For the Love of AAOC

T

he Apartment Association of Orange County (AAOC) has proudly served, protected, and advanced the interests of local rental property owners, managers, and suppliers for the past 60 years. During this time, its development and delivery of high-caliber educational and legislative advocacy programs, its presentation of informative membership meetings and events, its provision of resident screening and other important member services, and its facilitation of member networking and business development have contributed to AAOC becoming a leader among apartment associations.

Our association has been fortunate to have had many dedicated members and industry leaders over the years who have given of their time and talents to position AAOC as a valuable and reliable resource for rental-housing providers, particularly as it relates to the protection of private property rights, general advocacy on behalf of the rental-housing industry, and education on a wide-range of subjects related to the ownership and operation of rental property. Our volunteers — those who have provided leadership and vision on the board of directors, ideas and input on our member committees, and knowledge and expertise as educational instructors — have been particularly instrumental in AAOC providing its members with effective representation, training, and other services. There is no doubt that through our association’s leadership, our members’ engagement, and our

partners’ guidance, we have all made contributions to the betterment of the rental-housing industry.

I am proud to be part of an association that is so committed to providing value and helping its members achieve success as rental-property owners, operators and service providers. I am also proud to be part of an association whose members are so dedicated to giving back to the AAOC and their fellow members — something that makes our association truly special. It is edifying to hear the stories from decades past and personally observe in more recent years just how many individuals have not only developed into successful rental housing professionals thanks to their AAOC memberships, but who got involved as volunteers along the way because they wanted to give back to the association and invest in the next generation. These members embody the concept of “paying it forward,” and I am so thankful to all of them who given so selflessly over the past 60 years.

The success of our industry is not guaranteed, which is why I am so proud that the Apartment Association of Orange County and its members do their part to push forward and contribute, when, where and however they are able. It is true that any member contribution matters to the success and longevity of AAOC and its ability to serve and have a positive impact. From our members who reliably pay their dues each year to receive services and representation, to those who also volunteer

and give back to the association and its members in any number of ways, to those who also contribute to AAOC’s political action committees, legal defense fund, and in other ways, you all make a tremendous difference, and I am grateful for you.

I have been a member of the Apartment Association of Orange County for more than 20 years, and there is no doubt in my mind that my involvement in the association, both as a member and as a volunteer, has contributed to my success as well as my development as a leader. I am honored to give back to the association that has given me so much, and to continue my duty as AAOC president, to serve the association, my fellow members, and the greater rental housing industry. If At First You Don’t Succeed…

A

s the old proverb by W.E. Hickson goes, “If at first you don’t succeed, try, try, try again.” And I would add, in the COVID19 era, be prepared to keep trying.

These words are ringing particularly true as we have again made the decision to postpone the AAOC Trade Show & Conference until COVIDconditions improve in Orange County and the greater Southern California region. As of the writing of this message, Governor Newsom had just lifted the stay-at-home order for Southern California, but the vaccination rollout continues to be riddled with difficulties and challenges, to put it mildly. So, we will remain patient. We will wait until more people have had time to get vaccinated. And we will try again, later this year, to present our long-overdue trade show. And as a “silver lining” kind of guy, I like to think that this further delay might work to our advantage. If conditions improve enough while we wait, then perhaps the show could even be brought back indoors. Time will tell, I suppose.

In the meantime, while we wait to resume in-person events, including the trade show, we have a full lineup of online meetings and classes coming up over the next few months that you won’t want to miss.

February 4 — COVID-19 Eviction Moratorium & Rent Repayment Briefing. By the time you read this message, our members only briefing on the new legislation extending California’s

COVID-19 eviction moratorium and rent repayment protections will have already been presented online. February 25 — Lunchtime Learning: Best Practices for Maintaining Team Morale During Unprecedented Times.

March 23 — Sexual Harassment Prevention Training Certification.

Senate Bill 1343 requires that all California employers with five or more employees provide sexual harassment prevention training to both supervisory and non-supervisory employees.

Training must take place within six months of hire or promotion and every two years thereafter. This certification class will cover Sexual Harassment, Sex Discrimination, Prevention of Claims, Title VII Civil Rights Act, and Investigating Complaints. A certificate of completion will be provided to each attendee who completes the training.

April 12 — Earthquake Vulnerability & Retrofitting 101. AAOC and Optimum Seismic invite you to a free informational workshop on seismic retrofitting and the steps you can take to protect your rental property investment.

April 15 — Get Compliance Ready: SB 721 Balcony Inspection Law. Senate Bill 721 requires multifamily residential buildings with three or more dwelling units to have their balconies and other exterior elevated elements inspected by January 1, 2025. The inspection requirement includes decks, porches, stairways, walkways, and entry structures that are

more than six-feet above ground level.

Almost all wood-based external elevated structures must be inspected by the state-mandated deadline. Find out what is involved in the inspection and what else you are required to do to comply with the law.

April 26 — Fair Housing Certification Training. AAOC and the Fair Housing Council of Orange County offer this half-day certification class that will provide you with comprehensive information on state and federal Fair Housing laws. Find out if your policies and procedures are compliant with the law. The class will cover topics including tenants with disabilities, families with children, service animals and emotional support animals, and more.

Plus, have your questions answered and learn how the Fair Housing Council of Orange County can serve as a resource for you.

April 27 — Passing the Torch: A Family Succession Workshop. We are hearing with increasing frequency

This workshop will explore the worries and how to eliminate them, and reveal the benefits of continued, multi-generational rental property ownership. A panel of knowledgeable and experienced rental property owners will walk you and your heirs through the steps you should take to preserve your real property assets for future generations.

April 29 — ADA Compliance & Reasonable Accommodation Workshop. Navigating the Americans with Disabilities Act (ADA) can be as treacherous as a minefield. Sometimes rental property owners can be in violation of the law and not realize it. Other times their lack of awareness of the law leaves them open targets to plaintiffs’ attorneys looking for quick and easy monetary settlements over real or alleged ADA violations. This workshop will walk you through the basics of the Americans with Disability Act, how to ensure your property’s compliance, preemptive measures you can take to ward off predatory attorneys, plus what types of reasonable accommodations must be made to comply with state and federal laws.

California’s COVID-19 Eviction Moratorium Extended

O

n January 25, 2021 the Governor issued the following statement: “Today, we are announcing an agreement to extend the eviction moratorium in California through June 30, 2021—protecting tenants and small landlords from losing their housing as the nation continues to confront the pandemic. We are also moving forward as quickly as possible to deploy California’s share of the latest federal stimulus bill—ensuring that up to $2.6 billion in renter aid is administered quickly, equitably and accountably…

While we are proud of this agreement, which maintains California’s COVID eviction protections as the strongest statewide rules in the nation, our work is far from over.”

The bill, SB 91, is a simple majority vote bill that proposes to use federal funds (not state or local revenue) to pay up to 80% of past due rent that started on April 1, 2020 and ended March 31, 2021. A landlord accepting the federal money would be required to “forgive”

the remaining unpaid rent, which if the property is in a rent control community, could become a significant issue.

Federal money could (if available) help pay for the unpaid rent from March through June 2021.

The extension of the provisions of AB 3088 was in large part due to sunset on January 31, 2021. Quite frankly, no one reasonably expected the law to sunset.

The author of AB 3088 proposed to extend the date to December 31, 2021…a date that would have allowed tenants to remain in possession and not pay rent from March 2020 through the end of this year. The author, Assembly Member David Chiu, proposed several other restrictive measures in a bill he recently introduced.

Tenants that pay just 25% of the rent will receive protection from evictions.

Other elements of the bill that creates the rental assistance program that became law on February 1, 2021: • Attorney fees are capped.

• Courts are permitted to reduce the damages awarded to a landlord if the court determines that the landlord did not in “good faith” seek rental assistance from the new program. Thus, landlords will be “encouraged” to participate in the State Rental Assistance Program.

• Federal law set the program in place to establish eligible tenants whose household incomes do not exceed 80 percent of the area median income for calendar year 2020.

• And federal law, and thus state law, gives priority to tenant households whose income does not exceed 50 percent of AMI. To implement the program, the state has structured the program as follows: – These households are placed in Round 1.

Proposition 19 — continued from 10 are disproportionately impacted

by COVID-19 as determined by the state.

– Round 3 are eligible households not otherwise in Round 1 or 2 that are not earning more than 80% of the area median income.

• It is important to note that the eligible uses for funds made available to a locality or a grantee as follows: – Rental arrears – Prospective rent payments – Utilities – Any other expense related to housing as permitted by federal law.

– Priority, however, is to be given to rental arrears to stabilize renter households and prevent evictions.

• Will pay rental property owners 25% of rent in arrears if the tenant applied for assistance (not likely) but the owner elects not to participate in the program. Should an owner decide not to participate, the tenant household will remain in possession.

• All property owners will be required to provide a notice to tenants that owe back rent of the existence of the new rental assistance program.

Owners will be prohibited from proceeding with an eviction due to the non-payment of rent if notice is not provided and with an opportunity of the tenant to respond to that notice.

• The state of California will select a vendor to serve as the program administrator to manage and fund services. The vendor will be a Community Development Financial Institution (CDFI).

• Federal funds will be allocated by population, consistent with federal law.

– $150 million is set aside for counties with populations under 200,000.

– Populations greater than 500,000 will receive their funding as a block grant from the state and the money is to be implemented locally. Our involvement in this aspect of the program will be essential. The bill prohibits a locality that receives the funds in this manner from instituting additional programmatic requirements that inhibit participation in the program and it requires any locality that receives a block grant to attest to the state that it will distribute assistance equitably and consistent with need with that jurisdiction. request block grants by February 12, 2021 and are to contractually obligate at least 65 percent of those funds by June 1, 2021 and fully expend those funds

by August 1, 2021. Failure to meet those deadlines by localities will require return of unused funds to the state for reallocation.

• The new law imposes a moratorium on actions that seek to recover COVID-19 rental debt until July 1, 2021. All landlords seeking to recover COVID-19 rental debt are to provide documentation to the court that the owner has made a good faith effort to cooperate with tenant obtaining rental assistance.

• Administrative fees cannot exceed 10 percent ($260,000,000). Yes, that’s right, $260 million.

As the rental-housing industry transitions from the provisions of AB 3088 to those in the new law outlined above, AAOC will again take steps to help its members understand and comply seamlessly with the requirements.

Informational webinars will be presented starting in February, member questions will be answered, operational guidance will be available from your member services team, and AAOC will revise all relevant operational forms and develop new ones as needed. AAOC will make an announcement when those forms are available.

The Shift in Orange County’s Cities

O

range County shares the tectonic population shift that has shaken up California over the past couple of years. California’s overall population growth has stalled for the first time in over 100 years. More people are moving to other states than are moving to California. The California Department of Finance numbers have recently shown that our birthrate has slowed at the same time that older Baby Boomers are passing away. In 2019, even before the pandemic, Orange County’s population growth was only .02%.

These population shifts will have policy and political ramifications for Orange County. The COVID-19 pandemic and the anti-police riots of last summer have made the Orange County suburbs more attractive to the liberals who want to escape the urban crowding and rising crime rates of Los Angeles and the San Francisco area. The Irvine Company recently reported that their Orange County housing inventory is at a 40-year low because of the people moving here from the big-cities up north. This will also shift the politics of our Orange County elections more to the left over the long-term. But even with this shift from the big cities to the suburbs, Orange County is losing more residents than it is gaining.

The next election in Orange County is already upon us. March 9 will be the Special Election for Orange County Supervisor in the Second District, which includes the coastal area from Newport Beach to Seal Beach and north to Buena

Park. The special election will be held to replace Michelle Steel, who was sworn-in as a new Member of Congress on January 3. It will be an all Vote-ByMail election, and ballots will be mailed to approximately 445,000 district voters starting on February 8. Whoever is elected Supervisor will run for re-election in 2022, in an entirely redrawn district because of census redistricting.

Even though Bay Area residents are moving south, the statewide census redistricting this year will probably see Orange County lose a Congressional seat and at least one State Senate and Assembly District seat to the Inland Empire. Orange County will see shifts in political representation, largely from coastal communities that are seeing little or no growth, to inland regions that are still growing, albeit slowly. This will impact the influence that our cities have in Sacramento and Washington, D.C. The representation shift will become clearer when the first drafts of the redrawn State Legislative and Congressional districts are released by the state’s redistricting commission at the end of November this year. The California Department of Finance, which monitors the state’s population data, found that from July 1, 2019 to July 1, 2020, California saw a net gain of only 21,200 new residents, which is a 0.05% growth rate. As of July 2020, the state’s population was 39.78 million.

Seven of the 10 most populous counties in California experienced a reduction in population last year.

Orange, Los Angeles, San Diego, San Bernardino, Santa Clara, Alameda and Contra Costa Counties all saw a drop in their number of residents. The COVID19 pandemic fueled greater migration out of California by people who lost jobs, were priced out of coastal areas and those who now have ability to work remotely from anywhere. Even the tech billionaires Elon Musk and Larry Ellison left our state.

AAOC has been actively reaching out to Orange County’s newly elected officials at the local and state levels, as maintaining relationships and frequent engagement with our policy makers will become even more important as Orange County’s population shifts. Our priority is to make sure that AAOC and its members, and the rental-housing industry, continue to have a voice, and a seat at the table, as new laws and ordinances are proposed are negotiated.

Even though people are moving, defending property rights and advocating pro rental-housing positions remain constants for AAOC.

Questions & Answers I rented an apartment to four roommates quite a while ago. One of the four is now moving out, but the other three want to stay. The one moving out is demanding that I return his portion of the security deposit, he says that he paid it so he should get it back. Do I have to?

No, the security deposit remains with you as long as any of the roommates remains in possession of the rental unit.

Often, owners and residents will enter into an agreement replacing one resident with another, thereby removing the one original resident from the lease. The agreement will further provide that the ‘new’ roommate pay the ‘old’ roommate his portion of the security deposit.

Absent a written agreement to the contrary, the owner should retain the entire security deposit, then when all the remaining roommates vacate, the refund check should be made payable to all four of the original roommates named in the rental agreement.

My building has just enough parking spaces for my residents to each have one space. If a resident has more than one car, they must park it on the street. It has been working out fine for years but now I have this one tenant who refuses to follow the rules. He is constantly parking his second car in someone else’s assigned spot. I’ve told him several times, but he just ignores me. What do I do?

Your written community rules and regulations should specify your parking rules, specifically stating that only one vehicle may be parked on the premises, and that all parking is assigned. Ensure that you have the proper signage at the entrances of the parking area. Most cities require the sign to contain certain restrictive parking language, plus the local police department telephone number, and the California Vehicle Code section that provides for towing of unauthorized vehicles. Contact your local police department for its specific requirements, as they vary from city to

city. Next, if you know the offender, provide a written warning of the violation. Attempt to serve it at his residence, post it on his door if he’s not in, and also put the warning on the windshield of his car. If practical, take and save a photograph of the warning on the vehicle windshield, because the offender will always claim that you did not give prior notice before towing. If he fails to remove the offending vehicle, the car may be towed, according to the terms of your parking rules.

I’m getting conflicting advice about whether or not I must rent to someone who does not have a valid social security number, nor an official picture ID. Seems like most of the attorneys and the Fair Housing guys say I ‘cannot discriminate’ and that I must rent to all, regardless of whether or not the prospect can prove who he is, or verify his tenancy history, or his ability to pay the rent. I have been following that advice for years, and now have a building full of undocumented people, who I could never find in a million years if I ever had to collect from them. The rent usually gets paid, but the building, and the neighborhood, look like hell. I want to take my building back, and only rent to persons who qualify, who have verifiable identities and credit, and who are good credit risks.

Legal Q&A — continued from 16 occur over many years. Many landlords have looked the other way, in favor of the quick rental, the cash payments, the full building, the reduced confrontation. We’ve taken the easy way out.

Landlords have been wary of lawsuits claiming discrimination and have believed the bullying taunts and threats from the tenant and immigrant rights activists, that we have just taken the easier and less confrontational course of allowing it to happen. We blame our government for not addressing the illegal immigration issue; one side of the aisle wanting cheap labor, the other wanting cheap votes. We blame employers for hiring, and our ‘welfare state’ for creating the magnet that keeps drawing. Landlords are part of the problem as well. By succumbing to the shortterm temptation of the quick rental to the unverified, the undocumented, we are contributing to the problem. Many landlords are realizing that rather than just complaining, they can be a part of the solution.

Landlords have absolutely no obligation whatsoever to rent to an individual who is unable to independently verify his identity, his past tenant history, and his ability to comply with the terms of the rental agreement, including his financial ability to pay the rent. Our system of society is built around a numeric social security or tax ID number. Our life history, good and bad, is reported more often than not into a

database that is organized by and sorted by the social security number. Names are common, but social security numbers are unique. No two people should share the same number. Credit as well as criminal convictions are reported similarly. These very basic requirements should be applied uniformly to all applicants, regardless of race, national origin or ethnicity. It is just good business sense. With average rents over $1,700 a month, landlord investment of $200,000 or more per rental unit, and a litigation climate that is out of control, landlords must know who their residents are, must reduce their risk of financial loss and must know how to recover from a breaching resident.

I’m looking at a single-family residence to purchase. It’s a pocket listing, no signage, not on the MLS. The agent claims it’s a great deal because the seller needs cash quickly, wants a quick escrow, and is willing to let it go for under market. The only catch is, the tenant doesn’t know the house is for sale, and the owner doesn’t want the tenant to know. He says that when I close escrow, I can serve my own notice to have the tenant leave, but he doesn’t want the tenant getting nervous and moving out if the deal doesn’t go through. It seems like a really good deal. I know the house, I’ve peeked in the windows, and it’s in incredibly great shape. What am I missing, what can go wrong?

in possession. That means that you are bound by whatever rental agreement, or contract, exists between the owner and the existing resident. The tenancy agreement may turn out to be a fixedterm lease for a long period of time at less than market rent. The resident may have a lease with an option to purchase the house for a fixed sum, possibly less than what you are paying for it. There may be litigation between the parties relating to the premises, possibly mold or some other contamination issue that you may not be aware of. If the deal really is as described, then prepare a purchase agreement providing a due diligence period allowing you a brief time period to check title, condition and other issues. Once escrow is open and you are satisfied with title and the condition of the premises, contact the resident, confirm the terms of his tenancy, get a copy of his rental agreement, and prepare an estoppel certificate for the resident to sign affirming the tenancy agreement, amount of deposit, and affirming that he has no equitable or legal interest in the property.

I have been replacing rusted and dented HVAC vents and electrical wall receptacles in a rental unit.

However, they don’t look right. There are a lot of gaps between the vents and plates and the wall. Some of the walls are not perfectly flat or the texture is bumpy. How do I make these installs more professional looking? Julien

Dear Julien:

Caulk is your friend and caulk will hide a multitude of sins! On a job like this we recommend getting a squeeze tube of painters’ caulk. Squeezable caulk tubes are readily available at any hardware or home center. Cut a small angled cut off the tip of the tube. Best to make the cut about 45 degrees. You want to open the tube just enough to get about an eighth inch thick line of caulk out of the tube. Run this caulk line all around the vents and wall plates edges. Gently run your finger along the caulk line

pressing it into place. Any excess caulk can be removed with a damp paper towel. Once done, your vents and plates will look like they are part of the wall and will look very professional.

Maintenance Men — continued from 20 when we get them back from our departing residents. Here’s a useful time table and work schedule for a one- or two-bedroom apartment requiring complete paint, carpet, flooring, minor repairs, window coverings and cleaning.

Day 1 & 2: Paint prep, trash out, minor repairs, removal of blinds, drapes, switch outlet plates, etc.

Day 3: Paint Day 4: Carpet/Flooring Day 5: Installation of window coverings, doorstops, switch/outlet plates, fixtures, accessories, toilet seat, etc.

Touch up paint if needed.

Day 6: Cleaning — General cleaning including windows & final inspection.

If you have done a pre-inspection of the unit before the resident moves out. You

can plan what needs to be done before the unit is vacant. Organize the maintenance techs and contractors ahead of time. Have all the repair and replacement parts ready to go. The key is to plan each day and try to stick to the plan.

The Federal Emergency Management Agency (FEMA) estimates 40 percent of businesses that close their doors as a result of disasters will never reopen. When buildings collapse, owners or lessees can be left with no operating business and communities are hurt as workers lose their livelihoods and housing. Recovery can take years, if not decades.

USC researchers estimated Southern California could suffer property damage of $113 billion in a major temblor, with additional businessrelated impacts of $68 billion or more.

Estimates put damages caused by a magnitude-7 earthquake on the Puente Hills fault running through downtown Los Angeles at more than $252 billion with thousands killed and hundreds of thousands displaced.

More than 90 percent of buildings in California’s urban areas are estimated to not comply with modern building codes.

In addition to the costs of physical damage, business interruption and lost market share caused by earthquakes, courts have determined property owners can be held legally liable for deaths and injuries occurring in their buildings if they are found negligent of maintaining a hazardous condition by not taking reasonable actions to safeguard their facilities.

A 2020 Case Study: NAA and COVID-19 Advocacy Special from the National Apartment Association

A

s the cliché goes, “2020 was an unprecedented year.” The COVID-19 pandemic seemingly overnight knocked the nation’s economy to its knees and marched the health care system to the edge of an abyss where we continue to teeter. The virus took on average 906 lives each and every day and started a culture war over an individual’s right to ignore public health guidelines. For housing providers, who immediately had to grapple with operational challenges and adaptation to new COVID-19 safety regulations, the pandemic and its economic devastation broke the most important link in the housing ecosystem chain of events — the timely payment of rent.

Despite a bipartisan, rapid response at the outset of the pandemic, Congress and the Administration remained deadlocked for most of the year, taking nine months to finally reach an agreement on additional, much-needed support in December 2020. To be sure, in many ways we all would like to forget 2020 ever happened and move on to a hopefully better 2021. Yet, it is important to do some reflection on the advocacy front, where the battles were lost and won to protect the industry from the ongoing effects of the pandemic. Follow along the timeline as we revisit NAA’s

National Emergency and Congress’ First Response

On March 13, 2020, the last day of the NAA Advocate Conference in Washington, D.C., the President declared the COVID-19 outbreak a national emergency. What followed in the next two weeks was a rapid succession of legislating by the Congress. By March 27, three bills totaling $2.1 trillion were passed in quick succession: the Coronavirus Preparedness and Response Supplemental Appropriations Act, the Families First Coronavirus Response Act and the Coronavirus Aid, Relief, and Economic Security (CARES) Act. The common thread of these bills was allocating resources to fight the virus, helping businesses survive the economic displacement and supporting impacted individuals and families.

NAA added its voice and that of the apartment industry to these first deliberations, stressing the importance of assistance for rental housing providers and renters alike, and we worked quickly to ensure that compliance resources were made available to support the industry as they operationalized these new requirements.

These bills were of mixed benefit. On

the positive side, the “boost” of federal unemployment benefits and individual “recovery rebate” checks would prove critical for partial or complete rent payments. Also, substantial allocations of federal grant funding for state and local governments would eventually be used to support rental assistance programs.

Even with some challenges with program requirements implemented by states and localities, these resources helped housing providers fill growing gaps in rental income.

Expanded mortgage forbearance options for housing providers with federally backed loans and temporary business loans through the Small Business Administration’s (SBA) Paycheck Protection Program (PPP) were on their face helpful. Unfortunately, both would prove only marginally beneficial as time went on, as the latter excluded segments of the multifamily industry from eligibility.

Advocacy — continued from 28 guardrails. The legislation also failed to set aside dedicated emergency rental assistance funding, a crucial federal resource that NAA and many other housing groups urged Congress to deploy. Ultimately, not being able to agree on the right structure to deploy rental assistance, Congress opted for direct payments to individuals.

Quick Lessons Learned and Leaning into Advocacy

From the passage of the CARES Act going forward, NAA’s advocacy efforts would ramp up dramatically and were defined by two factors. First, we learned more about how the pandemic and economic instability was truly impacting our members and what they really needed to survive the crisis and ensure industry viability in the long-term. We would learn that using programs like mortgage forbearance or PPP loans to fill the hole left by unpaid rent were at best weak band-aids and that the only true way to address the crisis was rental assistance. Only financial assistance could stabilize renters experiencing financial challenges and provide quick relief directly to struggling housing providers who needed help to cover their expenses in light of rental payment shortfalls. Second, we quickly saw the direct impact of eviction moratoria on industry operations. Housing providers, especially small firms, were steadily draining reserves and even personal savings to keep their businesses afloat.

They could not be asked to carry the burden of the pandemic alone. Funding robust rental assistance and ending eviction moratoria would form the core of our efforts going forward.

The House Acts: A Very Mixed Bag

As NAA and the apartment industry bombarded Congress almost nonstop from April through October (nearly 75,000 letters were sent over this period), partisan fighting stopped any real negotiating by policymakers, even

as NAA continued to educate them on the need for rental assistance and further relief for the rental housing industry and the dire consequences of continued extensions of the federal eviction moratorium. Lost was the unified voice that had marked Congress’ initial legislating in March.

In May, House Democrats passed H.R. 6800, the Health and Economic Recovery Omnibus Emergency Solutions (HEROES) Act, a massive $3.4 billion COVID relief bill that left no aspect of the crisis untouched or unfunded but also included numerous items unrelated to COVID-19 that were guaranteed to be nonstarters for Republicans. For rental housing, the bill provided for $100 billion in emergency rental assistance, albeit through a distribution system of concern. On the other hand, the HEROES Act also imposed a 12-month eviction moratorium for virtually all rental housing, continued restrictions on consumer reporting and placed significant limitations on the debt collection process, which would leave the heavy burden of the financial impacts on COVID-19 solely on housing providers.

Senate Republicans, on the other hand, stuck to a very narrow band of proposals costing around $500 billion, but could never actually pass a bill. And while the Administration attempted to negotiate a compromise, it became clear over the summer than neither side could or would get to a deal and that the politics of the fall elections were becoming too much of a distraction. Throughout the wax and wane of negotiations, apartment advocates sent nearly 75,000 letters to Congress to continue to ensure that our industry’s voice was heard and housing remained an important part of the COVID-19 relief discussions.

When the pandemic started, the narrative was framed to suggest an intrinsic link between housing and health and to protect vulnerable populations of renters through emergency action at any cost. The view seemed to be that housing providers could absorb

any lost rent. NAA was quick to respond to the inaccuracies being perpetuated that rent needs only cover mortgage payments, and housing providers had no other expenses with which to contend. That narrative slowly shifted over the summer. Now, the needs of housing providers and their residents are tied together as a result of NAA’s advocacy and thousands of advocates speaking to policymakers in one voice.

“Eviction Tsunamis” and the CDC

After the CARES Act moratorium ended in July, activists began predicting total calamity in the fall amid what they characterized as a “tsunami” of evictions.

Analyses by economists and others raised significant doubts about these claims, but it was ultimately moot as the Trump Administration issued an order from the U.S. Centers for Disease Control (CDC) halting evictions in all rental housing through the end of the year. Industry concerns with the CARES Act moratorium were now exponentially amplified as essentially every housing provider was captured under this umbrella, as opposed to the more tailored restrictions under the CARES Act. While NAA continued its advocacy with Congress and the Administration, we began to pursue legal avenues, joining a lawsuit against the CDC order on behalf of a rental property owner in western Virginia and arguing that the CDC exceeded its authority with its order. It was important to recognize that the agency has no expertise or business delving into housing concerns and to establish a precedent for future moratoria to be deployed for any future emergency. While our immediate request for a temporary injunction against the order was declined, the large case is still pending.

As we engaged in multiple avenues to protect the industry’s interests, we continued to aggressively lobby Congress and the Administration to ensure they understood the consequences of conAdvocacy — continued on page 32

Advocacy — continued from 30 tinued extensions of federal eviction moratoria. NAA Chairman Mike Holmes and member Travis Sheets, Vice President and General Counsel at BH Companies, led a meeting with White House officials to emphasize the need for emergency rental assistance, discuss concerns around the CDC eviction requirements and urge them to issue supplemental guidance to make it easier for rental housing providers to operationalize the new policy. Our concerns were heard and, in October, the CDC issued guidance to address many of the industry’s concerns. First, property owners could access the courts during the period of the order, were not required to notify residents of these protections and it was made clear that the validity of residents’ attestations could be challenged in court, thus continuing the courts role as a neutral arbiter. While there continues to be inconsistent enforcement of the order around the country, this development was a step in the right direction.

Election 2020, A New Administration and Congressional Endgame

Finally, the Presidential election came, went and we had a new Administration on the horizon with an entirely different set of goals as it related to housing. Based on their respective campaign platforms for President, we have some sense of the philosophy of President-elect Biden and VicePresident-elect Harris on housing. I believe we can expect their support on efforts to reduce barriers to construction and reforming the Section 8 Housing Choice Voucher (HCV) Program. We will disagree on issues like source of income protection and resident screening. As with any new Administration, NAA has already started discussions with the transition team about our priorities, their objectives and where we can work together.

package two days prior to Christmas.

But, in classic 2020 style, the President announced shortly after that passage of the bill that he was disappointed in it. It did not have enough in direct stimulus payments to individuals and had too much foreign aid (this was part of the annual federal appropriations package which rode along with the COVID relief legislation and was negotiated between the Administration and Congress).

After several days of high drama, the President ultimately relented and signed the legislation.

Of greatest importance to the apartment industry, the COVID bill contains emergency rental assistance in the amount of $25 billion that goes directly to housing providers and is eligible for both future rent and rent arrears. This should be invaluable to owners and operators who have gone many months without rent due to the eviction moratorium, especially small housing providers who are barely hanging on. The current Treasury Department and the transition team for the Biden Administration are now working on guidance for the program, and we expect dollars to start flowing in February.

As in any negotiation, the bill has trade-offs, including a 30-day extension of the CDC order on evictions.

While not ideal, this is much shorter than what was originally proposed by the activist community. Any extension is not entirely surprising given the resurgence of spread of COVID-19 and the worsening economic displacement.

Our hope is that now that emergency rental assistance is finally flowing, future moratoriums can be avoided.

Celebrate the Tangible and Intangible

The advocacy work by the apartment industry in 2020 culminated in a major victory with the $25 billion emergency rental assistance program.

This is a tangible victory. Not so tangible but as important is the power of our grassroots advocates who mobilized every time we asked, even during a pandemic. We must maintain and har-

ness that energy for future battles — and there will be many — when the voice of the industry will be critically needed once again.

Our grassroots mobilization also helped us secure another intangible victory — an acceptance by policymakers the needs of residents and housing providers are on equal footing. That will be extremely important looking ahead to discussions around additional funding to replenish what was lost to housing providers because of the federal eviction moratoria.

The Future is…Different

Washington D.C. has changed dramatically from 2020 to 2021. Most prominent is the Democratic Party’s control of the White House and both chambers of Congress. This will mean a more challenging environment in several areas for the apartment industry but also opportunities for success in others. To be successful in this new environment, NAA must expand our place in the conversation. We have to bring solutions to the nation’s housing challenges, not simply say “NO!” to proposals with which we do not agree. Moreover, we must continue to be an honest broker of information, experience and data for policymakers and their staff.

It is also important to note that there has been an evolution on issues like eviction and housing affordability.

These concerns and others like resident screening and ex-offender reentry are now part of larger debates around health care equity and social justice. We fully anticipate a rise in federal, state and local efforts to impact laws in these areas that are adverse to the rental housing community. NAA is devoting substantial, additional resources to support the work of our affiliates in their campaigns around these issues. Taken together with the lessons we have learned and the advocates we recruited to the cause in 2020, NAA is well positioned for success. Every affiliate and member can and should be part of that effort too.

Only together can we win.

January General Membership Meeting Recap

T

he first AAOC General Membership Meeting of the new year always generates significant interest and healthy attendance numbers, as members look forward to an informative evening learning about the newest laws and regulations affecting California’s rental-housing industry.

This year’s meeting was no exception, except that it was presented online, with members viewing from their homes rather than gathering and filling a hotel banquet room to capacity.

The evening began with President Frank Alvarez honoring the recipient of AAOC’s Legislator of the Year Award for 2020, Senator Melissa Melendez (R-Lake Elsinore). Melendez has been an ardent supporter of private property rights, small business, and the rentalhousing industry. As a member of the State Assembly and more recently as a member of the State Senate, Melendez has consistently spoken up for our industry despite the legislative environ-

ment becoming increasingly hostile toward us and what we do. She reiterated her support for AAOC and the rental-housing industry when stating, “I am your voice.”

At the conclusion of her remarks, Melendez transitioned and administered the ceremonial oath of office to the 2021 AAOC Board of Directors, as well as to President Alvarez, who was reelected last fall and began his second term in January. Again, like the meeting itself, the ceremony was a little different this year, with the board members having to take their oath “virtually,” on camera, rather than standing, in person, before their peers.

Once the virtual pomp and circumstance wrapped up, Executive Director David Cordero introduced the evening’s headliner, Stephen Duringer, Esq., who presented his 11th Annual Legal Corner…Live! to the online audience. Duringer began his remarks with the acknowledgement that members

Duringer provided a recap of the 2020 General Election and the outcomes of two key ballot measures, Proposition 21, the rent control initiative that voters rejected by a nearly two-to-one margin and Proposition 15, which would have created a split-roll property tax and eliminated Proposition 13 (1978) protections for commercial properties in California had voters also not rejected the measure. Duringer expressed his belief that while both measures were defeated, neither will go away for long and they could both appear on future ballots.

Cures & Solutions, Heralding a New 2021

A

s we move into 2021, the challenges of 2020 have not been left behind.

The devastating impact of COVID19 continues despite the rollout of the vaccine. Nearly all acknowledge that while we are heading in the right direction, we can’t forget the lessons learned nor ignore the need for mask wearing and social distancing, even among family and friends.

At the same time, many struggle under the constraints of a severe economic downturn brought about by restrictions of the pandemic. Apartment owners and investors also face statewide rent control and an eviction moratorium. However, just as with the vaccine, there are some glimmers of relief.

In conjunction with last year’s CARES Act, federal dollars became available to provide local economic relief and resources. The City of Santa Ana used a portion of these funds and worked with local landlords to devise a rent forgiveness program that was implemented at the end of last year.

The agreement, under the terms of this program, was that the city would pay landlords up to 80% of overdue rent if the owners would forgive the balance. A total of 45 property owners participated and 323 Santa Ana families received this assistance. The city paid out to landlords $1,140,957, who in turn forgave $285,239 in resident debt, as reported by Roxana Kopetman in The Orange County Register (December 28, 2020).

With the advent of a new administration, more federal funding is very apt to become available. How much trickles down to the local levels is unknown. Yet by working with our city leaders, we as managers and owners can help both our residents and ourselves.

Back in June of 2020, Tim Gorman wrote an article about “Positive Changes to Come.” He started off with a reference to “a willingness to pull together for the greater good.” Making these types of opportunities happen is going to take extra work, but the rewards may well be worth the effort — not just for residents and landlords, but for our entire industry.

There is a caveat to the Santa Ana story. To participate in the program, the landlords also had to agree not to not raise rents or evict tenants for nonpayment for six months from the date of the agreement that they signed.

These types of restrictions are apt to be pretty much a matter of course. In a sense, it is the cost of doing business.

Yet before completing disregarding this type of opportunity, an owner/investor needs to do some serious thinking and analysis.

It all comes back to running the numbers and the “what if ” scenarios.

In not taking advantage of this type of opportunity, what is the outcome? The eviction moratorium keeps being pushed further and further outward, so removing a non-paying tenant is perhaps not going to be a near-term option, along with collecting past-due rent after

move out.

Raising rents, too, is questionable.

First, there are the limitations of AB 1482. More importantly is the question of how the market is trending and what residents can (and are willing to) afford.

When your residents are already struggling, a rent increase may push them over the edge. At that point, rather than trying to meet their obligations, they may stop paying anything.

Under an eviction moratorium, you have now backed yourself into a corner.

Even at properties where the residents are, for the most part, minimally impacted by COVID-19, there is higher than normal turnover. Stuck working from home and unable to enjoy the freedom of going out for meals and entertainment, these residents are taking advantage of the low interest rates and buying homes.

So, what should you do? Everyone’s situation is different. You need to run the numbers and look at the choices not only in terms of how they impact the cash flow on this one property, but also the effect on your entire portfolio and your own financial situation.

As we keep saying at W.R. Gorman & Associates, it’s the “New Norm” and we cannot forget nor ignore the best practices and lessons already learned.

Virus Effects on Apartments and Real Estate

W

e are now in unchartered and difficult waters with the COVID-19 virus epidemic. The rules, customs and ways of doing business are changing and still unknown. The social distancing will alter how people buy, sell and lease apartments after the COVID-19 crisis has ended. We must be flexible, adaptable and changeable in the future.

Demographics

The buzz word for liberals in California and other states prior to COVID-19 was “higher density.” Build more high-rise apartments in urban

centers (cities) and near rapid transit lines. The highest death rates and infections have come from New York City and other high-density areas. In the future, will apartment tenants and condo owners choose to live in closely packed urban areas 24/7, with crowded buses and subways?

Suburban areas have fared better, as well as semi-rural areas just outside the suburbs, with more room to spread out and observe the safe distancing (6 feet).

Even when they find a cure for COVID19, viruses will reoccur in the future and the fear will linger and people may not want to live in cities.

Demand for Apartments

The demand for apartments in Southern California will continue to grow. The jobless rate has soared and those that remain employed fear losing their jobs or having their job eliminated.

The single-family housing market will decline in price as employment will determine qualifying for a mortgage loan. Many younger people have moved back in with their parents during this lockdown period. Will they now want to move into their own apartment again? Will they want roommates? Virus Effects — continued from 42 they want a smaller, less expensive unit?

Since many employees have worked remotely from their homes during this lockdown, will they want to continue to do so and not have a daily commute to work? Maybe they will go in one day a week. Having good Wi-Fi is a necessity for apartments in the future.

The real demand is by the homeless and people who cannot afford to pay market rent. Our governor never mentions the State providing rent subsidies, like HUD Section 8, to the potential tenants who cannot afford rent. Rent control caps what landlords can charge, thereby effectively reducing the dollar amount State and Local housing programs pay in affordable housing subsidies.

Supply of Apartments

The pipeline has lots of new apartment projects, however most of these are “Class A” high-end and high-rent apartments. Due to high land costs and

using union labor, it is not feasible to build working class “Class C” apartments in Orange County and Los Angeles.

I see additional housing supply coming from underutilized hotels and office buildings in the future. Due to the fear that COVID-19 carries, fewer people will travel and or want to commute to work in a large office building.

The value of these properties will drop and an adaptive reuse would be to retrofit them into lower-rent apartments in the future. If this happens, supply will exceed demand and the rent and price (cap rates) for existing apartments will decrease.

Governement Controls for Apartments

The state and local governments are increasingly putting more restrictions and rules on landlords. Evictions are more difficult and the time for landlords to regain possession has been lengthened. There are curbs and caps on rental increases and landlords still must provide the same habitability on

aging apartment buildings. Where will landlords get the funds to make the improvements for new electrical and plumbing on these 50-year-old apartment buildings with strict rent control?

The purchase cost of existing apartments at today’s high prices do not pencil out. Let us take property taxes for instance. Even under Prop 13, most cities have added water, sewer, school, and utility bonds to property taxes.

Some cities have even added paramedic services to tax bills. For example, an existing 20-unit apartment building sold for $6 million and the tax rate is approximately 1.4%, and not 1% which is the basic tax levy. The tax bill is $84,000 per year or $7,000 per month or $350 per month/per unit. If the rent is $1,600 per month, that equates to 21.9% of the rent going toward property taxes.
