President’s Message REALTORS® Code of Ethics- 100 Years Old millions of Americans. In fact, the National Association of REALTORS® (NAR) was founded by real estate practitioners determined to unite the profession with the singular goal of establishing high ethical standards to protect buyers and sellers.

Donna Zerega, 2013 President “Under all is the land,” begins the Code preamble which sets forth the social responsibilities of REALTORS®.

The Code identifies professional responsibilities owed to clients, customers, other REALTORS® and the general public in its three sections. The Code commits REALTORS® to be honest with all parties in the transaction, to put clients first, to be forthcoming with all parties and to be truthful in advertising and communications with the public. Buyers and sellers need to be able to depend on REALTORS® to act with their best interest in mind as they make major decisions affecting every aspect of their lives.

When added to the Code in 1974, Article 10 mirrored federal fair housing and employment laws, including amendments incorporated in 1989. In 2010, REALTORS® moved beyond the existing federal classes to ensure equal services without regard to sexual orientation. The Code’s preamble tells REALTORS® and the public we serve that “… the interests of the nation and its citizens require the highest and best use of the land and the widest distribution of land ownership.”

In addition to their work with local governments and their communities in creating housing opportunities,

REALTORS®’ commitment to Article 10 and to fair housing ensures equal professional services for consumers and protects the dream of homeownership and diverse and thriving American communities. The Code’s centennial is the perfect opportunity for REALTORS® to reaffirm their commitment to the honor, integrity, and professionalism that the Code demands.

Locally, the St. Louis Association of REALTORS® abides by the Code and promotes the protection and promotion of private ownership of real property, the institution of professional standards of practice, the continuous collection of data pertinent to the real estate industry, and the promotion of unity within the real estate community.

Spring always brings with it a sense of hope and renewal. This season seems to mirror the general tone of REALTORS® at the NAR Midyear Legislative Meetings & Trade Expo in Washington, D.C. There was a definite sense of cautious optimism.

Key items that your fellow REALTORS® and association staff addressed with our legislators were the preservation of the mortgage interest deduction for taxpayers who own a home, strengthening of the FHA program, and responsible reform of Fannie Mae and Freddie Mac. On the commercial front , NAR continues to advocate for commercial real estate liquidity including, “(1) the creation of a U.S. covered bond market, (2) increasing the cap on credit union member business lending (MBL), (3) additional banking agency guidance related to term extensions, and (4) improving credit availability for small businesses” (NAR, 2013).

On the local front, the new website is complete and will be launched in a matter of days. A focus of the strategic plan is to prepare our members for the future of real estate and we believe that this new website is a positive step towards that goal. Another component of the plan is to position our members as essential to the transaction which includes becoming the source of real estate information and driving community collaboration in healing our market. To reach that goal, marketing and governmental affairs staff have been working with Housing and Community Solutions, Inc. to launch an Energy Efficient Housing Contest (EEHC).

Step Up to Higher Income There has been a great deal of attention, recently, on both the state and national levels of organized real estate to the issue of professionalism. It seems that the routine answer is always more CE, better CE, and stricter licensing requirements. The problem with these solutions is that they don’t appear to work and they are largely mandated and administrated by the state licensing bureau. The local associations have minimal control over these solutions. NAR’s “Pathways to Professionalism” have been published in the professional standards article of this magazine; this is the lowest standard of professionalism, the bare minimum.

At the WCR leadership principles event (Ignite), Elizabeth Mendenhall, 2012 National Association of REALTORS® Strategic Planning Committee Chair, expressed the concept of being not at the center of the transaction but essential to the transaction.

Think about what it takes for a professional to be essential to a transaction or exchange of services.

The surgeon is essential to a surgery, a lawyer essential to a trial, a certified teacher is essential to a public classroom, but a CPA is not essential for the completion of a tax return. In fact, the surges of Turbo Tax and similar online products have replaced, or rather, displaced, tax professionals and accountants.

This does not mean people would not want a CPA to prepare their return but many with a simple tax circumstance have opted to replace the expensive professional with the inexpensive online software. A hard look at the real estate industry shows

many similarities, as both consumers and clients look to the Internet to provide REALTOR® services.

The consistent thread that these “essential service providers” have in common is higher education. These individuals went beyond the bare minimum of a college degree to earn an advanced degree. The state also mandates that their services be used in the transaction. Noncertified teachers cannot teach in public schools and doctors cannot practice without a license. Although CPAs also have a higher education and are licensed their skills have been replaced with software.

Can you imagine a day when the seller will go through a software program to “list” their property on the internet, get the proper pricing range (RVM®), upload pictures from their phone, and complete their disclosures all without the assistance of a REALTOR®? The buyer, in this hypothetical future market, can hit a “make offer” button and use a program that will take them through all of the necessary paperwork.

This program will also schedule a showing online with the seller, and choose from a list of inspectors, title companies, and mortgage brokers.

The Internet vendor guarantees the transaction; not unlike the audit guarantees from the online tax program. Think long and hard about what makes the REALTOR® essential.

There is value in the REALTOR® network, the MLS. There is value in the specialized REALTOR®. The solutions then become clarified.

The data in the MLS must be professionally maintained, primarily accurate and current, and both those

REALTORS® must go beyond the bare minimum of CE and invest in themselves through designations and advanced degrees, just like professionals in other industries. The local associations offer designation programs, attend them. The National Association of REALTORS® (NAR) has maintained statistical data that prove even one designation increases income by 20-40%. Currently, NAR is offering advanced degrees through its accredited university with a Masters of Real Estate and several specializations. NAR offers scholarships and personal education loans (through the REALTORS® Federal Credit Union) to make these programs accessible to you. Finally, for the REALTOR® to be essential, every member needs to be involved in legislative advocacy through answering calls to action, donating to RPAC, or going personally to The Hill. We need to ensure that our states maintain strict licensing standards and that the federal government supports homeownership. The time to step up to the plate is now! This is a critical time in the national economic recovery but an even more critical time for the real estate industry. Now is the time to prove we are professionals operating not only under the highest standard of ethical behavior but also under the highest standard of professionalism.

From around the industry….

New Home Industry Doing “Better” But It’s All Relative At our last forum meeting, I talked about how recent news headlines about large increases in the number of building permits and new home starts paint an inaccurate picture.

Researchers are comparing current data with one year prior; however, a year ago, things were very bleak for the building industry. So, while there is improvement, there is still a long way to go.

To illustrate further, take a look at the headlines below. These headlines are all accurate but tell quite a different story: • New home permits up almost 50 percent (47%) in St. Charles County in 2012 over prior year.

• New home permits up 25 percent in St. Louis County in 2012 over prior year.

• 2012 sees highest number of building permits issued in 5 years in St. Charles and St. Louis County.

• In 2012 St. Louis County issued only one-fourth the number of building

permits as in the prior 25 years on average.

• From 1987-2011 St. Charles County averaged 2,676 new home permits per year. In 2012, St. Charles County received just over half that amount (1,497).

Get the idea? While all these stats are accurate, they do not necessarily paint the real picture. The real picture is that we are seeing some definite improvement in the new home market in St. Louis and there has been a fairly significant increase in building permits in the past year from the prior year. The numbers are still awful, just not as awful as last year. As the last bullet point above shows, St. Charles County is, even with the improvement, at just 55 percent of the number of new home permits that were issued on average in each of the prior 25 years, St. Louis County issued 552 permits in 2012, just 27 percent of the average of 2,027 in the prior 25 years.

Update from the HBA on New Home Tax Incentive Legislation At our meetings, and in this article, we have discussed legislation that was proposed in Missouri that would create a tax deduction of up to $10,000 for purchasers of a new home. The HBA is extremely supportive of this legislation and our forum thinks it will help the troubled St. Louis new home market. This legislation, introduced in House Bill 194, was voted “do pass” from the Senate Progress and Development Committee on April 24 and will be heard on the Senate floor in the near future. Short Sales and Credit Elizabeth Kayser of the Kayser Short Sale Law Firm shares some information on Short Sales and credit that will be helpful to SLAR members!

A graceful exit to a difficult situation for a homeowner is a short sale.

A foreclosure devastates homeowner credit, further depresses property values, blights neighborhoods with vacant REO properties, results in steep losses for lenders increasing the national financial crisis, and results in high deficiency balances. A foreclosure results in banks holding the property in their inventory as a nonperforming asset, commonly known as a toxin in today’s economic terminology. Banks have strong incentives to get rid of these toxic assets at discount prices. For a lender, doing a short sale avoids many of the costs associated with the foreclosure process by getting rid of the property faster.

Short sales produce financial and nonfinancial rewards for all key players and the economy as it: • Protects homeowners’ credit and saves the embarrassment of foreclosure, • Keeps properties occupied rather than vacant (blight), and • Minimizes losses to lenders Millions of homeowners are behind on their mortgage and can no longer make their mortgage payment due to job losses, divorce, and/or bad loans they should have never have received. A solution for the homeowner is a short sale. This

By Elizabeth Kayser, Kayser Short Sale Law Firm process involves getting the lender to accept an amount below the mortgage payoff and to waive the deficiency against the homeowner.

In most cases, the deal is structured so that the lender pays the closing costs. On occasion, the seller will need to bring cash to the closing table. Everything is determined on a case-by-case basis. Lenders generally demand fair market value for the property which, in a short sale, is significantly below the mortgage balance.

Credit implications The number one reason a distressed homeowner should proceed with a short sale is to protect their ability to obtain financing in the future. Most short sales result in a “settlement” status on a credit report as opposed to “foreclosure.”

Fannie Mae and Freddie Mac guidelines are much more favorable to borrowers with short sale on their credit report, typically allowing a borrower to obtain financing for a

new home within a couple of years.

In sharp contrast, a foreclosure remains on a credit report for seven years, making it very difficult to finance another house or a car, to open a new business, or to even qualify for a credit card. Any loans received will most likely bear very high interest rates. Foreclosures have a devastating effect on credit history, job security, employment opportunities, security clearances, military and law enforcement careers, and most serious of all the ability to purchase a home in the future and obtaining credit in general. Bottom line: the end result of a short sale is much more favorable when compared to the consequences of a foreclosure.

A Short Sale offers a fresh start, eliminating debt, while minimizing damage to credit and avoiding eviction proceedings.

REALTORS® Will Work to Protect The American Dream in Washington, D.C. May 13-18 REALTORS® from across the country will descend on Capitol Hill in May to meet with every federal legislator and discuss issues of importance to the Real Estate Industry. Imagine if the Mortgage Interest Deduction, celebrating its 100th Anniversary this year, were to be eliminated. This middle class tax break is brought up almost weekly as part of the overall budget and tax reform discussion. What if the secondary mortgage market (e.g. Fannie and Freddie) was altered in such a way as to make 30-yr mortgages more difficult to obtain? Would it be easier to sell condos if the FHA rules were adjusted? How will ever-increasing regulation by federal agencies affect the ability of our Commercial REALTORS® to lease, sell and develop property?

Legislative Issue Update Local Foreclosure Mediation Ordinances: Both the St. Louis County and St. Louis City ordinances which require lenders to offer mediation to homeowners prior to filing a foreclosure deed are currently tied up in court. Neither ordinance is currently in effect. The County ordinance is under an injunction and is awaiting a hearing in the Missouri Court of Appeals. The City ordinance is under a Temporary Restraining Order, awaiting the results of the County case. Both cases were brought by the Missouri Bankers Association and each case also includes a specific bank as plaintiff, which will allow for damages to be sought.

In addition, HB 446, which would prohibit local jurisdictions from passing ordinances which would affect the enforcement and servicing of a real estate loan, is moving through the Missouri Legislature and may render the ordinances in both St. Louis County and City invalid before a decision can be reached in the courts.

St. Louis County Considering Code Changes: St. Louis County is reviewing its building, plumbing, electrical, existing building, residential, and land disturbance codes. SLAR is monitoring the proposed changes along with other real estate related associations.

Methamphetamine Lab Remediation: Several St. Louis County municipalities have enacted ordinances which require remediation of properties that are known to have had active meth labs on the premises. The ordinances require testing, clean-up, and re-testing of the properties for various chemicals. Until testing meets the required standards, occupancy permits will not be issues for these properties.

SLAR’s Governmental Affairs Committee has formed a task force to research this issue. The goal is to gather information from state and local departments and agencies that handle any part of a meth lab breakdown, occupancy permits, and health research related to meth lab exposure, and use that information to determine the best course of action that will protect public health and facilitate risk management for our members.

Law & Ethics Is there a difference between ethical behavior and professionalism?

As an Association Executive for many years, I have often been the first contact for public ethics complaints. The complaints I receive have more to do with professionalism than the REALTOR® Code of Ethics. The most common complaint is that there is a lack of communication between the REALTOR® and the client. I often hear the following: “My REALTOR® never calls me back” or “I cannot get a hold of my REALTOR®”.

Many complaints arise out of a lack of understanding of the terms of the contract, and others appear to be a disconnect between expectations and service delivery. To address this phenomenon, the National Association of REALTORS® created the Pathways to Professionalism. Following this simple guide, a REALTOR® can avoid unnecessary ethics filings.

I. Respect for the Public 1. Follow the “Golden Rule”: Do unto other as you would have them do unto you.

2. Respond promptly to inquiries and requests for information.

11. When showing an occupied home, always ring the doorbell or knock—and announce yourself loudly before entering. Knock and announce yourself loudly before entering any closed room.

12. Present a professional appearance at all times; dress appropriately and drive a clean car.

13. If occupants are home during showings, ask their permission before using the telephone or bathroom.

14. Encourage the clients of other brokers to direct questions to their agent or representative.

16. Be aware of and respect cultural differences.

17. Show courtesy and respect to everyone.

18. Be aware of—and meet—all deadlines.

19. Promise only what you can deliver—and keep your promises.

4. Notify the listing broker if there appears to be inaccurate information on the listing.
