Gun Owners of America Michigan Department of Natural Resources Washington, DC --(Ammoland.com)- In January, the new Congress will be sworn in, and each member will swear an oath to uphold and defend the Constitution of the United States.

Michigan --(Ammoland.com)- The Department of Natural Resources and Environment reminds hunters that muzzleloader season for deer opens Friday in the Zone 1 (Upper Peninsula) and Zone 3 (southern Michigan) Friday.

Judging by how often Congress operates outside the bounds of the Constitution, one wonders if the members actually ever read our most important founding document.

The season runs for 10 days in the U.P. and 17 days in southern Michigan.

If there is a mandate for the Congress coming out of the 2010 elections, it is that the Constitution must be made relevant again. And what better way to begin the One Hundred Twelfth Congress than to have read aloud, in both the House and Senate, the Constitution in its entirety.

Hunters must possess appropriate license tags – firearms license or combination license tags to take an antlered buck, or antlerless deer licenses to take antlerless deer. Muzzleoading season in Zone 2 (northern Lower Peninsula) runs from Dec. 10-19.

The House and Senate will waste hours congratulating sports teams, naming post offices, and various other meaningless tasks. Even worse, it will spend much more time doing things for which it has absolutely no constitutional authority.

The purpose of this petition is clear and obvious. The Congress must be reminded that this is a nation of laws, and there is a law that governs what the Congress is empowered to do — either to justify their actions or to demonstrate when they are unlawfully operating beyond their bounds, no matter how well-intentioned.

Firearms Freedom Act Heads to the Ninth Circuit Court on Appeal

The MFFA is designed to test the power of Congress to regulate everything without limits under the narrow power given to Congress in the Constitution to “regulate commerce … among the states.” The MFFA declares that any firearms, ammunition and firearm accessories made and retained in Montana are not subject to any federal authority under the Commerce Clause. Congress must find some authority among the Constitution’s “enumerated powers” for every action it takes.

Plaintiffs filed the lawsuit MSSA v. Holder on the day the MFFA became effective in Montana, October 1, 2009. Since the MFFA enactment in Montana, the MFFA has been cloned and enacted in seven other states, and FFA bills have been introduced in the legislatures of 20 more states. In a judgment entered on October 19, 2010, the district court granted the U.S. Motion to Dismiss. It is this judgment that is now appealed to the Ninth Circuit. MSSA President and plaintiff Gary Marbut commented, “We’ve known all along that the district court will not provide what we seek, the reversal of a half-century of bad Commerce Clause precedent. We need to get to the U.S. Supreme Court for that. This notice of appeal puts us at the 50-yard line in our quest to get to the Supreme Court – it is a big step in the direction we need to go.”

Not only has the FFA concept attracted the interest and support of many other states frustrated with an overbearing federal government, but the MSSA v. Holder lawsuit has attracted an unusual, perhaps record, number of amici (amicus curiae, friends of the court). Some qualified observers say they’ve never seen a case that has attracted as much amici support at the district court level as this case has. Amici include the State of Utah (also representing several other states), Gun Owners Foundation (Gun Owners of America), the Goldwater Institute of Arizona, the Paragon Foundation of New Mexico, the Weapons Collectors Society of Montana, an amicus group of Montana legislators who supported the MFFA, and another amicus group of non-Montana legislators who sponsored or co-sponsored FFA bills in other states. The State of Montana has also intervened in support of the MFFA. Other amici are expected to enter in support of the MFFA when the lawsuit is argued before Ninth Circuit.

“It is totally obvious from the positions of federal participants, both lawyers and judges for the U.S.,” Marbut commented, “that the federal establishment definitely, almost desperately, wishes to prevent this issue from having a trial on merit.” The likely options for the Ninth Circuit are to uphold the judgment of the district court or to overrule the district court and remand the case back to the district court for trial. Regardless of what action is taken by the Ninth Circuit, MSSA v. Holder is certain to be appealed to the Supreme Court. If the Supreme Court only reviews the district court dismissal on appeal to it, the Supreme Court can still rule on the merits of the case since part of the grounds for dismissal is based on merit.

“No one was shot and killed while deer hunting this year in Wisconsin,” said Tim Lawhern, Department of Natural Resources hunter education administrator and conservation warden. “This has happened once before in the state’s history of gun-deer seasons. And that was 36 years ago.”

Overall, there were 12 hunting incidents during the nine-day deer gun season. Lawhern said that for the families of those injured hunters, 2010 didn’t feel like a success. The agency only tracks firearm-related incidents and does not keep track of deaths or injuries due to heart attacks, tree stand falls or other causes.

Lawhern’s analysis shows about one-third to one-half of all injuries is related to deer drives. The self-inflicted injuries will be one-third to one half of all the total of the gun-deer season.

“We also know the shooters younger than 18 will make up about 20 to 30 percent of the shooting injuries. The vast majority will occur on private land and half will happen on opening weekend,” he said. “Ultimately, nearly all are linked to a violation of one or more of the four basic rules of firearm safety – treat every firearm as if it is loaded, never point your firearm at a person, never put your finger in the trigger until you are ready to shoot and know what is behind your target.”

And, Lawhern says, the most significant contributors to hunting incidents are those 35 and older – the hunters not covered by the mandat ory hunter education course rule. “All hunters should take the hunter education certification course – no matter the age.” Safety doesn’t take breaks “Our hunter education program is revered as one of, if not the best in the country,” Lawhern said, adding most of the volunteer instructors have never experienced a gun-deer season free of fatalities. “Those instructors, along with other factors, are major contributors to the success and safety of hunting.”

You see, GORE isn’t like most companies. There isn’t some hierarchical ladder that prevents employees from the bottom from being heard at the top. I live in the world of the treestand hunter and spend 95% of my time hunting from a treestand. When you’re 20 feet up in a tree like I am you have bright sky, dark leaves and branches and the vertical lines of trees all around you. It’s these lines that make it easier for a whitetail to pick you out of the tree on that cold November morning. Even if you’re wearing mimicry camo you will blob out with every movement you make because most of the mimicry camo patterns don’t have the contrast to break you up.

Almost everyone has heard of GORE-TEX and Windstopper, two of GORE’s most noted products, but the company makes everything from fabrics that protect our firemen and astronauts to guitar strings, fishing line, and medical devices that can plug a hole in your heart. All of these products were developed because GORE gives it’s employees the chance to be different and think outside the box. And that’s the problem GORE set out to solve: How can a hunter get close to an ungulate without being detected at typical engagement distances? What I really like about GORE is their scientific approach to solving problems. The Company didn’t just decide to enter the camouflage market, they knew hunters wanted to get close to game without being detected and nothing on the market had been designed specifically for hunting ungulates, or hoofed animals. The problem with traditional mimicry patterns on the market is that they block up into a mass of gray at close range – the range you need to be at for a successful hunt. So while your new HD camo might look amazing on the rack at the store, when you’re in the woods the real concern becomes how is the animal going to react when it sees you at close range? And that’s the problem GORE set out to solve: How can a hunter get close to an ungulate without being detected at typical engagement distances?

Sitka GORE Optifade Camo Shown in Real Field Conditions With help from their panel of experts, GORE figured out that ungulates suffer from red-green color blindness and have a larger field of view than humans. Using this knowledge they were able to test patterns with different colors, macro patterns and micro patterns on live animals and see how they reacted to each pattern. After a long test period, GORE was able to determine which colors worked best for treestand hunters and how to arrange the macro and micro patterns of the camoflague to help the hunter appear as nothing to the eyes of the ungulate.

To help answer these questions and develop a scientific solution GORE brought in a panel of experts including: • Dr. Jay Neitz, an animal vision expert at the University of Washington Medical School in Seattle.

To help understand the difference between a macro pattern and a micro pattern think about a tiger and a leopard. A tiger is a stalking predator with a macro pattern to help break up it’s outline as it chases it’s prey. Leopard’s, on the other hand, are ambush predators and have a micro pattern that helps them blend into the background as they prepare for their attack.

Optifade incorporates a macro pattern of large fragmented shapes – mathematically configured to match those of the animal kingdom – that breaks up your body symmetry and outline. Additionally, Optifade also incorporates a micro pattern of small fragmented shapes – matching the fine texture that defines our world – which makes you fade into the background.

In 2009, GORE released Optifade Open County, a pattern scientifically designed for engagement ranges of 35 yards and beyond at ground level. The larger neutral areas of the pattern, or the macro-pattern, are more critical to concealment at these engagement ranges, in a landscape of rocks, brush and scattered trees. This year GORE released Optifade Forest, a pattern scientifically designed for close engagement ranges of under 20 yards and for elevated angles of attack – typically 15 feet up in a tree stand. At that proximity, the micro-pattern becomes more critical: it compensates for the contrasted, highly detailed background perceived by the prey.

This is the science behind the Optifade pattern that makes it so effective. I’ll admit, I was hesitant to put on my green looking Optifade Forest and head out to the dead brown woods, but I’ve been successful using Optifade and I’ve watched whitetails look up at me and right through me

as if I wasn’t even there. When a deer picks it’s head up, looks in your direction, and goes back to feeding, that’s the ultimate rush as a predator. You’re out there up in your tree and you have your desired game well within bow range without a clue you are there.

Well, apparently, not in New Jersey.

Personally, I’ve been extremely impressed with the Optifade pattern and I think GORE hit a home run with this one.

What makes Aitken’s conviction all the more disconcerting is that he had contacted the New Jersey State Police prior to moving his home and his firearms — and he thought he had all his i’s dotted and his t’s crossed.

According to the Philadelphia Daily News (10/30/10), Aitken had two handguns in his trunk, both of them “locked and unloaded as New Jersey requires.” Not only that:

Suffice it to say that Gun Owners of America believes this is a travesty of justice. “This is precisely what’s wrong with gun control,” said GOA Director of Communications Erich Pratt. “Gun laws typically target non-violent gun owners like Aitken, even while there are sex offenders who are serving shorter sentences in New Jersey!”

Governor Christie refused to reappoint Superior Court Judge James Morley based partly upon the fact that he exonerated a cop of animal cruelty charges, even though he had engaged in oral sex with calves.

So this judge condones that kind of activity, but he sentences a lawabiding gun owner to jail for seven years — for owning guns he had legally purchased in another state! ACTION: Please contact Governor Christie and urge him to issue a pardon for Brian Aitken. Some might argue that the Governor should wait until Aitken’s legal options run out. However, there is NO CONSTITUTIONAL REQUIREMENT that Christie wait for the courts to act. The Governor needs to end this travesty today.
