isa Curtis, when asked, admits it sounds hokey, but it’s true: helping patients severely damaged or killed because of medical negligence makes her feel like she is doing something good in the world to make medical care safer. “This is one of the best jobs in the world,” said Curtis—an attorney for almost 20 years, fighting for the rights of patients, and others hurt or killed by the wrongful conduct of others. “The people my firm represents are so damaged, they can’t heal or grieve from the wrongful death of their loved one unless we hold people accountable for what’s happened,” Curtis said. This is true too for the victims of childhood sexual abuse, that she and her firm represent. “I have an extraordinarily committed team that has been working with me for many, many years. This is what we do to make the world a better place.” Curtis knew from an early age she wanted to be a lawyer and feels blessed to be recognized by her peers in the law as one of the “Best Lawyers®.” While her firm provides a strong, seasoned voice for the victims of bad medical practices inside the courtroom, Curtis herself works for all of New Mexico’s residents in a much larger capacity outside of the legal arena. In late 2011, Governor Susana Martinez appointed Curtis to fill a vacated State Senate seat. Curtis assumed the District 21 seat previously held by Senator Kent Cravens, who resigned last year. Curtis is serving the remainder of Cravens’ term, which expires at the end of 2012. She’s seeking the backing of the state’s voters this November in a bid to retain her current Senate post. Curtis said having her firm singled out by Best Lawyers® is an honor she holds dear. “This is the most important honor I have ever had as a lawyer, because it is voted on by my peers,” Curtis said. “This is not an honor a lot of patients’ attorneys get so it really means a lot to me.”

t’s inevitable—at some point in your life, you’re going to need a lawyer, and you won’t always be able to forecast when that need will arise. Perhaps you or a family member is involved in an accident or accused of a crime. These are all serious matters for which you need first-rate legal representation. New Mexico’s Best Lawyers® helps take the mystery out of locating a platinum standard advocate to protect you, your family, your business and all other assets. The exceptional attorneys listed in this guide are listed in The Best Lawyers in America®. These attorneys were nominated by and voted in by their peers. Lawyers cannot buy their way into this guide. Attorneys must earn a spot in Best Lawyers through exemplary legal work that attracts the notice of their colleagues. To remain in the guide, they must be at the top of their game, year after year. Best Lawyers, the leading referral guide in the legal profession, is for the first time self-publishing this invaluable resource for readers, whatever your legal needs may be. We hope this publication is easier to use and more valuable than ever. Lawyers in this guide are arranged by their legal specialty—from Administrative/Regulatory Law to Workers’ Compensation Law—which makes it easy to find the professional advice you need. Keep this comprehensive guide available for those times when you need a first-rate advocate to assist you. The lawyers listed in New Mexico’s Best Lawyers are eager to help.

METHODOLOGY

T

his list is excerpted from the 2013 edition of The Best Lawyers in America®, the preeminent referral guide to the legal profession in the United States. Published since 1983, Best Lawyers® lists attorneys in 124 specialties, representing all 50 states, who have been chosen through an exhaustive survey in which thousands of the nation’s top lawyers confidentially evaluate their professional peers. The 2013 edition of Best Lawyers is based on more than 3.9 million evaluations of lawyers by other lawyers. The method used to compile Best Lawyers remains unchanged since the first edition was compiled more than 25 years ago. Lawyers are chosen for inclusion based solely on the vote of their peers. Listings cannot be bought, and no purchase is required to be included. In this regard, Best Lawyers remains the gold standard of reliability and integrity in lawyer ratings. The nomination pool for the 2013 edition consisted of all lawyers whose names appeared in the previous edition of Best Lawyers, lawyers who were nominated since the previous survey, and new nominees solicited from listed attorneys. In general, lawyers were asked to vote only on nominees in their own specialty in their own jurisdiction. Lawyers in closely related specialties were asked to vote across specialties, as were lawyers in smaller jurisdictions. Where specialties are national or international in nature, lawyers were asked to vote nationally as well as locally. Voting lawyers were also given an opportunity to offer more detailed comments on nominees. Each year, half of the voting pool receives

fax or email ballots; the other half is polled by phone. Voting lawyers were provided this general guideline for determining if a nominee should be listed among “the best”: “If you had a close friend or relative who needed a real estate lawyer (for example), and you could not handle the case yourself, to whom would you refer them?” All votes and comments were solicited with a guarantee of confidentiality—a critical factor in the viability and validity of Best Lawyers surveys. To ensure the rigor of the selection process, lawyers were urged to use only their highest standards when voting, and to evaluate each nominee based only on his or her individual merits. The additional comments were used to make more accurate comparisons between voting patterns and weight votes accordingly. Best Lawyers uses various methodological tools to identify and correct for anomalies in both the nomination and voting process. Ultimately, of course, a lawyer’s inclusion is based on the subjective judgments of his or her fellow attorneys. While it is true that the lists may at times disproportionately reward visibility or popularity, the breadth of the survey, the candor of the respondents, and the sophistication of the polling methodology largely correct for any biases. For all these reasons, Best Lawyers lists continue to represent the most reliable, accurate and useful guide to the best lawyers in the United States available anywhere. 2013 Lawyers of the Year John C. Bienvenu

James A. Branch, Jr.

Labor and Employment Law Santa Fe, NM

Personal Injury Litigation Al b uquer que, NM

Civil rights attorney John Bienvenu was perhaps predestined for his profession. Born the son of a litigator, the Stanford Law alumnus said there was “this expectation” he would follow in his father’s noble footsteps—which he did, of course. But not right away. “After graduating from college, I started my family and worked other jobs,” Bienvenu explained. “I did construction, wrote for the newspaper, worked as a park ranger, made documentary films. But in time, I started to get involved in certain legal matters” and before long, “law school was a natural progression.” Today, Bienvenu—who is also the father of an attorney— is a partner at Rothstein, Donatelli, Hughes, Dahlstrom, Schoenburg & Bienvenu, using his more than 20 years of court experience fighting for the rights of employees. “I’m a civil rights attorney and the workplace is a key area for enforcement of rights, from equality and-non discrimination to First Amendment freedoms of speech,” Bienvenu said. His clients include whistleblowers and other workers who’ve been retaliatory terminated for bringing unsafe work practices to the attention of management. He also works with those who’ve been sexually harassed on the job and handles class actions, consumer law cases and business torts. Bienvenu—who has been a partner at the firm the last eight years—said that since legal battles against employers can be quite costly, many victims fail to take action. “There are just certain cases that cry out for legal redress based on the egregious violations of individual rights,” Bienvenu said. “There are things that go on in workplaces that are unfair, and to which it’s impossible not be sympathetic.” A family man, Bienvenu spends much of his time outside of the office with his sons. A member of Santa Fe’s Public Campaign Finance Advisory Committee who has served on the Supreme Court’s Rules of Evidence Committee, Bienvenu is also active in the local arts scene. “I am very involved on a day-to-day basis as Board President of the Center for Contemporary Arts in Santa Fe, which is very fulfilling and time-consuming. n 8 | n e w m e x i c o ’ s Best Lawyers®

Plaintiffs’ personal injury attorney Jim Branch has had a career that’s literally taken him around the world. There was his stint in Micronesia, where he defended criminal cases from the Marianas Islands to the Marshall Islands, to a teaching fellowship— interspersed with law firm work—in Brazil. Then there were the years he spent teaching law school at the University of Denver, not to mention his active duty tour in Vietnam while he was still earning his J.D. at the University of New Mexico School of Law. But for the past 27 years, Branch has stayed pretty close to home, expertly shepherding clients through insurance disputes, medical malpractice, and catastrophic injury cases via his solo practice in Albuquerque. “I never take more than 10 cases a year,” says Branch, who takes the word ‘solo’ quite literally: he doesn’t even have a paralegal. “The way I work means that I always know what’s going on in a case—because I’m doing the work.” Branch brings that sense of ownership to every case he takes on—and wouldn’t have it any other way. “It’s the way I’ve handled my work for nearly 30 years,” he says, noting that the vast majority of his work is on referral—a testament to his reputation. “The way I practice helps me make sure that everyone’s on the same page. It works.” And though Branch, a faculty member of the National Institute of Trial Advocacy (NITA) for 25 years, has the record to prove it, he isn’t one to tout major verdicts or settlements. “It’s not my style,” he says. So what is his style? Advocacy for clients at its finest. n

Gretchen Walther family law Albu q u erq u e , NM

You only need to talk to family lawyer Gretchen Walther—of the namesake Walther Family Law that she runs with her father, David—for a short few minutes to understand why she champions divorce choices: Collaborative, Interest Based Settlement Facilitation, or litigation, depending on a family’s particular needs. Walther, who went to New York University as an art history undergrad before turning to law, sees her practice as the ultimate exercise in negotiation. So it’s definitely no surprise to learn why this daughter of 1960s civil rights activists is actually a pioneer in collaborative divorce in New Mexico. In 2001, Walther formed the New Mexico Collaborative Practice Group, a 501C-3 organization made up of lawyers, financial and mental health professionals who promote the process. “What’s great about is that professionals are finally acknowledging that unless we manage the emotional overlay of this traumatic time, people aren’t going to be making good legal decisions,” says Walther, who became interested in social justice issues as early as elementary school, when she was bussed out of her predominantly white, middle-class neighborhood to go to school in a poor, mainly African-American area. “Our job is to make sure they make good decisions. It brings a whole other level of understanding to the conflict that traditional methods can’t.” But that’s not to say Walther encourages alternative approaches in every case—and she is prepared to go to trial if necessary. “I fundamentally believe that what I’m doing helps families,” she says. “My satisfaction comes with helping clients remember their long-term goals.” n

Little, Gilman-Tepper & Batley, P.A.:

Shepherding Clients Through the Process of Divorce

F

or people going through the emotional process of divorce, there is comfort in the knowledge and confidence to make decisions based on long-term goals as opposed to what may bring short lived relief and satisfaction. The partners at Little, Gilman-Tepper & Batley, P.A. have the ability to shepherd clients through the process focused on the future. This is what has made the firm one of New Mexico’s top family law firms. “We try to keep the camera focused on a wide angle,” says founding partner Jan Gilman-Tepper, who has practiced alongside co-founding partner Sandra Morgan Little for more than 35 years. “We want our clients to acknowledge where they are in the present, but get them to see where they want to be in the future.” For clients embroiled in the stresses involved in dismantling a marriage, looking forward can sometimes be a tall order—but partners Sandra Morgan Little, Jan GilmanTepper and Roberta Batley are experts in guiding clients through the process. “We know that divorce is an emotional time, but the reality is our clients are making some of the most crucial financial decisions of their lives,” says Little. “We steer them through making the best decisions for their future and their children’s future.” Whether a client’s case requires litigation, mediation, or the collaborative process, the attorneys at Little, Gilman-Tepper & Batley P.A. stand ready—as a team. “What makes our firm unique and successful is that we have a very team-orientated approach.” says Batley. “We work closely together and that allows for many different perspectives and utilizes each of our strengths. It ends up being a real benefit to our clients.” In representing business owners and high profile individuals with complex cases, the firm ensures privacy and confidentiality. They also offer the expertise and experience required to handle the intricacies of these cases. “Family lawyers need to have knowledge in many areas of the law,” says Gilman-Tepper. “We have to have legal knowledge in business, real estate, tax, and whatever other area the case may require. We see a little bit of everything.” The firm’s attorneys are sensitive to the fact that the end result of a family law case can have a profound effect on every aspect of a client’s life. “How a divorce is handled can truly affect the financial, emotional, and personal happiness that clients enjoy for the rest of their lives. This is why it is our philosophy to give very personalized attention to the people we counsel.” says Little. “We tailor each case to meet the individual needs of the client, depending on their particular situation and priorities.” With a client’s goals in mind, the attorneys offer results through multiple options. The partners are pioneers and

leaders in the area of Collaborative Divorce in New Mexico. In this process, the attorneys of both parties meet with a team comprised of a mental health expert and a financial coach. Together, they use non adversarial techniques to coach the parties out of court in order to make sound and fair decisions and minimize emotional damage. The attorneys suggest that the Collaborative Process oftentimes is the right solution for a divorcing couple, especially when children are involved. “Co-parenting after a divorce is like running a three-legged race,” says Gilman-Tepper. “Parents are joined at the hip and are not going anywhere without cooperation. We work very hard to get everyone on the same page about the children. When one parent realizes the other parent isn’t going to disappear, that’s when they understand they have to work together.” The attorneys state that the Collaborative Process may not be for everyone. As skilled and effective trial attorneys, they are also prepared to advocate for the best interest of their client and the client’s children. “What keeps me so dedicated to family law is witnessing the successes of my clients,” says Roberta Batley. “A defining moment for me is running into a former client who tells me they couldn’t have made it through it without us—and that they are better off!” For Jan Gilman-Tepper, it is the drawer full of thank-you notes and cards. Sandra Morgan Little states she knew she had reached a high level of success when “two clients confided in me to say I had helped save their lives.” Regardless of how their clients reach closure, the partners all say that watching them flourish and emerge from the fog of divorce—with dignity and a financial plan in place—is what brings them to work every day. n For more information go to www.bestlawyers.com | 1 1
