s the founders of Anderson & Reynolds, trial lawyers Steve Anderson and Sara Reynolds offer a distinctive approach to litigation that combines their extensive courtroom experience with the client focus of a boutique setting. “We’re handling the same level of sophisticated work that we handled when we worked at larger firms,” Anderson notes. “But we’re doing it in a smaller environment where we have the flexibility to be creative on each individual case.” While Anderson and Reynolds are primarily known for medical malpractice defense, they have also represented plaintiffs and defendants in significant commercial cases. Last year, Reynolds handled a high-dollar commercial dispute spanning two states and involving multiple parties. Anderson, meanwhile, tried a recent complex commercial case in federal court. For a firm founded in 2011, Anderson & Reynolds has already received significant recognition, including a Tier 1 ranking in Nashville for defendants’ medical malpractice law by U.S. News–Best Lawyers “Best Law Firms.” In addition, Anderson was named as the 2013 Best Lawyers’ Nashville Lawyer of the Year for defendants’ medical malpractice law.

Anderson has been a member of the invitation-only American College of Trial Lawyers since 2009, and in 2012, Reynolds was recognized by Super Lawyers as a Rising Star. She also served as president of the Nashville Bar Association’s Young Lawyers Division from 2011 to 2012. “We both take a lot of pride in what we’ve accomplished,” Anderson says. “That our clients have followed us on this venture indicates that we’ve gained their trust, and that’s personally very satisfying.” Those clients include Vanderbilt University and its highly regarded medical facilities, which Anderson has represented for nearly 20 years. He and Reynolds attribute these long-term relationships to their ability to act as problem-solvers for their clients. “Sometimes the best solution is to take a case to trial, but often there are more cost-effective answers to the problem,” Anderson says. “And we pride ourselves on being able to find those solutions on a case-by-case basis.”

METHODOLOGY

T

his list is excerpted from the 2013 edition of The Best Lawyers in America, the preeminent referral guide to the legal profession in the United States. Published since 1983, Best Lawyers lists attorneys in 124 specialties, representing all 50 states, who have been chosen through an exhaustive survey in which thousands of the nation’s top lawyers confidentially evaluate their professional peers. The 2013 edition of Best Lawyers is based on more than 3.9 million evaluations of lawyers by other lawyers. The method used to compile Best Lawyers remains unchanged since the first edition was compiled more than 25 years ago. Lawyers are chosen for inclusion based solely on the vote of their peers. Listings cannot be bought, and no purchase is required to be included. In this regard, Best Lawyers remains the gold standard of reliability and integrity in lawyer ratings. The nomination pool for the 2013 edition consisted of all lawyers whose names appeared in the previous edition of Best Lawyers, lawyers who were nominated since the previous survey, and new nominees solicited from listed attorneys. In general, lawyers were asked to vote only on nominees in their own specialty in their own jurisdiction. Lawyers in closely related specialties were asked to vote across specialties, as were lawyers in smaller jurisdictions. Where specialties are national or international in nature, lawyers were asked to vote nationally as well as locally. Voting lawyers were also given an opportunity to offer more detailed comments on nominees. Each year, half of the voting pool receives fax or email ballots; the other half is polled by phone.

Voting lawyers were provided this general guideline for determining if a nominee should be listed among “the best”: “If you had a close friend or relative who needed a real estate lawyer (for example), and you could not handle the case yourself, to whom would you refer them?” All votes and comments were solicited with a guarantee of confidentiality—a critical factor in the viability and validity of Best Lawyers surveys. To ensure the rigor of the selection process, lawyers were urged to use only their highest standards when voting, and to evaluate each nominee based only on his or her individual merits. The additional comments were used to make more accurate comparisons between voting patterns and weight votes accordingly. Best Lawyers uses various methodological tools to identify and correct for anomalies in both the nomination and voting process. Ultimately, of course, a lawyer’s inclusion is based on the subjective judgments of his or her fellow attorneys. While it is true that the lists may at times disproportionately reward visibility or popularity, the breadth of the survey, the candor of the respondents, and the sophistication of the polling methodology largely correct for any biases. For all these reasons, Best Lawyers lists continue to represent the most reliable, accurate and useful guide to the best lawyers in the United States available anywhere. innard, Clayton & Beveridge has provided highquality legal services to victims of others’ negligence for more than 30 years. The firm’s dedicated attorneys bring more than 100 years of combined experience to the investigation, negotiation, and litigation of serious personal injury, medical malpractice, and wrongful death cases. “We make it a priority for our clients to know that we care about them and value them as individuals,” notes firm founder Randy Kinnard. “We try to be their friends as well as their advocates.” A highly decorated combat veteran, Kinnard says he isn’t afraid of a fight, especially when insurance companies fail to offer a fair sum of compensation to his clients. “Cases are increasingly settling outside the courtroom, but we believe in the power and fairness of trial by jury. The other side knows we’ll go to court if necessary.” A recent example of the firm’s tenacity was in a case where insurance companies offered a settlement of $4 million, but Kinnard turned down the offer and obtained a $22 million verdict. Indeed, the firm’s attorneys have achieved several record-breaking verdicts in Middle Tennessee and have successfully tried more than 250 cases in front of juries.

The firm has been recognized as Tier 1 in Nashville for plaintiffs’ medical malpractice law, personal injury litigation, and product liability litigation by U.S. News – Best Lawyers “Best Law Firms.” In addition, attorneys Mark S. Beveridge, Daniel L. Clayton, and Kinnard have all been selected for inclusion in The Best Lawyers in America. In 2013 Kinnard was recognized as Best Lawyers Nashville Lawyer of the Year for personal injury litigation, and in 2010 he was inducted into the prestigious Inner Circle of Advocates. Clayton, meanwhile, was named Best Lawyers 2012 Lawyer of the Year for plaintiffs’ medical malpractice law in Nashville. The firm’s attorneys regularly give back to Middle Tennessee, providing annual support for organizations such as Prevent Child Abuse Tennessee, the Wounded Warriors Project, and Not Alone. “We are proponents of safety, accountability, and justice within our society,” Kinnard says.

F. Dulin Kelly MEDICA L MA LP R ACT ICE LAW — P LA IN T IFFS N ASHVILLE

For the past 42 years, Dulin Kelly—founder of The Kelly Firm—has served as a staunch advocate for victims of medical malpractice, oftentimes against powerful and wellfunded opponents. This year, he was selected as the Best Lawyers’ Lawyer of the Year in Nashville for plaintiffs’ medical malpractice law. “We protect the rights of the common people when the odds are stacked against them, because we’re always trying cases against defendants who seem to have no limit to the amount they can spend,” Kelly says. “Were it not for plaintiffs’ lawyers, many of the people we represent wouldn’t have access to the courts.” He adds: “We often go to trial, rather than settle, because we feel the defendant’s offer to our client is inadequate. Our focus is therefore on a few cases rather than many in order to maximize the results for our clients.” Kelly is very selective about the medical malpractice and pharmaceutical cases he takes on, as this approach allows him to devote all of his time and attention to a limited number of cases. In the process, he has obtained some of the top medical malpractice jury results in Tennessee, including a final judgment in Nashville totaling $10 million with interest. Kelly is board-certified in medical negligence by the American Board of Professional Liability Attorneys (ABPLA) and the Tennessee Commission on Continuing Legal Education and Specialization. He is also a member of many professional organizations and serves in leadership positions for the ABPLA, American Board of Trial Advocates, and International Academy of Trial Lawyers. n
