Night to Remember Event

T

he Night to Remember 7th year of publishing anniversary celebration was fabulous. Thanks to all the wonderful community members that attended. The entertainment was phenomenal, the food was spectacular, and the dancing a joy. Our local politicians honored us with their presence as well. It was a great and memorable evening and we have a photo essay which captures a small amount of the evening’s excitement. A

lain Pinel Realtors is a real estate firm that stands apart from all others. Paul L. Hulme, CEO and President of Alain Pinel Realtors (APR), started his business career at the age of nine. In 2015, they are still on the forefront of technology and plan to recreate apr.com to be a collaborative space that will rival any existing real estate platform online today. Just this last fall, APR moved into the Almaden Fashion Plaza, a beautiful location in the heart of Almaden. Dave Walsh, who has managed the Almaden office for eight years, was thrilled with the new location. “I am so excited to continue our long term relationship with the Almaden Valley community from our wonderful new Almaden Fashion Plaza location. I see many of my Almaden neighbors on a regular basis visiting this center and I’m confident that we couldn’t have chosen a better location nor designed a more friendly environment,” said Walsh of the new office. “In addition to serving the Almaden Valley, we are at the crossroads of three or four of San Jose’s prime real estate zip codes being just minutes from downtown Willow Glen, the charm of old Cambrian and the ever growing community of Blossom Valley.”


Walsh was hired specifically for his experience in the San Jose community, having been a Realtor in Almaden for 36 years and having lived in Almaden Valley for 14 of those years. In addition to being past President of the Santa Clara County Association of Realtors, he was Realtor of the Year in 2007 and Volunteer of the Year in 2014. APR opened with a bang in the Almaden Fashion Plaza, throwing a Grand Opening party. The party lit up the Fashion Plaza with lights and live jazz, while guests mingled out by the fountain and toured the new office. Members of the San Jose Chamber of Commerce attended and performed the ribbon cutting ceremony. Paul Hulme spoke to the group, reflecting on the journey that has brought him to open yet another office in Silicon Valley, and took the opportunity to donate to Family Supportive Housing, a Santa Clara County organization that provides resources to homeless families. Jill Mitsch, the Development Director, received the donation at the ceremony. 2014 wasn’t just a busy year in Almaden, but was a huge year for all of APR. Always leaders in real estate marketing, they launched a brand refreshed with bold, modern fonts and beautiful photography as well as a new ad campaign. Once again, they were named the 5th largest residential real estate firm in the nation and Paul Hulme was named one of the Most Influential People by Swanepoel Top 200. Despite the market’s challenges and low inventory in 2014, APR’s business did not slow, but rather expanded. They achieved their most profitable year yet, closing over $10.8 billion in sales volume. Not only did they expand in Almaden, but they opened new and remodeled offices in Alameda, Larkspur, Saratoga, Sonoma, and Tahoe. As a local company with global reach, in 2015, APR plans to focus on China and also expand their international reach to focus on other emerging markets. As a locally and family owned company, community is always at the heart of their business. In 2014 they continued to focus on community relationships, charity and events, through food and backpack drives, along with charitable contributions all over the Bay Area, including Family Supportive Housing, InnVision Shelter Network, Second Harvest Food Bank and the Alameda Point Collaborative, to name a few. Dave Walsh is passionate about the Almaden community. He spearheaded a partnership between the Martin-Fontana Parks Association and the Santa Clara County Association of Realtors to maintain the Jeffrey Fontana Memorial Garden, which honors Jeffrey Fontana, a police officer who was killed in the performance of his duty in his neighborhood. He also leads Realtor events that raise money for local charities; between the annual Chili Cook-off in Almaden Lake Park and the exciting Realtor Pumpkin Auction held at BJ’s, his office raised almost $15,000 in 2014. This year, Alain Pinel Realtors is celebrating their 25th anniversary and they have a big year ahead of them. “At APR, we have embraced technologically-driven productivity from the beginning and we still operate under the assumption that improvement comes from taking risks, innovating, adapting to change, and continually questioning assumptions. We are looking forward to being at the forefront of the trend setting movement in Bay Area residential real estate in 2015. Almaden Women – Hearts of the Valley by Linda Stone

How a small group of women who volunteered for their community in order to make it a better place to live, ended up becoming one of the most powerful and influential women’s group in 95120... “Having lost my mother when I was eight and my father at Christmas when I was sixteen, I understood first-hand what a young person experiences losing a parent,” said Dawn Clarkson, current president of the Almaden Valley Women’s Club (AVWC), “my brother, sister and I were split up.” She had nowhere to turn to. No grief services were offered or even available. Little did Dawn know then, but her tenacity would fuel her desire to grow up and enter a life of service bringing her in contact with an organization that would hold a special place in her heart. HISTORY LESSON Fifty years ago the AVWC was born. Not born of vanity but for practical reasons by eleven or so residents to better the local schools and foster a family atmosphere. Organized in 1965, the purpose of the non-profit organization is to stimulate, by the active participation of each member, interest in the social, civic, and cultural improvement of the community. In 1976 the club wanted to expand into an event for the whole family and came up with the idea to hold an Art and Wine festival. It was so successful that the club ran out of ice for the thousand plus attendees and it was the spouses who had to drive downtown, which was considered a trek without the current Highway 87, to purchase more for the festival, the Councilman recalled.

By her successful (72.4 percent) 2000 bid for reelection to the city council for District 10, Pat Dando was already a member of the women’s club. It was she who co-founded the club’s major fundraiser – The Almaden Valley Art & Wine Festival held every fall at Almaden Lake Park. Today it is one of the oldest and continuously running festivals in California. She joined the club about fourteen years after its inception, ultimately becoming president. By that time the club had a group of twenty women. Most had moved to the Valley from out of state with young children, and whose goal was to create a community which was lacking in the sparsely populated area. This included finding a place where families could gather and figure out a way to make money to buy the things for the community that it couldn’t afford. In the club’s first five years monies raised went to a piano for the Almaden Community Center, books for the library, and the jaws-of-life for the San Jose Fire Department. Later on they funded the ARK, a forty-foot metal container filled with supplies in the event of a disaster such as a flood, fire or earthquake. To date the women have raised over a million dollars. Besides helping Almaden raise monies for needed items, the club provides college scholarship grants to 95120 high school seniors and funds other non-profits. GIVING BACK TO THE COMMUNITY To determine who becomes a recipient of a grant the AVWC use past grant recipients and new grant requests. “They must fill out a grant request form that is available on our Web site. 5 Attributes You Want in Your Business Attorney

very business needs to rely on experts to fill the knowledge gaps of the owner (my business included!), and finding a good lawyer is no exception. But specifically, what traits should you expect to find in a good business attorney? I can give you quite a few, but here are some suggestions: 1. Your attorney should be a CONNECTOR: An experienced business attorney is routinely working with other professionals, and can give you qualified referrals to other resources, such as an accountant, insurance agent, real estate agent or banker. Often, they may even have other clients that may be a strategic relationship for your business, a customer for your business, or even a funder for your business. Use their connections while you develop your own! 2. Your attorney should be a PROTECTOR: How do you best protect yourself from liability? A Corporation? A Limited Liability Company? Do you need a Buy-Sell Agreement? What about Key Man insurance? How do you protect the intellectual property of your company, whether that be your copyrights, trademarks, patentable ideas, computer code, customer lists, or proprietary know how? Your legal counsel needs to be advising you about how to protect your company’s interests against outsiders, and how to protect the company from those on the inside as well. 3. Your attorney should be a “T” CROSSER and “I” DOTTER: In over 20 years of practice, there have only been a handful of occasions where a new client comes to me, shows me their corporate records, and that information is both correct and current. Working closely with an attorney gives you the best shot to ensure your corporate records are maintained, which in turn helps preserve the reason you incorporated in the first place, your limited liability protection.

Your attorney should be a CONTRACT SPECIALIST: Just as you want to pick a doctor who specializes in the area of treatment that you need, the attorney for your business should be a business attorney. This is someone who is experienced in drafting the day-to-day agreements you’ll need in your business to protect your business. While this need obviously varies by business, having the correct documents in place can prevent a lot of problems. Offer letters, nondisclosure agreements, consulting agreements, and lease agreements are examples of fairly routine agreements most businesses will likely need. In addition to that, your specific business may need “custom” agreements, although these can often be modeled from existing agreements in order to control cost.

5. Your attorney should be a bit of a SKEPTIC: The right business attorney will be supportive of your ideas and your company’s goals; however, it’s also his or her role to be the skeptic. For example, in drafting a joint venture agreement between your company and another company, I not only draft the agreement to reflect the opportunity, but I review the terms from the standpoint of asking “what if everything that has been planned goes terribly wrong?” A good agreement not only anticipates success, but also provides the appropriate mechanisms in the event of failure. It is probably not surprising to hear that when a joint venture is failing, the parties are a lot less agreeable working out details. The bottom line is that your business attorney should be a good team member, bringing some skills and some perspective you may not have in your business. While cost can sometime keep businesses from bringing in that expertise, the right lawyer will not only work with you on the cost, but ultimately, should bring you more value than you pay. Using his Wall Street background, he has created a unique on-line game which he says will get more people than ever to donate. “The traditional fundraising model is dependent on the established donor base. In the on line game, Billion4Charity players can not only give, but also get. Participants buy a $5 ticket and say in 10 words or less why they decided to play. Their five dollar contribution goes directly to global causes and one winner of the game will be awarded one million dollars. Hill says the Billion4Charity winning Ambassador will then go on three missions around the world to see firsthand how the charities are using the donations. The Billion4Charity game serves as the focal point for a variety of charities. Hill says “the infrastructure provides a technology solution for reaching millions of people and providing exposure and information. The game is collaborative, technology driven, and fun!” The Billion4Charity foundation is more flexible than traditional charities, which gives them the ability to make major changes internally without layers of bureaucracy that prohibits direct implementation and execution of support. “When we come across a fundraising idea that we believe will generate a significant return on time, money, and effort, we can implement it immediately. We’ll let the market determine whether it is a good idea rather than going before Boards, Trustees, lengthy meetings and studies before the project can be launched.” Hill, 49, has a bond trading, structured finance and investment banking background. He has been involved with charitable work and volunteerism since his early years in college. Thinking he had a model that would encourage millions of people to play and could generate a billion dollars for many worthy causes inspired him…. thus, Billion4Charity was born. The million dollar award winner will be announced on July 19, 2015. Hill says the July 19th date is both unusual and significant for him. “It’s the late ESPN Sportscaster Stuart Scott’s birthday. He was my favorite of all time. He passed away from cancer in January. The fight against cancer is personal for me in another way; my mother is a cancer survivor.” The disease took others in his family including his grandfather. “As a Track & Field athlete and sports fan, I admired Stuart’s character so much that we felt compelled to make this statement.” To provide transparency and security for playing the game, they are using the largest money center bank in the world as custodian of the funds – Citibank. KPMG is the accounting firm that will provide a review of the transfer of money to the charities. The Billion4Charity Game officially launched on January 1, 2015. Kara, a grief organization, was one of the recipients. “Kara (karagrief.org) contacted me as the current Festival Chair in 2013 looking to partner with us,” she continued. “I absolutely loved what they represented and offered. This group touched my heart deeply because of the services they offer to people in need of grief counseling and care giving support.” There was hardly a dry eye at the October meeting when Kara’s Executive Director, Jim Santucci, came to the club to show his appreciation to the women for their grant. He spoke about his personal story of coming to Kara when his wife passed away in 2000 and how it helped him so much and how he was so impressed that he stayed to volunteer ultimately ending up in various management roles. “Kara offers support for those situations and many more. Grief comes in many forms and I am thankful to have an organization we partner with to help those in need. I will continue to support them,” Dawn emphasized.

FIFTY YEARS LATER Now in its 50th year, along with the club’s president turning fifty, plans are underway for special events throughout the year. As usual, the fall festival will be the main event. Committee chairs are selected at the beginning of the year and work together like a well-oiled machine to produce the largest event in 95120. UP AND COMING IN 2015 The club’s future looks solid. “I hope to see the club thriving and continuing an upward trend in growth and community partnerships along with developing new working relationships with non-profit groups such as the Rotary Club,” Dawn, a thirty-year resident of the area, said. “I look forward to the festival continuing to be a huge part of the fabric of Almaden Valley while supporting local business and the community.” Also the Web site will have a new look streamlining both the club and festival sites. It promises to be more user friendly and colorful, with a list of festival sponsors and updated photos. GIRLS JUST WANT TO HAVE FUN Being in an all-female club has its perks. The women enjoy a sisterhood bond that is fostered by game nights, parties and movie nights, with some events planned to include spouses. Every year new members are treated to a luncheon and introduced to the group. Good natured Councilman Khamis once posed as Bosley in a Charlie’s Angel’s photo spoof with new members. With a cadre of professionals, homemakers and retired women, AVWC is set to continue to enlarge their presence by working with the city and community alike. Everyone has their own personal reason to join the club, and like Dawn, it just takes one person to make a difference in another’s life.
