing more than 200 professional football players in landmark concussion-related litigation against the NFL. Moreover, his track record includes some of the country’s most influential legal cases. In the mid-1990s, for example, Yerrid was the youngest of 11 private trial lawyers selected by the late Governor Lawton Chiles as part of his legal “Dream Team” to

represent the State of Florida against the then unbeaten cigarette industry. Three weeks into the jury trial, Big Tobacco finally relented, agreeing to one of the largest civil settlements Tampa lawyer Jeff Murphy ever recorded—over $17 billion— as well as landmark advertising concessions that ended Joe Camel, retired the Marlboro Man, halted many of the industry’s marketing practices, and banned cigarette vending machines, billboards, and other forms of public advertising. In addition, millions of dollars from the settlement went to creating and funding the nationwide “Truth” campaign. For Yerrid, who lost both of his parents to tobaccorelated illnesses, the outcome was a deep personal victory in addition to being transformative for society (the incriminating “smoking-gun” documents obtained by the Dream Team and the settlement’s concessions were extended nationally, benefiting every state in the country). “There was a sea change in American culture regarding smoking as a result of our case, and that demonstrated the profound difference trial lawyers can make.” Most recently, Yerrid secured a $27.4 million settlement for the City of Tampa in its lawsuit against BP over the 2010 Deepwater Horizon oil spill—the largest recovery of any city in Florida. As a result, Tampa Mayor Bob Buckhorn personally praised him and pledged to use the funds for community legacy projects. “Like many people, I was sickened by the rig’s explosion,” says Yerrid, an avid fisherman. “It was a tragedy both in terms of the eleven people who lost their lives and the profound damage to our environment. I was honored by the opportunity to hold BP responsible for its wrongdoing.” Yerrid’s significant and far-reaching results have solidified his reputation as one of the nation’s best trial lawyers. This year, the National Trial Lawyers Association inducted him into its Hall of Fame—a group comprising 49 of the country’s most distinguished trial lawyers, who have all earned recognition as champions for justice. “As a way to help people, I certainly chose the right profession,” says Yerrid, who also helps others through his family’s self-funded charity, The Yerrid Foundation, which has donated millions of dollars to more than 500 charities and causes over the years. “My successes have always come about through the help of others, and that’s why I believe it’s important to give back and provide others with a helping hand.
