Dolan Law Firm: Christopher Dolan (Employment Law – Individuals, Personal Injury Litigation – Plaintiffs, Product Liability Litigation – Plaintiffs, 2014) authored an opinion article addressing concerns of a mother whose child is being cyberbullied. According to Dolan, California recognizes bullying as a form of violence, and under the state’s Safe Place to Learn and Safety Demonstration Acts, educators have a duty to intervene with all forms of bullying. He notes that any school employee must report said activity to the principal who can inform the student of their right to file a formal complaint. The principal can begin a procedure that is as simple as mediation after speaking with all involved parties all the way to contacting the social media site to have the offending material removed and the abuser’s privileges on the site revoked.

Law Offices of Amitai Schwartz: Amitai Schwartz (Administrative/Regulatory Law, Appellate Law, 2013) represented California Advocates for Nursing Home Reform and an unnamed patient during an appeal regarding end-of-life decisions for mentally incompetent residents of the state. The appellate court ruled that physicians could administer psychiatric medications so long as there was input from family members and an independent representative. “The Court has required nursing homes to provide more due process to critical medical decisions affecting these infirm and otherwise powerless patients, including the administration of psychotropic drugs and decisions surrounding the end of life,” said Amitai Schwartz. A 2016 court ruling threatened a 1992 law allowing physicians authority over residents. The clarification from the appellate court stipulated that an independent representative must be made available for any resident “determined to be decisionally incapacitated.” Law Office of Gilbert Eisenberg: Gilbert Eisenberg (Criminal Defense – General Practice, Criminal Defense – White Collar 2012) represented 22-year-old Aneth Sandoval who advertised “hella illegal guns” for sale in Oakland and San Leandro. After pleading guilty, Sandoval received a five-year federal prison sentence and her co-defendant, David Shahbazpour was sentenced to four years in a federal prison. Federal prosecutors said the two sold eight guns over a two-month period in 2018. “She desperately needed money and respite from worrying about where she could get money. She was increasingly suicidal and self-destructive. It is very important to note that adolescents and young adults often manifest their depression as anger and acting out,” Eisenberg wrote at sentencing.

Catastrophic Injury, Consumer Protection, Discrimination ROUDA FEDER TIETJEN & MCGUINN is a nationally renowned plaintiff law firm that, over the past 40 years, has regularly celebrated major results, milestones and accolades. The firm continued that tradition this past year by securing precedent-setting verdicts and settlements in the areas of personal injury, wrongful death, premises liability and public entity liability. Partner Cynthia McGuinn said the firm’s success rests on a combination of focus, determination and heart. “We’re hired to win and secure maximum compensation, but we also provide emotional support,” said McGuinn, who was named to Lawdragon’s top 500 Leading Plaintiff Consumer Lawyers in 2019. She has also been recognized as a “Top Woman Litigator” in California every year since 2005. “We accept the cases that have heart and meaning for us.” Many of those are challenging, high-profile cases which present unique factual and legal issues. McGuinn led one such case, representing a woman who was found at the bottom of a fire escape nearly 14 hours after she left a colleague’s apartment, where social drinking had occurred. No one saw her fall and how she got there was unknown. What was known was that her injuries had rendered her brain damaged and paraplegic and that the fire escape was not fully protected by a rail. That case settled for $14.25 million. In another tragic case, McGuinn represented a woman struck by a vehicle transporting fire debris from the 2017 Tubbs Fire, in which the woman’s home had been destroyed. That same woman later became the victim of medical malpractice at the hospital that treated her for her accident-related injuries and, thereafter, she tragically succumbed to cancer before her case could be completed. Nonetheless, McGuinn was able to secure $2 million for her surviving spouse for her own losses of the care and comfort of the decedent. McGuinn holds the record for the largest personal injury jury verdict in the history of Sonoma County.
Partner Tim Tietjen was a major contributor to the firm’s red-letter year, having secured two results involving separate accidental tree falls and crashes: a $58 million judgment along with firm lawyer Robert Igleheart for a 28-year-old worker who was catastrophically injured and a $47.5 million settlement for a 12-year-old’s critical injuries, surgeries and future treatment after Tietjen led the Rouda legal team through a six-year litigation to its successful conclusion. This marked the largest pretrial injury settlement for a single plaintiff in California history. Partner John Feder, a past president of California’s statewide plaintiff consumer attorney organization, has successfully handled wrongful death cases involving bicyclists struck by motorists, where both the motorists and the public entities that controlled the roadway were at fault. He successfully handled a recent matter involving four bicyclists struck by a truck during a charity bike ride to promote bicycle safety. Feder and firm attorney Mandissa Logan also successfully resolved bus/pedestrian collision cases. Feder and firm partner June Bashant secured nearly $20 million for a wrongful death case involving a major hotel owner/operator who had created a public safety risk by designing and constructing unsafe accommodations that exposed guests to the potential of serious injury and death. Additionally, the firm was again recognized by Best Lawyers, achieving a Tier 1 ranking in the areas of Personal Injury Litigation–Plaintiffs and Product Liability Litigation–Plaintiffs in the San Francisco metro area for 2020. ne thing that has kept R. A RECORD SETTLEMENT
The catastrophic injury of a 12-year-old inspired the lawyers of Rouda, Feder, Tietjen & McGuinn to take on a tree-fall case that, six years later, made California history. BY JUSTIN SMULISON
R
ouda, Feder, Tietjen & McGuinn has a lways prided itself as a plaintiff’s injury firm with the resources and stamina to last for the long haul, and a case that was settled in September 2018 demonstrated that commitment. After six years of litigation led by partner Timothy G. Tietjen, the firm secured a record-breaking $47.5 million pretrial settlement, reportedly the largest for a single plaintiff in California history. “This is one of our firm’s toughestfought cases and involved four motions for summary judgment and two appellate decisions,” Tietjen says. “But we knew we had to achieve justice for our client, who had his whole life ahead of him.” The inciting incident occurred July 25, 2012, while 12-year-old Zachary Rowe was camping with his family in a designated c a mpg rou nd i n Sa n M ateo Cou nt y Memoria l Pa rk. Ea rly that morning, a rotten 72-foot-tall tanoak tree came crashing down on Zachary’s tent, crushing him while he slept. The tree was located approximately 20 feet from a paved access road and was surrounded by a cluster of five campsites, including Zachary’s. The tree was also 37 feet from PG&E’s adjacent power line and within striking distance of the line had it fallen in that direction.
“There was evidence that this tragedy was entirely preventable,” Tietjen says. “The tanoak that fell had been rotten for years, with a 30-inch hole in its stump that rendered it hollow.” Zachary was rushed to a local hospital, where doctors recognized that the fight to save his right leg was futile. Crush injuries to Zachary’s pelvis prevented all blood flow to the limb, and the leg essentially died. Less than a week after the incident, the leg was amputated at the hip.
“The endless patience and positivity of Zachary and his fa mily inspired our whole firm to work tirelessly and secure the best result possible.” Fol lowi ng t he published appel late decisions, wherein the court found the defendants were not immune from the suit, the case proceeded to mediation in May 2018. After a two-day mediation, San Mateo County and its contractor Davey Tree agreed to pay $30 million to settle the case; PG&E and its contractor WECI agreed

Not only would Zachary lose his right leg, but his right pelvis and buttock as well. “This brave young man underwent more than 30 surgeries and initially spent over six months hospitalized,” Tietjen says.

This brought the total settlement to $47.5 million, and the case was finally resolved in September 2018. “Our result was certainly worth the effort,” Tietjen says. “The compensation ensures that Zach receives the best medical treatment and the chance to heal. N
ot every lawyer is created equal, and that’s especially true in the complex area of traumatic brain injuries. Often called invisible injuries, these are among the most challenging injuries to litigate, especially in cases where a victim outwardly appears unaffected. “Oftentimes, particularly in mild cases, a jury will look at a client who has suffered a traumatic brain injury, and they won’t see anything wrong; so, it’s the attorney’s job to help the jury understand the injury and its devastating impact on the family,” says Randall Scarlett, one of the country’s leading attorneys in the field. “To present a case involving these injuries, you have to be experienced in trying traumatic brain injury cases and knowledgeable in the science and latest diagnostic tools and treatment modalities.” In the early 2000s, Scarlett’s f irm, Scarlett Law Group, was one of the first firms to utilize 3T MRI technology in order to present evidence. The case involved a minor crash where the firm’s client didn’t begin experiencing the full effects of his injury until days after the accident. While his initial MRI—conducted at a local hospital—showed no sign of injury, a 3T MRI machine (which employs a
higher strength magnet) confirmed two small brain lesions. With this evidence, Scarlett was able to convince a jury in a conservative jurisdiction in California that what appeared to be a simple fenderbender had in fact resulted in a serious brain injury.

But the Scarlett Law Group has continued to innovate in its use of novel demonstrative evidence to litigate traumatic brain injury cases. From diffusion tensor imaging to the software applications running the MRI machines, Scarlett and his firm remain abreast of all the latest technology—not only to demonstrate the nature and extent of an injury to a jury, but also to ensure clients are benef iting from the most advanced diagnostic and treatments.

Mary Alexander was a lead attorney in a lead paint case which settled for $305 million on behalf of ten California counties against several paint companies involved in the nearly 20-year lawsuit. Ms. Alexander worked on this case for its entirety with the settlement ending two decades of litigation, which included a $1.5 billion bench verdict. She also obtained a $21.4 million verdict on behalf of the families of two brothers who died of cancer as the result of their exposure to the known cancer-causing chemical benzene.
