Keepit Light Keep natural light flowing through your home by layering sheer curtains under your heavier curtains for daytime use, choose light colored walls and add mirrors on opposing walls of large windows. Using natural light and bouncing it around the room will create a light and airy feel, while also filling your space with a free light source that brings out the best in colors and decor. This creates the beginning of a perfect canvas, one that you can balance with sand tones and bright ocean colors. Make sure to pay close attention to textures, fabrics and comfort when it comes to these large staple pieces, as they may not be updated as often. Slip covers are also a plus when decorating with lighter colored couches and chairs and they are easily maintained. Another great and extremely durable option is using outdoor fabrics inside. They are now offered in so many colors, textures and patterns you are able to create a very durable staple piece of furniture. he condominiums of La Jolla at KM 29.5 are often referred to as the original San Jose del Cabo beachfront community. Built in 1990, this development has stood the test of time and based on the feedback I have received from homeowners has aged like a fine vintage. The complex has two separate Home Owners Associations. One for the six story “AB” building that houses 56 units and is pet friendly and another for the 119 units in the “C-G” buildings which is not Fido friendly. While both buildings have their own charm, the owners that I interviewed live in the latter. The condos in “C-G” are made up of studios, one, and two bedroom units that are surrounded by lush tropical landscaping, a large shimmering heated pool, a smaller chilled pool, and water features. Security patrols at all hours of the day and the HOA is one of the strongest in town. Dues include TV, Internet, and Water. Over the past five years there have been no special assessments, even after Hurricane Odile, due to their wise spending and comprehensive insurance policy. I caught up with a pair of married homeowners to get insight into their decision to purchase in La Jolla and to find out if they have ever regretted their decision. “We bought in La Jolla because we loved the location, we wanted to be right on the beach and the condo we bought offered us that where no other property in San Jose del Cabo has that exact ability. As well we were liked the fact that the HOA’s were lower than other comparable properties. The first time I came into the gardens I turned to my husband and said, This is where I want to buy.” When asked whether they had toured other properties before making an offer they said “We looked at TONS of other properties, La Jolla was the only place that gave us what we wanted for a reasonable price as compared to other properties on the beach in San Jose del Cabo. We thought we knew what it would be like to own and live on the beach but until you experience it you really don’t know how wonderful it is. As well, the other owners I think set La Jolla apart from other properties, we really have a lovely community of owners who have lots of fun together and who do things like hold a Christmas party for the workers’ children and grand-children, Santa comes and the kids really have a wonderful experience!” Queried about the biggest disappointment of the property they said, “None really... actually that is not true. I wish we had a hot tub!” Finally I asked if they would buy there again knowing what they know now but before I could even finish the question she said, “ABSOLUTELY!”

You’ve been to Cabo a few times and with our perfect weather year-around, beautiful beaches, stunning sunsets, and attractive lifestyle, you are now considering a more permanent move to Cabo. You are not alone! In the past 10 years, thousands of residents in Cabo have migrated from the United States and Canada making Los Cabos their home. Owning Real Estate is entirely possible and many foreign investors/buyers have come to the market to pick up on great deals in stable and safe Baja California Sur. The basics for foreign investment revolves around the method of purchase available for foreigners, a bank trust called the “Fideicomiso”. The Mexican government realized they needed to make foreign investment available in Mexico and passed the Foreign Investment Act of 1993. Since the Mexican Constitution prohibits foreigners from owning property within 60 miles of the U.S. border, or within 30 miles off the coastline (as Los Cabos is), a secure form of holding title was needed and created with the implementation of the North American Free Trade Agreement (NAFTA) in 1994. The “Fideicomiso” is a trust, just like an estate trust in the U.S., which gives the Purchaser all rights of ownership and is the legal equivalent of Deeded Property, as we refer to it in the States. In order to obtain rights of ownership, the Department of Foreign Affairs in Mexico City issues a permit to the Mexican bank of the buyer’s choice, which allows the bank to act as “Purchaser” of the property. Simply put, the bank acts as the “Trustee” for the trust and the Purchaser is the “Beneficiary” of the trust. The trust is not an asset of the bank - the banks only act as the Trustee to hold the trust. Just like living wills and estate trusts in the U.S., the Mexican bank, or Trustee, takes instruction only from the Beneficiary of the trust. The Beneficiary has the right to use, occupy, lease/rent and possess the property, including the right to build and improve the property as well. The Beneficiary may also sell the property by transferring the rights to another individual. The term of the trust is 50 years, but the trust can be renewed for additional periods of 50 years indefinitely, thus allowing long term control over the property. *
