Deals page, and add their own special announcements and press releases to a live Member News portal. “For many businesses the summer months offer a lighter workload, but nothing is slowing down here at the Chamber,” said Director of Public Relations Katie Galvin-Surbatovic. “Our members have shared with us their struggle to run their businesses while finding time to attend regular networking

events. We have heard their concerns and have been busy brainstorming and developing some new ideas on how to offer more value to our members without them having to attend every meeting. As we move into the hottest days of the season, it is easy to want to sit back and enjoy “the lazy days of summer.” However, life and business continue as normal so it’s smart to prepare for the months ahead. Now is the time to do maintenance in your business, whether it be repairs, replacements of parts and materials, or educating your staff, and yourself, on new marketing ideas and knowing what is best for business. This leads me to the subject of “knowing your facts” and I am here to discuss the facts about your Chamber. As a society, we make the mistake of judging before having all the information. We allow those with the loudest voices to

sway our decisions and convince us that something is “bad for us” or “not what we need” when we haven’t even heard all the information. For the most part, the majority of readers and supporters of the Chamber understand what the Chamber exists to do. Our mission is to: • •

since it’s a like-kind exchange, he only has to recognize $15,000 of his gain: the amount of cash (boot) he received. Ted’s basis in his new building will be $100,000: his original basis in the land he gave up ($100,000) plus the $15,000 gain recognized, minus the $15,000 boot received. No matter how much boot is received, you will never recognize more than your actual (“realized”) gain on the exchange. If the property you are exchanging is subject to debt from which you are being relieved, the amount of the debt is treated as boot. The theory is that if someone takes over your debt, it’s equivalent to his giving you cash. Of course, if the property you are receiving is also subject to debt, then you are only treated as receiving boot to the extent of your “net debt relief” (the amount by which the debt you become free of exceeds the debt you pick up). Because the like-kind rules are very complex, and because the rules noted in this article are general, you should obtain counsel from your tax adviser before undertaking a like-kind exchange. You might be able to dispose of appreciated property without being taxed on the gain by exchanging it rather than selling it. You can defer tax on your gain through the “like-kind” exchange rules. A like-kind exchange is any exchange (1) of property held for investment or for productive use in your trade or business for (2) likekind investment property or trade or business property. For these purposes, “like-kind” is very broadly defined. As long as the exchange is real estate (land and/or buildings) for real estate, or personalty (non-real estate) for personalty, it should qualify. However, exchanges of some types of property (for example, inventory or shares of stock), do not qualify. If you are unsure

whether the property involved in your exchange is eligible for a tax-free likekind exchange, please call and we can discuss the matter. If it’s a straight asset-for-asset exchange, you will not have to recognize any gain from the exchange. You will take the same “basis” (your cost for tax purposes) in your new property that you had in the old property. Even if you do not have to recognize any gain on the exchange, you still have to report the exchange on Form 8824. Frequently the properties are not equal in value, so some cash or other (non-like-kind) property is tossed into the deal. This is known as “boot.” If boot is involved, you will have to recognize your gain, but only up to the amount of boot you receive in the exchange. In these situations, the basis you get in the like-kind property you receive is equal to the basis you had in the property you gave up reduced by the amount of boot you received but increased by the amount of gain recognized. Ex: Ted exchanges land (investment property) with a basis of $100,000 for a building (investment property) valued at $120,000 plus $15,000 in cash. Ted’s gain on the exchange is $35,000: he received $135,000 in value for an asset with a basis of $100,000. However,

After 11 public hearings at Historic Resources Commission, Planning Commission and City Council, the Council unanimously approved the Lincoln Specific Plan for the former Fred C. Nelles site. The project brings a number of benefits to Whittier including: • • • • • •

750 new quality homes Up to 208,000 square feet of new sales tax generating retail space A $1.75 million development agreement fee Age targeted single-family and multi-family housing $1 million per year in net revenue to City after paying for police and other City services $3 million in park fees

In addition to this great news, other development is moving forward around town. Chick-Fil-A has submitted plans to demolish the old Johnny Carino’s site and build a new restaurant at the Whittwood Town Center. This month, the Planning Commission considered a development proposal at the former Saturn site which includes both Applebee’s and Starbucks. Vallarta

Market will open at the Quad August 19th and recently held a job fair to hire local residents for 200 jobs. Uptown will be the center of a great deal of growth in the near future with the City Council already designating millions of dollars from redevelopment bond proceeds toward infrastructure improvements to build capacity for future development. The City Council held a ribbon cutting in July for the new Founders Memorial at Founder’s Memorial Park. After the memorial was destroyed by vandals who stole the bronze plaques, the City rebuilt the memorial with granite plaques listing the names of those interred at the historic cemeteries. Rose Hills Memorial Park contributed to the project and the memorial is now surrounded by roses in memory of these early residents of Whittier. Whittier values our history and we are very proud of the fact that we have an active historic resource preservation program that adds benefit to the community. In July, the City Council designated 61 residential properties with local historic landmark status. Thank you to all who joined your neighbors at the City’s Fourth of July flag raising ceremony and freedom walk at Palm Park and the Whittier Greenway Trail. The City Council honors and appreciates veterans and active service military personnel who are committed to keeping our country free. Remember to say thank you this week to the military veterans in your life!

Back to school time is exciting for many people, from kindergarteners to college students, as well as parents and school staff. Back to school time is also an exciting time for criminals who exploit unsuspecting victims as streets fill up with students carrying valuables, and school parking lots fill up with vehicles. The following list contains various tips on making your school year a safe one: • Be sure your child knows his or her home phone number (including area code), address, your work number, the number of another trusted adult, and how to use 911 for emergencies. • Plan a walking route to school or the bus stop. Choose the most direct way with the fewest street crossings. Test the route with your child. Tell him or her to stay away from parks, vacant lots, fields, and other places where there aren't many people around. • Teach children - whether walking, biking, or riding the bus to school - to obey all traffic signals, signs, traffic officers. Remind them to be extra careful in rainy weather. • Make sure they walk to and from school with others - a friend, neighbor, brother, sister. • When car pooling, drop off and pick up children as close to school as possible. Don't leave until they have entered the school yard or

building. Parents please follow all school valet drop off and pick up plans. Teach your child never to talk to strangers or accept rides or gifts from strangers. Remember, a stranger is anyone you or your children doesn't know well or doesn't trust. If your child is home alone for a few hours after school: Set up rules for locking doors and windows, answering the door or telephone. Talk about what activities your child can and cannot do while home alone. Make sure he or she checks in with you or a neighbor immediately after school. Agree on rules for inviting friends over and for going to a friend's house when no adult is home. Take time to listen carefully to children's fears and feelings about people or places that scare them or make them feel uneasy. Tell them to trust their instincts. Take complaints about bullies and other concerns seriously. Teach you kids to stay alert when they walk to and from school. This means refraining from listening to music in both ears and always watching for suspicious persons or vehicles. If you choose to send your kids to school with valuables such as ipods, ipads, laptops, smartphones, or expensive jewelry, ask them to keep the items hidden in a backpack as they travel to and from school. They should also keep a close eye on their property throughout the day. If you park your vehicle at school, make sure the alarm is on, all doors are locked, and all valuables are removed from plain view.

WHAT’S COOL IN YOUR SCHOOL Whittier Union Teachers Learn New Strategies, Share Successes in the Classroom In anticipation of another rigorous year at the Whittier Union High School District, instructors are spending their summer months attending professional development workshops at the Sierra Education Center, breaking into teams and setting an ambitious agenda designed to continually enhance teacher development and student achievement. The District-wide summer professional development program involves five week-long district team sessions along with site team planning days. Both the District and site teams work on modifying and refining common assessments, incorporating technology and sharing effective classroom strategies. This work will help prepare students for the Smarter Balanced tests, which assess students’ understanding of content under the rigorous California Standards. All 11th-grade students will complete the exams in the spring. “The professional development workshops are teachers teaching teachers, evaluating what has worked in the classroom, sharing successful instructional methods and identifying areas where students need additional support,” said Carlye Olsen, Director of Accountability, Staff Development and Curriculum. The summer sessions, now in their eighth year, are a traditional Whittier Union activity and have proved very effective in helping the District increase graduation rates and close the achievement gap. As Whittier Union continues implementing the new standards, teachers are continually being challenged to help students reach deeper levels of understanding of the core subjects – social studies, math, science, English and world language. The sessions provide a blend of new information, independent reflection and open discussion in which teacher groups working across school boundaries assemble to brainstorm ideas, share resources and discuss instructional strategies. Teachers learn from those whose classes or departments showed

promising achievement on previous assessments. “It’s a simple concept: teachers learn more, students learn more,” Olsen said. “We trust the collaboration and have seen amazing results because of it.” The program is facilitated by Olsen and Dan Esquerra, Coordinator of Curriculum and Assessment, along with a team of teacher leaders, called support coaches, who assist their colleagues with the intricacies of collaborative work. During a session over English week, teachers sat in small groups, talking animatedly about blending Google Classroom platforms into their curriculum, while researching and creating sample audio questions – the type which is used on the new standardized tests. “The District really embraces collaboration,” said Martin Mathews, a science teacher at Pioneer High School and a Curriculum Assessment Coach. “We facilitate discussion and disseminate information among the teacher leaders and their teams. They set their own agenda for the week, eager to implement new innovations into their classrooms.” Though the meetings are not mandatory, the participation rate among teachers is exceptional; last year, Whittier Union High School District teachers spent more than 13,800 hours in these summer sessions, with

The contest, which will feature a popular “People’s Choice” award, is open to all high school students and will be judged by local artist, Marti Wilson. Employers Must Have Policy in Place to Cap Sick Leave Benefit at 3 Days Clarifying California’s Sick Leave Law In the midst of much misinformation and confusion, July 1 marked the day California employers were required to begin providing paid sick leave benefits to their eligible employees. The California Chamber of Commerce is providing resources to help employers understand and comply with the new sick leave mandate. A video, white paper, and fact sheet are available at www.calchamber.com. Sick Leave Policy Important “There is a lot of misinformation about what this law requires,” said CalChamber President and CEO Allan Zaremberg. “This is not a straightforward requirement of three days of leave per employee as many have suggested. “Rather, employers must create a policy addressing the amount of leave they are providing or else they will be subject to the statutory mandated accrual rate of one hour of sick pay for every 30 hours an employee works. “This means that if employers are not clear about capping their leave at three days, full-time employees will be entitled to 69 hours of paid leave per year and they will be allowed to carry that over to the next year, and so on. This is nearly nine days—not three—if the employee works a 40-hour workweek. It is critical that employers understand that they must have a policy in place—preferably in writing—that clearly communicates to employees about the amount of leave they are providing.” Small Employers Included In addition, it is important to note that the law applies to private and public

employers regardless of size; there is no exception for small employers. Any employee who has worked in California for 30 or more days within a year from the beginning of his/her employment will be entitled to paid sick days. Notice/Posting/Recordkeeping The law also includes several notice, posting and recordkeeping mandates. • Pay-Stub Notice: An employer must provide an employee with a written notice setting forth the amount of paid sick leave available to the employee each pay period. An employer can provide this notice to the employee either on the already-required itemized wage statement or in a separate written document provided to the employee with the payment of wages. • Wage Theft Notice: The Wage and Employment Notice (Labor Code Section 2810.5), which employers have been required to provide to nonexempt employees since 2012, has been updated by the Labor Commissioner to contain information about an employee’s right to accrue and use paid sick leave and about employee

protections under the law. The updated Wage Theft Notice is available on the Labor Commissioner’s website and also on HRCalifornia.com. • Poster: There is a new required poster advising employees of their sick leave rights. The Labor Commissioner has released the poster, and it’s available on the Labor Commissioner’s website. Purchasers of CalChamber’s 2015 California and Federal Employment Notices Poster will receive this posting. • Recordkeeping Requirements: Employers will need to keep records for at least three years which document the number of hours that each employee worked and paid sick days accrued and used by each employee. California’s new sick leave law also carries consequences for noncompliance. If employers do not comply with the new law, they can face Labor Commissioner enforcement measures that include awarding back pay, damages and penalties up to $4,000. The law also specifies that employers are prohibited from retaliating against employees who take sick leave.

Chamber Members Team Up to Support Special Olympics World Games Last month the City of Whittier was honored to be chosen as an official Host Town for athletes participating in the 2015 Special Olympics World Games. 118 athletes and delegates from Macau, China received a warm welcome from the community with a parade and special presentation at Whittier City Hall, followed by a visit to the Whittier Museum and a Concert in the Park. The next two days were spent touring the city before participating in the World Games at the Los Angeles Coliseum. 14 Alcohol businesses in Whittier commit to prevent underage drinking Fourteen alcohol businesses proudly display stickers which read “I am a MERCHANT COMMITTED to stopping underage drinking” and “I am committed to not selling alcohol to anyone under the age of 21.” Preventing underage drinking is everyone’s responsibility and off-sale retailers (e.g. liquor stores, markets, convenience stores, and gas stations) are the first line of defense in stopping the sale of alcohol to minors. SPIRITT Family Services (SPIRITT) is one of five non-profit organizations in Los Angeles County Service Planning Area 7 (SPA 7) funded by the Los Angeles County Department of Public Health, Substance Abuse Prevention and Control to decrease underage drinking in Los Angeles County. Rather than look at the individual drinker as the focus of prevention efforts, this

grassroots environmental approach looks at settings and circumstances in which youth obtain and use alcohol. The 14 businesses that have committed to prevent sales to persons under 21 and to “Be a Good Neighbor” in the city of Whittier include Green Dollar, Grog Shop on Colima Road., Grog Shop on Leffingwell Road., Ten Four Liquor, Lucky Liquor Store, Bailey’s Beverage Corner, Uptown Liquor, J & L Wine & Spirits, Helen’s Market, California Market, Espinoza Produce, Bakers Liquor, Party Snacks Liquor, and Uptown Market. Initial data collection efforts in Whittier found that approximately 25% of young adults said they “knew of a store in their neighborhood that sold alcohol to underage youth.” About 80% of young adults indicated they “could get friends of age to purchase alcohol”

for them, and 47% said that alcohol was somewhat or very easy’ to get. In addition, research shows that stores are a source for youth access and use through direct sales, ‘shoulder taps’ and alcohol theft or ‘beer runs.’ Taking these findings as a starting point, SPIRITT implemented a community-level prevention initiative aimed at supporting best practices for off-sale alcohol outlets through the 8– Step Retail Framework. While off-sale outlets may contribute to the prevalence of underage drinking, they are also an important resource for employment, tax revenue, service and convenience for the city and community. In an effort to encourage responsible business practice, SPIRITT invited offsale retailers to sign up as participants to the “Merchant Committed to Stopping Underage Drinking,” “Committed to Not

Selling Alcohol to Anyone Under the Age of 21,” and “Be A Good Neighbor” programs. A “Good Neighbor” is a business committed to following Alcoholic Beverage Control (ABC) regulations and Retail Operating Standards. The prevention campaign was made possible through the support of the Whittier area Drug & Alcohol Abuse Prevention Community Council (PCC), Ms. Nancy Felix, Children’s Happy Teeth, Whittier Police Department, and the California Highway Patrol. Next time you visit your local market or off-sale alcohol retailer, ask if they are Merchant Committed and Good Neighbor retailer and look for the stickers which read “I am a MERCHANT COMMITTED to stopping underage drinking” and “I am committed to not selling alcohol to anyone under the age of 21.”

National Survey: Kids’ Healthy Habits Decline During Summer When kids are out of school, they can face hurdles that prevent them from reaching their full potential. Nationwide, the Y helps over nine million youth to hop gaps in hunger, health, learning, water safety and safe spaces. As part of this nationwide approach to nurture the potential of youth, the YMCA of Greater Whittier provides a place to stay healthy, build friendships, and achieve more – all while having fun! According to the YMCA’s Family Health Snapshot survey, conducted in partnership with the American Academy of Pediatrics Institute for Healthy Childhood Weight and based on responses of nearly 1,200 parents of kids ages 5 to 12, 64 percent of parents reported that their kids spend three or more hours per day online, playing

video games, or watching TV during the summer. That’s a 30 percent increase compared with results for during the school year. Only about half of the kids get at least 60 minutes of daily physical activity during the summer. “Without access to daily lessons, enrichment, and exercise, kids are at risk of falling behind during the summer months,” said Lori Tiffany, Vice President and Executive Director of the Uptown Whittier YMCA. “This summer, we’re helping parents turn their good intentions into reality with programs designed to strengthen their kids’ minds and bodies and keep them on track for good health and academic success year-round.” The YMCA of Greater Whittier, fiscal administrator of Activate Whittier, recommends that families follow the
