THE PRICE OF ADMISSION States and the federal government are engaged in a pitched battle over immigration and refugee settlement— with the legal profession caught in the middle, taking fire from both sides.

C

What sort of impact have these new regulations had on your practice? Immigration attorneys in Connecticut try to bridge the divide between state and federal law by helping legislators understand the consequences that state laws can have on immigrants in our communities. Without this communication, state legislators may pass a law to solve one problem and unwittingly create new ones. How can immigration lawyers contribute to policy reforms? In several ways. For example, we can educate the public about how U.S. immigration laws actually work. I’ve found that most people are shocked to learn how few options exist to obtain lawful immigration status, and how harsh the consequences can be for violating U.S. immigration laws. Immigration attorneys can also communicate with both state and federal lawmakers to advocate for humane immigration policies. It’s critical to show how seemingly dry administrative rules can have a devastating impact on individuals and their families.

AN STATES REFUSE to settle refugees within their borders once the federal government has granted them entry into the U.S.? The Refugee Act of 1980 gave the president the power to admit refugees facing “persecution or a well-founded fear of persecution on account of race, religion, nationality, membership in a particular social group, or political opinion.” Some states, cities, and counties have since deemed themselves “sanctuary jurisdictions,” declaring that they won’t cooperate with federal efforts to enforce immigration law by removing aliens with no legal right to live there. Connecticut is one such sanctuary jurisdiction, having enacted a law “to allow in-state tuition benefits for certain unauthorized immigrant students,” according to the National Conference of State Legislatures. Can you explain the new H-1B visa registration rule and talk about how it will affect your practice? This year, for the first time, U.S. Citizenship and Immigration Services (USCIS) is requiring employers to submit online an H-1B registration in order to qualify to file a new H-1B petition. The H-1B registration is effectively a lottery ticket. Our firm and our clients face a new web-based system that USCIS has never tested in high-demand events. We’ve spent considerable time learning the new system and counseling clients regarding backup plans in case the new system becomes inoperable, which USCIS has acknowledged is a possibility. In the future, the new system may result in our firm filing fewer petition packages than before, because USCIS will only accept H-1B petitions from lottery winners. I anticipate some measure of financial impact for our firm and clients due to a potential reduction in petition filings along with the new layer of processing associated with the registration requirement. What is the much-discussed “public-charge rule,” and how will it affect immigration law? The law has historically required immigrants to overcome a ground of inadmissibility by showing they are not likely to become primarily dependent on the government for support. The new public-charge rule has dramatically changed how applicants for immigrant and nonimmigrant visas may prove that they will not become a “public charge.” I anticipate that the new rule will require many hours of our firm’s time to counsel clients and prepare the new form. It will create a morass of new paperwork, new grounds for USCIS to issue requests for evidence, and a series of applicant representations to be reviewed once again when the time comes to apply for naturalization.

OST ADULTS SPEND a third of their lives at work, according to the World Health Organization. What happens when you’re made to feel uncomfortable there? That’s when New Haven, Connecticut’s 2020 “Lawyer of the Year” in Employment Law - Individuals, Nina T. Pirrotti, steps in to help. A partner at Garrison, Levin-Epstein, Fitzgerald & Pirrotti, P.C., Pirrotti advocates for anyone disenfranchised at the office in some way: those who were sexually harassed or assaulted, victims of a hostile work environment based on race, disability, age, or anyone in any other protected category. Such cases are often quite sensitive, naturally, so Pirrotti works hard to win her clients’ conf idence a nd convince them that she’s their champion. “Gaining their trust ta kes time, patience, a nd understanding, because what they’ve gone through sometimes is so traumatic,” she says. “They’ve been treated so poorly that it’s very difficult to lay themselves out and make themselves vulnerable yet again to someone else.” Pirrotti has never lost a case, but she cites one instance in which, for reasons beyond her control, she wasn’t able to obtain the

full measure of justice for her client. “[This] is where the trust comes in,” she says. “Because if I’ve done my job and the client trusts me and knows I’m doing everything in my power to leave no stone unturned, that I’ve gone to the ends of the earth to advocate for them, to do the research, the investigation, everything necessary—and if we don’t achieve all that my client hopes, that trust makes all the difference in the world.” A lt hough her work ca n be t i r i ng and sometimes frustrating, Pirrotti has never been bored, she says, finding her cases emotiona l ly a nd i ntel lectua l ly challenging: “They bring tremendous reward in championing the rights of the disenfranchised. I have that same passion that I’ve had from the first day, and it’s because when you do this type of work, you have the ability to change someone’s life.” Pirrotti would love to see more young people from all walks of life, all races and nationalities, gravitate toward employee advocacy. “You have the opportunity to make a difference in someone’s life that is incredibly important and meaningful,” she says. “The rewards that come from that cannot be measured in money—or any other way.”

Resolving Emerging-Technology Cases

Koskoff’s lawyers keep themselves abreast of emergingtechnology risks that affect the legal landscape. Bloss, for example, is currently representing the family of a woman whose keyless car allegedly caused her accidental death due to a design f law. “The car failed to automatically shift into park after it had stopped, which it should have done after the shoulder belt was removed,” Bloss says. “Most car models that have this stopping feature will shift automatically, but we found that this one did not have that design. The car rolled forward and dragged our client with it. It is terribly tragic, and we are working tirelessly not only to secure justice for her family, but also to ensure that this does not happen to others in the future.” The firm is highly regarded for its success in trucking litigation as well. As part of discovery, Koskoff uses vehicles’ tracking technology to prove defendants’ fatigue and irresponsibility while driving. “We always acquire the information from the trucks’ black boxes, but we also get toll records and cell phone usage records of the defendants,” Bloss says. “Many trucking companies now have video cameras in the cabs that often show driver impairment due

Bloss is litigating what’s known as an “orifice injury” case in which a young woman was severely injured after falling into a watercraft’s jet thrust. “When water enters someone’s body at such a high intensity, it can cause catastrophic internal damage,” he says. Cases like these are indicative of the complex matters the firm handles, often with a broader goal of promoting social justice. “We’re confident that our achievements in product liability litigation lead to improvements in product safety,” Bloss says. “That’s important not only for our clients but also for all people who will use those products in the future.”

Michele Volpe has practiced for nearly 30 years in the field of health care law.
