Misor guv pays tribute to slain councilor

“HE was one of the most sincere people I know. He goes beyond everything a politician is because he was a true friend. Even when he had the authority, he never asked anything for himself, but rather what was for the greater good of the greater number of the people of Gingoog City.” With voice choking of emotion within him, Misamis Oriental Governor Yevgeny Vincente Emano narrated how proud he was to have met in his lifetime a person as sincere and honest as the former Kagawad Marc Bagaipo, whose life was cut short by an assassin’s See tribute, page A11

De Lima: US did not transgress PH sovereignty JUSTICE Secretary Leila de Lima on Wednesday said the limited involvement of the United States in the January 25 secret police mission to get two wanted international terrorists holed up in Mamasapano was covered by existing bilateral agreements and did not transgress Philippine sovereignty. Appearing at the House joint probe into the Mamasapano incident, De Lima also pointed out that the U.S. participation, which was limited to intelligence sharing and medical evacu-

ation of wounded Special Action Force commandos, was well within the bounds of the Constitution. “The bottom line always is the ability of the Philippine government to determine the extent of U.S. involvement and the full exercise of its control in making the decisions as to what, who, when and how of a particular operation,” De Lima told lawmakers. “So long as these considerations are met and absolute Philippine control is exercised all through-

out, there can be no argument that U.S. involvement has transgressed any of the constitutional and legal boundaries on foreign participation in Philippine military and law enforcement activities under the facts so far established in any of the investigations,” she said. De Lima said the presence of the American troops in Mindanao was covered by the Visiting Forces Agreement (VFA) and the Mutual Defense Treaty (MDT) with the U.S.

“Foreign affairs is the primary jurisdiction and core competence of the executive branch of government and therefore the President, as Chief Executive, may enter into agreements that do not need concurrence of the Senate as treaties for purposes of enhancing international cooperation in global law enforcement, specifically against terrorist threats and especially if such threats find sanctuary through the back doors of the See transgress, page A11

Security guard indicted of murder for death of ex-lover’s son

D

By Jessie L. Casalda

AVAO CITY - The City Prosecution Office (CPO) has filed murder charges in court against a security guard tagged in the brutal killing of a nine-year-old son of his former girlfriend due to jealousy.

In a resolution approved on Monday by Davao City Prosecution Office Officerin-charge Victor Sepulveda, assistant city prosecutor Panfilo Junior Lovitos found

sufficient grounds to hold Crispel Perote Rosalita, 33, for trial in court for the death of Jhondhyle Mora Barrios, 9. Lovitos anchored his

resolution on the testimony of the witnesses who were neighbors of the victim. Court records showed that at around 1:30 in the morning on March 29, 2015, witnesses saw Rosalita walking towards the house of the victim located at Purok 38, NHA, Ma-a, Davao City. At around 2:00 in the morning, Rosalita was seen by a witness jumping from the window of the victim’s house and minutes later, heard someone crying and

shouting for help. The boy was the son of Rosalita’s former girlfriend Dissere Mora, 28. Rosalita and Mora were live-in partners for almost three years until they parted ways in 2014. In a separate affidavit, Mora said at around 12:45 in the morning while she was on her way home on board their company’s service vehicle, she noticed that Rosalita, riding a motorcycle, was tailing them and then overtook their vehicle

and stopped at the roadside then stared at her. Fearing for her life, Mora instructed their driver to turn back and proceeded to McDonalds where they spent some time and ordered some food for her children. At around 2:10 in the morning, Mora said she received a call from her niece informing her about her son’s fate, thus, she immediately went home. In a follow-up operation, the suspect was arrested by the Talomo Police opera-

tives at round 5:30 in the morning at his residence in South Villa Subdivision in Maa. Mora said Rosalita admitted to her that he killed her son due to jealousy. Mora added Rosalita also told her that he waited at her residence but she did not come home and out of anger, he entered the victim’s house through the window and killed the boy. Mora said the suspect wanted to get her back but she refused. (PNA)

Land claims hound Davao City’s sports complex project DAVAO CITY — The city should consider looking for another location of its sports complex instead of building it inside the University of the Philippines Mindanao campus due to unresolved land claims over the area, an official said Tuesday. Vice Mayor Paolo Z. Duterte told reporters the proposed site, a 20-hectare lot inside the campus, would affect the claimants at Sitio 117, Bago Oshiro. There are 32 land claimants at UP Mindanao but it was not clear if all of them live within the 20-ha site. LET US PURSUE PEACE, JUSTICE AND RIGHTEOUSNESS IN OUR LAND

PCEC Statement on the Current Situation in our Land

As followers of Jesus Christ, the Philippine Council of Evangelical Churches (PCEC) envisions to help transform our nation. Our faith allows us to see a land “where peace, justice and righteousness reign.” Our hope moves us to help build communities “where everyone has a decent standard of living.” Our love compels us to share the Good News of Jesus Christ in a society where every person and every community is free to express and practice their worldviews, while respecting the worldviews of others. As we face various challenges in our country, especially in the aftermath of the Mamasapano Tragedy, based on our biblical perspectives on truth, mercy, justice and peace we make the following calls: :: We call for the truth about the Mamasapano Tragedy. We support the on-going investigations by the government, by the Moro Islamic Liberation Front, and by independent bodies, like the interfaith fact-finding initiative, who would make credible presentation of the facts. We reject the irresponsible conjectures of some sectors who misuse this case for their personal interests. Instead, we expect a truthful, prompt, and just closure of this case that will bring healing to all concerned and to the whole nation. :: Because we envision a peaceful, long-term social transformation we call on President Benigno S. Aquino III to finish his term. We are concerned that some individuals and groups in our society are using the said Mamasapano Tragedy to call for the resignation of President Aquino. We do not support such call. We call instead on the President to rise above the current situation and to press on toward the goal of a good, transparent, just, and peace-oriented governance. :: As we hear of the ‘all-out-offensive’ of the Armed Forces of the Philippines (AFP) against the Bangsamoro Islamic Freedom Fighters (BIFF) and the Abu Sayyaf Group (ASG) in various parts of Mindanao, we call on all parties to make the safety of civilians their primary concern. These armed clashes have resulted to the displacement of more than

75,000 persons. We are concerned that these might actually escalate into an all-out-war, as is the nature of most armed conflicts. Instead, we support the call for an #AllOutPeace being advanced by various civil society organizations all over Mindanao and throughout the Philippines. :: We call on both the Government of the Philippines (GPH) and the Moro Islamic Liberation Front (MILF) to continue the Peace Process. We will continue to discern and process the implications of the Bangsamoro Basic Law (BBL) as we help advance the kingdom of God in Mindanao and in our society as a whole. Along with other peace advocates throughout the country, we will continue our active participation in this process through our Peace and Reconciliation Commission. “Surely his salvation is near those who fear him, that his glory may dwell in our land. Love and faithfulness meet together; righteousness and peace kiss each other. Faithfulness springs forth from the earth, and righteousness looks down from heaven. The Lord will indeed give what is good, and our land will yield its harvest. Righteousness goes before him and prepares the way for his steps.” Psalm 85 BISHOP NOEL A. PANTOJA National Director Philippine Council of Evangelical Churches - PCEC Philippine Relief and Development Services - Philrads -- PCEC is the largest network of evangelical denominations, local churches and parachurch and missions organizations in the country which seeks to disciple the Philippines for the Lord Jesus, and thereby help establish a society where peace, justice and righteousness reign; where everyone has a decent standard of living; and where Christ is recognized as Lord and Savior of all.

The country needs a new national political party With a limping leadership, the presidential and local elections in 2016 could be the worse for the ruling Liberal Party (LP) in the country. At the outset, every aspiring candidate and supporters would scramble in the search for a new, credible, and dependable political party in the national context. The 2016 presidential elections would have been ripe for the Nacionalista Party (NP) to regain its status as one of the country’s reliable political organizations in the national and local level. However, with partymates without solid political loyalty, the Nacionalista Party would be another candidate for the dustbin. Thanks to the former Senator Manny Villar, the NP president, who sold the soul of one of the country’s enduring political party to the LP in the 2013 senatorial and local elections. Today, the NP persona has lost its value and has shattered the dreams of the country’s “nationalist” virtue. What seemed to be the only alternative to attain a political change and governance that the NP could possibly carry out with

effectiveness have become a whisper in the moon. Undoubtedly, the Filipino people need a political party that would otherwise cultivate a new political value. There were various attempts in the past, like the formation of the Pwersa ng Masang Pilipino (PMP), an ambitious political party that would cater largely to the needs of the impoverished Filipinos. However, the political elite smells the filth of those living in squalid communities that the only recourse then was to send the PMP’s figure head to prison. As a result, the elite political party of the Lakas-Kampi sent President Erap Estrada to prison on trumped-up charges. A mixture of elite and the struggling political personalities also formed what could have been a formidable national political party: The United Nationalist Opposition (UNO). Organized in 2007, UNO was a coalition of the PMP headed by Pres. Erap Estrada and the Partido Demokratiko Pilipino – Lakas ng Bayan with Vice President Jejomar Binay as the party President. Although the UNO did not last long, there is now

The CYNOSURE

an attempt to form a new political opposition party: The United Nationalist Alliance (UNA) headed by VP Binay. The UNA is formed in preparation for the 2016 Presidential and local elections where Binay is running for President. The reorganization of the UNO and the formation of the UNA is necessary to weed out partymates whose alliance with the opposition is questionable. There is no question that some incumbent elected officials – in the Senate and in the locality – are “political opportunists.” These political leeches are no more than “political turncoats” who would always jump, albeit with callousness into the wagon of winning

Wow, the power of one or two words spoken in one second with sheer gratitude has the capacity to provide hope and change lives sometimes dramatically. We never know how a heart felt word or

political parties. While the character is prevalent in the locality, the same is true at the national level. Thus, perhaps, VP Binay should see to it that the UNA would not be infiltrated by political tyrants who would definitely sell the party’s principle. One should know that the UNA has a formidable support by various opposition political parties at the local level. As far as one could remember, there are more than 20 local opposition groups throughout the country that are now fully supporting UNA. This is the reason that Binay’s popularity as a presidential candidate has not wavered in contrast to the popularity of other presidesidential bets. We understand that more than half of the incumbent senators are now threatened that their re-election in the 2016 polls is now in now hanging in the balance. These senators are certified turncoats, and political opportunists who won their seats because of the support of the opposition. This column will definitely mention the names of these senators in the coming days. -0- react: crisguardian@yahoo.com

two can plant the seed of gratefulness in this around us. By pairing those words with a smile much sunshine and a sense of worth can shine into the lives of those experiencing a struggle of darkness or an emptiness of spirit. God supplies much to all if we are willing to share His gifts with others. God must have invented multiplication and he counts on us to distribute his gifts.

S. Maclang , of the Branch 1, Regional Trial Court, 10th Judicial Region; PCI Amadeo A. Meude, Jr. of the Philippine National Police XIII; Exec. Dir. Arnold L. Tapere of Propegemus Foundation, Inc. and Dir. Mary May R. CadosalesDiaz of the Educational Discipline in Culture and Area-Based Development Services, Inc. (EDCADS). Three major criteria, to wit (1) efficiency in operations, (2) effectiveness

in securing Katarungang Pambarangay (KP) objectives, and (3) creativity and resourcefulness of the Lupong Tagapamayapa were followed in the assessment. T h e Lu p o n g Ta g a pamayapa Incentives Awards (LTIA) was established since 1997 as a means to institutionalize a system of granting economic benefits and other incentives to the Lupong Tagapamayapa that demonstrates exemplary performance in settling disputes at the grassroots level. These Lupons, comprising of the Punong Barangay as chair and 10-20 members, are based on the mandate of the barangays to enforce peace and order and provide support for the effective enforcement of human rights and justice as stipulated in Republic Act 7160, otherwise known as the 1991 Local Government Code. Decentralization has facilitated the recognition of the Katarungang Pambarangay or Barangay Justice System as an alternative venue for the resolution of disputes.

Butuan Bishop tells inter-faith crowd: ‘Be the first to love…’

BUTUAN City -- Most Rev. Juan de Dios M. Pueblos, bishop of the Diocese of Butuan, tells hundreds of inter-faith crowd gathered on Black Saturday as part of the city Lenten celebration composed of youth, priests, nuns, church leaders, military, police and representatives from the government agency, academe and media to be the ”first to love…” Bishop Pueblos was the main speaker of the ecumenical gathering for worship and prayer initiated by the Diocese of Butuan in partnership with the Butuan Evangelical Ministerial Association, Inc. (BEMAI) and the United Church of Christ of the Philippines (UCCP) dubbed as “Butuan Youth Arise” at Guingona Park, 4:00 a.m. Saturday. Seen also attending the

event were contingent from the 402nd Philippine Army Brigade led by its commander Col. Isidro Purisima and the staff of the Philippine Information Agency 13, led by Regional Director Abner Caga. The event started with praise and worship songs led by the “Love and Mercy” Community Charismatic Worship Team and the “Jesus Is Lord” Worship Team. Bishop Pueblos during his message praised God for sparing the region from typhoon “Cheding” and blessing Caraga region with fine weather during the observance of the Lenten season. He challenged everyone present to heed what Pope Francis said “To live the faith… everything should be part of our faith.” According to him that living the faith should

start from the family. He said that the family has a vital role in molding good character of its members in order to create a strong community. He said that in the basic ecclesiastical communities (BECs) under the diocese, no drug problem has been noted. “Parents must always be there to give love, care and constant guidance for their children…let us create a new and vibrant future that is free from corruption. We should start to reflect and renew our commitment to catalyze a positive change, starting from own selves,

tation in the area, left it to the care of the residents, he said. In 1997, after the UP Mindanao campus was established in the site, the government has deprived the residents of their rights to the lots they have been occupying, he said. He stressed the residents would only leave the area if their livelihoods can be assured. According to the 1997 Memorandum of Agreement between the city and UP, the university would be responsible in relocating the claimants. Budget not assured Duterte said he questioned the funding terms for the proposed P8-billion project, citing that the initial disbursement from the GAA approved last year only amounted to P200 million. He added there was no assurance from the national government that the project could be continued after the initial phase of the construction. The city council learned that in 1997 the city gov-

ernment, through Mayor Rodrigo R. Duterte, signed a MOA with UP Mindanao for the creation of the sports complex. The council referred the item on the proposed complex back to the committee on rules and privileges after getting hold of the 1997 MOA on the project. “The problem with this item is that we keep on talking about the P200 million, when the total amount of the project is P8 billion,” Duterte noted. “But the project will affect some residents. Why should we add to their problems? … If we can, we should consider using the funding to purchase a lot and develop the sports complex there,” he said. The vice mayor said the city should not just think of relocating the residents to 100-square meter lots, for example, if they have been tilling lots as huge as two hectares each. “The committee should consider other factors.” He added the city should not rely on national government funding for the project. Mayor Climaco cites police commitment vs illegal drugs

AMBOANGA CITY -- Mayor Beng Climaco extolled members of the Zamboanga City Police force for their dedication and commitment in anti-drug operations even as she urged them to never back down notwithstanding threats from lawless groups. The mayor said she can see and feel the fervour and eagerness of police authorities to pursue the campaign amidst the numerous threats, most evident of which was the blast near the Ayala Police Station on Good Friday. Post blast investigation revealed that the incident that was triggered by an improvised and explosive device lobbed/placed at an abandoned vehicle near the police station was drugrelated. “We commend the PNP operatives for the strict conduct of drug buy bust operations as the enemy

is very powerful and very moneyed,” Mayor Climaco said stressing “we have to push for drug buy bust operations and incidents like these (blast) should not

The city government, she reassured, is closely working with the police in this aspect and will not tolerate the rampant spread of drugs in the city as this will vic-

timize innocent people and contribute to the escalation of crime incidents. “We want this stopped because once a member of the family is infected by the drug menace, the entire family suffers, there is loss of money, loss of trust and loss of confidence and rehabilitation is very difficult,” the mayor stated. She expressed support to the planned drug summit and appealed to the media to help strengthen public awareness on the control and prevention of use of drugs. (Sheila Covarrubias)

GENERAL Santos City -The Department of Agriculture (DA) has released an initial grant of P24 million for the rehabilitation and upgrading of a priority farm-to-market road in Malapatan town in Sarangani Province. Sarangani Gov. Steve Chiongbian Solon said Tuesday the grant will fund the initial phase of the 8.1-kilometer Lun Masla-Kinam road concreting project in Malapatan. Such funding will be utilized for a 2.6-kilometer stretch of the road, which leads to vast agricultural production areas in Barangay Kinam and other upland villages in Malapatan, he said. “We’re very grateful to the national government for this grant as it will help a lot in the development of the area,” the governor said. Solon said the DA approved such funding under the infrastructure development component of its food security program. He said the project will mainly be funded by the DA grant and additional counterpart funds from the municipal and provincial governments. It will be supervised by

the provincial government, through the Provincial Engineer’s Office (PEO), in coordination with the DA. Engr. Jerry Belbider, Sarangani PEO head, said the DA regional office has already approved the project’s plan and issued a certification regarding the availability of the allotted funds. He said the project’s bidding was conducted last week by DA Region 12 in Koronadal City. “We will implement the project as soon as its contract is finalized and awarded to the winning bidder,” he said. Aside from the food security grant, Belbider said they have submitted a proposal to DA for an additional P50-million funding to facilitate the completion of the road project. He said they specifically sought for the inclusion of the project into the infrastructure development component of the Philippine Rural Development Program. Belbider said the additional funding will cover for the concreting of the remaining 5.5 kilometers of the road project. (MindaNews)

BECAUSE there are simply too many activities to enjoy this summer, this is already the third stretch of a column that I’d want to share the activities around CDO and neighboring places that are ideal for vacationers who are out of school. For starters, Museo de Oro is offering summer art workshops for kids which are separated by age bracket. Five to eight-year-old ones get the kiddy art lessons half a day within 11 sessions from April 11 to May 5. Kiddies aged nine and above will have a separate session while those who want to enhance their talents more may opt to continue with the advance stage. The resource persons

will be Errol Balcos, Michael Bacol, Jake Vamenta and Nonoy Estarte. Registration fee is P2,000 per person and that’s inclusive already of one piece canvas for painting. For inquiries and registration, please look for Oscar Floirendo at Museo de Oro. The culminating exhibit of the graduates will be on May 9. Meanwhile, R Productions a whole month of Summer Art Workshop for only P1,500. The first batch has already started learning. But there’ll be another batch of enrollees to start on May 4. They’ll end their session by May 29. For the whole duration, they’ll learn basic art, pastel application,

watercolor, anime, acrylic painting, portrait sketching, t-shirt painting and sculpture. If interested, just drop by their registration desk near Limketkai Customer Service. For those fresh grads who will be taking their civil service exam this May 3, then good luck to you. Feeling kinda nervous? How about going to the spa to have some soothing massage. There’s a new one in town. It’s called Elysium Body Massage and it’s located at the third floor of RA Uy right beside that DVD house. Because it’s still new, they still have five percent off from regular rates. Speaking of Elysium, I wonder if South African ac-

claimed director Neil Bloomkamp will revive a sequel for that movie? Hmm…. that’s still eons down the lane. Meanwhile, enjoy the following movies as they will hit theaters this summer – Avengers: Age of Ultron, Hot Pursuit, Mad Max: Fury Road, Tomorrowland, Poltergeist, San Andreas, Spy and Insidious: Chapter 3. Speaking of Insidious, I now remember Monina Cadangan who used to work at Sun. Star and who’s now an OFW. She was my movie date that evening when Insidious 1 was shown here in CDO. I could still hear the screams ringing in my left ear. That was in 2011 when there was no Centrio cinema in Dolby

Fresh Gospel of the day (April9, 2015-Thursday) Luke 24:35-48”They began to relate their experiences on the road and how He was recognized by them in the breaking of the bread. While they were telling these things, He Himself stood in their midst and said to them, “Peace be to you.” But they were startled and frightened and thought that they were seeing a spirit. And He said to them, “Why are you troubled, and why do doubts arise in your hearts? See My hands and my feet, which it is I myself; touch me and see, for a spirit does not have flesh and bones as you see that I have.” And when He had said this, He showed them His hands and His feet. While they still could not believe it because of their joy and amazement, He said to them, “Have you anything here to eat?” They gave Him a piece of a broiled fish; and He took it and ate it before them; they began to relate their experiences on the road: The worst of the two disciples, they forgot the words of promises of Jesus for them. This means that in time of troubles and doubts recall and remember the miraculous works of God in your life in the previous events of your journey for you to be fueled by the passion to move forward. This was the mistakes of these two men because they focused on the death of Jesus but never to his promised resurrection. They were very emotional at the time and made them coward to face the truth of Jesus fortune in Israel. bullet a week ago. “In the entire span of our friendship, I have never heard of a person who Marc has taken advantage of; or hurt; or stolen anything from. Whenever he comes to my office, I know he would request for something, but not for himself,” Emano said in his eulogy. Talking like a father to the orphaned daughters of the former kagawad, the governor told the children to be proud of their father. “You can look anyone you meet on the street straight into their eyes with pride because you have a father who cared and loved the people he served,” Emano said. The governor pledged to Kagawad Bagaipo’s family that he will do everything in his power to find justice and bring the suspects to court. “I will use every power and authority in my office until justice is done to the senseless murder of my friend,” Emano said. Some four thousand residents of Gingoog and nearby towns joined in the two-kilometer funeral march of the former Kagawad last Monday. The governor, along with the department heads of the provincial government and friends of the deceased working at the capitol, travelled to Gingoog City to attend the said funeral.

The DOJ chief also cited the 2002 Supreme Court ruling in Lim vs. Executive Secretary which, she said, “painted the allowable activities for joint military cooperation in broad strokes.” “It states that the VFA contains no enumeration or limitation of what activities would be covered by the (agreement) and provides only the broad limitations that must be approved by the Philippine government and that they must not be inconsistent with the spirit of the agreement, which is cooperation,” De Lima said.

In the same hearing, De Lima insisted that President Benigno Aquino III is not covered by the chain of command within the Philippine National Police (PNP). “In my reading of the Constitution and law, the principle of chain of command does not strictly apply insofar as the President is concerned,” De Lima said, noting that President’s relationship or dealings with the PNP is not as commanderin-chief but only as chief executive. “It is in the same manner as the chief executive over all executive offices and departments. We all know that in a civilian agency or in a civilian organization, chain of command is not there,” she said. A report from Cielito M. Reganit of the PNA

LATO CDO held another successful pop-up dinner recently at 99 Ranch, its second successful one. This time, the collaborating chefs were JJ Javier, Chino Mempin, Ryan Rivero, Pink Floyd Pepito, Sara Concepcion and Ai Tacastacas. The nine-course dessert consisted of boquet de gulay, dapper snapper, champorado inspirado, imbao ceruela, creeping cucumber salad, prawn with taro, coal-kissed beef, caramel house ice cream and mango float. To understand more on what a pop-up setting looks like, it was conceptualized abroad for young chefs to gain exposure of their skills beyond what is offered in the restaurants that they are employed with. As a result, the experimental dishes that they offer are the primary reason for their popularity. And Plato CDO wants to replicate that here. Also in a popup setting, diners typically make use of social media to make online reservations. That’s exactly what Plato CDO did. What’s striking about these courses is that each ingredient is available fresh and local. Well that’s what Plato CDO is all about. Missed the two pop-ups? The third one is coming up pretty soon.
