n Aug. 1st, the feds are tightening real estate regulations again. The Consumer Financial Protection Bureau (CFPB) is creating more red tape and even though the trend over the past several decades has been going in the direction of tight, quick closing schedules, the question is, can the industry streamline a closing process that is more bloated than ever? Back before the Great Recession and even before a housing bubble or two between Y2K and now, it could take about three months

to close on a home. This was in the 1980s when automated underwriting, DocuSign, and document sharing services like Dropbox were still science fiction. Along come these advances, coupled with loose regulations, and closings were whittled down almost 50 percent. For more than a decade, 20 to 35 days became the norm. In recent years, as the government piled on regulation after regulation, not to mention the scrutinization of prospective buyers’ bank statements and credit scores – almost to the point of absurdity – real estate professionals are anticipating transaction times ratcheting back up 35 to 40 days. The onus to streamline the closing process can only fall on the shoulders of those in the trenches, not legislators working to shelter consumers. REALTORS, lenders, and title agents have no choice but to be compliant with new regulations. So it’s important that everyone work together to establish protocols that won’t cut corners or add new layers to a process already

This summer when title agents will be required to receive signed disclosure documents from buyers three days prior to closing, it will be just another bureaucratic snarl to deal with. And then there’s the threat of restarting the entire process if a single document is unaccounted for or an impossibly tight deadline is overlooked. So it’s no wonder industry professionals are at their wit’s end. It’s not that anyone is rallying to get buyers into their dream home within weeks. That may never be realistic. So now, there’s a push to cautiously bulldoze through the pre-closing stages. A few insider suggestions for streamlining the closing process include partnering with trusted colleagues and utilizing file-sharing tools.

April is Fair Housing Month This month marks the 47th anniversary of the 1968 Fair Housing Act, the landmark fair housing law that promises equal professional service to anyone looking for a home. Talk to your office about the importance of Fair Housing Month, especially in our local market. You can find more information on the Fair Housing Program, including ways you can promote the cause at bit.ly/FairHousingMonth. Also, the City of Austin’s “source of income” ordinance is now in effect. The ordinance applies to all professionally-managed properties, and prohibits discrimination against any housing voucher holder (i.e. Section 8) by refusing to rent or show property to someone on the basis of their source of income. The ordinance also prohibits any advertising or notice

that a rental property does not accept prospective tenants based on source of income. You can find more about this new ordinance at bit. ly/ATXincome.

Make it a “green” Spring According to NAR, green homes and energy efficiency continue to grow as an important factor for those looking for homes. Williamson County is not Austin Travis County Judge Sarah Eckhardt said “the Austin area has reached a point where growth is becoming a con.” Has Austin continued to meet or exceed the expectations of the consumers and businesses looking to relocate here? This is an important question, and needs to be asked. TomTom's annual worldwide traffic index was released this week. Austin, Texas is ranked the 13th worst city for traffic in America. TomTom’s report ranks 86 out of 146 major world cities in terms of rush-hour congestion. Austin is now grouped in the top 13 with the likes of Los Angeles, San Francisco, Miami, Chicago, and Houston, which are cities notorious for traffic. The growth Austin has continued to experience has pushed the limits of its city and its longterm residents. Austin is struggling to stay ahead of the curve in terms or infrastructure, affordable housing, roads, water, education, and quality of life. The growth Austin is experiencing is taking its toll. The most important take away from this

www.myRealtyLine.com article is that Williamson County is not Austin, Texas! Williamson County is poised to continue to support its growth and arguably has exceeded the expectations of its residents. Williamson County continues to offer quality education, roads, affordable housing, and strong quality of life. So, let’s talk about housing in Williamson County! The growth of Austin has certainly benefited the region. Many employers are setting their sites on Austin, Texas but ending up in Williamson County. We have the land, the affordable housing, and the infrastructure including roads and water, and the ability to continue to support its growth long into the future. In terms of Real Estate in Williamson County, let's look at some of our major areas of new construction growth. The great news is Williamson County has attracted quality builders and unrivaled master planned communities for traditional and especially the luxury homebuyers. Travisso is the new luxury master-planned community with a nine-acre amenity complex located off 1431 in Leander. Prices ranging from the low $300s to the $800s. The premiere builders in Travisso are Taylor Morrison, Toll Brothers, Drees, Grand Haven, and Highland homes.

I

once read somewhere that growth is the No. 1 killer of business. At the time, it seemed counterintuitive. It would seem growth is what businesses need to survive. However, after some thought, it begins to makes sense. A business’s ability to succeed is in direct proportion of its ability to meet or exceed the expectations of its audience. When a business or entity’s growth outpaces its ability to deliver on its core services, the consumers are left feeling unsatisfied, and assuming the consumer has choices on the provider of the services, they tend to look to a solution elsewhere that will “wow” them. The dangers inherent with rapid growth does not just affect business. It affects any entity that provides a service such as cities and municipalities. It is certainly no secret that Austin is experiencing rapid growth. I am not sure if we are at the point of labeling it “hypergrowth”, but I believe we are getting close. In fact, according to US Census Bureau, the rate at which it is increasing is even more challenging than the fact that it’s increasing.

RE/MAX isn’t for everyone, but it is for problem solvers. Which would explain why nobody sells more real estate than RE/MAX. Others might shy away from daunting circumstances, but we push on. And we succeed. Find yourself at RE/MAX.

When buyers come to Monica Hampton, a REALTOR at Realty Austin, with a lender she’s unfamiliar with, Hampton wants to be sure the MLO has an incentive to close in a timely fashion. After more than three years in the business, Hampton prefers partnering with independent lenders and brokers because they have an incentive structure that encourages a fast-paced working environment.

Unifying the Team with Technology Recent regulations may have created a pool of more qualified buyers while also protecting many others from purchasing homes they only temporarily qualify for. These are the same regulations, however, that have weighed title agents down in reams of paperwork that, for some, has decimated their earning potential. Overworked and understaffed title companies are at risk for making errors that can postpone a closing date. On the other hand, Rooker praises title agents for being one of the first links in the industry chain to go paperless, thereby connecting and unifying every individual responsible for dotting an I and crossing a T on a real estate transaction, including the customer. According to Steve

Benet, a senior loan officer with 20-plus years in the lending business, and Kilpatrick’s partner at CMG Financial, there can be at least 15 different hands in just one closing transaction. And that’s being conservative.

Like their relationship with a trusted lender, agents also have alliances with specific title agents. Rooker once had an irate client on his hands when the customer noticed an escrow bill that was higher than expected. If the closing team were using Google Drive, Rooker would have had access to the client’s Tax Certification document and a chance to catch the error – and possibly even correct it, or at least warn the customer he was on it. Instead, he had an agitated buyer to placate and an overworked escrow officer to sort out. While it’s not ethical to steer a customer toward a specific MLO – or any service provider – agents can have working relationships with more than one lender and title agent and then explain to clients how it’s beneficial to work with professionals that have closed deals together in the past. For now, no one is expecting things to get easier or regulations to scale back on any of the processes that are jamming the closing timeline. It’s nice to feel nostalgic for the way things were – a time when buying a home was a breezy 20-or-so days. But before current regulations, too many unqualified buyers found their way into the housing market. That’s a mess we’re still cleaning up today. Considering how the industry coped years earlier with snail mail, landlines and pen-andpaper files, there’s no doubt that we can find a way to power through again. RL

Having our clients thank us and grab those keys is the culmination of weeks, if not months, of hard work. What if we could help them to easily arrive at a decision earlier, or even feel better about the decisions they are making? Here are a few techniques I have learned from those who came before me and still work with clients today.

The Solidarity Close Talk about the transactions or clients that are similar to them. Tell them how this client overcame similar challenges and concerns and by following a particular course of action they are now very happy.

The Opportunity Costs Close This close takes your client to the pain of not doing what they already stated to you they wanted to do. They want to sell their house or to buy a house. Highlight the cost of not selling or buying (i.e. – can’t move closer to family). Remind them that costs are not just monetary but also include hassle, dissatisfaction and problems. Time, in particular, is a great motivator. Hopefully these techniques for closing will bring you success. Each client deserves a different close that suits their personality and needs well. So far, Kerrigan notes that many of Tessera’s early residents are families seeking an attractive home value in a great school district as well as couples seeking high-quality home designs in a unique setting. The Lago Vista ISD has an enrollment of 1,275 students in its elementary, middle and high schools.
