Petrol bomb attacks on vehicles in Bangladesh leave teenager dead and at least 30 injured after violence linked to disputed election escalates

Bangla sanglap Desk: An 18-year-old man has been killed and at least 30 injured in Bangladesh following petrol bomb attacks linked to the country’s disputed elections.

The violence in Bangladesh has escalated since January 5 when protests broke out over the elections which was boycotted by the opposition Bangladesh Nationalist Party, who said it would be rigged.

They were angry that Sheikh Hasina, who has been in power since 2009, refused to stand aside to make way for a neutral caretaker administration to oversee the election.

The teenager who was killed on the burnt out bus today was named as Mohammad Sohag. The driver of the vehicle jumped free and escaped with minor burns.

1At least 30 people – including five police officers – have been injured in attacks on vehicles in Dhaka, the country’s capital, since yesterday night.

Prime Minister Hasina said the culprits ‘will not be spared’ on a visit to a hospital to see the policemen who had sustained burns today.

4But the government has ruled out deploying the military to restore order.

Authorities have, though, blocked popular internet calling and messaging service Viber on security concerns.

5Khaleda Zia, leader of the BNP, and Prime Minister Hasina have alternated in power for much of the last 20 years when the army has not been in government.

7The prime minister has resisted calls to give up her post and her government has tightened its grip on power by arresting opposition leaders and clamping down on the media.

It comes in the wake of violent clashes between opposition

activists and police during the general election, which saw 18 people killed on polling day and scores of polling stations torched.

6Human rights groups have expressed concern over the violence and urged those involved to refrain from further attacks.

The UN human rights office has also called for a ‘prompt, impartial and effective’ investigation in to the violence.

Bangladesh Democracy and its Administration

For Bangladesh, democracy is a national all party constitutional commitment, and the government in power is obliged to establish Democracy in the country. As we approach the first anniversary of the Tenth Parliament, it will be useful to take stock of our democratic credentials, especially in view of the fact that the events of January 5 2014 in the name of ‘elections’ actually saved or destroyed our democracy.

One essential feature of ideal democracy is periodic elections, which are free, and fair.

Democracy also requires rule by the people’s representatives not only at the national level, but also at the local level. Article 59 of our Constitution provides for elected local bodies at all administrative units to manage local affairs. Thus, unless local body elections are held at regular intervals, democratic governance remains incomplete.

Another distinguishing feature of democracy is that it requires effective institutions for proper functioning.

To this end, our Constitution provides for several institutions.

Two of these institutions the Executive and the Parliament are created through parliament elections. The party winning majority seats in the parliament elections forms the government and in this process a group of parliament members become ministers and perform the the Executive roles. The council of ministers thus created headed by the prime minister to govern the country with the assistance of the bureaucracy and law enforcement agencies. The other members of the parliament, especially those belonging to the opposition party, are expected to ensure the transparency and accountability of the Executive. Thus, if the parliament elections are not genuine and fair the legitimacy of both the Executives and the Parliament becomes questionable not only for the oppositions but every citizen whom the Executives and the Parliament is responsible to.

Yet another distinguishing feature of democracy is that in such a system, people enjoy certain unalienable rights.

Part III of our Constitution recognizes a set of rights as fundamental rights of the citizens. They include freedom of expression, religion, assembly, association, movement, right to protection of law, protection of right to life and so on.

Have the elections of January 5, 2014 fulfilled these essential features of a democratic policy? Have the elections been free, fair and competitive, that is, genuine?

Are the institutions performing more effectively after January 5? Are the rights of the citizens safeguarded following the elections? The answers to these questions will determine the state of our democracy.

The elections of January 5, 2014 were far from genuine.

They were not competitive as only 12 of the 41 registered political parties participated in the elections. Of the 300 MPs, 153 were elected unopposed and hence there was no voting at all in those constituencies, not to speak of constitutionallymandated ‘direct election’.

In the remaining 147 constituencies, based on the counting of counterfoils of ballot books from nearly nine thousand polling stations, Election Working Group (EWG) estimated that the voting rate was about 30 percent. However, according to media reports there was widespread ballotbox stuffing and other forms of flagrant rigging during the elections.

Nevertheless, if we accept the EWG’s estimates the total number of vote casting in 147 constituencies was about one crore 33 lacs, which reduces the average voting rate for the entire country to about 14 percent, compared to nearly 87 percent in 2008 elections. But according to knowledgeable observers, the actual voter participation rate in the Tenth Parliament elections was less than 10 percent. In AFM Shah Alam vs. Mujibur Rahman [41 DLR (AD) 1989], the Bangladesh Supreme Court stated: ‘That is no election that is no democracy. Election is needed to sustain democracy and a perverse or voter less election destroys democracy.’

In addition the overdue local body elections namely the Zila Parshad and Dhaka City Corporation elections were not held after the elections of January 5.

Our institutions have not become stronger either during the year following the elections of January 5. In fact, the institutions have increasingly become weaker and losing their vitality,genuinity and effectiveness. The Tenth Parliament has no opposition as such since the Jatiyo Party

now is also a part of the government. The bureaucracy and the law enforcement agencies have become more partisan since the election. Citizens are now concerned that the law enforcement agencies are now acting and behaving as personal force of the current ruling party.

Since the government formed after January 5th 2014 has no popular mandate, it has been trying to stay in power by infringing upon the rights of the citizens. The infraction of the right to expression and peaceful assembly appears to have reached a dangerous level. The state and all its apparatuses are now hyperactive in undermining the rights of citizens.

According to reports published in Prothom Alo (December 10, 2014), there were 82 unaccounted for disappearances in the first nine months of 2014, which is the highest in the last eight years. Although 23 dead bodies were found, there were no traces of 39 other persons. Thus, the right to life of 23 persons was nakedly violated and the lives of other 23 are in danger. According to latest report of Ain O Salish

Kendra, the state of human rights is alarming in Bangladesh, with crossfire and enforced disappearances on the rise (The Daily Star, January 1, 2015). In addition, the denial of the rights of the people to vote on January 5, 2014 itself represents a violation of their rights to expression as Courts now recognize that voters exercise such rights through voting [Union of India vs. Association of Democratic Reforms (2002)5SCC294].

To conclude, since 1991 we have had an ‘electoral democracy’ in Bangladesh, where people could more or less freely exercise their franchise. However, the situation has completely changed after the so-called elections of January 5, 2014, when the vast majority of the people were denied, through manipulations and unfair practices their right to vote. It is clear from the foregoing that the events of January 5 caused a serious setback in our endeavor to create a ‘substantive democracy’ in Bangladesh.

Victoria Wasteney, 37, was disciplined for alleged bullying and harassment after Enya Nawaz, 25, told managers that the senior occupational health therapist had tried to convert her to Christianity.

Today, Miss Wasteney launched an employment tribunal against the East London NHS Trust, claiming her employers discriminated against her because of her religion.

Miss Wasteney accused the NHS of making her look like a ‘religious nutcase’ and said she never attempted to convert Miss Nawaz.

She told the tribunal that she believed she and Miss Nawaz were friends and alleged Miss Nawaz was ‘manipulated’ into complaining against her by colleagues who had an anti-Christian agenda.

Today Miss Wasteney claimed the Trust had failed to clear her of wrongdoing

after a nine-month disciplinary process because it would be ‘politically incorrect’ to find a Christian innocent.

The Trust insists the disciplinary hearing was fair and they deny they discriminated against Miss Wasteney.

Miss Wasteney told the East London Employment Tribunal that her professional career ‘had been jeopardised, her reputation damaged and relations with colleagues ruined.

She added: ‘I was subjected to an ordeal of persecution dressed as a “disciplinary action” for an extraordinarily long time.

‘All this was a result of a manifestly false complaint and it was obvious I had done nothing wrong. I was discriminated against because of my faith.’

Miss Wasteney, who describes herself as a born-again Christian, was working at the John Howard Centre, a secure psychiatric hospital in Homerton, East London.

She said she was always careful about discussing her religion at work because her managers had warned

her it could ‘get you in trouble’.

After Miss Nawaz joined the hospital as a newly qualified occupational therapist in 2012, the two women discussed Islam and Christianity, as well as work done by Miss Wasteney’s church to campaign against human trafficking.

Miss Wasteney told the Daily Mail this week her colleague had ‘definitely initiated’ the conversations, before she invited Miss Nawaz to attend church events linked to the anti-trafficking work.

She said Miss Nawaz had then come to her in tears because she was upset about health problems.

Miss Wasteney said: ‘I put my hand on her knee to comfort her and asked if that was okay, and said ‘Would you like me to pray for you?’

‘She said yes, so I asked for God to bring peace and healing. She left the office afterwards and said she was okay.’

Eric Pickles ‘unlawfully discriminated’ against gipsies who wanted to pitch on Green Belt land, High Court rules Bangla Sanglap Desk Communities Secretary Eric Pickles ‘unlawfully discriminated’ against gipsies by using his ministerial powers to personally decide whether they should be allowed to settle on green belt land, the High Court has ruled.

In a ruling likely to affect many other travellers, a judge found both human rights and equality laws were breached

by Mr Pickles and his department for ‘calling in’ cases which would normally be considered by his planning inspectors.

Mr Justice Gilbart, sitting in London, said Mr Pickles was operating a legally flawed policy of ‘recovering’ for his own consideration appeals by travellers who claim there are exceptional circumstances for allowing them Green Belt sites.

The judge said an inspectors’ decision was normally received within eight weeks of the end of an inquiry - but it could take six months or more for a decision letter for a called-in case.

No attempt had been made by Mr Pickles and his ministers to follow steps required by the 2010 Equality Act to avoid indirect discrimination, and ‘substantial delays’ had occurred in dealing with the appeals in violation of Article 6 of the European Convention on Human Rights, said the judge.

His test-case ruling was a victory for two Romany gipsies- Charmaine Moore, a single mother with three children who is under threat of eviction from a site at North Cudham in the London borough of Bromley, and Sarah Coates, a disabled woman also with three children fighting

to live temporarily on Green Belt land at Sutton-at-Hone near Dartford, Kent.

Both women wanted to live with their children in caravans on their own green belt land but were refused planning permission by their local councils.

Their subsequent appeals were automatically referred to Mr Pickles under the 2013 ‘calling in’ policy, which meant any appeals over planning decisions relating to traveller sites in the green belt were automatically referred to the Secretary of State.

The judge found Mr Pickles had breached the Equality Act 2010 by indirectly discriminating against gipsies and travellers through this policy.

The judge said Mr Pickles’ department had ‘coined and developed’ a practice in 2013-2014 of calling in all, and then a majority, of Green Belt traveller cases - most involving Romany gypsies or Irish travellers - ‘which discriminated unlawfully against a racial group’.

He was also found to have breached Article 6 of the European Convention on Human Rights by delaying the women’s right to justice.

He ruled that the Moore and Coates cases were two such ‘unlawful recoveries’ and quashed them.

There were fears it would break the longstanding rule of confidence when the British government is dealing with foreign governments.

In the Commons today, Mr Cameron said he had not heard of evidence that ‘that anyone is trying artificially to delay this report’, adding: ‘I don’t believe from what I understand that anyone is trying to dodge this report or put off this report.’

In his letter to the Prime Minister, Sir John said he had reached agreement on the details from notes and conversations between Mr Blair and US president George Bush which will be published in his long-awaited report.

He said that his team intends ‘to finish our work as soon as it is possible to do so, whilst being fair to all those involved’, but that there is ‘no realistic prospect’ of this being done before the May 7 poll.

In a letter in reply, Mr Cameron accepted Sir John’s decisions, but said he would like to have seen the report - first commissioned by Gordon Brown in 2009 - published ‘well ahead’ of the election and hopes it will now be published soon afterwards.

Mr Cameron wrote: ‘As you know, I would have liked to have seen your report published already and certainly well before the forthcoming election.

‘The Iraq War, the lead-up to it and its aftermath were hugely important events in this country’s recent history. It is very important that your Inquiry sets out comprehensively for the British people what happened and why, so that all the lessons can be learnt.’

Barrister Nazir Ahmed When President Zillur Rahman died, the then Speaker Abdul Hamid was made the President. As a result, the office of the Speaker became vacant. Everyone anticipated that an experienced and seasoned parliamentarian would be nominated by the government party to replace Speaker Abdul Hamid in the Ninth Parliament. There were many front benchers from the governing party in Parliament who were elected as Members of Parliament (MPs) from five to seven times. Prime Minister Sheikh Hasina could have appointed one of them as the Speaker. Giving everyone a complete surprise, she nominated Dr Shirin Sharmin Chaudhury (commonly known as Dr Shirin Sharmin) as the Speaker as an emotional move in the name of making the first Woman Speaker in the country’s history. Dr Shirin Sharmin was a new comer to the Parliament, for she entered the Ninth Parliament for the first time. She was not even an elected MP. She became an MP on reserved seats for women.

Many experienced front benchers of the governing party were very unhappy on such a move. A number of them expressed their resentment and anger in private. However, they did not dare to express their strong reservation and feelings in public fearing Prime Minister Sheikh Hasina, for Prime Minister would not hesitate to reprimand or penalise some way or other as she has done many times in the past. Some lawyers and opposition leaders raised some voice and expressed some displeasure, but these were not so visible.

As a result, the legality, morality and validity of appointing a Speaker from MPs on reserved seats have gone almost unnoticed, unchallenged and unquestioned.

Elected and non-elected MPs – a brief comparison There are two types of MPs in Parliament: directly elected MPs and women MPs on reserved seats. There are many Articles in the constitution which refer to the parliamentary election and the elected MPs. For example, Article 65(2) of the constitution says “Parliament shall consist of three hundred members to be elected in accordance with law from single territorial constituencies by direct election and ...... the members shall be designated as Member of Parliament.”

Article 122(1) says “The elections to Parliament shall be on the basis of adult franchise.” Article 123(4) says “an election to fill the seat of a Member of Parliament which falls vacant otherwise by reason of the dissolution of Parliament shall be held within ninety days of the occurrence of the vacancy.”

Appointing Dr Shirin Sharmin Chaudhury as the Speaker in the Ninth Parliament: constitutional quest for her validity and legality

reference of the constitution are in relation to the 300 elected MPs. Only Article 65(3) provides provision for reserved seats for women. Under Article 65(3) of the constitution, women members on the reserved seats shall be elected by the MPs in accordance with law on the basis of the procedure of proportional representation in Parliament through the single transferable vote.

Thus, reserved seats are allocated to parties in proportion to their overall share of the seats in Parliament. Apart from this Article, there is no other indication or direction in relation to the reserved seats.

Though women MPs (currently 50 under the Constitution (Fifteenth Amendment) Act 2011) in the reserved seats are not elected directly by the people, they enjoy the same status, from legal point of view, as the 300 directly elected MPs do. However, from the view point of representation they have weaker status than that of directly elected MPs, for these women MPs do not really represent any portion of population except the party proportional strength in Parliament. Though they have national geographical constituency, they do not have link with it, for the people of that constituencies do not elect them and therefore the constituencies they represent are essentially imaginary.

They cannot be said to represent women in general, as the women of the country have no role in electing them.

Furthermore, since these women MPs do not go through a competitive election process, they are taken less seriously by their directly elected colleagues who, in reality, consider them more as a mere “vote bank.”

Experienced and seasoned parliamentarian should be appointed the Speaker Appointing the Speaker from the reserved women seats in the last Parliament was unprecedented in the 43 years history of Bangladesh. Even it is unprecedented in the world’s history and records of parliamentary democracy. The Speaker is the guardian of Parliament. How could a non-elected person be elevated to lead and provide guardianship to elected House? The Speaker is the representative and spokesperson of Parliament in its collective capacity, he/she presides at the meeting of the House, and declares and interprets the law.

To discharge this duty competently, the Speaker ought to be conversant with relevant parliamentary rules and procedures. To command respect, honour and dignity from all the members of the House, the Speaker ought to be matured, relatively aged and experienced. Dr Shirin Sharmin had none of these, for she was relatively

young and just came to Parliament on reserved women seat. Thus, we often saw her making mistake in giving rulings, giving floor to Members, interpreting rules or procedures. On few occasions she was found to be embarrassed for ignorance. On many occasions, she was found to be acting on the tips of the Prime Minister or leading governing party’s front bench MPs.

A trainee, probationary officer or a new comer cannot be made the head of an organisation. Under Article 94 of the constitution, The Supreme Court is a unitary organ of the State consisting of the Appellate Division and the High Court Division. A Judge is the High Court Division is initially appointed as an Additional Justice for two years’ probationary period. However, all judges of both Divisions are called Justices and addressed as “my lord” in the court. Now, can an additional Justice or a permanent Justice of the High Court Division be elevated straight to the position of the Chief Justice of Bangladesh to lead the entire judiciary superseding senior High Court Division’s Justices and Appellate Division’s Justices? This is exactly what had happened when Dr Shirin Sharmin, a non-elected new comer in Parliament, was appointed as the Speaker to the entire legislature.

Why did the Prime Minister so keen to make her the Speaker? No, doubt, Dr Shirin Sharmin was a brilliant student in her student life. That does mean that she should be elevated to lead the legislature, the most important institution of the Republic. The Speaker is one of the senior most position holders of the State – third in rank (used to be second in the past) in accordance with the Warrant of Precedence. If the President dies or becomes incapable of performing his duties, the Speaker would become Acting President (Article 54). In such an important position, why the Prime Minister was so keen to send Dr Shirin Sharmin to? What was her strength and connection? The most important qualification Dr Shirin Sharmin had was that her father was one of the secretaries of the Prime Minister’s late father. That enabled her to jump straight at the top of the ladder.

This is not the first time Prime Minister had favoured her own people breaking norms, customs, convention and constitution.

She made her personal physician as an important Adviser (Cabinet minister rank) to the Government. She also made her private lawyers a Minister more than once.

Many such examples in this line can be given. Is it the sign of good governance?

Is it the sign of women empowerment?

Shame, Honourable Prime Minister.

How the Prime Minister has violated the constitution?

Why did the Prime Minister nominate the Speaker from the non-elected MPs on reserved seats of Parliament instead of elected MPs? By doing so she violated the constitution and disrespected people’s will. Under the constitution, there is no scope for being appointed as the Prime Minister, the Speaker and the Deputy Speaker without being a directly elected MP. These positions are specified, reserved and protected for elected MPs. These State’s positions are reserved for those who have been directly elected. The constitution has clearly divided the power, significance and role of elected MPs and MPs selected on reserved women seats.

Parliament or the Prime Minister has no jurisdiction to intervene. Where the constitution has given clear direction of separation, it will be clear violation of constitution to merge these into one class. Elected MPs cannot be replaced by non elected women MPs selected on reserved seats. Our constitution clearly says “The Republic shall be a democracy in which ........effective participation by the people through their elected representatives in administration at all levels shall be ensured.”

Three hundred MPs represent all people of Bangladesh. Women MPs on deserved seats are not elected.

Even in relation to the President, who is elected by MPs, former Chief Justice ABM Khairul Haque said in Thirteenth Amendment case judgement that President is constitutionally the highest position holder of the State, but he is not democratically elected representative of the Republic. Article 74(1) of the constitution has made an obligation on Parliament to elect a Speaker from the elected members of Parliament, for this Article provides provision for electing a Speaker and a Deputy Speaker at the first sitting after general election when the women MPs on reserved seats are not even nominated and selected.

Even in Article 152, in explanation of the position, among others, of the Speaker, it says “The Speaker means the person for time being holding the office of Speaker pursuant to Article 74.”

When any of three hundred seats becomes vacant, there has to be a byelection within three months to fill the vacancy [Article 123(4)]. It cannot be replaced or filled in by a non-elected MP on reserved seat. Similarly, the State’s posts/positions reserved for elected MPs cannot be filled in by non-elected MPs, for it would be contrary to the ideals and spirit of the constitution. ......To be continuned
