PRACHUAP KIRI KHAN The discovery and attempted clean up of a huge ‘garbage island’ off the coast of Prachuap Kiri Khan has highlighted a problem that most foreigners have been aware of in Thailand for years, namely the appalling habits of many Thais in dealing with rubbish properly. The floating eyesore is estimated to be around 8,000 square metres in area, with a mass of 100 tonnes, and has been drifting from where it was originally discovered about 12 kilometres offshore from Bang Saphan to an area near Koh Talu, although strong winds and waves have broken some of it away, and some has been deposited along the coastline. A large quantity of the rubbish is said to be plastic, particularly bags, which are particularly dangerous for sea creatures as they can be mistaken for food but cannot be processed in their systems, leaving their stomachs full and the creatures unable to eat leading to their deaths. A clean up operation was put together at the weekend and had begun, but the strong winds firstly hampered and then caused a delay to the efforts by the Marine and Coastal Resources Department, but hopefully the work will have been able to recommence by the time AWOL is published. Experts have been quoted as blaming the huge garbage island on debris from water draining into the sea after the recent floods, and while this may well be the case, the real problem is the amount of litter discarded thoughtlessly on a daily basis by everybody - it is a common site to see all sorts of rubbish thrown out of car windows, tossed carelessly aside by motorcyclists or simply dropped on the pavement by pedestrians. The obsession with plastic bags and the lack of a public education campaign on the dangers and poor aesthetics of littering have also helped lead to the current situation. Will lessons be learned and long term solutions be instigated? Your guess is as good as ours....

THE LAW OF THE LAND Dealing with the law in Thailand, whether you are on the wrong or right side of it, can be a daunting prospect for a foreigner, and not least because of the language barrier. While most laws are broadly similar to most western countries, there are some important procedural differences in both how they are enforced, and should you have to go to court, what happens then. Imagine a scenario where a crime has been committed against you, such as someone has broken into your home and stolen something. In our home countries this would be reported to the police and they would investigate to find clues as to who might have carried out the crime, such as looking for fingerprints. In Thailand, for relatively minor crimes like this, there generally won’t be a similar investigation; your statement will be taken, and you will have documents proving that the crime has been reported, but this really only serves the purpose that you can then make a claim from an insurance company. Many crimes like this remain unsolved, although many do get marked as resolved if a criminal is caught and then confesses to a number of other crimes, often getting ‘rewarded’ for doing so when being sentenced by getting a shorter time in jail for assisting the police. Some crimes require you to carry out investigation for yourself, which you can then present to the public prosecutor. These tend to be more like legal disputes over agreements or contracts, such as might occur when purchasing property. There are no hard and fast rules though, and one of the beauties and frustrations of the Thai legal system is that it appears much more flexible than what we are used to in many cases. Two areas of the law that foreigners may get caught out with are the lese majeste, and slander/libel laws. Lese majeste is the crime of violating majesty, by insulting, defaming, defacing or threatening the Thai Royal Family, and in particular the King. For instance, deliberately (or even accidentally) placing your feet near or on an image of His Majesty, damaging flags or pictures connected to the Royal Family, writing articles that could be deemed critical of the Royal family and many others. Complaints of lese majeste can be filed by anyone, against anyone, and they must always be formally investigated by the police. Even hitting the “like” button on Facebook on a post that is deemed offensive to the king has led to people being charged, so you have been warned. The slander and libel laws are also very severe, with the major difference from much of the rest of the world being that the burden of proof lays with the person accused to prove that what has been said or written is true, and even then can still be found guilty of defamation because it has caused damage to the victim’s reputation and/or exposed them to hatred or contempt. This can lead to up to two years in jail and/or a fine of up to 200,000 baht. Again, you have been warned!

FOOD FOR THOUGHT First this week, a question for our women readers. Would the offer of free vitamins in a pretty red plastic heart shaped box encourage you to have a baby? Or would it have done so at any time during your child bearing years? No, thought not. But the Powers That Be in Thailand think it is worth a try, and will begin to dish out the freebie vitamins to women of a certain age (teens not included of course) from Valentines Day. It’s all to do with a declining birth rate, which seems on course to bottom out very soon and fail to keep up with the rate of deaths. The vitamins are intended to produce healthy mums and healthy babies, which makes you wonder if there is some underlying concern about ante natal care in the first place. Or maybe there is some unidentified economic or societal issue going on. Whatever the cause of the falling birth rate Britain had a similar problem at the end of World War 2, and introduced a financial incentive in the form of Family Allowance as it was known then. As it turned out we probably needn’t have worried, and let nature - and the armed forces returning from war - take their course, because now the resulting baby boomers are blamed for all of Britains’ welfare woes. But back to Thailand. The vitamin idea will certainly be cheaper than cash handouts, but for a quicker fix free roses and MaiTais on the 14th could do the same job. Expect to see supplies of Valentine Vitamins appearing on Ebay soon. Still on the subject of child bearing, midwives in Blackpool have been told to refer to expectant fathers as ‘partners’. This follows one complaint by an expectant lesbian couple, who were offended when the midwife at their antenatal class kept making blanket references to the role of the ‘fella’ during the arrival of the baby. You might have heard about the UK lettuce crisis. Bad weather in Spain has ruined crops of lettuce and other veggies, including courgettes, destined for our shops, and panic buying set in. Strange to imagine panic buying of courgettes I know, especially when so many UK gardeners struggle to get rid of the damn things during the summer. And almost as strange for shoppers to have to face lettuce rationing during our winter. Haven’t people heard of winter salads? As if that weren’t enough to cause chaos in the aisles, the supermarket chain Asda has taken the lead in refrigerating tomato ketchup. Not all of it - customers now have a choice

of buying the red stuff chilled or at room temperature. This decision has come about because some people like to keep their ketchup in the fridge, although Asda doesn’t seem to have noticed that it is winter either, and any purchases will be well chilled by the time customers get them home anyway. Which brings us very vaguely to pizzas, and the Mayor of New York, who recently committed the cardinal sin of eating pizza with a knife and fork. This made him the laughing stock of the Big Apple, where pizza etiquette - like most places in fact - is to treat pizza as finger food. New Yorkers should certainly know what they are talking about, because their city has an estimated 24,000 Pizzerias, and the Mayor, with a name like de Blasio, should know better. Back in Hull a full size replica of the biplane ‘Jason’ has been hoisted into place in the Interchange. The original Jason was flown by Hull born Amy Johnson, when she became the first woman to fly solo from England to Australia, and that first Jason is a fixture in a London museum. So much a fixture that it couldn’t be moved to Hull without serious risk of damage or disintegration, so the model has been constructed by inmates at the local prison. A very good job they have made of it too, and the designer has even said that he is pretty certain the model could actually fly. Fortunately he made that statement only after the plane had left the prison in the usual way - through the front gates. But on a serious note, seeing the Jason replica, with it’s open cockpit, single twin propeller, and tiny size, really does bring the amazing achievement of that Amy Johnson flight to life.
