HONG KONG, April 23, 2014 (AFP) – Hong Kong and the Philippines announced Wednesday they had resolved an enduring and deeply emotional row over a deadly hostage crisis, allowing soured diplomatic relations to return to normal. The breakthrough came after a deal was struck on the most sensitive issues of compensation to the victims of the tragedy, which saw eight tourists from Hong Kong killed following a bus hijacking

in Manila in 2010, as well as an apology. “The resolution of the incident enables the normalization of the bilateral relations between Hong Kong and the Philippines,” the Chinese territory’s chief executive, Leung Chun-ying, told reporters after the deal was struck. MANILA, Apr 24 (Mabuhay) – The Armed Forces of the Philippines (AFP) on Thursday said that the visit of US President Barack Obama will further improve security and defense ties between the United States and the Philippines. Obama is slated to visit the country this coming April 28 to 29. “The AFP believes that the visit of US President Barack Obama will further strengthen the relationship between the American and Filipino nations, especially in terms of mutual security and defense cooperation,” AFP public affairs office chief Lt. Col. Ramon Zagala said. Aside from this, both countries have a long tradition of partnership. “The US military and the AFP shares a long history of partnership built on the Mutual Defense Treaty. This visit will also affirm that partnership in order for both the US and the Philippines to create a mutually beneficial environment aimed at addressing broad regional and global challenges, including maritime security, climate change, terrorism, and transnational crimes among oth-

ers,” Zagala pointed out. Malacañang earlier stated that ways to intensify political and security cooperation between the Philippines and the United States will be discussed during Obama’s visit. Presidential Communications Operations Office (PCOO) Secretary Herminio Coloma Jr. said the PHL-US wide-ranging security partnership includes joint military exercises, such as “Balikatan” and humanitarian assistance and disaster response activities. No truth to visa-free policy for Filipinos in US – PHL Embassy MANILA, Apr 23 (Mabuhay) – The Philippine Embassy in Washington on Wednesday dispelled online news reports that the United States has announced a novisa policy for Filipinos. In a statement, the embassy said it has been “in touch with the US Department of State, which has denied making such an announcement.” “There is no truth to what appears to be an online news report that the U.S. has announced a no-visa policy,” the embassy said. “The Embassy reminds the public that the online article being circulated in social media is a satirical piece that should not be taken seriously,” it added. Quoting the U.S. State Department, the

article, which is being circulating in social media, says the no-visa policy will take effect “immediately.” The new policy, the report said, “comes on the heels of a recent survey showing that an overwhelming majority of Filipinos have a favorable view of the United States.” “The Philippines ranked first in a global survey on the image of the United States worldwide, beating even the U.S. itself when it comes to a favorable view on the American people,” the report said. OWWA to include MERS-CoV info in pre-departure seminars for OFWs MANILA, Apr 23 (Mabuhay) – Pertinent information about the Middle East Respiratory Syndrome coronavirus (MERS-CoV) will now be included in the pre-departure orientation seminar (PDOS) for overseas Filipino workers. This was according to Labor and Employment Secretary Rosalinda Baldoz, who said the incorporation of MERSCoV in the PDOS would inform Filipino workers on how to protect themselves. A non-government organization, the Blas F. Ople Policy Center, has earlier urged the government to include the MERS-CoV in the topics discussed PDOS especially for OFWs bound for the Middle East, where the virus is said to have originated from. Baldoz directed Overseas Workers Welfare Administration (OWWA) chief Carmelita Dimzon to craft an advisory to all PDOS providers, including licensed recruitment agencies, in-house PDOS centers, associations, and non-

government organizations to provide the orientation to all departing OFWs. OWWA is an attached agency of the Department of Labor and Employment. The PDOS is a country-specific, mandatory education and information orientation session conducted by the government for all departing OFWs to ensure that they are ready for their life of work abroad. “While the PDOS has already a health module that provides knowledge and information on such diseases such as Severe Acute Respiratory Syndrome (SARS), Acute Immuno-Deficiency Syndrome (AIDS), and other infectious ailments, the MERS-CoV, being fairly news, is not included, so we better incorporate it in the PDOS,” Baldoz said in a statement Wednesday. The advisory incorporating the MERSCoV in the PDOS will be disseminated to the media and will be posted on the OWWA website. (MNS)

Luisita farmers decry ‘hoax land distribution’ MANILA, Apr 24 (Mabuhay) – Hacienda Luisita farmworker-beneficiaries (FWBs) stormed the office of the Department of Agrarian Reform (DAR) in Quezon City Thursday to protest what they call a “hoax land distribution.� In a statement, the Alyansa ng mga Manggagawang Bukid sa Asyenda Luisita (AMBALA) said the administration of President Benigno Aquino III “is unlawfully wielding its clout to evict and disenfanchise farmers, and ultimately retain control of Hacienda Luisita� despite an earlier ruling of the Supreme Court. On November 22, 2011, the SC ordered the distribution of almost 5,000 hectares of Hacienda Luisita to 6,296 farmworkerbeneficiaries. In the decision, 10 Supreme Court

magistrates voted to compensate the managers of Hacienda Luisita based on a 1989 valuation. The valuation based on 1989 rates would mean that relatives of President Aquino would be paid P40,000 per hectare or around P200 million instead of P1 million per hectare or P5 billion as petitioned by Hacienda Luisita Inc. (HLI). The SC also reiterated its earlier ruling ordering HLI to pay the 6,296 farmers a total of P1.33 billion. AMBALA chairperson Florida Sibayan said under the current administration, Luisita’s ricefields and agricultural areas have been “brazenly transformed into walled garrisons.� “Luisita is under a reign of terror and impunity,� Sibayan said. BIR loses tax case against online brokerage COL Financial MANILA, Apr 23 (Mabuhay) -– The Bureau of Internal Revenue (BIR) has lost a tax case against COL Financial Group Inc. In a disclosure to the Philippine Stock Exchange, the leading online brokerage said the Court of Tax Appeals ordered the BIR to issue COL a tax credit certificate (TCC) amounting to P8.96 million. In April 2012, COL filed a petition for review to preserve its right to claim a tax refund or secure a TCC for the additional income tax paid under protest for 2009. The case stemmed from the BIR’s issuance of Revenue Regulation No. 2-2010 and Revenue Memorandum Circular No. 16-2010, effectively amending Section 7 of BIR Revenue Regulation No. 16-2008 with respect to the determination of the optional

standard deduction (OSD) of general professional partnerships and their partners, as well as the manner and period for making the election to claim OSD in the income tax returns. The rules were made to apply retroactively. “The company takes the position that RR 2-2010 and RMC 16-2010 should be given prospective effect,� the listed firm said. Civil Service suspends BIR employee for not filing SALN MANILA, Apr 23 (Mabuhay) – The Civil Service Commission (CSC) has suspended an employee of the Bureau of Internal Revenue (BIR) for not filing his Statement of Assets and Liabilities and Net Worth (SALN). The CSC found Arsenio N. Reyes, Revenue Officer III at BIR’s Revenue Region Number 10 (Legazpi City), guilty of failure to file his SALN in 2010, which earned him a three-month suspension. A SALN is the declaration of a government employee’s assets and liabilities, business and financial interests, including that of his or her spouse, and an identification and disclosure of his or her relatives. It is required by law under the 1987 Constitu-

tion and under Republic Act No. 6713, the “Code of Conduct and Ethical Standards for Public Officials and Employees.� Reyes’ case stemmed from the complaint filed by the Department of Finance’s anti-corruption arm, Revenue Integrity Protection Service (RIPS), the anti-corruption arm of the Department of Finance (DOF). In February 2011, Finance Secretary Cesar V. Purisima issued Department Order No. 12-2011, mandating all officials and employees of the agency and its attached officesvto submit a copy of their SALNs to the heads of offices, the Revenue Operations and Legal Affairs and RIPS. One of the objectives of the school gardens program as stated under House Bill No. 3843 is to coordinate the efforts of public schools, the DepEd, the Department

of Agriculture (DA) and other concerned government agencies and community organizations to establish gardens as integral components of public schools. Another objective is to establish and convene a Garden Advisory Committee at the local levels, composed of community organizations and other interested persons. It shall also be the function of the school garden program to collect data on the location and types of gardens in public schools as well as to provide agricultural guidance and technical assistance to public schools. The following are additional situations when wage theft are likely occurring: 1) Manipulating timekeeping devices to reflect only the hours that employees are scheduled to work and ignoring any preliminary or postliminary work-related activities such as preparing their tools before clocking in, or making reports after clocking out. 2) Misclassifying employees as independent contractors in order to deprive them of minimum wage, and overtime pay, among other things. 3) Paying piece rate employees the incorrect overtime rate even though they are made to work more than 8 hours per day. 4) Rounding down work hours. For example, if the employee clocked out at 5:15 p.m., the employer may round this down to 5:00 p.m., disregarding the extra 15 minutes of overtime worked. Fifteen minutes may not be a lot, but if it happens several days a week for years, the

employee may be owed significant back wages. 5) Not providing meal or rest breaks to employees, not providing them an opportunity to take breaks, not providing relievers, or interrupting employees during their breaks – these are all against the law and entitle employees to additional wages. There may be other situations where wage theft occurs. Employees who feel they are not compensated correctly would be wise to consult with a knowledgeable employment attorney. [C. RNs press case for hospital workplace safety Legislature set to hear bill on Violence Prevention Assembly Committee OKs bill on MRSA infection response The California state legislature is taking a first look on two bills sponsored by the California Nurses Association/National Nurses United intended to improve workplace safety prevention measures in California hospitals. The Senate Labor Committee will review legislation that would step up violence prevention policies in California hospitals, an issue that gained greater urgency this week by the stabbings of two registered nurses at two Los Angeles area hospitals. A separate bill to assure eligibility to workplace compensation for registered nurses (RNs) and

other hospital staff who contract the dangerous MRSA skin infection won approval by the Assembly Insurance Committee Wednesday. Assembly Bill 2616 by Assembly member Nancy Skinner was passed on an 8-5 vote. It will now go to the Assembly Appropriations Committee. On workplace violence, Senate Bill 1299, introduced by Sen. Alex Padilla would require the California Occupational Safety and Health Standards Board to adopt standards requiring hospitals to establish workplace violence prevention plans to protect health care workers and other facility personnel from aggressive and violent behavior. Trenas urges LTFRB to rush ‘speed limiter’ program for buses, trucks MANILA, Apr 23 (Mabuhay) – Alarmed with the rising number of deadly accidents involving buses and trucks, Iloilo Rep. Jerry Trenas on Wednesday urged the Land Transportation Franchising and Regulatory Board (LTFRB) to expedite the implementation of its plan to install speed limiters for buses, trucks and other vehicles that are above 7.5 tons in maximum payload. Trenas said that while these trucks and buses are essential in ensuring the continuous flow and transportation of people and goods, public safety should remain a paramount concern of the government. He said that for Metro Manila buses and

trucks, the speed limit should be set at 60 kilometers per hour (kph) while provincial buses can have a 90 kph speed limit. He noted that although the bill he filed seeking to require buses to be equipped with speed limiters is yet to become a law, the LTFRB under Chairman Winston Ginez can go ahead with its implementation because the agency is cloaked with the mandate to implement programs that are designed to promote safety in public transport. Trenas said that despite repeated public calls for bus and truck operators to impose proper driving discipline and etiquette for their drivers, there seems to be no progress

DTI eyes higher fines for violators of Consumer Act MANILA, Apr 23 (Mabuhay) – The Department of Trade and Industry (DTI) is looking to amend provisions in the Consumer Protection Law to protect consumers from fraud, and price and standard irregularities. DTI Undersecretary Victorio Dimagiba said the agency will propose higher fines for violators of the Consumer Act. He said the proposal seeks to raise the minimum fine to P50,000 from P500 and the maximum fine to P1 million from P300,000.

He added that the DTI will also push to increase imprisonment to two years from six months. The proposed amendments will also seek to strengthen regulations on online sales or e-commerce in wake of complaints of non-full disclosure on products and other acts of deceptive sales. The 22-year-old Consumer Protection Law protects consumers from illegal practices involving prices, standards, false or misleading information, deception, and product warranties. (MNS)

The National Disaster Risk Reduction and Management Council (NDRRMC) said that during the Lenten break alone, a total of 16 road accidents that killed 12 people have been recorded. Just this week, a woman was killed after she was hit by a Victory Liner bus, which eventually fell off a ravine in Olongapo City. About 50 passengers were also injured in the Victory Liner bus mishap. “These accidents could have been avoided if these buses are responsible enough for the safety of their passengers. It looks to me that there is really no hope for our drivers to be more cautious when behind the wheel, the only way to stop

their recklessness is to install these speed limiters,� Trenas said. Trenas said that the proposal to install speed limiters should be implemented as soon as possible to stop the senseless death and injury of people due to reckless drivers. According to the Visayan lawmaker, the LTFRB should skip the runaround and start requiring buses to install speed limiters within the year. V“With the speed limiters, we will definitely have better discipline among bus and truck drivers whether they like it or not. This will not only make our streets safer from these speed demons but would also mean extra savings on maintenance for our bus and truck operators. “Staying safe on the road would also mean longer life span not only for their drivers but also for their buses and trucks,� he said. DBM shells out P10-B for AFP, PVAO pensioners MANILA, Apr 23 (Mabuhay) – As part of the Aquino administration’s commitment to support the country’s retired men in uniform, the Department of Budget and Management (DBM) has released a combined amount of P9.91 billion to the Philippine Veterans Affairs Office (PVAO) and the Armed Forces of the Philippines (AFP) for the second-quarter pension requirements of war veterans and retired military personnel. DBM Secretary Florencio “Butch� Abad said that P7.50 billion of the total amount will benefit 120,296 pensioners of the AFP, of which 2,583 comprise new beneficiaries for 2014. Both releases were sourced from the Pension and Gratuity Fund under the 2014 General Appropriations Act (GAA) “This latest release guarantees the timely delivery of regular pension benefits to our retired military personnel for the second quarter of the year,� he said. At the same time, Abad said the government continues its transparency efforts to update, validate and cleanse our list of beneficiaries so that it’s free of invalid, duplicate, and ghost entries. “Our pensioners and their families will therefore receive the benefits due them

Meanwhile, some P2.40 billion was released to 208,458 PVAO veterans to cover old age pensions, death pensions, disability pensions, and total administrative disability (TAD) pensions for the second quarter of the year. Switching from check to ATM payments nipped these anomalies in the bud,� Abad said. “More important, however, is the fact that we’re able to give better support to our retired military personnel and our war veterans. Angat water level still normal – PAGASA MANILA, Apr 24 (Mabuhay) – The Philippine Atmospheric, Geophysical and Astronomical Services Administration (PAGASA) on Thursday announced that the quantity of water in Angat Dam is still sufficient to supply the water needs of Metro Manila which sources about 90 percent of its water from that facility. In an interview, PAGASA Hydrologist Richard Rondain said that the water level of Angat is at 184.61 meters as of 6:00 a.m. Thursday. �The Angat dam is still sufficient to supply water in Metro Manila and the water level isn’t critical yet and the water elevation there as still “normal,� Rondain told the Philippines News Agency (PNA). He said Angat can provide water to Metro Manila up to the month of June. He added that the agency expects Angat’s water level at below 180 meters or

critical low by mid-May if there are no rains, but water supply is still available during this time. Worst case scenario, he said, is if it does not rain until July. He is advising Metro Manila residents to rationalize their use of water as Angat’s water is also used for irrigation and power generation. “Use water wisely and people must make water conservation a habit,� Rondain said. He said the agency expects rains to begin by the third week of May that could replenish water supply in Angat. Built and first operated in the 1960s, Angat Dam impounds water from Angat River. Operation in the dam prioritizes domestic water supply over irrigation if the reservoir’s water level drops below the day’s lower rule curve threshold.

UP professor is new National Statistician MANILA, Apr 24 (Mabuhay) – Lisa Grace S. Bersales, former vice-president for planning and finance of the University of the Philippines (UP) System and erstwhile dean of the UP Diliman School of Statistics, is the newly-appointed National Statistician and head of the Philippine Statistics Authority (PSA). Economic Planning Secretary Arsenio M. Balisacan, who is also the PSA Board Chairman, led the oath-taking ceremony of Bersales on April 22 at the NEDA Central Office, Pasig City. President Benigno S. Aquino III appointed her on April 21, 2014. Prior to assuming the post, Bersales was the UP System’s Vice President for Planning and Finance, a position she has held since February 10, 2011. A member of the UP Diliman faculty for more than 30 years, she was director of graduate studies while also dean of the School of Statistics in the late 1990s. Bersales earned her bachelor’s degree in Statistics, cum laude, in 1978, MS in Statistics in 1981, and PhD in Statistics in 1989 in the same university. Her publications and research papers have mainly been on applying statistical analysis to a wide range of issues related to social development, agriculture, and the economy. She has been involved in several projects with government agencies, such as the former National Statistics Office (NSO) that is now under PSA, and the Departments of Social Welfare and Development (DSWD) and Education

Farmers urge Congress to vote on immigration Bakersfield, CA – On the heels of the anniversary of legendary United Farm Workers (UFW) founder Cesar Chavez’s passing, hundreds of farm workers from all over California gathered in Bakersfield today to deliver a personal message to House Majority Whip Kevin McCarthy (R-Calif.) on immigration reform: “I harvest for 10 hours a day. Can you take 10 minutes to schedule a vote?� Led by UFW President, Arturo Rodriguez, farm workers and immigration reform advocates marched single file to McCarthy’s office in Bakersfield and lined roadways with signs specifying what each farm worker harvests. Once at McCarthy’s office, farm workers and advocates took turns knocking on the door, requesting a meeting with the congressman. Said Arturo Rodriguez at the event: “I’m always inspired by the strength

and work ethic of these men and women who do the backbreaking labor required to harvest America’s produce, but today was truly remarkable. Minorities concerned on demise of Affirmative Action

LOS ANGELES – Asian Americans Advancing Justice- Los Angeles (Advancing Justice-LA) is deeply concerned by the U.S. Supreme Court’s decision in Schuette v. Coalition to Defend Affirmative Action upholding Proposal 2, a 2006 Michigan ballot initiative amending the state constitution to prohibit race-conscious college admissions policies. The decision overturns the 2012 ruling of the U.S. Court of Appeals for the Sixth Circuit, which held that Proposal 2 impermissibly imposed heightened burdens on racial minorities advocating raceconscious admissions policies – burdens not shared by the majority. As Justice Sotomayor pointed out in dissent: “The effect of [Proposal 2] is that a white graduate of a public Michigan university who wishes to pass his historical privilege on to his children may freely lobby the board of that university in favor of an expanded legacy admissions policy, whereas a black Michigander who was denied the opportunity to attend that very university cannot lobby the board in favor of a policy that might give his children a chance that he never had and that they might never have absent that policy.” The plurality decision by Justice Kennedy, who was joined by Chief Justice Roberts and Justice Alito, condones the entrenchment of this fundamentally unequal political system by disregarding the longstanding “political-process doctrine,” which prohibits the majority from creating a separate political process that makes it more difficult for racial minorities to enact beneficial legislation. “The passage of Proposal 2 demonstrates that race still matters and that the courts are more necessary than ever to protect the rights of minorities,” said Stewart Kwoh, president and executive director of Advancing Justice - LA. As Justice Sotomayor opined in dissent, “The Constitution does not protect racial minorities from political defeat. But neither does it give the majority free rein to erect selective barriers against racial minorities. The political-process doctrine polices the channels of change to ensure that the majority, when it wins, does so without rigging the rules of the game to ensure its success.” Despite the disappointing and harmful decision by the Supreme Court today, it is important to note that the Court did not address the merits of race-conscious admissions, which are still constitutional under Fisher and Grutter. Protest vs Filipinos rekindles anti-foreign anger in Singapore

SINGAPORE, April 25, 2014 (AFP) – An abusive campaign by Singaporeans opposing a planned Philippine independence celebration has shone a light on anti-foreigner sentiment in the city-state, home to large numbers of guest workers accused of taking jobs from locals and causing overcrowding. The Philippines marks its 116th year of independence on June 12 and a group of Filipino residents in Singapore is planning an event on June 8 at a shopping complex along busy Orchard Road. It became a hotly debated topic after commentators on anonymously-run local websites and Facebook pages heaped racial abuse on Filipinos and attacked the choice of venue, saying it should be held in the Philippine embassy grounds instead of the public Orchard Road area. Prime Minister Lee Hsien Loong, who attended a “Singapore Day” celebration in London on March 29 attended by 9,000 people, condemned the “thuggish behavior” of people who harassed the organizers of the Philippine event, calling them a “disgrace to Singapore”. Blaming “a few trolls” for the online attacks, he wrote on his Facebook page: “How would we have felt if British netizens had spammed our website, and abused Singaporeans living in Britain?” A spokeswoman for organizers Pilipino Independence Day Council Singapore (PIDCS) referred to a previous statement which said they were “heartened, grateful, and happy to receive support from Singaporeans.” She declined to comment on whether the event would go ahead as planned on June 8. Police say they have not yet received a permit application for it. The Philippine embassy in Singapore was moved to post an advisory on its website urging Filipino residents to exercise caution. “Participating in these online debates will only inflame the situation and may result in untoward incidents, possible loss of employment and investigation by authorities,” it said. ‘Over-reaction’ Eugene Tan, an associate law professor at the Singapore Management University, said the online backlash is a “visceral over-reaction and it does not reflect the sentiments of the average Singaporean. “The anger probably stems from unhappiness with the government’s immigration policy,” Tan, a social commentator and appointed lawmaker, told AFP. Singapore’s low birth rate prompted the government to grant an average of 18,500 new citizenships every year between 2008 to 2012 – helping the population surge by 30 percent since 2004 to 5.4 million last year. Out of a foreign population of 1.55 million

More than 200,000 others work as domestic helpers. About 172,700 Filipinos work in Singapore, according to the latest publicly available Philippine government data. Many Singapore citizens – who now make up barely over 60 percent of the population – see the overseas arrivals as competition for housing, schools and space in a city-state whose per capita income of $54,500 masks one of the biggest income gaps in the world. Critics posting on ultra-nationalist blog The Real Singapore as well as on various Facebook pages say the Filipino event is illustrative of foreigners overstepping their welcome in Singapore. “The government has sold us out by bringing in foreigners to replace us at the job front and new homes are specially build to house them. Opposing xenophobia Kirsten Han, a Singaporean civil activist and blogger, said opponents of the event are blind to their own double standards given the lack of rancor when the city-state’s Irish community annually celebrates St.Patrick’s Day in the main nightlife district. “State policy could feed resentment and anger, but it certainly does not have the power to make a person use words like ‘scum’ or ‘undesirable underlings’ against others,” she wrote in a blog. Law professor Tan said the government is concerned that rising anti-foreigner sentiment could affect the city-state’s international reputation for being one of the world’s most open economies. A large-scale social survey by Singapore’s Institute of Policy Studies released this year showed that over 30 percent of the resident population felt that nationality-based prejudice had risen over the past five years.

1.6-B people in Asia-Pacific might slip back into extreme poverty – ADB MANILA, Apr 24 (Mabuhay) – The Asian Development Bank (ADB) said in a report released Thursday that 1.6 billion people in Asia-Pacific are at risk of being pushed back into extreme poverty. The Manila-based lender said the 1.6 billion people who subsist on less than USD 2 a day remain vulnerable to shocks. “They are constantly at risk of being pushed back into extreme poverty through loss of employment, health problems, prolonged recession, inflation, crop failure, disasters or social upheaval,” the ADB said in a report. The report, which assessed ADB’s long-term strategic framework dubbed as Strategy 2020, noted that high food prices are a major source of vulnerability. It added that sharp increases in food prices affect the poor who devote more than half of their income to food.

ADB noted that Asia-Pacific is home to 60 percent of the world’s extreme poor. Around 733 million people in Asia-Pacific continue to live on USD 1.25 a day—the threshold for extreme poverty. “The challenge for ADB is to help developing member-countries eradicate remaining poverty, support greater inclusiveness to address inequalities, and become more relevant and effective in middle-income countries,” said ADB President Takehiko Nakao. The Manila-based lender said it is realigning its operations to emphasize inclusiveness, build resilience and strengthen support for middle-income countries. The report identified 10 strategic priorities for ADB to “sharpen and rebalance” its operations and strengthen its responsiveness to the changing business environment as well as increase its capacity and effectiveness.

The ruling was the latest to chip away at a practice used to promote racial and ethnic diversity of university student bodies while countering the effects of racial discrimination. A broad range of surviving spouse/domestic partner rights are canceled upon finality of a judgment of dissolution or nullity including beneficiary rights under retirement plans, pay on death accounts, transfer on death vehicle registrations, trusts and a marital property agreement. Probate Code § 5600(e) . Now since Wills and Trusts executed during the marriage is revoked upon entry of divorce or nullity judgment, you should think about setting up a new estate plan after the divorce or nullity to have a new plan in place in case you pass away. If you pass away with at least $150,000 in gross assets and you do not have a living trust (even if you have a will), your beneficiaries would have to open up a probate case before title to the assets can pass to them. When I say gross asset, I mean regardless of how much debt you owe on them. For example if you own a house valued at $850,000 at the time of your death, it does not matter that your mortgage balance is 800,000, a probate case has to be opened in order to pass title to that property. The same is true with other types of assets such as owning a business, a professional practice, bonds, equities, etc. This is a very low threshold to exceed specially in California where real estate prices, even after the economic crisis, remains in the upper end of the curve among the 50 states. Commencing a probate case is expensive and a very slow process. Someone qualified will have to file a Petition with the probate court to have someone appointed as executor or administrator. gross estate. The probate referee will have to be paid for appraising the assets of the estate. If it is necessary to post bond, the premium on the bond would have to be paid as well. There is also the cost of administering the estate such as selling some of the assets to satisfy the estate’s obligations and to divide the estate according to the will or the intestate line of succession if there is no will. The entire process could take up years specially if certain beneficiaries and creditors file certain claims. The probate court file would be public record. On the other hand if you have a revocable trust, your estate can avoid the entire court system and court supervision. In certain situations, the process may also save you estate taxes which may be substantial if your assets exceed a certain threshold. Basically, you and/or your spouse can be named as the initial trustee of the trust while you are alive. The trustee is the person who manages the trust. This means you retain control of all your assets the same way as if you never had a trust. For revocable trusts, you can later on, at any time during your lifetime, revoke the entire trust if you change your mind. The assets held in your living trust will be managed by the trustee and distributed according to your directions without court supervision and involvement when you pass away. This can save your heirs time and money. Since the trust would not be under the direct management of the probate court, your assets and their value and your beneficiaries’ identities would not become a public record. Your heirs and beneficiaries would still have to be notified about the living trust and advised, among other things, of their right to obtain a copy of the trust. If you recently got divorced or had a marriage annulled, you should have a new estate plan (wills and trust) set up to save on estate taxes, save on probate and administration cost, and make it more convenient for your beneficiaries to inherit from your estate. Facing charges, ex-CJ Corona and Chavit blocked from leaving country MANILA, Apr 25 (Mabuhay) – The Sandiganbayan on Friday issued Hold Departure Orders against former Ilocos Sur Governor Luis “Chavit” Singson and former Chief Justice Renato Corona for separate cases. The HDO against Singson stemmed from a P26-million graft case while the one against Corona stemmed from a perjury case, radio dzBB’s Glen Juego reported. This is despite a court motion from a Enrile’s deputy chief of staff, Jose Antonio Evangelista, taking full responsibility for processing the disbursement of Enrile’s Priority Development Assistance Fund. “Probably, that is their (Enrile camp’s) strategy. (But) we stand by our evidence. It can’t be na hanggang level lang ni Evangelista,” said De Lima. Earlier, in a partial motion for reconsideration – prepared by lawyers Edwardson L. Ong and Mercedes Isabel Mayoralgo of Ponce Enrile Reyes & Manalastas Law Offices – Evangelista took full responsibility for processing the disbursement of Enrile’s pork barrel allocations, according to a Philippine Daily Inquirer report. Evangelista, however, blamed implementing agencies for allocating the pork

barrel funds to alleged bogus non-government organizations, it added. He said this after Reyes, who returned to the Philippines on April 19, told the Office of the Ombudsman that she had no participation in the release of Enrile’s pork barrel funds. “These were done by DCOS (deputy chief of staff) Jose Antonio V. Evangelista,” said Reyes, in a separate Inquirer report. She added that her signatures on documents related to the releases of Enrile’s pork barrel funds were forged. The Ombudsman earlier found probable cause to file malversation charges against Evangelista and Reyes for their alleged participation in allocating Enrile’s pork barrel funds to questionable NGOs for nonexistent projects. UERM health workers conduct medical missions, relief operations in PHL LOS ANGELES – This year, the University of the East Ramon Magsaysay Medical Alumni Association in America (UERM –MAAA) and UERM Medical Alumni Association in Southern California (UERM - MAASC) sponsored and organized the annual medical mission and relief operations on Feb 5- 15, 2014, intended to help the victims of typhoon Yolanda and indigent children and their families in the Philippines. The group started its humanitarian mission at Municipality of Kananga, Province of Leyte, and then proceeded to Lucena, and Coron, Palawan. They provided medical care to more than 2500 patients and distributed relief goods to 1,765 families, and conducted a gift-giving and feeding program for 100 indigent children in La Union on Feb. 5-6. The mission is now becoming an annual project to the Philippines and focuses on serving the indigent children and families from underserved and neglected communities, including victims of disasters and calamities. Spearheading the success of the 2014 humanitarian mission are Dr. Edgar Ba-

Depression, insomnia and nightmares blamed on typhoon Yolanda were some of the complaints along with uncontrolled HTN with a systolic Blood Pressure of more than 200 mm HG. URI’s, dermatitis and musculoskeletal complaints were also common and we heard a lot of stories of devastation and death. We hope we had provided a glimmer of hope to everyone we saw. We ran short of medicines but we

were able to get some from local Pharmacy in Ormoc City which is thirty minutes away. We got lucky; we had enough medicines until the last patient was seen. On the third day of mission to Kananga, a relief distribution was conducted providing school bags, mats, towels, plates, bowls, glasses including spoons and forks to 1000 families. We had an early lunch and there was no rest, the group proceeds to Tacloban to catch the 4:30 pm flight back to Manila. From the NAIA domestic terminal in Manila, we were picked up by the bus sent by Bishop Emilio Marquez of the Archdiocese of Lucena and we arrived at Bahay Pare in Lucena, Quezon before midnight.” On Feb. 10-11, the mission team attended to more than 1,000 patients consisting of mostly adults at Bahay Pare. As a result of spearheaded actions by Bishop Marquez and his staff, were able to perform major and minor surgeries. The Bishop also hosted the group sumptuous meals and lodging accommodations for two days. On Feb. 12, the group proceeded to Coron, Palawan where approximately 850 patients were attended to. At least 765 families living in Baran-

gay Cabugao, Lilian and Banuang Daan received relief goods. The Tagbanuas (natives) in Coron also received school bags, sleeping mats, towels, pales and grocery items. “We made them smile, we hoped it made a difference. And the 2014 Medical/ Surgical Mission was officially over. We thank our Lord for giving us the opportunity to serve, make the lives of others a little better, and make a little difference in this world one family, one barangay at a time,” Dr. Bañez added. The local partners, Kananga Municipal Mayor Elmer Codillo, Bishop Marquez, and Coron Municipal Vice Mayor Jim Pe, on behalf of their constituents were so thankful and grateful to this timely mission that benefits thousands of underserved individuals, including the recent victims of Typhoon Yolanda. Breastfeeding may protect against heart disease: study (PARIS-AFP) – People who had low birth weights and those breastfed for short periods may be more likely to develop chronic inflammation linked to heart disease in adults, a study said Wednesday. Researchers in the United States found a “significant” association in almost 7,000 people between birth weight or duration of breastfeeding and higher levels of Creactive protein (CRP), an indicator of inflammation, in blood samples of young adults. The protein is produced by the liver and levels increase when a person suffers from inflammation. “Each pound of additional birth weight predicted a CRP concentration that was five percent lower,” said a statement from Northwestern University, whose experts took part in the study published in the journal Proceedings of the Royal Society B. “Three to 12 months of breastfeeding predicted CRP levels that were 20 to 30 percent lower compared with individuals

who were not breastfed.” The study found that breastfeeding had “the same or greater effect” as medicines on reducing CRP levels in young adults. Chronic inflammation had long been linked to cardiovascular disease, but the causes of the little-understood condition remain unclear. The US study was done among 24- to 32-year-olds from different race groups and educational backgrounds, and included comparisons between siblings so as to rule out the confounding influence that growing up in vastly different socioeconomic environments could have on the results. “The results suggest that breastfeeding may reduce a major risk factor for heart disease well into adulthood,” said Alan Guttmacher, director of the Eunice Kennedy Shriver National Institute of Child Health and Human Development. Identification with model conducive to learning, study suggests (Relaxnews) – In non-verbal contexts, learning occurs primarily through the observation and imitation of a model. In a recent study on this process in monkeys, researchers found that the learner’s ability to identify with the model appears to be an essential condition of learning. To explore the effectiveness of different modes of non-verbal social learning, researchers from the Lyon Neuroscience Research Center in France chose to work with rhesus macaques, a species of monkeys known for their biological proximity

to humans and their ability to imitate. Monkeys trained to find a food reward hidden by an object were tested with three different learning models in succession. The first model was another macaque, who immediately ate the reward once it was found. The second was a “stimulusenhancing” human, who actively drew the monkey’s attention to the object concealing the food. Finally, the third model was a “monkey-like” human who performed the task exactly as the monkey would, including eating the food reward.

After each of these exercises, the researchers evaluated the monkeys’ learning by testing whether they were capable of reproducing the same results on their own. “The results show that monkeys learn more effectively if the exercise is demonstrated by a model that acts like they do, in other words, who eats the reward once it has been found,” explain the study’s authors in a press release. “It even seems that this is an essential condition for skill transfer,” indicates co-author Elisabetta Monfardini.

Another key finding was that modeling errors optimized learning success rather than hindering it. In other words, the monkeys learned more effectively from monkeys or humans who did not complete the task perfectly the first time. In light of the psychological similarities between macaque monkeys and humans, the researchers indicate that their findings could have applications in schools. “When a schoolteacher calls one of the brightest students to the board to show an example, this may not be the best strategy.

WASHINGTON, April 23, 2014 (AFP) – Young adults who smoke marijuana may be at risk for serious or even fatal heart problems, according to a study by French researchers on Wednesday. The findings in the Journal of the American Heart Association raises new concerns about the safety of marijuana, just as many parts of the world are relaxing laws on its use and medicinal marijuana is gaining popularity for treating certain health conditions. The risk of heart complications appeared small in the study, which included nearly 2,000 people who sought medical attention for complications related to marijuana from 2006 to 2010. Of those, two percent, or 35 people, had heart attacks or circulation problems related to arteries in the brain and limbs. Of greater concern was the high death rate. One in four of the patients with cardiovascular complications died, said the researchers. The analysis also found that the percent-

age of reported cardiovascular complications more than tripled from 2006 to 2010. “The general public thinks marijuana is harmless, but information revealing the potential health dangers of marijuana use needs to be disseminated to the public, policymakers and healthcare providers,” said lead author Emilie Jouanjus, a medical faculty member at the Centre Hospitalier Universitaire de Toulouse in Toulouse, France. “There is now compelling evidence on the growing risk of marijuana-associated adverse cardiovascular effects, especially in young people,” Jouanjus said. Doctors should be aware of the heart risks and consider marijuana use as a potential contributor to cardiovascular disease in some patients, said Jouanjus. People with pre-existing conditions appeared most vulnerable, the study added. U.S. Supreme Court ruling may lead to decline in minority college enrollment WASHINGTON – The U.S. Supreme Court’s decision in Schuette v. Coalition to Defend Affirmative Action, which upheld a Michigan ballot initiative amending the state constitution to prohibit race-conscious college admissions policies, will likely lead to further decreases in minority enrollment in higher education, Asian Americans Advancing Justice (AAJC) asserts. The 6-2 ruling overturns a lower court decision striking down Proposal 2 because it placed an unfair burden in the political process on those seeking to have race, as opposed to other types of factors, considered in admissions policies. “The Court has given states a way to circumvent decades of hard-fought gains in affirmative action by creating an unequal system where those who support diversity in higher education will now have to overturn a constitutional amendment,” said Mee Moua, president and executive director of Advancing Justice | AAJC. “Ballot initiatives like Proposal 2 in Michigan have increased barriers for young Asian Americans to access higher education.” The case did not call into question the merits of race-conscious admissions policies, which the Supreme Court has upheld in prior cases. The ruling has no bearing on efforts other states may take to diversify college campuses. In states such as Michigan that have banned affirmative action, minority enrollment in higher education has significantly decreased. I n California, for example, UC Berkeley has seen a decline in the percentage of Asian American and Pacific Islander students who are enrolled in the university – from a growth of 16 percent in the nine years prior to Proposition 209 to an increase of only six points in the 16 years after the measure’s enactment. Moreover, studies have shown that a less diverse learning environment directly impacts the breadth of experiences and viewpoints to which students are exposed, leading to more limited educational experience. As a vastly diverse group themselves, Asian Americans – like all students – benefit from diversity in higher education, which promotes cross-racial interactions and cultural

understanding, and prepares all students to be more effective leaders in an increasingly multi-cultural society. “Race still matters,” said Carl Hum, vice president of policy and programs at Advancing Justice | AAJC. “Asian Americans by a vast majority recognize that universities that consider diversity among their student bodies are better positioned to give students the highest quality of education possible.” Schuette comprises two separate lawsuits consolidated by the Court. GM asks bankruptcy court to bar most ignition claims NEW YORK, April 22, 2014 (AFP) General Motors asked a US bankruptcy court to bar most suits filed over its faulty ignition system, arguing its 2009 court-approved bankruptcy reorganization shields it from liability in most cases. In papers filed late Monday, GM said it is not seeking protection from suits over the 13 fatalities and other injuries linked to the defect. But GM argued that under the 2009 bankruptcy agreement, which came after the government took the company over to save it from collapse, it should be shielded from economic damages due to product defects. These would include the decline in value of a damaged vehicle, or the cost of child care or alternative transportation while the car was out of use. â&#x20AC;&#x153;It was an absolute condition of New GMâ&#x20AC;&#x2122;s purchase offer that New GM not take on all of Old GMâ&#x20AC;&#x2122;s liabilities,â&#x20AC;? the filing said. â&#x20AC;&#x153;That was the bargain struck by New GM and Old GM, and approved by the court as being in the best interests of Old GMâ&#x20AC;&#x2122;s bankruptcy estate and the public interest.â&#x20AC;? GM said the plan to restrict liability was also endorsed by the US Treasury as the company emerged from bankruptcy. Treasury, which on the governmentâ&#x20AC;&#x2122;s behalf held a majority stake in the automaker at the time, wanted the structure that â&#x20AC;&#x153;would best position new GM for a successful business turnaround,â&#x20AC;? GM argued in the brief. A GM spokesman said the company

â&#x20AC;&#x153;has taken responsibility for its actions and will keep doing so.â&#x20AC;? The company has hired victim compensation expert Kenneth Feinberg to advise it on how to deal with victims of accidents tied to the ignition problem. But attorneys in a class action suit on behalf of people whose GM cars have been recalled for the ignition defect asked the court on Monday to reject GMâ&#x20AC;&#x2122;s request. They argued that the company had â&#x20AC;&#x153;fraudulently concealedâ&#x20AC;? the ignition problem from its government shareholder, from the bankruptcy court and from consumers in the bankruptcy reorganization. GM knew of the ignition problem for more than a decade and did not disclose it, they said. â&#x20AC;&#x153;As a result, consumers did not have an opportunity to assert or have any reason to believe that they should try to assert any objections or claims in the bankruptcy case concerning damages caused by the defect,â&#x20AC;? said the complaint. Plaintiffs attorneys noted GM faces a criminal probe by the Department of Justice into its actions. They also cited a letter from five US Senators requesting the US to oppose GMâ&#x20AC;&#x2122;s efforts to avoid liability for the pre-2009 problems. Meanwhile GM announced Tuesday a restructuring of its global engineering division into divisions overseeing product integrity and vehicle components and subsystems, appointing chiefs of both sections. GM has said the creation of the global integrity division will bolster safety and prevent another debacle like the ignition recall.

BOC finds 185 container vans of supposedly smuggled rice in Davao MANILA, Apr 25 (Mabuhay) â&#x20AC;&#x201C; Authorities are now tracking down the owners of rice found in 185 container vans in the Davao City, as the shipments were believed to have been smuggled into the country. The container vans were in two ports â&#x20AC;&#x201C; Davao City Port and Panabo Wharf. Customs Commissioner John Sevilla was on-site when the container vans were opened. Initial investigation showed the rice was consigned to a company based in Metro Manila, without identifying the consignee. Davao City Mayor Rodrigo Duterte was expected to take a tough stance against smugglers, having warned he was ready to kill rice smugglers operating in his turf. Last January, the National Bureau of Investigation (NBI) arrested trader Davidson Bangayan, claiming he was the David Tan who was allegedly involved in rice smuggling. Bangayan was arrested after he surrendered to Justice Secretary Leila de Lima to refute the charges against him. De Lima said Bangayan was arrested by the NBI based on a 2010 arrest order issued by the a Caloocan City Regional Trial Court. Going with the higher-rate, no-closingcost option runs $43.24 a month more, or $15,567 more over 30 years. In this scenario, it takes six years and nine months to break even and recoup the closing costs via the lower monthly house payments. It’s not something that every lender will offer, but it doesn’t hurt to ask about that option. To me, i will go for the no cost loan even if i intend to stay long term. US new-home sales dive 14.5% in March WASHINGTON, April 23, 2014 (AFP) - US new-home sales dived in March, the second month in a row of slower sales, according to official data released Wednesday adding to signs of weakness in the housing market. New singlefamily houses were sold at a rate of 384,000 units annually in March, from February’s revised rate of 449,000 units, the Commerce Department said. It was the steepest monthly decline since last July. Analysts on average estimated the sales pace increased to 455,000. Sales were down 13.3 percent from a year ago. New-home sales are a small part of the US housing market, where recovery is stalling

after a rise in mortgage interest rates last year and a brutal winter in the first months of 2014. The supply of houses on the market jumped 20 percent in March to a 6.0 months’ supply at the current sales rate, compared with 5.0 months in February. The median sales price of new houses sold in March was $290,000, up 11.5 percent from February and 12.6 percent from a year ago. “At least some rebound in sales and a drop in prices is a decent bet for April, but our core view is that the housing market has stalled and won’t contribute to GDP growth this year,” said Ian Shepherdson, chief economist at Pantheon Macroeconomics.

LOS ANGELES, April 24, 2014 (AFP) – Floyd Mayweather says Manny Pacquiao has lost a step and that the Filipino’s superstar slide has coincided with his decision to split from former strength trainer Alex Ariza. The 37-year-old undefeated welterweight champ Mayweather weighed in Wednesday on the latest performance by Pacquiao who beat Timothy Bradley on April 12 in Las Vegas in a rematch of their first bout in June 2012. “Actually, I did watch the fight,” said Mayweather who is training to fight Argentina’s Marcos Maidana in a 147-pound title bout on May 3 in Las Vegas. “You know, I haven’t seen Pacquiao fight in years. I’ve seen highlights, but I haven’t seen Pacquiao fight since he fought Miguel Cotto.” Mayweather said he wasn’t impressed and fired a couple of verbal jabs of his own at Pacquiao. He said Pacquiao looked like an “amateur” and that in his opinion the World Boxing Organization welterweight champ has less power and stamina than he did five years ago. “I thought Pacquiao fought like an amateur and I wasn’t pleased with his performance,” Mayweather said. “He got the victory the best way he knew how. I’m seeing something totally different in Pacquiao.” Pacquiao worked with Ariza for five years before splitting with him last year. Ariza had a key role in helping Pacquiao win titles in several different weight

WASHINGTON, April 25, 2014 (AFP) â&#x20AC;&#x201C; US auto giant Ford posted Friday a large decline in first-quarter profit as sales fell in its key North America market and costs rose for vehicle recalls. The second-largest US automaker blamed bad winter weather in part for its disappointing performance in North America. Other negative factors included an unfavorable exchange rate in South America. â&#x20AC;&#x153;While similar factors could occur in the future, it is unusual for items like these to occur in this magnitude in the same quarter,â&#x20AC;? Ford said in a statement. Net income was $989 million in the first three months of the year, down 39 percent from $1.6 billion a year ago. Adjusted earnings of 25 cents per share came in six cents below Wall Street expectations. Revenue rose 0.8 percent to $35.9 billion, beating estimates. Ford president and chief executive Alan Mulally, who is expected to leave the company this year after a seven-year run, said the automaker had a â&#x20AC;&#x153;solidâ&#x20AC;? quarter as it transitions into an ambitious program for the year that includes the launch of 23 new global vehicles. â&#x20AC;&#x153;We are on track with our most aggressive product launch schedule in our history,â&#x20AC;? said Mulally. The Dearborn, Michigan-based company said it scored continuing market-share gains in the Asia-Pacific region, including a record share in China. In North America, Fordâ&#x20AC;&#x2122;s largest market, wholesale auto sales fell two percent in volume and revenue declined five percent. Pre-tax profit fell to $1.5 billion, down $892 million from the year-ago record profit. The lower results reflected higher costs of $500 million linked to weather-related charges and vehicle recalls. South America pre-tax losses more than doubled to $510 million. Ford said it expects lower full-year earnings in North America and a wider loss in South America. Upward trends The Asia Pacific region swung into pre-tax profit of $291 million from a $28 million loss a year ago. Leading the growth was China, the worldâ&#x20AC;&#x2122;s largest auto market, where wholesale auto sales volume soared 45 percent.
