TECHNICAL REQUIREMENTS

Press-ready PDF files are strongly preferred (at least 300 DPI) with fonts embedded and an additional 0.125 (1/8”) on each side should be included for bleed ads. Trim size: 8.125 x 10 InDesign, Adobe Illustrator, Photoshop and Acrobat files are accepted. Files can be e-mailed, supplied on CD, drop box or FTP.

AD CLOSE DATES Check with your sales rep for space reservation deadline. Advertiser will be held responsible for space canceled after closing date. Check with your sales rep for Press-ready copy due dates.

AD DESIGN If you need your advertisement designed, we will be glad to help in the design. Photography services also available.


REQUIREMENTS FOR ACCEPTING ADVERTISING A. Rates, conditions and space units are subject to change. Publisher will make every attempt to provide sufficient advance notice when changes occur. B. Publisher cannot be bound by any conditions, printed or otherwise, appearing in order blanks or copy instructions submitted by or on behalf of the advertiser if such conditions conflict with the magazine’s policies or with any provision contained in its Rate Sheet. C. Publisher reserves the right to reject or cancel any advertising for any reason at any time. D. All advertisements are accepted and published by the Publisher on the representation of the agency and the advertiser that both are authorized to publish the entire contents of the subject matter of the advertisement and upon acceptance by the agency and the advertiser of all the terms of the Rate Sheet. It is the responsibility of the advertiser to ensure that all inserts and other advertising comply with the U.S. Postal Regulations and other applicable federal and state laws and regulations. When advertisements containing the names, pictures and/or testimonials of living persons are submitted for publication, the order or request for publication thereof shall be deemed to constitute a representation by the advertiser and agency that they have obtained the proper written con- sent for the use thereof from all such persons, and that they may lawfully publish or cause such publications to be made. In consideration of Publisher’s publication of an

advertisement, the agency and the advertisers jointly and severally agree to hold harmless Active OC Magazine and its officers, agents and employees from any and all losses, damages, liabilities, judgments and expenses (including reasonable attorney fees) arising out of or in any manner related to the publication of an advertisement and all material appearing therein furnish by the advertisers or its agency, including, without limitation, claims, actions or proceedings for libel, violation of any per- son’s right of privacy, copyright infringement, plagiarism and trademark infringement. E. Cancellations or changes in insertion orders by agency or advertisers prior to or following the closing date must be in writing and will not be considered accepted unless confirmed in writing by the Publishers. Advertisers will be held responsible for space cancelled after closing dates. F. All advertisements must be clearly identifiable as such with trademark or signature of the advertisers. The word “Advertise- ment” shall be placed on copy which in the Publisher’s opinion resembles editorial copy. G. Publisher shall not be liable for any failure to print, publish or circulate all or any portion of any issue in which an advertisement accepted by the Publisher is contained because of acts of God, acts of government instrumentality (whether federal, state or local), strikes, accidents, work stoppages, fires or any other similar or dissimilar circumstances beyond the control of the publisher. H. Publisher shall not be responsible for errors in keying numbers or other type setting done by Publisher.

I. Orders specifying positions, other than covers, accepted on request basis only. However, position cannot be guaranteed unless position is secured by a 10% surcharge. J. The liability of the Publisher for any error for which it may be held legally responsible will not exceed the cost of the space occupied by the error. The Publisher will not, in any event, be liable for loss of income or profits or any consequential damages. K. Failure to make insertion order correspond in price or in any other way with the rate schedule is regarded only as a clerical error and publication is made and charged for on the terms of the schedule in force. L. Rates charged and discounts allowed are subject to short rate or rebate at expiration or earlier termination of the contract period if different from rates or discounts earned on space actually used. M. Agency commission: 15% to accredited agencies on space, colour and position on display advertising, only if paid within 30 days from the date of invoice. An additional 2% per month will be added after 30 days from the date of invoice.
