Never let your guard down when dealing with electricity. That’s the advice given to every lineman who works at Alabama Power. It’s also the advice we give our customers. Here are a few “must-know” tips to help keep you and your family safe. You may have heard a few of these before, but it can’t hurt to hear them again. 1. Stay away from downed power lines. Don’t drive over one. And remember, it’s not just the power line that may be electrified, but the ground surrounding the line, as well. 2. If a power line is touching your car, stay inside the vehicle and call 911. 3. Call 811 before you dig. 4. Install Ground Fault Circuit Interrupter outlets in your kitchen and bathrooms. 5. If something that’s plugged in falls into a sink full of water, DON’T reach in to get it. Don’t even unplug it until after you’ve cut the power off at the circuit breaker.

6. Watch where you’re placing that ladder. Do not let it touch any electrical wires. 7. Don’t overload outlets. We’ve got more gadgets to plug in these days than ever before. That doesn’t mean an outlet can handle them all. Overloaded circuits cause an estimated 5300 fires a year.

How do you know if your Ground Fault Circuit Interrupter is protecting you and your family? It’s easy. Press the “test” button on the outlet. Whatever is plugged into that outlet should turn off immediately.

8. Don’t touch a damaged electrical cord or one showing bare wire. 9. Don’t run an electrical cord under a rug. Don’t staple or nail electrical cords. 10. If you’ve got kids, cover your unused electrical outlets with plastic safety covers.

Department of Transportation “Tiger” Grant Could Jumpstart Trail System Construction by HUGH J. RUSHING


irmingham is vying for a $23-milliondollar grant from the U.S. Department of Transportation which would enable the construction of the first 33 miles of the recently announced Red Rock Ridge & Valley Trail system. Backing the Tiger IV grant application is a $1-million commitment from private sources, including $385,000 from the Community Foundation of Greater Birmingham. 08 AL CONSTRUCTION NEWS

The DOT has some half billion dollars in discretionary funds to give away in the current fiscal year as part of the American Recovery and Reinvestment act of 2009. The Fresh Water Land Trust’s Red Rock Ridge & Valley Trail System, unveiled in a February meeting, calls for a 200-mile-long network of greenways, bike/pedestrian paths and trails connecting recreational and historical sites in the Birmingham metro area. The master plan was developed over 18 months with community involvement by over 3,000 local citizens and was funded by the Health Action Partnership’s efforts to reduce obesity in Jefferson County. The total cost of the project according to the Fresh Water Land Trust’s Mary Elizabeth Roberson is projected at $200 million. “The Freshwater Land Trust has a goal of ‘5 years and 50 miles’.” Roberson said, “Although only about 3 percent of the identified network is in place to date.” However, many of the miles of trails and greenways already exist through the trails of Red Mountain Park, Five Mile Creek Greenway and the Shades Creek Greenway, Roberson pointed out. If the Tiger IV grant is awarded, the projection is that 33 miles of the system could be completed connecting Pratt City, Railroad Park, Sloss Furnaces, the Civil Rights District and the new Multimodal Transportation Facility downtown. Other connections would be from downtown Birmingham and Homewood to Red Mountain Park via bicycle-pedestrian

corridors along Valley and Shades Creeks. Off street greenways will include re-development of abandoned rail corridors and construction of new trails. Depending on the setting and expected usage, trail surfaces will range from gravel to finished asphalt and have widths of between four and twelve feet. Roberson also pointed out that, “On-street trails will involve striping for bike lanes and ‘sharrows’ (shared lanes) and will include sidewalk enhancements such as retrofitting for ADA compliance.” The Fresh Water Land Trust has posted a priority list of projects on the trail’s website at “Our priorities are based on cost-benefits that take into account serving the greatest numbers of people, serving all geographical areas equally while linking existing major destinations in the area,” Roberson said. Roberson also pointed out that there may be other funding sources available aside from the potential Tiger IV funding. “Since the Red Rock plan was developed under a grant from the Department of Health and Human Services, it may be that we can tap into health foundations and future HHS funding, which traditionally hasn’t been available for communities to build transportation and recreational amenities.” The Health Action Partnership is a coalition of more than 100 nonprofit organizations working with the

Jefferson County Department of Health to encourage physical activity, reduce obesity, expand food access, advance smoke-free policies, reduce tobacco use and improve the overall health of Jefferson County residents. Other potential funding outlets being explored include corporate and private funding as well as federal programs such as the Safe Routes to School, Land and Water Conservation Fund, Recreational Trails programs, and the DOT’s Transportation Enhancement Program and Congestion Mitigation and Air Quality programs. The Fresh Water Land Trust works in eight central Alabama Counties for water quality protection, biological conservation, and potential sites for recreation. It serves as a connector between existing conservation areas and for community conservation priorities. The organization, an independent nonprofit, was originally set up as part of Jefferson County’s consent agreement with the EPA over its aging sewer system in 1997. The organization has gathered wide support since its first acquisition of land in 2000 for its use of a non-advocacy, businesslike approach to conservation efforts. It is also accredited by the Land Trust Accreditation Commission.

1920’s fire station gets a facelift

Landmark Fire Station on Southside Birmingham Repurposed as Bogue’s/Salon Stewart Perry Construction has wound up renovation and restoration work on a long-vacant 1920s-era fire station at the corner of 32nd St. South and Clairmont Avenue on Birmingham’s Southside. Long-time breakfast eatery, Bogue’s, along with Triple Platinum Salon have moved into the revamped structure. A grassroots social media effort helped preserve the fire station, which under original plans was schedule for demolition. Stewart Perry is now working on a new Walgreen’s at the former site of the salon and restaurant. The result, architectural experts say will be a unique footprint for a Walgreen’s property which will blend into the character of the historic neighborhoods surrounding the project. Stewart Perry is also close to finishing up a project in Madison, Alabama. The Shoppes of Madison is a $20-million project featuring a Target-anchored center with eight retail units. On 28-1/2 acres, the project is over 246,000 square feet. Meanwhile a redevelopment project in Florence is under construction with an expected finish date of early fall. The $14 million project on 20 acres will feature 103,000 square feet of space owned by Books-A-Million of Birmingham. The project will include a network of 150,000 cubic feet of underground storm water detention chambers. A second phase of the project will include building of Publix Supermarket and a Panera Bread location, according to Brittiny Russell, a spokesperson for Stewart Perry. Stewart Perry also has finished the new U.S. Steel Birmingham headquarters at the Preserve in Hoover. Featuring New Orleansstyled ornamental iron balconies and an old brick façade, the project consists of 20,000 square feet of executive office space. The firm is also working on a new Target location at Brookwood Village.

Summary of Benefits and Coverage Rules Pushed back to at least September

Familiar Names Form New Construction Company Two long-time Birmingham area constructors have joined to form a new venture. Mitch Bruhn and Duane Watson have launched WatsonBruhn Builders, LLC. Bruhn was most recently vice president of Engineering and Construction Services for Southern Company Services and is a former president of Associated Builders and Contractors and currently serves on ABC’s board of directors. He is a graduate of Auburn University with more than 25 years in the construction industry. Watson and Bruhn have worked together in the past at a large regional general contractor completing over $250 million in projects with the project size averaging over $10-million each. WatsonBruhn Builders emphasis will be on privately-owned projects in the commercial, industrial and healthcare markets.

The U.S. Departments of Health and Human Services, Labor and Treasury have released long-anticipated final guidance on the requirement for health plans and health insurance providers to provide a summary of benefits and coverage to applicants and enrollees in health insurance programs. The health care reform law created the summary in an effort to provide consumers with simple and straightforward information on plan coverage in a uniform format, making comparisons easier. Originally set to start in March, 2012 inter-departmental wrangling apparently delayed final guidance and pushed the compliance deadline back. Beginning on the first day of open enrollment period that begins on or after September 23, plans must provide the summary to participants and beneficiaries who enroll or re-enroll for coverage. Beginning on the first day of the first plan year that begins on or after September 23, plans must provide the summary to participants and beneficiaries who enroll for coverage other than through an open enrollment period. This includes newly eligible individuals and special enrollees.

Federal Court Blocks NLRB Poster Rule Washington, D.C. – On April 17th Associated Builders and Contractors (ABC) today celebrated the U.S. Court of Appeals for the D.C. Circuit decision to grant an injunction in the legal challenge against the National Labor Relations Board’s (NLRB) “Notification of Employee Rights” notice posting rule. Considered a major victory for ABC, the NLRB’s “Notification of Employee Rights” notice posting rule’s compliance date of April 30 is no longer in effect, as the injunction places the rule on hold while the court considers the Coalition for a Democratic Workplace’s appeal of the U.S. District Court’s unsatisfactory ruling. “For the last several months, ABC has vigorously fought NLRB’s politically motivated policies that threaten to paralyze the construction industry in order to benefit the special interests of politically powerful unions,” stated ABC Vice President of Federal Affairs Geoff Burr. “The NLRB’s notice posting rule is a perfect example of how the pro-union board has abandoned its role as a neutral enforcer and arbiter of labor law.” The decision by the U.S. Court of Appeals for the D.C. Circuit follows a decision issued on April 13th by the U.S. District Court for South Carolina, stating that the NLRB does not have the statutory authority to require business owners to post a biased poster.

Supreme Court: Sue the EPA In a case with what experts say could have far reaching implications; the U.S. Supreme Court unanimously ruled in March that landowners can sue in efforts to void compliance orders issued by the Environmental Protection Agency. The court ruled that EPA compliance orders are the equivalent of “final agency action” and, therefore, fall under rules allowing law suits in the Administration Procedure Act. EPA had ordered an Idaho couple, Chantell and Michael Sackett, to restore their home lot to its preconstruction state, claiming the plot originally held wetlands. The Sackett’s decided to sue the EPA rather than waiting for the EPA to sue them. Environmental groups warned, following the ruling that the decision will undermine the government’s ability to respond rapidly to clean water threats.

Monthly Leasing and Finance Index Up, AIA Billings Index Marks Fourth Straight Increase The Equipment Leasing and Finance Association’s Monthly Leasing and Finance Index which reports economic activity for the $628 billion equipment finance sector, showed overall new business volume for February was $5.0 billion. This is up 22 percent from a volume of $4.1 billion in the same period in 2011. Volume was down 2 percent from the previous month. Credit quality metrics were mixed. Receivables over 30 days increased to 2.5 percent in February, up from a two-year low of

1.9 percent in January. This shift is due to higher-than-normal delinquencies reported by one of the 25 companies responding to the survey. Charge-offs were unchanged from the previous month at 0.5 percent. Credit approvals rose to 79 percent in February, up from 77 percent in January. ELFA President and CEO William G. Sutton said: “The data shows that companies continue to invest in equipment, replacing obsolete and worn assets in some sectors while beginning to expand in others. The roller coaster trend pattern of our creditquality metrics, aging of receivables, chargeoffs and credit approvals are caused by the unique aspects of different sectors and their cash-flow cycles. However, we see them continuing to move in a positive direction overall.” Meanwhile, led by the commercial sector, the Architecture Billings Index (ABI) has remained in positive territory four months in a row. As a leading economic indicator of construction activity, the ABI reflects the approximate nine to twelve month lag time




to the 2011 Award of Excellence Eagle Winners between architecture billings and construction spending. The American Institute of Architects (AIA) reported the February ABI score was 51.0, following a mark of 50.9 in January. ABC’s chief economist, Anirban Basu, reported that the construction industry’s unemployment rate dipped to 17.1 percent in February, down 17.7 percent from January. The nation’s construction industry has added 65,000 jobs or 1.2 percent since February, 2011 when the unemployment rate was at 21.8 percent. “The recovery in construction spending has been halting to date, and therefore occasional setbacks are to be expected,” Basu said. “ABC’s Construction Backlog Indicator, which declined during the fourth quarter of last year, foreshadowed both this jobs report and indicates that the construction industry employment is likely to be sluggish in the months ahead.”

February Construction Falls Seven Percent Construction starts in February dropped 7 percent from the previous month, according to McGraw-Hill Construction. Diminished activity for nonresidential building as well as a loss of momentum from the non-building construction sector has been reported also. Total construction starts on an unadjusted basis were shown at $52.9 billion for the first two months of 2011, down 14 percent from a year ago. Total construction starts were down by 2 percent for the twelve months ending February 2012 versus the twelve months ending February 2011. Nonbuilding construction dropped 16 percent in February. Highway construction plunged as well, resuming the declining trend that was present for much of 2011 before contracting improved briefly in December and January. The electric utilities category’s percentages fell in February. However, last month did include several large and promising projects. Water supply systems, miscellaneous public works and sewers, registered large declines for public works as well. The decline for miscellaneous public works was cushioned by $344 million for site work at an oil storage facility in Houston TX. The two public works categories able to register gains in February were the following – bridges with the help of a $162 million railroad bridge in California and river/harbor development. Nonresidential building dropped 7 percent. A large portion of this decline resulted from a 22 percent slide for educational buildings. This is continuing the descent that this category has been subject to for the past three years. On the commercial side, warehouses and hotels retreated in February, falling 8 percent and 47 percent respectively. Office construction, however, saw an increase in February. Store construction and the manufacturing plant category saw increases also. he unemployment rate has increased from 17.1 percent in February to 17.2 percent, according to the April 6 Department of Labor employment report. However, industry unemployment is down compared to the 20 percent rate of March 2011. Over the past 12 months the industry has added over 55,000 jobs. The nonresidential construction sector lost 6,000 jobs for the month but has added 7,000 jobs, bringing the total number of jobs to 659,400. Nonresidential specialty trade contractors shed 5,000 jobs in March, while residential specialty trade contractors added 5,000 jobs. Across all industries, the nation added 120,000 jobs in March. The private sector expanded by 121,000 jobs and the public sector shrank by 1,000 jobs. On a yearly basis, the nation has added 1,899,000 jobs, or 1.5 percent. The national unemployment rate stood at 8.2 percent in March. This is down from the 8.3 percent in February. Associated Builders and Contractors Chief Economist, Anirban Basu, gives his thoughts on the latest decline. “Today’s employment report was disappointing, particularly for construction. The first quarter of 2012 will be judged as a step backward for the industry as construction spending levels stagnated and employment momentum disappeared.”

HE GREAT RECESSION MAY BE OFFICIALLY “over,” but there’s still a long hangover expected in the construction industry. Anemic economic growth over the past several years and a large clot of underutilized properties probably mean that the torrid growth of the first seven years of the new century probably won’t repeat itself. But, economic recruiters and economists are looking forward to growth and believe there are positive signs. Troy L. Wayman, vice president of economic development for the Mobile Area Chamber of Commerce reports that his project load is, “Higher than it has been anytime in the past five years and not in any one particular industry but across the board.” Wayman’s office has been fielding inquires in the areas of steel, aerospace and chemical industries, all mainstays of the Mobile area’s industrial base. “Our port is also expecting expansion with the 2014 enlargement of the Panama Canal,” Wayman says. “We are preparing a new turning basin for the larger ships which will transit the canal and are hoping to get an intermodal facility financed and completed.” The Mobile area expects a spike in distribution and logistics construction as firms look to take pressure off of West Coast ports once the canal can handle larger ships, particularly container ships which are responsible for much of the consumer goods brought into the U.S. But, aside from geographical advantages, Wayman believes that the state’s human capital makes a big difference in economic growth and business recruitment. “Incentives are one-time things and you have to have them to compete, but beyond that a strong work ethic is vital and that is one of the good things about folks in our state.” Bill Taylor, the president of the Economic Development Partnership of Alabama (EDPA) agrees that one of Alabama’s strengths is its stable workforce that is nimble, trainable and productive. “We have certainly proved with existing industries such as automotive assembly plants that Alabamians are capable of providing potential industry a quality workforce which thrives in very sophisticated environments.” Taylor said that he believes there is still room for more automotive assembly plants in the state, as well as tier one and tier two suppliers, considering that Alabama is home to three major producers—Hyundai, Mercedes and Honda and adjacent to the Kia plant in Georgia and Volkswagen in Tennessee. “They (the large OEM plants) understand logistics quite well and understand shorter supply chains are more efficient.” Just recently, Lear Corporation broke ground on a $19.6 million plant at Brookwood that will produce frames and seats for close-by Mercedes. As many as 150 employees could be working there by 2014, sources say. In addition the state was successful in attracting a new final assembly plant from Navistar in Colbert County. Previously the site of the defunct National Alabama rail car plant that was bank-

rolled by the state’s retirement system, Navistar, will mate engines made in its Huntsville plant to a multi-purpose chassis allowing maximum flexibility of the truck’s end use. Greg Canfield who heads the newly renamed Alabama Department of Commerce (previously the Alabama Development Office) believes that the development earlier this year of a strategic sector plan targeting eleven different industries will pay dividends going forward (See sidebar). “We calculated both the state’s existing strengths and the industries, which we think will be in the growth mode over the next five years. We are working to align those sectors interests with our recruitment efforts,” Canfield says. “Take for instance aerospace and aviation,” Canfield points out. “We have over three hundred businesses in this industry already in Alabama and we think that is a great basis on which to work to secure a Maintenance, Repair and Overhaul (MRO) facility. Airline fleets are aging, and such a one-stop resource would be a valuable addition to the state’s industrial growth.” Lockheed Martin, as an example, just announced a $66 million contract for further development of a high altitude area defense missile system. The truck-mounted launcher systems carry eight missiles, along with fire control and radar systems. The missiles themselves are produced in Lockheed’s facility in Troy, Alabama. Lockheed has even sold the systems to the United Arab Emirates. EDPA’s executive vice president, Steve Sewell, says he believes that there exist prospects within the next five years for parts of the state, such as the poverty-ridden Black Belt, and some of the state’s western counties, which have been traditionally bypassed by industrial development. “We were heartened by the decision of Golden Dragon Copper to locate a $100- million tube plant in Pine Hill which could employ up to 500,” says Sewell. “We are spending a great deal of time helping those rural counties capitalize on opportunities not only within existing sectors but new ones such as Golden Dragon. This is a great example of an alignment between the state’s efforts and the local communities’ needs,” Sewell says. He pointed out that Wilcox County, location of the new investment had an unemployment rate of over 16% at the end of 2011. When the city of Thomasville, where the original project was to be located discovered it could not handle the larger facility demanded by the firm, it partnered with neighboring Wilcox County to find the needed larger site. Dr. Keivan Deravi at Auburn University of Montgomery has advised Alabama governors with models showing gains of activity in response to economic incentives. He hopes that Alabama can continue to break away from low-wage, extractive industries in favor of higher tech jobs. “There’s not going to be another ThysenKrupp to come and invest $4 billion. We need to figure out how to attract service industries which comprise a quarter of the U.S. economy and offer stable and well-paying jobs.” Deravi worries that relentless tax cutting and demagoguery puts at risk future growth. “We ought to have more taxes for

training and educating and not be cutting funds for education. We are running on fumes, and it risks backfiring and leaving us without the sort of education system that can produce people who can do high-paying jobs. I am appalled that we don’t have pre-kindergarten programs throughout the state. That’s the most important time to educate a child. If we were as concerned about education as we are about, say football, we’d leave a better state to our children and grandchildren.” Greg Canfield wants to commercialize research done at the state’s public universities and at private research outfits like Southern Research and the Hudson Alpha Research facility in Huntsville to grow the tech sector. “High tech plants would provide a big boost to construction in that they are capital intensive industries and they provide the type of jobs that aren’t at risk like low-wage jobs are.”

Become more strategic: If owners have more information about the contractors and construction process, contractors need to have more information about their potential customers. Build closer relationships with customers: This isn’t just a matter of a salesperson taking the customer out to dinner or playing golf. Buyers need to have confidence in their contractors.

Changing for the Future AS WE WORK OUR WAY OUT OF THE GREAT RECESSION, owners will continue to want the lowest price and best value. There appears to be a growing division in the market, just as we see in the economy in general. Those in the middle will be squeezed the most. So what can contractors do to survive and thrive in this future? The fact is that there are contractors making reasonable profits even in the downturn.

Embrace change: Most of the firms surprised by market changes were either not paying attention or ignoring what they knew was happening. Sometimes one has to believe your own eyes and data and make the necessary changes to adjust to market forces

Develop IT as a profit center: The goal here is to make the IT department a profit center, not just a group that fixes computers and installs new software. Project management, productivity tools and tracking software for job progress and cost reporting will help get waste out of the system and reduce costs. Understanding and using BIM has become a necessity rather than just a nice-to-have gimmick.

Become productivity experts: The construction industry is often chided as being unproductive and behind the curve of high-tech manufacturing sectors. However, more contractors are breaking out of that mold and looking for ways to employ technology and processes like BIM, prefabrication and modularization to gain on productivity, safety and workforce changes.

Be specialists in strategic market niches: To avoid being a seller of commodities, become best-in-class specialists. Best-of-class contractors know their customers’ business and add value. Self-perform more work: Self-performing contractors are often the most profitable. They benefit their customers by having more control over schedule, price and quality and, if they are productive, can make greater margins with their own labor.

Know how to innovate, accept and manage risk: The modern trend in business has been to avoid as much risk as possible by shifting it contractually or otherwise to others—who in turn move it on to others and so on. While it is important to avoid risk, the cost of shifting risk can be expensive.

Be greener: It is not only important to understand owner needs and wants for more sustainable projects, but it is also time that contractors learn how to be more sustainable in their own business.

Robert Courland Has a Few Words about



CALIFORNIA AUTHOR ROBERT COURLAND IS OUT WITH a new book on what would seem to be a prosaic subject: concrete. But, when you delve into the history and uses of concrete it turns out to not be so dull after all. It is especially interesting when considering the history of the substance, which has become ubiquitous in modern-day construction. For instance, the ancient Romans, just after the first century, constructed the Pantheon. Two thousand years after it was built, its coffered concrete dome is still the world’s largest unreinforced concrete structure. The height from the floor and the diameter of the Pantheon dome are both 142 feet. As a Roman Catholic Church (St. Mary and the Martyrs) since the seventh century, the Pantheon has been in continuous use since it was built. It remains standing despite earthquakes, hundreds of years of air pollution and constant exposure to the elements through its open top (oculus). Architects and engineers unaware of its long history presume it to be a modern structure. Robert Courland asks the question: What did the Romans know that we don’t? Across America Courland points out that 20th century structures built of reinforced concrete are crumbling. Nearly 70,000 bridges in the U.S. are structurally deficient. Occasionally a catastrophic failure, like that of the Minneapolis I-35W Bridge over the Mississippi in 2007, makes headlines. Even a 1944 study of 200 reinforced bridges showed that bridges built before the 1930s were more durable than those built after the introduction of faster hydrating Portland cements—in other words, faster setting, high strength concretes. Courland’s book points to the use of steel rebar as the weak point in much modern reinforced concrete deterioration. Courland points out that deterioration was blamed on poor quality control in the field for a long time when, in fact, it was the nature of the concrete and its interaction with mild steel that predicted its failure. “Concrete cracks; water infiltrates the crack, interacts with the steel reinforcing leading to oxidation and corrosion, which swells the reinforcing, leading to further cracking and a repeating cycle,” Courland said in a conversation with Alabama Construction News. Courland admits that he is a non-scientist, but his in depth look at concrete’s history, and his conclusions about the permanence of concrete, he knows that he’s made some people nervous. “There were two construction websites that agreed to carry and sell my book, but it was dropped quite quickly,” Courland said. “I understand the adverse reaction to new technologies in the construction industry. This will change. Nowhere else in the industry is more cutting-edge work being performed than in the area of new cement mixes and new forms of concrete reinforcement,” Courland commented. When fast setting, high strength concrete debuted in the 1930s, Courland says there wasn’t a lot of testing done. “It had a lot of good compressive strength, and it enabled faster and more economical construction. So, it was very quickly adopted.” There are two suggestions offered. The first being the use of concrete with greater qualities of fly ash in it, making it a concrete more closely resembling that of prior to the 1930s and the second which

is the use of non-oxidating reinforcement for concrete structures. Courland points out that lime kilns produce enormous quantities of CO2 when calcium carbonate is converted to calcium oxide. Fly ash can replace some of that calcium carbonate. He writes, “(S)ome three hundred years ago, people discovered that the chemical composition of slag and fly ash made the combination ideal for producing cement…(T)hey can replace not only much of the kilned clay in Portland cement but much of the kilned limestone as well. That’s not all: because of the high percentage of silicates in some fly ash, it can be used as a filler to replace some of the sand used to make the concrete.” Courland says that two cement producers, Novacem in the United Kingdom and Calera in California, are currently producing carbon neutral/negative cements. Calera’s process sequesters a half ton of CO2 for every ton of cement made using calcium carbonate from a power plant. Other companies are working on processes to use both the heat and byproducts of mining and power generation to do similar transformations. Courland says that the Birmingham area, a center for cement production due to large limestone deposits and an area with many coal fired power production facilities, would be a likely candidate for such operations. “I’m really quite optimistic that the recycling of fly ash will come to be a major constituent of concrete which will be more durable and have less of an impact on the environment.” Currently fly ash is considered an exempt waste by the EPA. But, in response to a flood of fly ash slurry from a failed catchment basin from Tennessee in 2008, the EPA has a proposed rule, which critics claim will make it more difficult to collect, store, transport and incorporate the stuff into cement. The nature of reinforcement used with concrete is slightly more problematic, Courland admits. Nonferrous rebar, such as GFRP (glass fiber reinforced polymer) and rebar made of a bronze aluminum alloy, are both potential candidates for replacement of steel rebar.

While GFRP cannot be field bent and is more suitable for bridge decks, bronze aluminum alloy would essentially be as user friendly as existing steel rebar, cost about the same as stainless steel bar (which Courland says, all though less likely to corrode, will still deteriorate over time) and would have real permanence. (See accompanying figure). “The switch to building more permanent structures will eventually save the taxpayers trillions of dollars. Economic considerations will ultimately push innovations in this field,” Courland said. Even the use of reinforcement for concrete may not be as necessary as one might think. Courland says, “I am on dangerous ground here, but there are enough examples—both ancient and recent of this.” An unreinforced concrete street in Bellefontaine, Ohio has lasted over a century, during which time it has required less maintenance than other nearby streets. “Concrete has enormous compressive strength,” Courland asks, “Why is reinforcement needed if it is made so that fractures don’t lead to lateral displacement?” The Hockley Railroad Viaduct in England was built in 1891 of unreinforced concrete and masonry. During World War II it carried huge loads far beyond its probable design strength, and yet it stands today, all though not in active use. And, then of course there’s the Pantheon, still standing strong over two millennia.

arathon Electrical Contractors, Inc. was founded by Larry Argo, Robert Bratton and Bill Proctor. All three men worked in the Electrical industry for over twenty-five years. Larry Argo still serves as president of Marathon Electrical. Other current owners include Vice President Chris McGregor, Chief Operating Officer Bruce Taylor and Secretary Treasurer Mark Harry.

President Larry Argo and his co-founders started out working at a different electric company. After leaving this company, they were faced with the task of formulating a successful business from scratch. Each of the three founders had his own wife and three kids, and each was determined to support his family. Argo shared what he referred to as an American success story, “We were able to start a company with nothing and build it into the largest electrical contractor in Alabama.” Despite a bad departure from a previous employer, they were able to take away lessons and apply them at Marathon. “At the other company we found out how to do a lot of things right, but we also found out how to do a lot of things wrong,” says Argo. With these experiences behind them, they created fair and equal opportunities for the employees of Marathon. This was important

because all of the current owners agree that the employees are the backbone of their success. Argo passionately portrayed the importance of treating employees and customers fairly and honestly. He went on to say that he would not be at Marathon for the next twenty-five years because he would eventually be retiring. He did, however, stress the confidence that he holds for the three “racehorses” that he would be leaving the company to. Argo believes that they will keep up with what Marathon has established and continue growing it as well. Bruce Taylor, a current owner, will be one of the men continuing the oversight of Marathon. He spoke on the company and their means for success. Taylor mentioned some of the big projects that the company has been working on such as Birmingham International Airport, Children’s Hospital, Princeton Hospital and Madison High School in Huntsville. When asked about trends in the industry such as prefabrication and how they have been incorporated at Marathon, Taylor responded with a positive note, “We have already adapted to prefab. We will continue down the road… We want a more economical product for our customers.” He also noted Building Information Model (BIM.)

These trends help set Marathon apart from most contractors. Prefab shops are taking labor off the construction site and putting it in a controlled environment where the production and safety controls are better. In a controlled environment Marathon employees are able to control safety, materials and production much easier than they could on the actual site. These kinds of innovative new practices are what push Marathon to the top of the list in electrical contracting. “We don’t want to do all the work around Birmingham, just all the electrical work,” says Taylor. And, with their success, chances are they will be getting a lot of that work. Taylor could not fully express how central the employees at Marathon are to the company’s accomplishments. He spoke many words of praise when discussing their dedication and skill. One such employee is Randy Woodley. Woodley has been with Marathon for twenty-one years. He shared that during that time, the company had turned into something more like a family than a place to work. He spoke highly of Marathon and their achievements. “The group of guys we’ve got and the reputation Marathon has made over the years is because we have the best people, the best electricians and superintendents that this area can offer.” Woodley commented that Marathon only hires the best with the intention of each of them being long-term employees. He also noted

that the employee-employer relations motivates everyone to do their best on every job. All of these circular efforts result in tangible results that can be seen at all of Marathon’s worksites. The employees are committed, and he believes this to be the biggest reason that the company has done so well for the past twenty-five years. Woodley had nothing but positive things to say about Marathon and its employees. His appreciation for this community of employees was obvious and unending. Owners, Chris McGregor and Mark Harry also spoke highly of the efforts put forth by employees. Both men applauded their employees’ dedication and precision on the job. “Our employees make this company,” says McGregor. Marathon has obviously built a strong employee base. However, the owners have played the role of choosing each employee and overseeing the values of the company. Therefore, a lot of the company’s merit is found in the men that oversee it. Chris McGregor, being one of these men, brings his own specialties to the company. McGregor graduated from Auburn in 1999 with a Bachelor of Science degree in Building Science. McGregor relayed how he has been able to incorporate this education into his work at Marathon, “It got me in the general contracting industry, which in turn allowed me to see what my customer wants. I know what my customer wants out of a subcontractor.” Being attentive to customer needs has been another huge factor on Marathon’s pathway to success. The company has been doing more with less, in the words of McGregor. He also sees a lot of potential for growth and expansion in the future for Marathon. Mark Harry also noted company growth in the future. “We’ve already started means to branch out,” says Harry. This owner offers a lot of experience to the company as well. He worked in the Engineering industry for twelve years and was an apprenticeship instructor. Harry commented on being an instructor, “It actually gives you one on one time with the guys in the field. And what it does

for you is not only helping them from the technical perspective but what they need in the field.” With such experienced owners and dedicated employees, it is no surprise to see Marathon’s triumph in the industry. The past twenty-five years have been such a huge achievement, and the future looks bright. “Larry Argo…It takes someone with his integrity and his care and knowhow to make a company perform like that, and it is going to be big shoes to fill,” says Harry. “But, the good part about it is he’s been training us for the last ten to fifteen years. So, I think he’s instilled values to us, the same as he has.” Though there has been some shift in staffing over the past twenty-five years, the company does not waiver in the mission

set forth by its founders. Marathon Electrical’s mission is to be the premier provider of electrical contracting service in the Southeastern United States. With this in mind, they deliver quality products and services to every customer.

THOSE SPECIFIC ARENAS INCLUDE ALL STATE BUILDINGS, schools (both public and private), hotels, motels and motion picture theatres. The intent behind the establishment of the commission was to insure that buildings where the public gathers should be designed and constructed with safety in mind. “Often times,” Lynn says, “code development is reactionary. Its primary focus is on life safety for citizens. Traditionally codes are amended in response to tragedies and events that weren’t foreseen before they occurred.” Lynn points to developments following 2005’s Hurricane Katrina and periodic outbreaks of devastating tornados in Alabama as an example. In 2010 the legislature provided that after June, 2010, any new public school constructed must include a Building Commission approved safe space. The Building Commission adopted the ICC 500 standard requirements for tornado shelters. “At the same time we discussed with the State Department of Education mandatory compliance with the code for hurricane shelters, but decided it was not necessary,” Lynn explains. “Tornados are shortwarning events, sometimes just 15 minutes. You know hours if not days before when a hurricane is to hit and there naturally are not going to be students in schools then. The emphasis is on protecting the public health, and it seemed with adequate warnings that are available that schools would have dismissed classes well in advance of any hurricane landfall.” While similar to mandates from FEMA, the ICC code is more prescriptive than descriptive. The safe rooms are designed to withstand 250 miles-per-hour winds in the northern two-thirds of Alabama and 200 miles-per-hour winds in the southern third of the state. The Building Commission doesn’t lobby the legislature, but it monitors what impacts proposed legislation would have on state agencies and their construction plans. For example, the commission has provided guidance to contractors when it comes to complying with HB 56’s provisions on state contracts. Various links were provided to builders, engineers and architects involved in K-12 school systems, community colleges, and other contracts for state agencies. Contracts awarded beginning in January of this year require affidavits regarding compliance with both the act and the E-Verify program. “When there are changes,” Lynn said, “We send an email blast to architects and engineers so they can incorporate those changes into a contractor’s bid package. Any time we have a submittal for review, we capture the address so we can put that party into the database.” The Building Commission also keeps its website up-to-date which provides a real-time resource to designers and builders. The Commission also posts on its website myriad documents and samples that aid both designers and engineers in producing public buildings. The Building Commission’s rule provides that a technical review be made by its technical staff prior to bid letting for projects. Three levels or phases of plan submittal exist: schematic, preliminary and final. These are intended to minimize changes in design development to accommodate Building Commission requirements. The schematic drawings typically only require a site plan, small scale (1/16” = 1’) floor plan, elevation if available, a schematic energy

The schematic aids in keeping designs that may not meet requirements from requiring extensive planning that would then be discarded. In keeping with its vision of a level-playing field, the submittals do not allow sole-source materials for public projects unless specific requirements are met. In addition, the building commission does inspections both during construction and a year after construction is completed to make certain that all relevant requirements were met. Prior to joining the state Historical Building Commission in the mid 2000’s, Lynn worked in a civil engineering department at Maxwell Air Force Base in Montgomery. “I learned a lot from working with such outstanding firms as Blount and Caddell on differing types of turnkey, design/build projects, including a larger military housing project. Successful projects happen because there is a team. Everyone has to do their part and recognize they have to work together. I’ve tried to bring that philosophy into my work with the

Lynn commented. Alabama has been criticized for not having a statewide system of building code inspection and enforcement. Lynn says that most municipalities do have codes, but construction outside city limits is often done without code compliance. “The secret to codes is to have enforcement. You might pass a statewide residential code, but unless you have the ability to do inspections, then just having a code doesn’t really help you.” She does see events such as the 2011 deadly tornado outbreak doing more to promote the use of codes. “But one of the problems is that you have existing structures built many years ago. Codes typically are only effective on new projects.” However, Lynn does observe a greater emphasis on the use of storm shelters, community shelters and safe rooms in homes. “That’s a good thing which will help save lives.” But Lynn says she recognizes that codes are not necessarily a cure-all, even if they were strictly enforced. “There is always

government.” The slumping construction economy has also hit the Building Commission as well. “We have probably the leanest staff we have ever had. “Even though there are signs that construction is recovering, tax revenues are such that there are across the board cuts throughout state government. We like to think that we are learning to do new things in new and better ways and making the most of what we have in order to serve the public,” Lynn said. It is unclear how the Governor’s announced 10.3 percent proration will impact the Commission’s services, Lynn added. Lynn points out that it would be nice if plan submittals could be done electronically. “As much as that would be helpful, it is just not an inexpensive thing to undertake. We are still reviewing paper plans, and I think that we keep up very well considering our staff reductions.” Typical designs are allowed up to 30 days for each of the three reviews but are often completed before that,

Legislative Update ABC President Jay Reed Talks about Progress in the 2012 Alabama Legislative Session. by HUGH J. RUSHING AT THE HALF WAY POINT OF THE 2012 Alabama legislative session, the solons in Montgomery have thus far been embroiled in discussions over charter schools, state budget woes and tweaks to the state’s immigration law. That means, according to ABC President Jay Reed, that very little industry-specific legislation has passed. “So much of the House and Senate’s time has been occupied with those issues that it has been difficult to get much attention paid to major legislation, which the construction industry and allied trades are behind.” Reed along with ABC Legislative Commit-

tee Chair Tim Hightower have spent long hours in Montgomery laying the groundwork for future legislation and playing defense. “We may not get our major bills passed,” Reed observed, “but we are certainly preparing for 2013 when some of these major issues are behind us.” Issue number one for ABC this legislative session is an attempt to get construction materials for non-taxable entities such as the state, federal government and schools exempted from sales and use taxes, revised and simplified. Construction firms are spending thousands of dollars and in-

ordinate amounts of time trying to comply with sales/use tax calculations and reports for items going into such tax-exempt construction. ABC has met with the Alabama Department of Revenue and the Attorney General’s Office in attempt to get the situation returned to the way the process worked prior to 2004. “I don’t know if we will get this passed this session, but we certainly have had excellent meetings in Montgomery. And, I think we will ultimately be successful in this effort,” Reed said. “If not this session, surely in 2013.” The association has provided overwhelming resource for our subcontractors. “Subs are the “workers” on a job site. We have to monitor any issues that could hinder their ability to perform for the general contractors,” Reed stated. Reed points to electrical legislation, sprinkler concerns and the Alabama Plumbing and Gas Board to name a few areas of focus. Another major win predicted is on legislation, which would ban government-mandated project labor agreements (PLAs) for taxpayer funded work in Alabama. Reed praised Representatives Jack Williams and Senator Slade Blackwell’s work on the bill. Government required PLAs are said to add as much as 20 percent to the cost of construction when they require non-merit shop employment in connection with projects. Less than ten percent of the state’s construction workforce is unionized. “The republican majority embraces this concept, and the bill is out of committee. We simply need someone on rules to pick it for the calendar.” Reed is confident that the Alabama Construction Recruitment Institute (ACRI) will be extended by legislation this session. The ACRI’s Go Build program, driven by the need to train and qualify skilled craftspeople, has marked significant successes, and its funding, by a self-imposed fee on construction wages, needs renewal by the legislature. “The legislation would put the ACRI under the Sunset Review Committee process going forward, and we think that’s a great thing for ABC members and all of the construction industry in the state,” Reed

pointed out. ABC has typically steered away from involvement in local legislation, but Reed said that this year the association has been monitoring legislation for Jefferson, Madison and Mobile counties. The reason being that these three areas are economic engines for large portions of the state’s population. At issue in Mobile are efforts to find a solution to soaring property and casualty insurance rates along hurricane prone coastal areas. In Jefferson County, the issue of an occupational tax reinstatement is also drawing attention, Reed said. “We are concerned obviously that unless the Jefferson County delegation can come to some sort of agreement among their selves, there doesn’t seem to be much the legislature is willing to do. We are concerned that inspection and planning processes will be stalled and delayed without some relief for the Jefferson County government.” ABC has been called to the table countless times to review drafts of a potential solution. ABC is also supporting and looking for

passage of legislation, which would allow for tax credits in data and call centers throughout Alabama. In an effort to lure such operations to Alabama, incentives are needed to help turn, typically, large empty retail spaces into data and call centers which would produce well-paying jobs for citizens. “General contractors and electrical contractors in particular are hopeful this can be done,” Reed said, “since much of this sort of renovation work is required for data and call centers.” ABC has also worked on an anti-indemnity bill, which would bar risk shifting from a responsible party to another via contract documents, which arbitrarily assign the risk to one group. “We have studied existing indemnity laws nationwide and are working towards having a bill ready for 2013,” Reed said. Reed also said while the construction industry appreciates the need for the state to save money, it’s concerned about proposals floated, which would consolidate numerous state licensing boards into a single entity.

“We want to make sure that critical areas are not left uncovered and that the quality of the licensing boards activities and building standards in Alabama are not compromised by the need for savings.” At time of print, ABC was monitoring 170 plus bills. Reed indicated that ABC’s website ( features a bill tracking report. The site also includes a weekly legislative briefing that generally posts early on Friday mornings during session. This allows the construction industry to get up to the minute information about any important piece of legislation. Reed serves as the association’s lobbyist. He welcomes meetings to discuss how contractors feel we can better our industry through legislation.
