Food Manufacturers Labeling Woes The food processing industry is facing an escalating situation that includes lawsuits due to labeling their products as “natural” with such class actions naming the labeling on some foods and beverages to be false. Some retail outlets have already begun pulling such foods off their shelves to avoid spillage from the lawsuits. Companies that produce targeted ingredients like soybean oil, alkalized cocoa, high-fructose corn syrup, yeast extract, betacarotene, vegetable glycerin, folic acid, citric acid, ascorbic acid and canola oil are living in uncertainty due to the products and money at stake. In such an uncertain environment with no state laws or federal guidance involved, companies are frantic to minimize potential liability. There is no simple answer to such a huge risk but there are cost-effective but efficient methods that can spare you such agony. Market research in 2010 showed that the “all natural” claim was the second most popular on most food products. The FDA then promised a policy shift to focus its efforts on the labeling however; the regulatory body has hitherto ignored requests to enforce a regulation to curb this menace citing other priorities and lack of resources to pursue the matter. With a non-committal policy that only affirms what everyone knows the term natural to mean that no artificial or synthetic additives, the FDA is practically vague about the issue as it holds no weight. This has led to a variety of state consumer laws that warn off “misleading” advertisement that use the word “natural” in their labeling. Litigation risk due to mislabeling is the most threatening situation for a company in the food business although warning letters, recalls and other related regulatory action can be denting to a product line. The risk comes from using harmful ingredients like carcinogens while purporting to use “natural” ingredients for a product that is labeled as healthy.

For instance, recent lawsuits have involved Ben & Jerry’s Ice Cream with the suit claiming that the product was misleading to consumers by being misbranded as “all natural” while it contained alkalized cocoa processed with potassium carbonate. Such claims have put manufactures with similar products on high alert as the lawsuits for more products are being filed with time. To minimize such risks, food manufactures have taken some measures like adopting alternatives for the “all natural” label. Ensuring attorney-client protection by seeking legal counsel to perform labeling reviews after a period of time is another way to avoid this risk. Also, ensure that suppliers’ ingredients adhere to the label specifications by obtaining verification and certification annually.
