ver the course of its 40-year history, the attorneys at Lowe Eklund Wakefield have established the firm as one of the top plaintiffs’ practices in the region. This is a firm whose depth and breadth of experience has a national reach as well, and is as known for its top-tier representation of clients in complex personal injury cases as it is for the work it does on behalf of victims of motor vehicle design defects, medical malpractice, birth injuries, construction site accidents, legal malpractice, traumatic brain injury, and more. The firm also has impressive class action capabilities as well, and has achieved the largest judgment in Ohio history. Lowe Eklund Wakefield is perhaps best known as a national leader in products liability, says partner Ryan Fisher, who says the firm routinely achieves multimillion-dollar verdicts and settlements in cases involving a wide range of consumer and workplace products. The firm handles all manner of motor vehicle defects, including defective seat backs, front and side airbag and seat belt failure, rollovers, collapsed roofs and more. “We are a firm of trial lawyers,” says Fisher. “We have the

experience and the resources to properly handle significant cases—and that includes on appeal.” Founding partner James Lowe has again been selected as Best Lawyers’ 2014 Lawyer of the Year in Cleveland for his work in products liability litigation. At its heart, Lowe Eklund Wakefield is a firm that puts clients first— and its six tenacious attorneys are willing to go the distance. “We help people who can’t help themselves,” says Fisher. “The courtroom is still the only place in America where corporate interests can be taken to task, and we take that responsibility very seriously.”

It’s inevitable—at some point in your life, you’re going to need a lawyer, and you

won’t always be able to forecast when that need will arise. Finding an advocate in whom you can place your trust—particularly during times of strain or duress—can be a particularly daunting task. For most of us, the choice must be made quickly and decisively, and large sums of money are potentially on the line. As when choosing a doctor, we place an immense amount of responsibility in the counsel we hire to represent us. In our search for the highest quality advocate, we expect to be treated fairly, for our grievances to be heard, and for our lawyers to take on our case as if it were their own. Best Lawyers is proud to be the oldest legal peer-review organization in the United States. Since 1983, lawyers have been nominating and voting on their colleagues, culminating in what is currently the 20th edition of The Best Lawyers in America, from which this directory has been culled. The 2014 edition includes 50,834 attorneys in 134 practice areas, covering all 50 states and the District of Columbia, and inclusion is based on more than 4.9 million detailed evaluations of lawyers by other lawyers.

A lot has changed in the last three decades. We now have myriad tools at our disposal, but has it gotten any easier to find a lawyer? No one is allowed to buy his or her way into Best Lawyers, so when you search for representation in this guide or on BestLawyers.com, you are certain to find only the most highly regarded advocates in their chosen field. Lawyers must be re-nominated every year, thus ensuring that those listed are still considered the most esteemed in the profession. As a result, we congratulate those lawyers who have earned a place in this year’s guide and offer special recognition to the select few who have been honored for 30 years by highlighting their names in red throughout this publication. This year, to make your search even more useful, we have included all listed lawyers in Cleveland and are pleased to announce the 2014 recipients of the “Lawyer of the Year” award. Only one lawyer per practice area per metropolitan zone is granted this distinction, based on the highest peer ratings received. Turn to page 8 to see the full list of honorees. We are also thrilled to unveil our new, fully interactive digital edition, truly putting the power

to make an informed decision at your fingertips. Every lawyer and law firm with an online profile on BestLawyers.com is hyperlinked within these pages and highlighted in blue. Simply scan the QR code on page 3 with your smartphone or go to the Regional Publications section of BestLawyers.com to access the fully responsive digital edition. It’s available anytime, anywhere—for free, all year long. Our aim is to quickly connect you to the Best Lawyer that best suits your needs. Whether in print or online, our publication strives to put you in touch with the legal champions in your hometown who seek justice for their fellow citizens each and every day. Because it takes a community to recognize the best, if you know an outstanding attorney who isn’t listed here, do not hesitate to go online to BestLawyers.com and nominate him or her today.

Meredith E. Hinshaw Director of Publications

METHODOLOGY Inclusion in Best Lawyers is based entirely on peer-review. The methodology is designed to capture, as accurately as possible, the consensus opinion of leading lawyers about the professional abilities of their colleagues within the same geographical area and legal practice area.

Best Lawyers employs a sophisticated, conscientious, rational, and transparent survey process designed to elicit meaningful and substantive evaluations of the quality of legal services. Our belief has always been that the quality of a peer-review survey is directly related to the quality of its voting pool.

NOMINATION

BALLOTING

VOTING

INCLUSION

ANNOUNCEMENT

Nominations are open to anyone. Our primary sources for nominations: clients, other lawyers & marketing teams.

Ballots are generated and distributed to listed lawyers. They are designed based on the voter’s practice area(s) and geographic region.

Best Lawyers asks voters the question: “If you were unable to take a case yourself, how likely would you be to refer it to this nominee?” Nominees are given a 1 -5 rating, with room to leave additional comments.

The Best Lawyers editorial staff reviews the votes and comments. Selected lawyers are checked against state bar association sanction lists to make sure they are in good standing with the ethics committee of their state bar.

Listed lawyers are notified of inclusion and the list is released to the public.

To submit nominations, please visit www.bestlawyers.com/ Admin/Nomination.aspx or email nominations@bestlawyers.com. For additional information concerning nominations, please contact us at info@bestlawyers.com.

Q&A

30

YEARS

with Malvin E. Bank of Thompson Hine, listed in The Best Lawyers in America for 30 years What interested you about going into your particular area of law? I believed that the federal tax laws are of great interest to many, many, many people. What would you say is the most rewarding aspect of practicing in your area of law? The practice of law is about helping and advising people and organizations. This is, of course, also true with regard to the federal tax laws. What has been the key to your success? Hard work and good judgment; understanding that my

work is about helping people and organizations, while being sure to “always do the right thing.” What is one example of a case/ matter you are particularly proud of? Assisting community foundations throughout the United States and the individuals who support them to understand the tax laws that govern community foundations, and the deduction of charitable contributions, to help donors identify their interests, and to help community foundations to assist donors to achieve their goals.

What does being included in Best Lawyers for 30 years mean to you? It is rewarding to be recognized for “always doing the right thing” and for helping all kinds of clients to achieve their goals. What is one piece of advice you would give to new attorneys? Work long hours, ask questions of those who are more experienced than you are, and be very, very thorough every time.

with Marvin A. Sicherman of Dettelbach, Sicherman & Baumgart, listed in The Best Lawyers in America for 30 years What interested you about going into your particular area of law? Commercial law seemed to come naturally to me and was something I had a good feeling about. What would you say is the most rewarding aspect of practicing in your area of law? When the Bankruptcy and Commercial Law Section of the Cleveland Metropolitan Bar Association surprised me within less than a month after my then wife just short of 50 years died, and “The Marvin & Sue Sicherman Excellence in Bankruptcy Award” was created in her memory and to honor me.

6 | CLE VEL AND

What has been the key to your success? Preparation, preparation, and preparation. Try the winners and settle the losers. What is one example of a case/ matter you are particularly proud of? When I coined the phrase “negative equity,” which has since become a common term. I started it in about 1964 (In the Matter of Dewie Sloan, Bankrupt) to drive home a point and established new law in Ohio that held for 20 years until a legislative change occurred. How has the legal industry in your field changed in the last 30 years? Since the advent of the Bankruptcy Code in 1978, effective 10/1/79, it seems the bench and

Bar have become distant from each other. What does being included in Best Lawyers for 30 years mean to you? It is something I have been very proud of, as it indicates others have recognized my efforts and given me their praise. What is one piece of advice you would give to new attorneys? As I was taught in law school over fifty years ago, “The law is a jealous mistress, and needs to be tended to full-time.” What is the biggest obstacle you see for your practice area in the next 30 years? Too many lawyers are in the practice and area for money and fail to recognize that the law is a profession, not a business.

Attorney John McLandrich knows as well as anyone that sometimes it takes a while for lawyers to find their path. McLandrich, chairman of the board at Mazanec, Raskin & Ryder and one of the region’s pre-eminent civil rights defense attorneys, started his career thinking, “I’d do corporate work,” says McLandrich. But in 1988, McLandrich had an opportunity to join Mazanec, Raskin and Ryder—and his path was all but set. McLandrich ended up working on some of the first civil rights defense cases the firm took on, and today is known as one of the top lawyers in the region handling complex cases for police departments, municipalities, and a variety of public agencies. “In my practice, it’s not as much about what the rule is, as what the rule ought to be,” says McLandrich, a veteran trial and appellate lawyer. For example, McLandrich often deals with sensitive matters involving civil rights and has been tasked with defending officers whose split-second decisions have come under scrutiny, including claims of excessive force, jail suicides and false arrest. “There’s an incredibly important interpersonal side to this work, you have to get at what makes people tick,” he says. “You have to have a good moral compass in terms of how a judge or jury is going to feel about a client’s conduct, and communicate an understanding from a human perspective why things happened the way they did.” It’s a matter of perception being reality, and McLandrich has built a career on helping clients navigate the often-choppy waters that is civil rights defense. “These cases involve no small amount of mental gymnastics, which I really enjoy,” says McLandrich. “Taking the facts and delving into the law to see how those work together to benefit my clients is what it is all about.”

Fourteen years with the State Department reviewing visa applications for people seeking entrance into the United States before he entered private practice was about as good a primer as immigration lawyer William Rosner could get on how the gears of government grind. But Rosner has built his practice on helping not individuals, but corporate clients—from large, publicly held companies to smaller, privately held firms—move their most important assets in and out of the country. Those assets? Their people. “I deal with people from all over the world, and they often have spouses and families to consider as well,” says Rosner, who founded Rosner, Ortman & Moss in 1994. Rosner knows better than anyone the constraints the United States’ immigration system can place on companies seeking to both recruit foreign talent and relocate domestic workers abroad—and the very real threat to American competitiveness that current legislation presents. “We need to agree on what we want and carry on with it, instead of piecemeal reform,” says Rosner, whose experience with the State Department also includes stints as consular chief in Ghana, Mexico, and the Netherlands. But he is also acutely aware that at its heart, immigration law is inherently a human practice that requires a level of sensitivity and tenacity—not to mention a keen eye for detail and the ability to wade through a notinsignificant amount of red tape. “There’s a lot on the line and the potential for making errors is very high,” says Rosner, whose firm has the most immigration lawyers in Cleveland. “But when we’re successful, it’s very satisfying. We make people happy.”

FOR MORE THAN A CENTURY, TAFT STETTINIUS & HOLLISTER LLP HAS BEEN COMMITTED TO FINDING INNOVATIVE SOLUTIONS TO ITS CLIENTS’ PROBLEMS Since its inception in 1885, Taft Stettinius & Hollister LLP has become a powerful force in the Midwest, serving clients in virtually every area of law from its eight offices in five states. In 2014 alone, the firm received Tier 1 rankings for 44 practice areas across five metropolitan locations from U.S. News – Best Lawyers “Best Law Firms.” And of its 400 attorneys, 131 have been included in this year’s edition of The Best Lawyers in America. “For an older law firm, we’re not just resting on our laurels,” notes Kevin D. Barnes, the partner-in-charge of the firm’s Cleveland office. “We’ve continued to expand our resources, reach, and capabilities, and frankly, that’s my vision for our Cleveland location—to continue to grow here.” And yet, while Taft has become one of the largest law firms in the region, its commitment to being a fullservice firm hasn’t wavered. As Barnes explains, the firm still provides services that other large firms no longer offer, such as assisting individuals and families through its private client group. “From the very beginning, the philosophy of the firm was to serve clients large and small; and because of that, in addition to handling typical areas like real estate, business, and finance, we handle a variety of matters that comparable firms of our size do not,” he says. “We just feel it’s the right thing to do for our clients.” For example, in Cleveland the firm is known for its robust litigation, real estate, and venture capital and private equity practice groups; but it 10 | C L E V E L A N D

has also established a strong presence in the family law arena: The firm’s Cleveland-based family law attorneys, partners Jill Friedman Helfman and Carl A. Murway, are both fellows of the American Academy of Matrimonial Lawyers and have been board certified as specialists in family law by the Ohio State Bar Association. Moreover, in 2014 Helfman was selected by her peers as Best Lawyers’ Cleveland Lawyer of the Year for family law.

WE’VE CONTINUED TO EXPAND OUR RESOURCES, REACH, AND CAPABILITIES, AND FRANKLY, THAT’S MY VISION FOR OUR CLEVELAND LOCATION— TO CONTINUE TO GROW HERE. “I started my career at a much smaller firm, and when I moved to Taft I realized that having access to so many specialists within one firm meant I could offer my clients a broader range of expertise and experience,” Helfman says. “Whether it’s a tax, business, real estate, or retirement issue, I only have to make a phone call or walk down the hall to discuss the matter with a lawyer who focuses in the area, all while keeping the information about the client’s case confidential from the outside world.” David H. Wallace, a partner in the Cleveland office who was named Best Lawyers’ 2014 Cleveland Lawyer of the Year for intellectual property litigation, adds: “There’s no time of day or

night when I can’t reach out to a partner in another office and get the help I need with a particular problem or in an area of expertise. We all work together as one team, and that ensures cases are worked up efficiently and with the highest quality of service.” As co-chair of the firm’s litigation practice, Wallace oversees a group that handles all kinds of complex business litigation, as well as class action and white-collar criminal litigation defense. This group includes some of the most experienced trial lawyers in the region, and it is known for responding quickly and effectively to its clients’ litigation needs; indeed, the firm regularly invests in litigation technology to remain as efficient as possible. “I take a lot of pride in the fact that we’re highly evolved in our litigation technology,” Wallace says. “By developing our electronic capabilities in-house, we have gained significant efficiencies that, in turn, have been passed on to our clients.” Taft is above all focused on providing clients with service that meets the highest possible standards. Attorneys at the firm pride themselves on being accessible to their clients seven days a week, day and night. And they also make a point of approaching cases from their clients’ perspective, handling matters in a cost-effective, results-oriented way. “Taft really brings something unique to the Cleveland area, in that we’re a large regional firm that offers the accessibility and commitment of a mid-size firm,” Helfman says. “We have counterparts in Cleveland that are large firms and feel like large firms, but when you come to Taft you get the best of both worlds—large firm resources with Midwestern rates and values.”

T

here is a reason Steve Kadish has been one of fewer than 2,000 lawyers nationwide on The Best Lawyers in America list in every edition since its inception in 1983. Steve is a lawyer’s lawyer who earns the respect of his peers and clients. He built his skills as a U.S. Tax Court clerk while earning his LL.M at Georgetown University after obtaining his law degree from Columbia University. For more than 30 years he lectured for ALI-ABA seminars on Tax and Business Planning and was a featured speaker at Ohio CPA tax seminars, providing annual updates on Federal tax cases and law changes to help keep tax professionals current. This also afforded him a valuable opportunity beyond speaking, to listen and gain feedback. He says the firm’s success can be attributed to: ■ Working as a coordinated team with good people who are technically talented and client-sensitive; ■ Dealing fairly with clients, other counsel and the IRS to achieve sensible and equitable results;
