hen it comes to handling substantial injury and wrongful death cases in Georgia and around the USA, Fried Rogers Goldberg (FRG) is consistently at the top of the list year after year. FRG is definitely not your typical personal injury law firm and partners Joe Fried, Buck Rogers and Michael Goldberg are not your typical plaintiffs’ lawyers. “While other lawyers often try to fit every case into a predetermined mold, we focus on what makes each case uniquely compelling,” says Fried. “For us, it is about finding the compelling story in every case that truly and universally cries out for justice.

It’s about figuring out why anyone should really care about the client’s loss.” “It is a very different way of practicing law,” adds Rich Hamilton, who recently joined the firm after spending twenty years on the defense side. “Now that I see what goes into every case at FRG, I understand why they always get top dollar results.” FRG is best known for their tremendous success handling truck accident cases and helping other lawyers with truck accident cases around the country, but because of their unique approach and history of great results, they are a go-to firm for any major damages case. “Other lawyers often associate us to

handle large cases,” says Goldberg. “They appreciate our team approach and generous referral philosophy.” Clients appreciate not only the results, but how they are treated at FRG. “We are committed to not only keeping our clients informed each step of the way, but to making our clients truly partners in the legal process,” Rogers highlights. “A lawsuit can be a very personal journey and clients should be able to know unquestionably that their lawyer has their back.” “Our firm is about making a difference in the lives of our clients, and also in the communities in which we all live”, concludes Fried. “That’s what it means to be a great lawyer.”

It’s inevitable—at some point in your life, you’re going to need a lawyer, and you won’t always be able to forecast when that need will arise. Finding an advocate in whom you can place your trust—particularly during times of strain or duress—can be a particularly daunting task. For most of us, the choice must be made quickly and decisively, and large sums of money are potentially on the line. As when choosing a doctor, we place an immense amount of responsibility in the counsel we hire to represent us. In our search for the highest quality advocate, we expect to be treated fairly, for our grievances to be heard, and for our lawyers to take on our case as if it were their own. Best Lawyers is proud to be the oldest legal peer-review organization in the United States. Since 1983, lawyers have been nominating and voting on their colleagues, culminating in what is currently the 20th edition of The Best Lawyers in America, from which this directory has been culled. The 2014 edition includes 50,834 attorneys in 134 practice areas, covering all 50 states and the District of Columbia, and inclusion is based on more than

4.9 million detailed evaluations of lawyers by other lawyers. A lot has changed in the last three decades. We now have myriad tools at our disposal, but has it gotten any easier to find a lawyer? No one is allowed to buy his or her way into Best Lawyers, so when you search for representation here, you are certain to find only the most highly regarded advocates in their chosen field. Lawyers must be re-nominated every year, thus ensuring that those listed are still considered the most esteemed in the profession. As a result, we congratulate those lawyers who have earned a place in this year’s guide and offer special recognition of those who have been honored for 30 years by highlighting their names in red throughout this publication. There have been other improvements to the magazine as well. This year, to make your search even more useful, we have included all listed lawyers in Georgia broken out by practice area and metropolitan region and are pleased to announce the 2014 recipients of the “Lawyer of the Year” award. Only one lawyer per practice area per metropolitan zone is granted this distinction, based on the highest peer ratings received. Turn to page 8 to find out more.

We are also thrilled to unveil our new, fully interactive digital edition, truly putting the power to make an informed decision at your fingertips. Each lawyer and firm with an online profile on BestLawyers.com is hyperlinked within these pages and highlighted in blue. Simply scan the QR code on page 4 with your smartphone or go to the Regional Publications section of BestLawyers.com to access the fully responsive digital edition. It’s available anytime, anywhere—accessible for free, all year long. Our aim is to quickly connect you to the Best Lawyer that best suits your needs. Whether you are in Atlanta or Augusta, our publication strives to put you in touch with the Best Lawyers in your hometown. Because it takes a community to recognize the best, if you know an outstanding attorney who isn’t listed here, do not hesitate to go online to BestLawyers.com and nominate him or her today.

Meredith Hinshaw Director of Publications

METHODOLOGY Inclusion in Best Lawyers is based entirely on peer-review. The methodology is designed to capture, as accurately as possible, the consensus opinion of leading lawyers about the professional abilities of their colleagues within the same geographical area and legal practice area.

Best Lawyers employs a sophisticated, conscientious, rational, and transparent survey process designed to elicit meaningful and substantive evaluations of the quality of legal services. Our belief has always been that the quality of a peer-review survey is directly related to the quality of its voting pool.

NOMINATION

BALLOTING

VOTING

INCLUSION

ANNOUNCEMENT

Nominations are open to anyone. Our primary sources for nominations: clients, other lawyers & marketing teams.

Ballots are generated and distributed to listed lawyers. They are designed based on the voter’s practice area(s) and geographic region.

Best Lawyers asks voters the question: “If you were unable to take a case yourself, how likely would you be to refer it to this nominee?” Nominees are given a 1 -5 rating, with room to leave additional comments.

The Best Lawyers editorial staff reviews the votes and comments. Selected lawyers are checked against state bar association sanction lists to make sure they are in good standing with the ethics committee of their state bar.

Listed lawyers are notified of inclusion and the list is released to the public.

To submit nominations, please visit www.BestLawyers.com/Admin/Nomination.aspx or email nominations@bestlawyers.com. For additional information concerning nominations, please contact us at info@bestlawyers.com.

with Morton A. Harris of Hatcher Stubbs, listed in The Best Lawyers in America for 30 years businesses and their owners become and remain successful. What has been the key to your success? Having good senior lawyers as mentors who allowed and encouraged me to participate in continuing education at a high level early on. Always attempting to achieve a positive result for my client. Good personal health and energy and What interested you about the good fortune of having partners going into your particular area who believed in excellence. of law? With an accounting major What is one example of a case/ as my background, in law school I matter you are particularly proud naturally gravitated toward business of? Helping a particular family and tax courses—along with estate business remain successful amid planning—and found that I enjoyed great financial stress and helping to these areas and was able to do well. successfully transition that business What would you say is the most to the next generation. rewarding aspect of practicing in How has the legal industry in your area of law? Helping people your field changed in the last 30 accomplish their personal goals, years? Practicing law has become especially in the estate and retirement much more technically based and planning areas, and in helping proceeds at a much faster pace, and is

fast becoming more of an “industry” than a “profession.” There is also a greater amount of competition from non-lawyer sources in the business, tax, employee benefits, and the trust and estates areas of practice. What does being included in Best Lawyers for 30 years mean to you? I am honored and proud to be recognized by my peers as being professionally excellent as a lawyer and for my respect of the responsibilities and obligations that lawyers have in our society. What is one piece of advice you would give to new attorneys? Always do your best, keep your clients informed in a timely manner, and be prompt in your response to clients, your fellow lawyers, and to the court. Also, it is very important to be fair and honest with your client and with opposing counsel; and if you are not skilled in what you are being asked

to do, get help, and never be afraid to tell your client you don’t know or are not sure of the answer, but will find out or get outside competent representation for the client if needed. What is the biggest obstacle you see for your practice area in the next 30 years? The growing expansion of nonlawyer participation in many areas which have traditionally been the sole province of attorneys, such as the areas of business, tax, employee benefits, and trusts and estates. I see a continuation of non-lawyer competition, which will continue to cause a decline in these areas of the law. I also see a continuation of the trend of the legal profession becoming a highly skilled “industry,” which blends in with non-lawyers who practice in these non-litigation areas.

with Robert G. Holt of Holt Ney Zatcoff & Wasserman, listed in The Best Lawyers in America for 30 years

What interested you about going into your particular area of law? Since middle school, I wanted to be an architect, but after studying architecture for two years, I decided to become a lawyer. Working in the commercial real estate practice gives me an opportunity to be on the team developing new real estate projects. What would you say is the most rewarding aspect of practicing in your area of law? Most of what I

work on is a win-win project. Overall, new value is added, which is shared by all parties involved. I tried litigation, but the win-lose nature of it was not satisfying. It usually is a lose-lose experience, because the winner of a law suit is usually unhappy about the time and expense he had to go through. What has been the key to your success? I identify completely with the needs and desires of my client. His victories and losses are my victories and losses. I usually become personal friends with my clients and enjoy socializing with them. What is one example of a case/ matter you are particularly proud of? I represented a major bank that was a subordinate lender in a large construction project. Due to cost overruns, the first mortgage lenders increased their loan, which decreased

the value of the collateral held by my client. I found in the details of the loan documents that the increases in the first mortgage lenders loan was not secured by the collateral, which made it necessary that they get my client’s consent to increase their loan. We negotiated in New York City all day each day for about 8 months to reach an agreement on the restructuring. How has the legal industry in your field changed in the last 30 years? When I started with a leading Atlanta firm, we had 24 lawyers. When the firm reached 135 lawyers I left to start my own firm. The firm I left now has over 900 lawyers, and my firm is the size that my former firm was when I started out with it. My firm is like an extended family. What does being included in Best Lawyers for 30 years mean to

you? I have always been proud to be included from the first year. The fact that the best commercial real estate lawyers in my state include me in their ranks is more important than being selected by outsiders. What is one piece of advice you would give to new attorneys? You have to learn to enjoy the day-to-day practice, with all its ups and downs, stresses & boredom. If you don’t enjoy the day-to-day, go do something else. What is the biggest obstacle you see for your practice area in the next 30 years? The practice is becoming more and more subspecialized. Each lawyer will be limited to a very narrow, repetitive practice, like a worker in an automobile manufacturing plant, just attaching one small part to a large machine, over and over and over again.

has named individuals as “Lawyers of the Year” in Georgia, based on their particularly high level of peer recognition. For all intents and purposes, Tommy Malone’s first medical negligence case—tried over the course of just a few short days in the late 1960s—should have been a slam dunk. His client, a 15-year-old girl, had taken a sulfur drug prescribed by a well-liked local physician despite her documented allergy to the chemical. The results were disastrous: the young girl, Malone says, developed severe exfoliating dermatitis, as in weeping blisters, all over her body, which left painful sores, raw skin, and complete paralysis. “At the hospital, the nurses had to put cornstarch on the sheets so she wouldn’t stick,” says Malone. “It was really horrible stuff.” As Malone is quick to point out, this was the deep South at a turning point in history, and young lawyers like himself all knew better than to take on the establishment in rural Georgia. But it didn’t stop Malone from trying. Sadly, they lost the trial. “It wasn’t polite to sue your neighbor, much less your doctor,” he says matter-of-factly. And while the outcome of the trial, given the times, may have been predictable, it was no less devastating for Malone. “I was left asking myself how I possibly could have failed this child,” Malone says with no small measure of emotion, despite the decades that have passed. “Here you’ve got a girl with a known allergy to sulfur who was given a sulfur drug. What was my life all about? I questioned everything.” For Malone, it was a swift punch in the gut and a reality check rolled into one. This isn’t where the story ends, however, in either the sulfur-drug case—in a separate suit, the drugmaker eventually settled for sum that satisfied his client’s medical bills and saw to her continuing care—or in Tommy Malone’s personal narrative. In fact, it was just the beginning, and was the case that Malone says for better or for worse cemented his path. “There are lessons to be had in losing a case that I felt nobody should lose,” says Malone, the son of a lawyer turned judge (Tommy worked at his father’s firm out of law school before striking out on his own some years later). “To lose such a case was more than humbling, it was earthshattering. But if anything, it, and others, is

what motivated me to keep moving forward.” Today, from his hardfought vantage point as one of the state’s best plaintiffs’ lawyers, the losses are much fewer and farther between, and the verdicts and settlements he and his firm obtain for clients are routinely some of the largest Georgia sees. In one 2009 example, Malone won a staggering sum, nearly $50 million in compensatory damages, for the victim of a traumatic brain injury who was hurt in a devastating accident involving two commercial truck drivers. ME D I CAL MA L PR ACT I C E L AW And in 1995, he won $45 million in compensatory P L A I N T I FF S damages due to medical negligence in the preventable ATL A N TA quadruple amputation of a six-month old baby. As a across the state as a go-to practice for result of the case, the Georgia legislature quickly moved to change the rules catastrophic personal injury, commercial governing the way HMO providers operate— vehicle accidents, traumatic brain injury, medical malpractice, aviation accidents and effectively saving other people from having products liability. The two Malones—both to jump through unnecessary hoops to board-certified by the selective American receive critical emergency care. H

ow does a former local police officer end up one of the top personal injury lawyers in the entire country? For Atlanta-based “out of the box” attorney Joe Fried, it’s been a natural progression. “I have always hated bullies and stood up for the little guy,” Fried says. “Holding those who are responsible for hurting others fully accountable is what I did as a police officer and it is still what I do today as a lawyer—I just have a better education and much better resources.” That education goes way beyond law. Fried has formal education and real world experience in physics, accident reconstruction and forensics, as well as hundreds of hours of training in psychology, neurolinguistics, persuasion science, story structure and story-telling. When you add all these pieces together with a tireless work ethic and a spiritual calling, the final product is a lawyer who is hard to beat. “Cases are about much more than a string of facts and legal principles,” Fried muses. “It’s my job to figure out why anyone should really care about my client’s case and how I can present that case in a credible and compelling way. The jurors in my cases get a chance to be heroes by righting a wrong and restoring justice.” All you have to do is spend a few minutes talking to Fried to know he is not your typical lawyer. He is genuine and real—and has a rare ability to feel what is going on in others and connect with them at a deep level. “I wasn’t always like this,” Fried says. “I had to learn to deal with my own fears— to be willing to be vulnerable—and to find my own truth before I could feel the truth in others. I am still a work in progress.” Fried is a master at seeing through negatives that constrain other lawyers and turning them into positives. A defense lawyer recently said of Fried, “I thought I had him boxed in with a world class expert who was set to gut his case, but by the end of a short deposition that expert had flipped and was supporting Fried’s case. There was nothing I could do about it.” “I don’t let the defense dictate what is

important in a case,” Fried admonishes. “Lawyers often fight the wrong issues and then get mad and look like jerks when they lose the fight. I try hard not to be that lawyer.” Fried started out handling medical negligence cases and then happened into a case where a woman was badly Joseph A. verything potential clients need to know about the Atlanta-based Boone & Stone can be summed up in one impressive figure: over $500 million. That’s how much the firm and its attorneys—made up of experienced, diligent plaintiffs’ lawyers who have made it their life’s work to help the catastrophically injured find justice in the legal system—have recovered since the firm first opened its doors decades ago. “Our opponents know that if they want to take a case to trial, they’re going to get their money’s worth,” says Stone, a fourth-generation attorney who considers the practice of law something of a birthright. “We operate on the premise of never giving

up. We won’t be outworked or outfought.” That includes heading to trial in cases that other firms would never agree to take on in the first place— in counties that are known to be difficult locations in which to win favorable verdicts, no less. “It’s simple: We believe in our clients and our cases,” says Stone. “We’re not afraid to get inside the courtroom.” And when they do? Look out. In September of 2011, Stone, and his partner David Boone, won the largest wrongful death verdict in the state of Georgia—$41 million—in a case involving a tractor trailer that ran a stop sign and killed two people. With results such as that, it’s no wonder that Boone &

Stone is recognized by their peers as being one of the best trial law firms in the business. Both partners have maintained AV®-ratings from Martindale-Hubbell for decades and have held prominent positions in local and state legal associations, while Stone was named Best Lawyers’ 2013 Lawyer of the Year in Atlanta for Personal Injury Litigation – Plaintiffs. But for Boone & Stone, what really matters is getting their clients a fair shake—no matter how high the stakes or how challenging the case. “We devote the full resources of the firm to every client because we believe in their cases,” Stone says. “That’s what we’re all about.”
