South Coast Property Specialist (Carlene Franzen) Tips: Pets in Strata Complexes – Are the Rules About to Change? In an unexpected development earlier this week, the upper house of the NSW government passed a bill that would make it nearly impossible for any apartment building to vote to keep pets out. The move by the Animal Jus#ce Party (AJP) means that, if the bill is passed by the Lower House in September, no strata scheme will be allowed to have a bylaw to ‘unreasonably’ ban animals. Naturally, pet-lovers are celebra#ng, while other apartment owners are angry over what they see is a reduc#on to their democra#c right to decide for themselves on issues like pets living in their blocks. The move is also not supported by organisa#ons such as the Owners Corpora#on Network where a former chair is quoted as saying “This is a terrible example of self-interest being allowed to trample over the collec#ve whole. A community should have the right to decide for themselves how to run their buildings. This has li=le to do with pets, and everything to do with the survival of the democra#c process.” The bill was proposed by AJP MP Emma Hurst, and supported by the Labor Party, Greens, Chris#an Democra#c Party and the Shooters, Fishers & Farmers Party. The government voted against it. MP Emma Hurst stated, “I understand what people say about democracy, but this is about people’s rights to keep a pet, who they o7en regard as their family, in their home. People shouldn’t have to choose between their home and their pet. “Animals are sen#ent beings and deserve a safe place to live with their human families. Especially with COVID-19, we’ve seen pet ownership becoming more and more important”. She proposed the amendment a7er hearing about a number of cases of pet owners in trouble with their buildings over their animals. For example there was a case of an elderly man and his greyhound, who were being evicted a7er their building changed its bylaws retrospec#vely to ban animals. The bill will now con#nue to the Lower House in midSeptember.
