Automakers And Auto Dealers Oppose Recall Bill For Rental Cars

For years, advocates have been pushing for legislation that would require rental car companies to fix recalled vehicles before loaning them to customers. The rental car industry helped kill such a bill last year, but a new version has been drafted, and it’s now working its way through Congress. Only problem is, the rental car companies still hate it and so do automakers. The Senate Commerce subcommittee heard testimony from Mitch Bainwol, CEO of the Alliance of Automobile Manufacturers, which represents nearly all major automakers doing business in the U.S., including the Detroit Three. He expressed concern that the new bill would have one of two unpleasant consequences, and possibly both: • It could force automakers

to prioritize repairs on vehicles owned by rental companies, putting vehicles owned by individuals and other corporations at the back of the line. • It could encourage rental companies to sue automakers for loss of revenue if their vehicles aren’t repaired lickety-split. Speaking for the National Association of Automobile Dealers, President Peter Welch said that the policy of providing loaner cars during recalls could be cost-prohibitive if immediate repairs are required on rental fleets. He pointed out that some recalls are more dire than others, and that while some issues make vehicles unsafe to drive, others don’t. Treating the former and the latter the same doesn’t make sense. Both Bainwol and Welch were criticized by legislators. Senator Barbara Boxer (D-CA) attacked

Bainwol, insisting that he had made assumptions about the bill that simply weren’t part of its language. Senator Claire McKaskill (DMO), who chairs the subcommittee, thought it very unlikely that rental agencies would sue the very companies they depend on for favorable deals on fleet vehicles. She also pointed out that automakers and dealers would face a public relations backlash for opposing a bill that offers such important consumer protections. David Strickland, head of the National Highway Traffic Safety Administration, spoke in favor of the bill. He pointed out that rental companies only repair about 50% of their cars within the first four months of a recall being issued. A year after those notices go out, the figure sits at just 60%.

Six Tampa Area Dealers Join Bizzlle Online Auctions

Six Tampa Area Dealerships have enrolled with in order to purchase and sell vehicles between each other, according to Derek Sheavly, Regional Sales Manager for Bizzlle provides Dealers a free portal to store their inventory and run their own auctions, under their own terms and conditions; cutting out the middleman. Bizzlle is there to cut out the middle-man, eliminate ‘nosale’ risk, and chop Dealer buying and selling costs by 2/3 of what they are paying now,” he said. Bizzlle uses the same inventory upload services that Autotrader, KBB, Edmunds, and the other retail sites utilize; so dealers don’t even need to punch in their vehicles to sell them. Dealers simply click on the vehicle they want to sell, click through a seller’s report, choose how they want to be paid,

the length of their auction, and the minimum bid to begin the auction. “It takes less than five minutes to launch your own auction. And if it fails to bring the amount you want, you simply don’t sell it. There is absolutely no charge to the Dealer in a ‘no-sale’, no enrollment, hosting, or subscription fees whatsoever,” he said. But those are not the only benefits to enrolling Dealers, according to Wilson. “Auction participants remain anonymous and nobody even sees a Dealer’s vehicle until he or she places it into an auction. Once that happens, all enrollees can see what that vehicle is brining for bids, even if they don’t want to purchase it. Additionally, Dealers can build ‘WishList’ cars and invite sellers to place their vehicles into a ‘Reverse’ auction. So even for those Dealers who are not sure they want to participate, there is a tremendous amount of market data available; what vehicles are desired and selling for in their marketplace, as well as, nationwide. Florida Dealer Alert: Court Decision On Spot Delivery Contributed By The FIADA

The Third District Court of Appeal rendered its decision in the Bengal Motor Company v. Cuello case. This was one of the cases that was causing a problem for spot deliveries in Florida. The Court’s decision is important for a few reasons. First, it holds that spot delivery is permissible under certain circumstances. Unfortunately, the Court found that the dealer’s use of conditional language in its Bailment Agreement and Retail Buyer’s Order violated the finality requirements of the Truth in Lending Act (TILA). The problem identified by the Court was that the Buyer’s Order and Bailment Agreement (sometimes called a Spot Delivery Agreement) were separate documents from the Retail Installment Sales Contract (RISC). Both the lower court and the appellate court found that because the RISC did not mirror the conditional nature of the transaction outlined in the Buyer’s Order and Bailment Agreement and also failed to reference either the Buyer’s Order or Bailment Agreement, the dealer violated the Truth in Lending Act and Chapter 520 of the Florida Statutes. Importantly, the Court seemed to indicate that if the RISC had contained conditional language or referenced the other two documents, the Court would have held that the dealership’s conduct was permissible. Thus, it would appear that spot delivery can be done legally, so long as the RISC

indicates that the transaction is contingent on financing approval. Dealers should also make sure that they fill in the blanks that are located in some RISCs in the “dealer’s right to cancel” section. Under this decision those spaces would need to be completed and applied. For example, some RISCs give a time period for acceptance. This period would need to be held to by the dealership. In an important ruling for dealers, the Court found that Chapter 520’s award of the finance charge as damages for violating its provisions is not a penalty as is provided for in TILA. Instead, the Court reversed the award of the finance charge to the customer, because the customer did not pay anything toward the finance charges

in this transaction. The vehicle had been repossessed before any payments were made. Thus, it seems that a customer will need to be paying back a loan before a technical violation of Chapter 520 results in an award of the finance charge. The Court did say that the practice at issue was a violation of TILA and would have triggered its automatic award of $1,000 and the potential for attorneys’ fees, however the Plaintiff in this case did not seek damages under TILA. A survey of almost 600 dealerships across the country found the labels were attached to only 63 per cent of the new vehicles on outdoor lots. And vehicles displayed in dealer showrooms had the labels affixed just 43 per cent of the time. Some high-end models BMW and Rolls-Royce, for example had a compliance rate of zero. The poor showing comes as Natural Resources Canada conducts a review of the voluntary label program for new vehicles, under the brand EnerGuide, including a proposal that it be made mandatory. The survey of 592 newcar dealerships in 33 large cities was carried this year by Posterity Group Consulting Inc. under a $113,000 government contract. The EnerGuide label program for vehicles was launched in 1998 to help consumers make informed choices about the fuel efficiency of new passenger cars, vans and light-duty trucks. The labels are attached by manufacturers, indicating the number of litres of fuel needed to travel 100 kilometres, and showing the difference between city and highway driving. The program requires manufacturers to test fuel efficiency of various models under governmentapproved procedures and standards. Access to Information Act. Posterity found some dealers removed the manufacturers’ EnerGuide labels because they also included the retail price. Others tore them off because of “esthetics,” while some said the labels affixed to the windshield were “impeding” drivers’ vision during test drives. Many others who pulled them off claimed the labels gave inaccurate or misleading information about fuel-efficiency. “At some dealerships, Ener-

Guide labels were missing due to the errors discovered in the mileage estimates claimed by these manufacturers,” says the report. “Ten makes had compliance rates of zero per cent, including Aston Martin, Bentley, BMW, Ferrari, Jaguar, Land Rover, Maserati, Mini and Rolls-Royce.” A spokesman for the Canadian Automobile Dealers Association, representing 3,250 dealerships selling 22 brands, said the poor compliance rate across the country was no surprise. “These things are less and less relevant,” chief economist Michael Hatch said. “The paper label is decreasingly relevant for consumers.” Apart from price, the most important specification for new-vehicle buyers today is fuel efficiency, Hatch said. And most consumers

walking into a showroom have done extensive homework online, unlike in 1998 when there were fewer options for obtaining timely data. “The world has changed,” Hatch said. Natural Resources plans to radically revamp the label program, with a label redesign, new information on carbon dioxide and smog emissions, and special labels for electric vehicles. The current fuel-consumption label “does not provide Canadians with the information they need to compare the energy, environmental, and financial costs and benefits of different vehicle choices,” the department says. A new fuel-efficiency testing regime would also expand to include air-conditioner usage, cold temperature operation and higher speeds with faster acceleration. “For most vehicles, consumption will increase by about 15 per cent,” spokesman Guillaume Berube said in an e-mail. The department is also considering making the new Ener-Guide label regime mandatory for the 2016 model year. Hatch says his group is opposed to mandatory labelling, given that consumers have many other ways to acquire relevant information about new vehicles. “It’s kind of an old-school solution to a problem that in our view doesn’t exist,” he said. “It’s just another layer of red tape.” Hatch’s group has no objection to retaining an improved paper label, but does not want regulations requiring them.
