any sellers ask this question of their RealtorÂŽ, while others just pack their belongings and go. Years ago, the standard earnest money agreement stipulated that the sellers would leave the home in â&#x20AC;&#x153;broom cleanâ&#x20AC;? condition, but this provision likely caused more confusion than clarity. Some people believed that a quick wipe down of the surfaces was sufficient while others believed that a professional cleaning was necessary prior to closing.

At present, the standard earnest money agreement used by RealtorsÂŽ states that â&#x20AC;&#x153;All electrical wiring, heating, cooling, plumbing and irrigation equipment and systems and the balance of the property, including the yard, will be in substantially its present condition at the time Buyer is entitled to possessionâ&#x20AC;?. The current language instructs sellers that they need to maintain the entire property and the yard until closing and that the property needs to be in substantially the same condition at the transfer of possession to the buyers as when the buyers wrote the accepted offer. I was recently involved in a transaction where the sellers hired professional cleaners prior to putting the home on the market. During the Open House, the listing agent informed us of all the wonderful attributes of the property and repeatedly mentioned that the home had recently been professionally cleaned. Following the viewing, my clients submitted an offer that the sellers accepted. The sellers also requested to rent back for 30 days after closing, so in the addendum covering the rent back, the sellers agreed to â&#x20AC;&#x153;transfer possession of the property in substantially the same condition as has previously been viewed by the buyerâ&#x20AC;?.

do the typical sweeping and vacuuming. I reminded the agent of the terms of our contract and that the buyers expected the home to be in the same condition as when they viewed it at the Open House. She protested that the sellers had professionally cleaned the home at that time. I informed her that I was well aware of that fact and that the buyer expected the property to be in a similar condition. We arrived at the home at 5 pm on a Friday when the sellers were obligated to transfer possession to the buyers. This date was known for six weeks and the sellers had obtained possession of their new home five days prior, but the sellers will still frantically trying to remove their belongings. Naturally, the buyer was upset but he also wanted to take possession of the home that he had actually owned for a month. When he returned a few hours later and the sellers were finally gone, he informed me that the sellers had not even vacuumed the carpet and that the counters were dirty. I felt terrible for my client. Purchasing a home, especially a first home, should be a wonderful experience. Unfortunately, the sellers did not abide by the contract or give any thought to the impression that they were leaving on the buyer. Sellers should ask themselves, â&#x20AC;&#x153;If I were the buyer, in what condition would I expect the property when I receive possession?â&#x20AC;? Sellers need to be mindful of the goodwill that they can extend to buyers. Buyers could opt to send the sellers a bill for cleaning or for the disposal of trash that sellers leave behind. Sellers could refuse to pay, but they may find the end result more costly if buyers opt to pursue them in small claims court. Just because the home has closed, does not mean that the seller is immune to additional legal and financial responsibilities. And you never know, the new owners may receive some of your mail by mistake or packages over the holidays. What lasting impression do you want to leave with the new owners when you may need their cooperation in the future?

btaining title insurance is one of the most important steps in the home buying process. The sale of a home, typically involves two types of title insurance policies: an owner’s policy and a lender’s policy. The owner’s policy insures that your title company will stand behind and protect you in the event that a title problem occurs. The policy’s coverage is issued in the amount of the purchase price of the home. Some of the possible title issues that could come up after closing include undisclosed heirs, errors or ommissions, or forgery.

The fee for an owner’s policy is a one-time fee paid by the Seller at closing. An owner’s policy will protect you for as long as you and your heirs are vested in the property. A lender’s policy protects only the lender’s interest in the property. Most lenders will require that the buyer purchase a lender’s

policy to protect their interest in the property should a problem arise. Remember, this policy only protects the lender, not the buyer or owner. The policy’s coverage is issued in the loan amount, and decreases each year until the loan is paid in full. Title insurance is there to protect you and guarantee your ownership rights in your new home.

6 Essential Tips for First-Time Homebuyers

T

he typical American spends more time thinking about buying a car than buying a house. Even though the house they buy might cost several times as much. While buying a home has long been part of the American Dream, it’s a daunting task–especially for first-time homebuyers. Many would-be buyers, overwhelmed by the process and the current state of the market, give up and decide to rent. It doesn’t have to be that way. The fact is, today’s housing market is a once-in-a-lifetime opportunity for first-time buyers. Interest rates are at near-record lows, homes are more affordable than they have been in years and there are plenty of homes for sale (with more on the way, thanks to the foreclosure crisis). Buyers are more likely to truly find the home of their dreams than they were in years past. Here's a list of 6 tips every firsttime home buyer should take. Keep these tips in mind as you begin the search for your perfect home. What’s the budget? This is the question my husband asked me when we were shopping for our first home. It seems like a no-brainer, but you’d be surprised how many buyers don’t start by figuring out how much money they have to spend on their house purchase. It’s easy to show up at open houses and fall in love, but why waste time looking at homes that are out of your price range? The last thing you want is to find your dream home and realize it’s way over your budget. Banks will tell you that you can spend up to 28% of your gross monthly income (GMI) on your mortgage, taxes and homeowners’ insurance premium, and up to 36% on your total debt. If you

take out an FHA loan, you can go even higher – to 42% of your GMI. The problem is 42% of your GMI will feel like nearly 60% of your take home pay, or more if you are contributing to a 401(k) at work. Remember this: Just because someone will lend you more money doesn’t mean you should borrow it. To calculate a housing budget you can live with, start by figuring out how much you spend each month. Track your daily expenses in a notebook over the course of four weeks to get a real sense of how much is going out and where you’re spending most of your available cash. Watch your savings and calculate how long it will take you to come up with a down payment. Before you commit to a mortgage amount, be sure to take the true cost of making those monthly principal, interest, taxes and insurance payments each month and apply them to your takehome pay. Don’t worry about mortgage deductions or the aftertax consequences–just look at the numbers and think about what else you spend each month and try to understand if you’ll feel comfortable. Because if you can’t sleep at night worrying about paying the mortgage or fixing your broken water heater, you’re spending too much. Come up with a realistic wish-list Based on the housing budget you figured out and where you want to live, compile a list of what you’d like to have in your home. Research is helpful when putting together your list. Check out some homes in your price range online to get a feel for what your money will buy, and make your wish list based on the home you see. If you’d love a fully renovated kitchen but none of the listings in your price range have one, be prepared to compromise. You can al-

ways upgrade later, but you really shouldn’t spend more than you can afford just for nicer finishes. Get pre-approved for a mortgage In this market, many deals contingent on financing fall apart because buyers can’t find a bank to give them a mortgage. Getting pre-approved for your mortgage will help you avoid this problem. Start by shopping around for a lender. You should speak to at least three or four different types of lenders including big national banks, mortgage brokers, regional banks, local lenders and possibly a credit union. Check out the Yahoo! Homes Mortgage page to see a list of lenders in your area, along with estimated rates and payments. Once you’ve compared a few loans from different types of lenders side-by-side and decided on the right one for you, it’s time to get pre-approved. Some lenders will charge for pre-approval, so be sure to ask about those costs up front. You’ll need to provide the lender with details of your credit, income and assets to start the process. The bank will verify everything and issue a letter that tells you, and sellers, how much the bank is willing to lend you. Typically, pre-approvals are good for 60 to 90 days. If you don’t find a home within that period of time, you may need to re-qualify with your lender. Find a good home inspector A knowledgeable home inspector is just as important as a great real estate agent. Getting a home inspection can save you thousands of dollars in the long run, but it has to be thorough. Ask friends and co-workers for referrals, or find out if your real estate agent has anyone they would recommend. Once you’ve gotten a few names, interview potential candidates. Don’t be afraid to ask questions: find out what their process is for inspecting a home, how long it usually takes, what their expertise


buyers is and what kind of information and paperwork you will receive after the inspection. If thereâ&#x20AC;&#x2122;s anything special about the property youâ&#x20AC;&#x2122;re interested in â&#x20AC;&#x201C; for example, a septic or propane tank â&#x20AC;&#x201C; be sure the home inspector knows what to look for. Many firsttime home buyers get so caught up in the idea of owning a home that they forget about life after closing. The real costs begin after you move into the house. In addition to mortgage payments, youâ&#x20AC;&#x2122;ll owe taxes, insurance and homeownerâ&#x20AC;&#x2122;s association (HOA) fees, and be responsible for any maintenance issues that come up while you own the home. These costs are all the more reason not to spend every last dime on your mortgage payment. If you have nothing left after paying your mortgage, youâ&#x20AC;&#x2122;ll be unable to pay all the other fees or save for unexpected expenses.

You may love the home, but get to know the neighborhood before you make an offer This is another good tip from one of my Twitter followers, @abirenews in Atlanta. He suggests talking to the neighbors to get the inside scoop on what itâ&#x20AC;&#x2122;s like to live there. Bad neighbors can affect your propertyâ&#x20AC;&#x2122;s value, but good neighbors can be an invaluable resource to first-time homebuyers. If you think youâ&#x20AC;&#x2122;ve found the neighborhood you want to buy in, take it a step further. Drive from your potential new home to your office during rush hour to see what the commute is like, and to places youâ&#x20AC;&#x2122;d go on a regular basis like the grocery store, gym and gas station. Thereâ&#x20AC;&#x2122;s a lot to think about when buying your first home, but remembering these tips should help you navigate the process and avoid potential minefields. Take your time, do your research and donâ&#x20AC;&#x2122;t let anyone pressure you into buying a home youâ&#x20AC;&#x2122;re not completely sure of. eâ&#x20AC;&#x2122;re sliding through fall with the grey bearded face of winter looming at us. The rain has come and as we all know, there will be plenty of it. There are some things that are best done or analyzed when itâ&#x20AC;&#x2122;s raining. Now is the best time to get after them. Itâ&#x20AC;&#x2122;s really important to get after winter maintenance issues as soon as possible. Water is the single most destructive element to a home ,and here in the great Pacific Northwest, we get plenty to say the least. So, itâ&#x20AC;&#x2122;s raining, really raining, and the harder the better. Put on your boots, long raincoat & hat. Weâ&#x20AC;&#x2122;re going to spend a little time outside so really dress to be comfortable so you donâ&#x20AC;&#x2122;t rush it. Take a notebook in your pocket or a camera if you like. Step back from the house, start in the front, go all around and just look at it. See how the water runs down the face of your roof and valleys. Watch the water running down all the way to the gutters. Be careful to notice if there is anywhere the water overflows the gutters or runs down, onto the siding of the house. If there is, these areas need to be fixed, â&#x20AC;&#x153;pronto.â&#x20AC;? At this time a working gutter and downspout system is the most important thing you probably own. The gutters and overall drainage system protects the structure from destructive water. The gutters not only protect the building envelope from destructive water but they keep all that water from setting against the foundation and (if properly designed) direct the flow of water away from the foundation to keep it dry. Most moisture intru-

sion problems I find in crawlspaces and basements are the direct result of faulty gutter/downspout systems, not area drainage or grading. Even if you cleaned your gutters early, they may not all be working correctly. If they are not sloped correctly, they wonâ&#x20AC;&#x2122;t work correctly. They may leak and need seal caulking inside to keep them from leaking and dumping water all over the house. Many houses have some kind of â&#x20AC;&#x153;leaf guardâ&#x20AC;? system. Most of them donâ&#x20AC;&#x2122;t really work all that well. During the fall all our beautiful deciduous trees get rid of their leaves for the winter and grow new ones in the spring. All the leaves, pine needles, and assorted debris lands on the roof, which can clog your gutters. If you have a screen or cover type leaf guard system, the debris plugs or covers the top and the rainwater just flows over, down the eves and onto the house cladding. This completely defeats the purpose of the gutter system and is quite damaging to the house. These gutters will need to be cleaned off or out, likely several times until they are clear. GOOD NEWS! By December or so, if youâ&#x20AC;&#x2122;ve gotten them cleaned out and flowing, you are probably â&#x20AC;&#x153;coolâ&#x20AC;? till next year! The flow will keep it â&#x20AC;&#x153;flushedâ&#x20AC;?. Be sure and check the downspoutsâ&#x20AC;&#x201D;you should see a good flow of water going through them. If the downspouts are backing up, the obstruction needs to be cleared. The downspouts should discharge into an area drain below ground or have splash blocks or â&#x20AC;&#x153;leadersâ&#x20AC;? that take the water at least 36â&#x20AC;? away from the house. By the time spring comes there could be literally thousands of gallons of water that has

flowed through that downspout, so get that water away from the house! If you see any area where water is setting near the foundation, it must be corrected. This may be a grading issue or something smaller that can be re-directed. If you are unable to determine the exact cause, consult with a landscaper, grading contractor or your friendly neighborhood home inspector. If the drainage problems are too great to tackle before dryer weather is with us again, you may be able to â&#x20AC;&#x153;stem the tideâ&#x20AC;? with the use of sandbags available at your local hardware or building supply. Lots of folks seem to think that covering the foundation vents to their crawlspaces in the winter will save them energy. NONSENSE! This is a damaging and potentially destructive practice. If your crawlspace foundation vents are below surface level, they need to have vent wells installed around them. The crawlspace vents are there to provide circulation and allow moisture to evaporate and escape. If they are closed off, moisture will be trapped in the crawlspace, keeping it damp and make it a breeding ground for wood destroying organisms and other moisture damage. Keep the vents open; donâ&#x20AC;&#x2122;t allow water to flow into them. More items to look for this time of year: â&#x20AC;˘ Cut back vegetation that grows too close to the structure. Rule of thumb: 12â&#x20AC;? at least. This can hold water against the building.

â&#x20AC;˘ Clean all decks and seal if necessary.

â&#x20AC;˘ Have furnace serviced by a licensed professional. â&#x20AC;˘ Remove hair from drains in sinks, tubs, and showers. Use a drain cleaner approved for the materials in your plumbing system if necessary. â&#x20AC;˘ Insulate pipes in unheated garages, attics and crawl spaces. â&#x20AC;˘ Test all smoke detectors (should be done monthly). â&#x20AC;˘ Test all ground-fault circuit interrupters (should be done monthly).

The Best Eateries in Our Favorite Coastal Town

S

o you want to visit Astoria. Maybe even check out some real estate while you're there. It's a fabulous ocean town that is so close to Portland, weekend getaways would be a snap. But you know what really makes it great? The restaurants. The good ol' fish houses and brew pubs with warm atmospheres, fresh seafood, and friendly people. Here are three of my favorite places to eat while in Astoria; make sure you pay them a visit! T Paul's Urban Cafe Although the unlimited strawberry lemonade is enough to keep anyone coming back for more, it's the eclectic atmosphere and the creative plates that make this place my regular haunt when I visit Astoria. There's live music Friday and Saturday nights, and the homemade desserts are nothing short of swoonworthy. Make sure you try the french onion soup and the fabulously named "Green Goddess." Also, if you want something more swanky for your night out, T Paul's Supper Club is an upscale alternative. Fort George When I visited last month, a friend insisted I must try the Baked Alaska at Fort George. It took some serious nudging to get me to veer from my favorite, T Paul's (see above) but am I sure glad I did. It's seasonal, so I can't guarantee this particular dish will always be around, but their carrot cake constant is always an option. Did I mention it's made from scratch with pineapple cream cheese frosting? 15 Ridiculously Useful Tips to Make Life Easier 1. Reheat Pizza Heat up leftover pizza in a nonstick skillet on top of the stove; set heat to med-low and heat till warm. This keeps the crust crispy. No soggy micro pizza. I saw this on the cooking channel and it really works. 2. Easy Deviled Eggs Put cooked egg yolks in a zip lock bag. Seal bag and mash yolks till they are all broken up. Add remainder of ingredients, reseal, keep mashing it up mixing roughly; cut the tip of the baggy, squeeze mixture into egg. Just throw bag away when done â&#x20AC;&#x201C; easy clean up. 3. Expanding Frosting When you buy a container of cake frosting from the store, whip it with your mixer for a few minutes. You can double it in size.
