The boy, who has been paralyzed on the right side of his body, blinded in his right eye, and has only this year regained his ability to speak, sustained the brain damage when his father’s seat-back collapsed onto him during the crash, and their heads collided. Rodriguez argued at trial that the car manufacturer was well aware of a serious defect in the design of the 2005 vehicle that led to the

Mark Kincaid Mark Kincaid (commercial litigation; litigation – insurance, 2015) passed away on January 19, 2016, after suffering a stroke. Kincaid, 56, was a prominent Austin attorney who had served as the leader of the Texas Office of Public Insurance Counsel in the 1990s, after his appointment by Governor Ann Richards, and subsequently worked in private practice, often fighting insurance companies on behalf of plaintiff policyholders. He was a partner at George, Brothers, Kincaid & Horton from 2012 on and previously practiced at the firm Kincaid & Horton for 15 years. Kincaid taught insurance litigation from 1995 to 2015 as an adjunct professor at the University of Texas School of Law and

was president-elect of the Texas Trial Lawyers Association. He was to assume office in 2017. Texas State Senator and former Austin Mayor Kirk Watson commented on Kincaid’s life and passing, noting both the man’s kindness and his intelligence: “He was very smart. He had excellent skills as a lawyer,” Watson said. “But above all else, he was one of the most caring men I’ve known.” Kincaid is survived by his wife Joan Erlinger Kincaid, their 9-year-old son William, and his two grown sons from a previous marriage, Connor and Matthew Kincaid.

He handled a lot of significant cases involving policyholder rights in Texas. He did anything to help the policyholder and make sure the coverage they were entitled to was received. It’s what got him out of bed each day.

Even though the boy at one point removed his boxing helmet, Rhodes showed unequivocally that the boxing helmet used at the event could not provide meaningful protection from the oversized gloves. The jury awarded the teen and his family $17.47 million. Thompson & Tiemann: G. That tendency toward making one’s own way in the world was not a gene that skipped Brophy, who graduated with his undergraduate degree in finance from the University of Texas at Austin and earned his J.D. at St. Mary’s School of Law, where he graduated magna cum laude, was a member of the John Harlan Academic Honor Society, and was an editor on the St. Mary’s Law Journal —schooling funded primarily by himself. And, now, Brophy applies that steadfast determination to winning for his clients. In 1993, Brophy started his career in San Antonio handling insurance and personal injury defense lawsuits, where he gained invaluable trial experience and learned how to successfully handle a case from beginning to end. In 1997, Brophy returned to Austin to work for a large national law firm, handling business litigation and professional malpractice matters. ardworking Americans in the oil patch live and toil in a perilous environment, performing some of the most dangerous jobs in the U.S. today. Nowhere is this work more dangerous than in Texas, where four out of every 10 oil and gas production fatalities occur, according to recent federal statistics. It’s not hard to see why. Oilfield workers log long hours for as many as 20 days at a time. Drilling and production sites are often 24/7 operations surrounded by heavy machinery, toxic chemicals, and deadline-driven schedules that require a high degree of coordination. In an industry known for lax governmental regulation and oversight, energy companies are responsible for ensuring that their workers and those nearby are safe from harm. Tragically, hundreds of oilfield workers are seriously injured or killed every year in workplace mishaps due to poor training and oversight. These catastrophic injuries and deaths take an enormous toll on communities in and around the oil patch. In addition, residents in these oil-producing areas are experiencing increased danger on roads and highways caused by the large number of 18-wheelers and heavy machinery required to support these intensive industrial operations. Trial attorney Frank L. According to recent analysis, 25 Texas oil patch counties reported triple-digit increases in truck wrecks. In Glasscock and Dimmit counties, two of the most heavily concentrated oil-producing counties in Texas, truck wrecks increased 300 percent and 229 percent, respectively.
