L

et's talk about coastal kitchen design- what can be more fun than designing a kitchen in an environment like Los Cabos? For those of us lucky enough to live near a vast sea or an ocean, designing a kitchen which reflects the laid back and relaxed vibe of a beach is the key. Often times, coastal kitchens are specifically designed for entertaining, and it's because they tend to be second homes where we spend more time entertaining our neighbours and friends. What is the best way to achieve this look? Begin by choosing a color palette. Color unifies and can bring much needed harmony into a room. Ask yourself what tones resonate with you. It can be shades of blue – from deep blues to turquoise, or perhaps sandy tones of beiges, pastels, and whites. Next, focus on textures. Always look outside for visual cues and bring those elements inside. Mother Nature provides an abundance of inspiration to us. For instance, choose natural hardwood floors, a rustic oversized wood table with a metal base, woven barstools or dining room chairs, and oversized glass pendants. Mixing textures creates balance and softness in a space – you can think of it as layering. So, make the most of your beachy setting and enjoy your kitchen with family and friends. i

stablished in the year 2000, Punta Ballena is a 174-acre planned community located on the Cabo Corridor, only 10 minutes from downtown Cabo San Lucas. Capital Gains on the sale of your home in Cabo

elling your home anywhere is a stressful experience. Finding out at closing that your net proceeds is vastly lower than you expected is a dreadful and avoidable experience.

Capital gains tax is assessed on the profit gained by selling a property. It is possible, however, to reduce or eliminate your capital gains tax, but the process starts immediately after purchase of your home. Whenever possible, get legal with the Immigration Department of Mexico. Exemptions on capital gains tax applies to foreigners who have permanent resident status in Mexico, and of course, Mexican nationals. The exemption has a limit of 700,000 UDIS (investment units) per each seller, which is a variable rate, currently equivalent to approximately $240,000 USD. The exemption applies up to this amount of the sales price, and the exceeding portion of the sales price will still be subject to the capital gains tax. Next, obtain a factura (legal official tax receipt) for any major expenditures fixed improvements on your home. (in Mexico, only fixed improvements are deductible from capital gains tax, furniture & appliances are not deductible items). Because the requirements can change annually, retain these records, along with all your utility bills. Make sure your utility bills are in your name and show the correct address of your home subject to the sale. This is additional proof of residency. When you list your property, request assistance from your agent to obtain a capital gains exposure estimate. This can be obtained from many attorneys or Notario Publicos, w. Whoho might charge you a small fee for doing the capital gains tax study. In many cases, additional steps may be taken to minimize your capital gains tax. Knowing your position in advance helps mitigate the stress of selling your home. If you are currently listed, and don’t know your capital gains exposure, ask your agent immediately for assistance in obtaining this information. i

OWNING Real Estate IN LOS CABOS By Blake Harrington

Y

ou’ve been to Cabo a few times and with our perfect weather year-around, beautiful beaches, stunning sunsets, and attractive lifestyle, you are now considering a more permanent move to Cabo. You are not alone! In the past 10 years, thousands of residents in Cabo have migrated from the United States and Canada making Los Cabos their home. Owning Real Estate is entirely possible and many foreign investors/buyers have come to the market to pick up on great deals in stable and safe Baja California Sur. The basics for foreign investment revolves around the method of purchase available for foreigners, a bank trust called the “Fideicomiso”. The Mexican government realized they needed to make foreign investment available in Mexico and passed the Foreign Investment Act of 1993. Since the Mexican Constitution prohibits foreigners from owning property within 60 miles of the U.S. border, or within 30 miles off the coastline (as Los Cabos is), a secure form of holding title was needed and created with the implementation of the North American Free Trade Agreement (NAFTA) in 1994. The “Fideicomiso” is a trust, just like an estate trust in the U.S., which gives the Purchaser all rights of ownership and is the legal equivalent of Deeded Property, as we refer to it in the States. In order to obtain rights of ownership, the Department of Foreign Affairs in Mexico City issues a permit to the Mexican bank of the buyer’s choice, which allows the bank to act as “Purchaser” of the property. Simply put, the bank acts as the “Trustee” for the trust and the Purchaser is the “Beneficiary” of the trust. The trust is not an asset of the bank - the banks only act as the Trustee to hold the trust. Just like living wills and estate trusts in the U.S., the Mexican bank, or Trustee, takes instruction only from the Beneficiary of the trust. The Beneficiary has the right to use, occupy, lease/rent and possess the property, including the right to build and improve the property as well. The Beneficiary may also sell the property by transferring the rights to another individual. The term of the trust is 50 years, but the trust can be renewed for additional periods of 50 years indefinitely, thus allowing long term control over the property. i 11
