Brownstein Hyatt Farber Schreck: ► Norman Brownstein (government relations practice, 2013) and Steven W. Farber (corporate law, 2013) were honored as distinguished alumni by the University of Colorado Law School.

Joseph Saint-Veltri, Attorney At Law: ► Joseph Saint-Veltri (criminal defense:

general practice, 1983) is defending fellow attorney David Furtado in federal court against charges of money laundering and attempting to make bank deposits of money obtained through illegal means. Saint-Veltri and his client argue that the money came only from Furtado’s involvement in a legal medical marijuana business and that he has not violated state law, adding, interestingly, that a budget amendment passed by the U.S. Congress in 2014 prevents the DOJ from allocating funds to prosecute cases like Furtado’s in states that have decriminalized or legalized marijuana.

Davis Graham & Stubbs: Jason M. Lynch ► (securities / capital markets law, 2014) and Robert C. Mathes (energy law, 2014) joined the firm from Reilly Pozner and Bjork Lindley Little, respectively.

Eytan Nielsen: Iris Eytan (criminal ► defense: general practice, 2011) and Jason

M. Lynch of Davis Graham & Stubbs are part of a team of attorneys working pro bono with the legal watchdog group Disability Law Colorado in bringing a suit in federal court against the Colorado Department of Human Services (CDHS), alleging that the CDHS blocked numerous mentally ill inmates from receiving timely mental health care IRIS EYTAN by enacting a policy of admitting only one person to the state mental health hospital per day. Under a 2012 agreement reached with Disability Law Colorado in federal court, the CDHS is responsible for ensuring that mentally ill inmates awaiting trial are screened in the state hospital within 28 days JASON LYNCH of their imprisonment; an audit by Disability Law Colorado revealed that only three of 103 cases last July had been attended to within 28 days and that some inmates had been awaiting mental health screening and treatment for as much as six months.

Kaplan Kirsch & Rockwell: Lori Potter ► (environmental law, 1995) is representing

Foster Graham Milstein & Calisher: ► Gary Lozow (criminal defense: general

practice; criminal defense: white-collar, 1995) represented former Denver city supervisor Larry Stevenson in a corruption case, helping him reach a plea agreement with city prosecutors. Stevenson accepted money from a taxi service while working for the city agency dedicated to regulating taxis. He also promised a parking contract at the Denver airport to an FBI informant in exchange for $5,500. The district attorney’s office agreed to drop two felony bribery charges, and Stevenson pleaded guilty to two misdemeanor conflict-of-interest charges.

Greenberg Traurig: Brian L. Duffy ► (commercial litigation; labor and

employment law, 2010) has been promoted to chief executive officer of the 1,800-lawyer firm. Duffy previously served as chair of the firm-wide litigation department, and splits his time between the firm’s New York and Denver offices.

the artist Christo in suits over the proposed construction of his temporary art installation, “Over the River.” Christo and his late wife Jeanne-Claude are famous for wrapping the German Reichstag in fabric in the 1970s and for their installation “The Gates” in New York’s Central Park in 2005. The “Over the River” installation, proposed in 2008, would consist of sheets of shiny silver fabric suspended over approximately six miles of the Arkansas River west of Colorado Springs. The project has been on hold since 2011 due to lawsuits brought by the group Rags Over the Arkansas River (ROAR), which has argued that “Over the River” would have an adverse impact on the river’s native bighorn sheep, challenging the federal Bureau of Land Management’s assessment and approval of the project. Keating Wagner Polidori Free: Christina Habas (employment law – individuals, medical malpractice law – plainttifs, personal injury litigation – plaintiffs, product liability litigation – plaintiffs, 2015) is representing victims of the Aurora movie theater massacre in a case against theater chain Cinemark, arguing that the company could have and should have provided more security to patrons at the theater where 12 were murdered and 70 were injured by gunman James Holmes in 2012. Holmes was convicted in criminal court of 24 counts of first-degree murder in July 2015 and was sentenced to life in prison. The civil trial against the theater chain is set to begin in May. Killmer, Lane & Newman: Darold W. Killmer (civil rights law; employment law – individuals; litigation – labor and employment, 1995) is part of a team representing two environmental activists from Boulder in a suit against Peabody Energy. The activists claim that their civil rights were violated when they were arrested at the company’s behest for attempting to protest a meeting of Peabody’s shareholders in Wyoming. The lawsuit filed by the pair’s attorneys includes DAROLD KILLMER lyrics from John Prine’s 1971 protest song “Paradise” about a boy who can’t get back to “where paradise lay” because “Mister Peabody’s coal train

has hauled it away”—an explicit reference to Peabody’s coal mining practices. An early motion by the energy company’s defense seeking to strike the lyrics from the suit was tossed out by a federal judge in Cheyenne, who suggested that the lyrics were too old and possibly too familiar to unfairly prejudice a jury. Mari Newman (employment law – MARI NEWMAN individuals, 2011) and co-counsel Darold W. Killmer are representing the family of Michael Marshall, a mentally ill homeless man who died after a fracas in jail in Denver only a few days after he was arrested for trespassing and creating a disturbance at a local motel. Six sheriff’s deputies at the jail have been reassigned to duties not involving contact with inmates until the police have finished their investigation. Newman has publicly called for an independent investigation and for the release of surveillance footage of the incident, arguing that the City’s investigation into Marshall’s death lacks transparency. Leventhal & Puga: Hollynd Hoskins (personal injury litigation – plaintiffs, 2013) is representing the family of a 22-year-old man who died in an in-patient mental health and substance abuse rehab in Littleton. The family has brought a suit against the facility, alleging that the young man was not properly monitored and that he received higher doses of the powerful synthetic painkiller fentanyl than were ordered by his doctor. Rathod Mohamedbhai: Qusair Mohamedbhai (employment law – individuals, 2016) helped win $3.9 million in a Denver court for a woman who was sexually assaulted by her former romantic partner and employer, an affluent Colorado business owner. The Law Offices of Gary Pirosko: Gary Francis Pirosko (DUI/DWI defense, 2015) passed away on August 4, 2015, at the age of 57. Born in Cleveland, Ohio, Gary moved to Colorado as a young man, attended Colorado State University, and worked as a police officer and a deputy sheriff for eight years before deciding to become a lawyer. After receiving his juris doctor from the University of Denver College of Law, Gary served first as a deputy in the Adams County District Attorney’s office and subsequently went on to start his own practice and lead a successful career as a criminal defense attorney specializing in DUI cases. Gary is survived by his numerous nieces and nephews and by his four siblings: Bruce Pirosko, Joan Sprinkle, Dennis Ross, and Connie Proulx. TRUSTS AND ESTATES BOULDER, CO ne might not automatically assume it, but Jennifer Spitz, a name partner in Stover & Spitz, has a wry sense of humor and delivers self-deprecating one-offs with endearing ease. Spitz has practiced trusts and estates law in Longmont, Colorado, since 1998, and she’s heavily involved in the Colorado Bar Association’s trusts and estates section. “It helps to be really detail oriented,” Spitz says of her professional success. “I spend a lot of time with minutiae.” Spitz’s work tends to focus on helping individual clients figure out how to plan for leaving their assets behind and choose whom they would like to make decisions on their behalf when they are unable to do so themselves. Much as it helps to be a specialist in this area, Spitz says, it is crucial as well to be a people person who is good at understanding the needs of clients and translating them into legal terms. “Sometimes clients don’t know much about the law, and they just describe what they want to happen. We have to

make that work in a legal framework and describe the law and describe issues to them in a way that’s understandable and not overly lawyerly,” says Spitz, adding: “It’s hard because estate planning doesn’t necessarily get wrapped up in the shortterm. After someone puts a will in place, they might be around for a long time, so it would really help to have a crystal ball. But if you don’t have a crystal ball, it is easier if you at least have some certainty with the law.” Through her involvement with the Colorado State Bar, Spitz gets the next best thing to certainty. By close association with state lawmakers, Spitz and her colleagues in the trusts and estates section often preview and suggest changes to the state trusts and estates laws that they work with daily. “If we’re not coming up with the idea, we’re at least looking at it,” Spitz says. “It is really helpful to be involved and see these projects coming down the road before they become law. And there constantly seem to be projects.”

Two of Colorado’s top plaintiffs’ attorneys make it official.

BY JOHANNA MARMON olorado plaintiffs’ attorneys Jim Chalat and John Purvis have known and worked with each other for more than three decades, so it was something of a nobrainer when the pair finally decided to announce an ofcounsel arrangement between their respective firms, Chalat Hatten Koupal & Banker and Purvis Gray & Thomson. For one, it’s a win-win for clients, who are able to reap the strategic benefits and rewards of having two of Colorado’s top attorneys and their firms work side-by-side on their cases. But it also made perfect sense to Chalat and Purvis, whose decision was practically the embodiment of that old saying about the whole being greater than the sum of its parts. From a purely practical standpoint, Chalat says, the partnership means lower client costs (cases are always taken on a contingent-fee basis). “It introduces economies of scale into the equation,” he notes. But that’s certainly not the only benefit. “What really matters to our clients and to the competitive atmosphere of the profession and the courtroom are the intellectual resources, stamina, and drive to win that your lawyer can bring to the table, and this arrangement helps us bring those resources to bear on our cases,” says Chalat, who has been repeatedly named to the Best Lawyers list and is a member of the American Board of Trial Advocates. Chalat is known

as a force to be reckoned with in catastrophic personal injury cases in Colorado and throughout the Western U.S. “That’s really the power of this relationship,” he says. Individually, the attorneys’ results are impressive, but their collective track record is virtually unmatched in Colorado. Chalat and Purvis, along with Purvis’s longtime partner Bill Gray, have a long history of litigating injury and accident cases related to the recreational skiing industry in Colorado. They began their working relationship in the 1970s and 1980s, when they worked together on a case involving a gondola accident at Vail. THE STEADFAST ADVOCATE As one of the country’s premier plaintiffs’ trial firms, Burg Simpson has a history of prevailing against the largest corporations and law firms in the world.

BY SEAN STONEFIELD or a firm with humble beginnings as a oneman practice, Burg Simpson Eldredge Hersh & Jardine, P.C., has experienced remarkable growth in the nearly 40 years since its inception. Today, the firm is comprised of more than 50 attorneys, with a national footprint and a track record of more than $1 billion in verdicts, settlements, and judgments for its clients, including more than 100 individual recoveries in excess of $1 million. But while much at the firm has changed since its early days, founder Michael Burg notes that the firm’s core values have remained consistent. “From the very beginning, my father told me to work relentlessly to be the best at my profession, and he said to ‘never chase the money.’ If you’re the best at what you do, people recognize it. So I think we owe a large part of our success to the fact that our work isn’t just about the economic benefits—we believe in our clients and their causes, and we’re committed to seeing their cases through, no matter how long or difficult the fight becomes.” This dedication was particularly evident in the firm’s advocacy against Bayer in a multidistrict litigation (MDL) over the

company’s drospirenonecontaining birth control pills, such as Yaz and Yasmin. Bayer has settled the approximately 10,000 claims—for approximately $2 billion in awards—since spring of 2012 for women who suffered venous thrombotic events after taking these birth control pills. In addition, in March 2013 Bayer agreed to a global settlement on behalf of approximately 9,000 women who suffered gallbladder injuries after taking its products. Finally, this past August, Bayer agreed to a $56.9 million settlement for the approximately 1,200 women who had experienced arterial thrombotic events after using Bayer’s drospirenone-containing oral contraceptives. “We fought this fight since day one, using all of our resources and years of experience to ensure our injured clients had the greatest chance of a successful outcome,” says Burg, who was appointed co-lead counsel for the plaintiffs by the federal judge overseeing the litigation. In addition to Burg, shareholder Janet Abaray was selected as co-chair of the MDL Science and Expert Committee, and fellow shareholder Seth A. Katz was named chair of the MDL Discovery Committee and appointed to the Negotiating Plaintiffs’ Committee.

“These were very difficult cases, and when you’re in a leadership role, firms around the country look to you to put this litigation together. It helped that we have attorneys like Seth, who was instrumental in conducting all discovery in the litigation and who is an expert in electronic discovery, and Janet, who is one of the top experts in the country with regard to the pharmacological issues of drugs and devices,” says Burg. Over the course of the litigation, Burg Simpson oversaw the taking of all depositions and the review of more than 100 million pages of documents, globally represented more than 260 law firms, and successfully argued 17 Daubert motions. “No other firm in the country has helped more women receive fair compensation for injuries resulting from the use of Yaz, Yasmin, and other drospirenone-containing oral contraceptives,” Burg notes. “At the end of the day, we’re proud to have obtained some measure of justice for the women injured by these drugs.” Burg Simpson continues to serve as a leading advocate for women on healthrelated issues, most recently investigating legal claims against the manufacturers of power morcellators—tiny surgical instruments with rapidly rotating blades that are used in the removal of

fibroids on the uterus. In 2014, the Food and Drug Administration issued a warning against these instruments, finding that for some women with undetected cancers, morcellators could end up spraying malignant cells inside the abdomen, speeding the progression of the disease. Burg Simpson is currently representing women injured by the devices in a multidistrict litigation against one of the main manufacturers of power morcellators. Shareholder Meghan Quinlivan has been appointed to the Plaintiffs’ Steering Committee in this litigation. “We are proud to be part of this fight to protect the health of so many women,” Burg says. “As trial lawyers, we have a responsibility to lead the way in guarding the rights of these individuals.” For the past decade, Burg Simpson has been at the forefront of significant multidistrict litigation, securing approximately $8 billion for injured plaintiffs through its leadership in mass torts. Burg’s appointments include serving as State-Federal Liaison for the Vioxx MDL and on the Plaintiffs’ Steering Committee for the Zyprexa litigation, which achieved a settlement of nearly $700 million dollars.
