NAAEI Recognizes AMA and Pam Shelton with Second National Pusateri Award By AMA and NAAEI In June, during the National Apartment Association Education Institute (NAAEI) conference in San Diego, Pam Shelton, a principal of Allison-Shelton Real Estate Services and Robert Hicks, Chariman of the Board of the Arizona Multihousing Association (AMA), accepted the Anthony V. Pusateri Apartment Career Promotion Award on behalf of the AMA. The national award recognizes an individual, a company or an association who has made the biggest impact creating awareness of careers in the apartment industry among high school and college students, military veterans and spouses or career changers through outreach activities. The Arizona Multihousing Association was awarded the Comprehensive Apartment Career Promotion Award. Shelton has served as the chair of the Education Committee for the

Slum Property Enforcement in Phoenix Takes Focus and Collaboration

This summer, the City of Phoenix demonstrated their commitment to taking a more aggressive approach to dealing with slum properties. The City Council Housing, Planning, and Development subcommittee reinstated the slum-property designation and the appeals panel that will strengthen the enforcement process on rental properties to protect renters and neighborhoods. Phoenix Councilmen Tom Simplot (District 4) and Daniel Valenzuela (District 5), worked with leadership and city staff to strengthen the enforcement of these laws. During the economic downturn, the City faced a number of budget cuts and the neighborhood services teams focused only on the most critical situations. Recently, additional resources were allocated to allow the city offices to focus on repeat offenders, track their progress in making necessary updates and repairs, and file criminal charges when necessary by collaborating with the City Prosecutor’s Office. The Neighborhood Services Department is able to issue slum property designations when code compliance staff identifies violations of the Phoenix Neighborhood Preservation and/or a zoning ordinance. past few years. Under her devoted leadership, the AMA created a series of large scale community job fairs in Phoenix and in Tucson. In addition, she worked with AMA members and the staff to create the “Jump Start” program to educate potential employees about the range of positions available in the apartment industry. For the first time, the NAA recognized the AMA and Shelton for a record second consecutive year. Working with local Arizona partners like Republic Media, Phoenix Channel 12, CareerBuilder.com and Apartments.com, Shelton was able to bring together high profile partners to spread the word about the job fairs to applicants. Attendees were able to interview with as many as 20 apartment management companies in one location during the job fairs. Back to Business By Robert Hicks, Alliance Residential As the summer winds down, our AMA teams have been busy working on programs for the fall, and on initiatives for Big Hearts for Little Hands. Tucson and Phoenix have hosted special events to bring together members to network and support families in need through these partnerships with local nonprofit agencies. Our Family (formerly New Beginnings) in Tucson and UMOM in Phoenix receive thousands of dollars and in kind contributions as a result of your generosity. Part of the mission of AMA’s Big Hearts for Little Hands is support families in need with housing opportunities. Both of these nonprofits help transition families into permanent housing following a difficult time in their lives. In addition to the housing efforts, we support reading programs through our work with Southwest Human Development and the Raising a Reader campaigns held in our

apartment communities. Innovative programs like this, deployed in partnership with great operators and associate members, continue to make a major difference in our communities. I urge you to get your teams involved with these programs. They are a testament to the impact that we have working together in our communities. Here at the AMA, we are also getting ready for the upcoming Perspectives and Projections conference that will be held at the Convention Center in late September. These folks are focused on the apartment industry only for this event, making this economic outlook of particular importance to our members. ArizonA Multihousing AssociAtion Padres ...continued from front page huge success this event was for the Tucson BH4LH committee efforts with more than 800 tickets plus products and raffle ticket sales resulting in $6,552 in funds raised. Tucson AMA members, their families and friends and the Tucson community enjoyed a night at the ballpark and gave a little back to the community as well! Another event held earlier this year, 1st Annual 5K Fun Run/Walk (March 23, 2013), netted almost $5,000 and will continue to be an annual event for the Tucson AMe, Inc. future campaigns. Both of these events helped inch the committee much closer to its goal of collecting $30,000 in 2013.

The AMe, Inc.-Tucson Big Hearts for Little Hands Closing Party, which will be held at The Hut in Tucson on Friday, November 22, 2013, is closing in fast and the committee is confident that it can reach the 2013 goal! During the next few months, onsite efforts from the 109 participating AMA Tucson multi-housing communities will be critical to reach this goal. In the past, the committee’s fund raising success has relied heavily on proceeds from Yard Sales, Bake Sales, Community Events and other creative fund raising activities. The Tucson Big Hearts for Little Hands committee continues to rely on these

events to meet the lofty 2013 goal. Several properties have already held events for BH4LH including Altamira (NFI); Carondelet (Scotia); Casa Bella (MEB); Coronado Villas (Prime); Desert Shadows (Scotia); Lantana (NFI); MEB Corporate Office; NFI Corporate Office; Pusch Ridge (NFI); Pueblo Villas (Weidner); Sandstone Ridge (NFI); Somerset Place (NFI); Stonybrook (Scotia); Sundown Village (HSL); The Edison (Scotia); The Woods (NFI). Pusateri, CAPS, CPM, a past president of the National Apartment Association, a founder of NAAEI and member of the Institute of Real Estate Management Faculty. Pusateri had the vision that NAAEI would lead the apartment industry in the promotion of apartment careers and the creation of new pipelines of skilled talent and worked diligently to make it a reality. q

Years ago, the AMA supported the original legislation allowing municipalities to designate a residential rental property as “slum property.” In August 1999, the state enacted Arizona Revised Statute (ARS) §331901 to empower municipalities to designate residential rental property as “slum property” for a deteriorated property in a state of disrepair and a danger to the health or safety of the public. This designation gave the municipality some leverage to enforce health and safety codes and protected resi-

dents and the larger neighborhood from owners and/or property managers who were not in compliance with the law. The newly reinstated 12 member panel consists of professional real estate experts and local citizens who will convene when appeals are requested by owners whose rentals have been designated as slum properties. The panel then reviews cases and evidence and makes their recommendation regarding the property’s status. Among those selected for the review panel are Jake Hinman of Capitol Consulting and Nedra Halley from Dunlap & Magee. q

What is Branding... and Why is it Important? By Ike Tippetts, Rainforest Plumbing & Air

If

you pay attention to business news, you’ll undoubtedly hear about brands and branding on a regular basis – especially in regards to “building a brand,” “the value of a brand,” or even “damage to a brand.” Usually, though, these kinds of ideas are being applied to a major corporation, so it might seem fair to assume that branding is something that only the biggest organizations have to worry about. The reality, however, is that every business and individual should be aware of what branding is, and how it works, because it can be such a powerful concept. Although there are a lot of different ways that branding is defined, it really comes down to this: a brand is just the sum of the way people feel about you and the impressions you make. It includes your visual identity, with things like logos, color schemes, and marketing messages. But at same time, it also encompasses your prices, the other businesses you work with, and even your reputation for customer care and service.

When you put all of these together, you have an idea of how people think about you, or at least how you’re trying to get them to think about you. That might be important to huge companies with massive advertising budgets, but it can be even more important to small businesses, or even individuals, who need to make an impression on the people around them in their local market or community. To get a bit deeper into the reasons that branding matters, consider a few of the great things that happen when you have strong branding efforts in place: Great brands tell a long story in a fraction of a second. Stop and think about your favorite businesses or products, and then think about the logos or advertising jingles you associate with them. If you love something like Starbucks, Cadbury’s Chocolate, or CocaCola (as many people do), then you already understand how just seeing the right graphic can make you hungry or thirsty, and create an instant unconscious impression in your mind. That’s the power of a strong brand. People like to work with brands they know and trust. Lots of research has gone into the reasons why customers prefer established brands, but the results basically come down to trust.

When the company has built a brand that becomes associated with a certain type of product or service, it’s easier for you to choose them because you know what to expect when you make that choice. In other words, people like to feel comfortable and unthreatened, and working with established brands allows them to do that. Strong branding helps you gain recommendations. When someone is looking for a product or service recommendation, they often turn to a friend, colleague, or family member first. Branding heavily influences those recommendations, since a person is far more likely to recall a strong brand off the top of their head instead of a weaker one. That applies to big companies and products, of course, but also to the people in their lives – personal branding is incredibly important for referrals and other suggestions. Branding helps your marketing, but it also does a lot more. Although a lot of the discussion about branding focuses on marketing, and finding new customers, the reality is that a great brand helps you in a lot of different ways. For instance, your branding efforts could help you secure a new loan, create relationships with vendors, generate interest from colleagues, or even

create employment and partnership opportunities for your team. Each of these is possible because good branding builds trust and familiarity, which paves the way for stronger business relationships. Whether you’re thinking about the apartment business, or even just your own personal career, paying attention to your brand is a good idea. hank you to all who voluntarily participated in the Arizona Department of Real Estate (“ADRE”) Broker Audit Survey. The results will enhance the Department’s mission of protecting the Arizona public and ensuring exceptional customer service while identifying ways to support real estate professionals like you. Top 10 Apartment Resident Customer Satisfaction Complaints J Turner Research study reveals three out of top five complaints directly related to customer service A leading marketing research firm exclusively serving the multifamily industry, J Turner Research, recently announced a ranking of the top 10 apartment resident complaints, as revealed in an analysis of 10,000 customer satisfaction surveys completed over the past two years at communities nationwide. Court Rules in Favor of Tucson and Phoenix on New Election Law

Arizona’s two largest cities have won a legal battle against the State to retain control over how they conduct elections for mayor and city council. Phoenix and Tucson will not have to

comply with a state law taking effect in 2014 that will require local governments to move their candidate elections to even-numbered years to coincide with statewide contests for

president and governor. Each of the cities’ charters allow them to set their own election cycles. One of the concerns of the two cities was that the consolidation of the elec-

tions could push city elections to the bottom of the ballot. Municipal elections are critically important and this allows cities to direct the timing of their elections. q

Top Seven Reasons to Use Rental Payment History Data Experian® RentBureau®, the leading provider of rental payment history data to the multifamily industry, recently released the findings of an analysis examining the financial risk posed by residents and the most effective screening metrics to employ to avoid lost revenue from risky residents. The analysis, Risk versus reward: identifying the highest-quality resident using rental payment history, provides unique, industry-specific insights regarding the use of rental payment data in conjunction with credit scores in screening to produce a superior prediction of a resident’s propensity to default. The analysis also includes first-of-its-kind data regarding late payments, nonsufficient funds (NSF), write-offs and rental collections. Here’s a look at the top seven takeaways from the analysis that offer multifamily owners and property managers a look into the best applications of resident payment history data: 1. Complement traditional credit scoring: The use of rental payment data in conjunction with credit scores in the screening process produces a superior prediction of

a resident’s propensity to default. To improve rent default rates and better assess an applicant’s risk, owners and property managers are best served by utilizing rental payment data along with credit scores. Renters with the highest credit scores show much lower rates of default. However, within that population, those with negative rental history are more than four times as likely to default as those with positive rental history. 2. Realize better risk management: Renters, as measured by credit scores, are a higher-risk group than the U.S. population overall. Eighty-five percent of the renters in the sample set are in one of the three lowest VantageScore® credit ranges (501 to 799), compared with a national average of only 64 percent. 3. Gain insight into propensity to default: How an individual paid rent in the past is a good indicator of how he or she will pay rent in the future. Renters with one prior rental debt have a default rate nearly four times higher than

applicants with positive rental history. 4. Avoid balances owed: Rental payment history data allows for the identification of residents who repeatedly move out of communities owing money. These individuals are nearly six times as likely to repeat this behavior compared with a resident who has consistently paid rent on time. 5. Spot serial skippers: By identifying prospects with multiple negative prior rental payments, owners and property managers can avoid renting to individuals who likely are serial skippers and have a 35 percent chance of defaulting again. 6. Minimize late and NSF payments: Default among residents who have a history of late or NSF payments escalates steadily as the number of late or NSF payments increases. Renters with three or more late or NSF payments have a default rate more than twice as high as renters with only two or fewer late or NSF payments.

7. Achieve higher occupancies: Augmenting the lack of a credit score with rental history data can help owners and property managers improve occupancy while also managing risk. Unscoreable individuals with positive rental history have lower overall default rates and could make strong renters for managers looking to increase occupancy. The complete report (available Oct. 1 at www.naahq.org/13ies) contains detailed data summarized for six geographic regions, and 91 metropolitan areas met the separate reporting criteria for market-rent properties. ack and neck injuries can occur at any time and may cause long-term pain if they go untreated. According to a recent ChiroCare – a chiropractic network – study, employees often underestimate their back or neck injuries and do not seek medical treatment, which can lead to productivity losses and possible spinal damage.

The study found employees with back and neck pains often do not seek professional help, resulting in missed workdays. Despite their pain, 68 percent of survey participants decided not to seek treatment because they were concerned the cost of treatment would be too high. However, by not seeking medical treatment, the study’s results showed workers were then twice as likely to miss work and three times more apt to make on-the-job mistakes, as nearly 20 percent of the survey par-

ticipants acknowledged their pain caused them to perform tasks incorrectly. The Bureau of Labor Statistics reported joint sprains and muscular strains and tears can cause back and neck injury. In 2011, 22 percent of spinal injuries resulted from overexertion in lifting or lowering. According to the BLS, the average recovery time for a back strain is seven days if the worker seeks treatment. However, the longer it takes for employees to seek medical care, the longer the healing process will be. No matter the industry, all workers should learn and use proper techniques to protect their spinal cord and back and neck muscles. The Reverse Trade Show Drives Business By Joanna Grassinger, AMA

T

ucson’s Freaky Friday Reverse Trade Show brought AMA members together for a role reversal that mirrored the famous film. For an afternoon, associate members networked with management companies to learn more about their properties and their service needs. Hundreds of AMA members gathered into 57 vendor teams to visit with the 24 tables representing management companies in the ballroom of the Hilton. Event emcee, Mike Rochon of Distinctive Carpets, kept the afternoon

moving quickly as he gave instructions on the “speed networking” set up. Despite his “tough-guy” costume, Rochon served as comic relief throughout the trade show. The management teams adopted the theme with great enthusiasm and creativity. With a little help from their friends at Valley Protective Services, the Scotia Group came prepared to serve dressed as guards in full uniform. Prime Residential got freaky and their management team took home top honors for their freaktastic décor and theming. Visitors to their tables were welcomed with toys and colorful games while their team sported wild wigs.

The AMA’s trophy fit the theme perfectly. Prime Residential was presented with a pink bulldog trophy bearing a “Best in Show” ribbon. The Reverse Trade Show creates a unique opportunity for associate members to meet property management companies and decision makers in a single afternoon. The organizing committee, led by Mike Ruske of Prime Group and Michelle Winston of Apartment Finder, devised a simple system to ensure that regular members were able to meet with nearly every associate member over the course of the afternoon. The process was developed to be like a “speed

dating” event where participants could give their “elevator speech” and learn more about management companies’ priorities and needs. The after-party brought together all of the participants for a causal gathering where members could continue their conversations. This popular close to the annual event featured an outstanding buffet for all of the guests. Thanks to all of the event sponsors and participants for making this year’s Reverse Trade Show a great success. q

Dunlap & Magee Partners with St. Mary’s to Provide Summer Lunches By AMA

A

rizona summer months can be particularly tough for Arizona families with younger children. During the school year, many families take advantage of school breakfast and lunch programs that offer children stable meals. Once fed, these children are able to concentrate better in the classroom and get the nutrition they need to grow. When the summer comes around and classes are out, some families struggle to feed their young ones nutritious meals every day. To address this serious issue, St. Mary’s Food Bank developed the Kids Café meal service program. For some of their clients, this may be the only meal of the day. The Summer Food Service Program (SFSP), funded through the U.S. Department of Agriculture and administered by the Arizona Department of Education, Kids Cafe contin-

ues its efforts to ensure that no child goes to bed hungry so they can live healthy and productive lives. This summer, St. Mary’s partnered with Dunlap and Magee, other apartment communities, community based health clinics and schools to offer locations where families could pick up their meals. The apartment communities offered a logical, accessible destination for the program and it’s an amenity for residents who take advantage of the program. “We’re proud that Dunlap & Magee has joined St. Mary’s Food Bank’s Kids Cafe program to provide children free, healthy meals this summer,” said Laura Brill, Director of Culinary and Nutrition Programs for St. Mary’s Food Bank. “One in four children in Arizona is at risk of going hungry tonight and relies on school lunches for their only meals. These are kids that should be growing, learning, and playing, not worrying about where they’re going to find

their next meal. In this partnership with Dunlap & Magee, we are closer to achieving our vision that no child goes to bed hungry so they can live healthy and productive lives.” The need for these meals, and programs like this one, is on the rise, as evidenced by the staggering growth of the program. This summer, the program has reported a more than 22 percent increase in the number of meals served. But this growing program still isn’t meeting the needs of all students in Arizona. Only 13 percent of those children who qualify for free and reduced lunches receive summer meals. 1 of every 8 Summer meals served in Arizona in 2012 were from St. Mary’s Food Bank ** The Food Research and Action Center (FRAC) Summer Nutrition Status Report 2013. q

Second Quarter Apartment Markets Mixed in Latest NMHC Survey While demand for apartment homes remained strong, rising interest rates exerted negative pressure on the industry’s ability to secure debt financing according to the National Multi Housing Council’s (NMHC) July Quarterly Survey of Apartment Market Conditions. Only the Market Tightness Index (55) remained above the breakeven line of 50 this quarter. Sales Volume (46) and Equity Financing (49) dipped, with Debt Financing dropping sharply to 20. “Debt costs for apartment firms have been rising. In addition to the 90 basis point increase in interest rates from the April survey, spreads over Treasuries have also gone up, likely dampening transactions somewhat. Rates are still low by historical standards, however, and at current levels should not put too big a crimp in apartment activity going forward,” said Mark Obrinsky, NMHC’s Senior Vice President for Research and Chief Economist. “Underlying demand trends remain strong, and we are approaching the cusp of a meaningful increase in supply that will hopefully be enough to meet the current need for apartment homes.”

Key findings include: • Construction costs are rising nationwide. More than two-thirds (68 percent) of respondents indicated that construction costs had increased by more than 5 percent since last year. Another 29 percent indicated construction costs had increased over a year ago, but by less than 5 percent. [Note: These figures exclude the 16 percent of respondents who answered “don’t know.”] • Market Tightness Index edged up to 55 from 54. Just 14 percent noted looser conditions in the markets they were familiar with. This represents the 13th time in the last 14 quarters in which the index was over 50. • The Sales Volume Index dropped from 55 to 46. This was the second time in the last three quarters in which the Sales Volume Index was below 50, though just by a little. Over the last eight quarters, the index has averaged 52, suggesting a small pickup in volume over that time. • The Equity Financing Index dropped 7 points to 49. This was the first sub-50 reading in the last four years. Forty-nine percent viewed equity financing as un-

changed. Twenty-one percent of respondents viewed equity financing as more available while 22 percent viewed equity financing as less available. • Debt Financing Index dropped sharply to 20 from 59. Two-thirds (67 percent) of respondents indicated that debt financing conditions had worsened since April, and 21 percent considered conditions unchanged. Only 8 percent of respondents thought debt financing conditions had improved – the lowest figure since October 2008. Full survey data are available at www.nmhc.org/goto/61291. q

Alcohol and the Employee Party By Paul A. Henderson, Esq. Law Offices of Scott M. Clark, P.C.

ere at the Law Offices of Scott M. Clark, P.C., we aim to be forward-looking and proactive in our legal approaches. There are certain key topics that may become issues in the future, and we’d rather address the matter while there is still time to act. Imagine, for a moment, that it is the end of the year. Given the nearly endless streak of 100°F-and-higher days we have been suffering here in metropolitan Phoenix, this is surely a pleasant fantasy. Diets have been abandoned, Christmas carols have been played incessantly (since before Halloween), and the Cardinals have imploded again. All right, so maybe it isn’t that pleasant of a fantasy after all. Nonetheless, in this hypothetical we are now at the time of the year when holiday and end-of-the-year parties are all the vogue and spirits are high. The other type of spirits – alcoholic ones – are generally in high supply as well. Many property management firms host an annual party to celebrate the conclusion of another year and to show appreciation for all the hard work done by their employees.

Drinks are poured, toasts are made, and merry-making is had. Please note that I am avoiding any references to mistletoe; sexual harassment is not the topic of this article. Unfortunately, with some people alcohol is the fuel for disaster. All it takes is one stupid decision and a driver can turn a vehicle into an engine of destruction. Alcohol-related deaths are not terribly uncommon, but most events involve the drunk driver and the victim. What happens when the lush became intoxicated at a company policy? In California, the courts are currently deciding whether the employer can be held liable for a vehicular death caused by an employee after the employee became drunk at a company policy. California’s position on this question? Yes, the employer could be liable. In Purton v. Marriott Int’l, Inc., --- Cal.Rptr.3d ----, 2013 WL 3942979 (Cal.App. 4 Dist. Div. 1, 2013) the California Court of Appeal recently decided that the employer could be held liable for a drunk-driving death caused by a very intoxicated employee. As the Court explained, Michael Landri was a bartender at the Marriott Del Mar who attended a company appreciation party, became intoxicated, and killed someone in an accident. What makes matters

complicated is that Landri consumed two drinks before going to the company party, consumed more alcohol than the company officially allotted through giving out two drinks tickets (although the company did nothing to prohibit extra consumption), and drove home safely before deciding to leave home again – which is when he caused the accident. The trial judge agreed with Marriott and granted its summary judgment application on the basis that the accident occurred during events beyond the scope of Landri’s employment and thus the company was not responsible; the appellate court, however, disagreed. The Court held that a trier of fact (i.e., the jury) could reasonably conclude that because the alcohol was provided at a company party held as an appreciation event for the employees, the employer could foresee that an automobile accident was possible. The Court did not specifically rule that the company would be liable; that decision is left up to be determined at the trial. Since the trial judge decided the issue and not a jury, the Court of Appeal remanded the case back for trial. There may be some concern that this California decision could be imported to Arizona. We need not specifically worry about this decision, however, insofar that California and Arizona have adopted opposing views on employer liability. Arizona’s rule, that the accident itself must occur at a time that the employee is acting within the scope of his or her employment, is set forth in Bruce v. Chas Roberts Air Conditioning, 166 Ariz. 221, 226 (App. 1990). The Court of Appeal specifically mentions in its opinion that Arizona is under a different legal standard. Additionally, social hosts are held to a different, and lesser, standard of liability than

bars and restaurants – the “Dram Shop Act” applies to merchants selling alcohol, not those providing it as part of a party. That being said, this topic brings up an important issue: alcohol at parties. Alcohol is frequently described as a social lubricant and is many times viewed as a de rigueur participant in any sort of party. Limiting the amount of alcohol at a party might not be popular, but it is a sound business decision. Issuing a limited number of drink tickets to each partygoer is a start – but, unlike at the Marriott Del Mar, those tickets need to be enforced. An open bar is an open invitation to danger; keeping access limited (or making it a cash bar) is not popular, but it is more practical. Additionally, making alternate transportation methods available (e.g., taxis, buses, designated drivers) is a smart choice and one that will serve both the company and its employees well. The Firm doesn’t oppose alcohol being present at parties. We would rather just see people enjoy it in moderation. Having a rational plan for alcohol consumption at company events is never a bad idea. The Troublesome Tenant By Matthew Koglmeier & Brady Jones, Esq., Koglmeier Law Group, PLC

dmit it, you already thought of your own troublesome tenant. Just like every family has its “black sheep,” every apartment complex has its “bad apple,” aka troublesome tenant, who manages to upset all their neighbors and the office staff on a regular basis, but somehow always cleans up their act in time to avoid eviction under the standard ten-day notice. There is light at the end of the tunnel, however, as long as you follow the correct process to serve 5 and 10 Day Notices and keep good records. Under A.R.S. §33-1368, any tenant that violates their lease or the Arizona Residential Landlord & Tenant Act should be served with a ten-day notice (or a five-day notice if the violation is related to health and safety). Even if the tenant cures, they have still used their one strike for that type of violation. If the tenant EVER commits the same or similar violation, even months later or after a subsequent lease renewal, they should be served with a non-curable, “second ten-day notice.” Even for health and safety violations, this non-curable

second notice gives the tenant 10 days to move, not ten days to cure as in a first notice. The “second ten-day notice” is not just another notice; it has to point out that the tenant has already been noticed regarding a same or similar violation, which makes the second violation non-curable. So just how similar do the violations have to be? If you could reasonably expect that, given the first notice, the tenant should have known that the new violation would not be tolerated, that is similar enough. For example, many would agree that a late-night party with thumping music is similar enough to loud music coming from a tenant’s car that disturbs the community or neighbors; they both disrupt the peaceful and quiet enjoyment of the other residents with noise. The key is to make sure that you give written notice of violations that describe the facts of the violation and include date and time of the breach. Weekly courtesy letters or polite chats with the troublemakers are helpful and you should continue to use these non-conventional methods if it is effective for you. Make sure you record these events in your communication log if you want to use this to your advantage at a later time. While they do not carry the weight of a legal notice, they show you have been rea-

sonable in your efforts to work out the issue with the tenant. They can be very helpful if the tenant makes a fair housing complaint because you ultimately were required to serve a legal notice due to the tenant’s bad behavior. Unfortunately, for the truly troublesome tenant, the nightmare does not end after the judgment and the writ of restitution. Sometimes . . . they come back, usually as a guest or unauthorized tenant with one of their regular party guests. A notice of trespassing on their return visit can help; then any time the troublemaker steps foot on the property you can call the police to escort them right back off or arrest them for criminal trespassing. You should also make sure you do not let that tenant have any ammunition against you once you have successfully protected your community and staff from their disruptive influence. After the tenant returns possession of the apartment and pays the amounts owed, including the bank’s confirmation that their check has cleared, make sure you let the court know the judgment has been satisfied. While some people think that filing a satisfaction of judgment with the court is merely a formality, it is not. The court rules of procedure for eviction actions require the prevail-

ing party to file a satisfaction of judgment after the judgment is paid off, fulfilled, or otherwise taken care of. If you do not file a satisfaction of judgment (or have your attorney do it) the evicted tenant can ask the court to rule that the judgment has been satisfied and then they can and will ask to have their attorneys’ fees and costs awarded against you, if any. The extenant may also have a legal claim, such as conversion, against you for not applying these payments to the judgment and thereby keeping it on the tenant’s record. Immediate Termination due to Discharge of a Firearm on Property By Michael R. Fletcher, Esq., Koglmeier Law Group, PLC

In

recent months, our firm has seen a rise in eviction complaints seeking immediate termination due to a discharge of a firearm on property. In several of these cases, the defendant alleged the discharge was not “illegal” as defined by A.R.S. §§ 33-1368(A)(2); 13-3107. And in some cases, tenants immediately reported the discharge to the local police, which resulted in the police reporting the discharge as accidental rather than illegal. This article will discuss the legal issues surrounding the discharge of a firearm on property, and the remedies available to landlords when a discharge of a firearm occurs. Pursuant to A.R.S. § 33-1368(A) (2): “If there is a breach that is both material and irreparable and that occurs on the premises, including but not limited to an illegal discharge of a weapon…” (emphasis added) the landlord may move for an immediate termination of the lease agreement. Pursuant to A.R.S. § 13-3107 an illegal discharge of a firearm “occurs when a person, with criminal negligence, discharges a firearm within or into the city limits of any municipality, and they are less than one mile from any occupied structure” (emphasis added). Under Arizona law, a person acts with criminal negligence when a person discharges a weapon and fails to perceive the substantial and unjustifiable risk that will occur as result

of the discharge. The risk must be of such nature and degree that the failure to perceive it constitutes a gross deviation from the standard of care that a reasonable person would observe in the situation. See A.R.S. § 13-105(10)(D) Consequently, in order for the discharge of a firearm to be considered illegal, the tenant must have acted in a criminally negligent manner. A person is criminally negligent when their conduct grossly deviates from that of a reasonable person in similar circumstances. In order to determine criminal negligence, the court reviews the conduct of the tenant and compares it to how a reasonable person would have acted in a similar situation. If the tenant’s conduct fell below that of a reasonable person in a similar situation, then the court would find that the defendant was criminally negligent, that the discharge was illegal under A.R.S. § 133107, and that the landlord is entitled to an immediate termination under A.R.S. § 33-1368(A)(2). For example, if a tenant cleans his loaded weapon in his apartment, which shares four walls with four other apartments, his conduct may qualify as a gross deviation from what a reasonable person would do and therefore, criminally negligent. The court’s reasoning would be based on the fact that a reasonable person would likely unload the weapon or clean it at another location where an accidental discharge would not put four other residents in danger. On the contrary, a court would likely find the same scenario

for a tenant in a rural setting as not grossly deviating from what a reasonable person would do because none of the same elements of risk exist in a rural setting. Accordingly, when assessing whether to evict a tenant due to a discharge of a firearm, one must always consider the facts and circumstances surrounding the discharge of the firearm. In most cases, the court will find that any discharge of a firearm in a multi-housing property constitutes an illegal discharge of a firearm due to the proximity of other tenants, and the risk of -- potential death -- posed by the conduct. However, as mentioned previously, some tenants will discharge a gun and then contact local police to report the discharge before property managers have the opportunity to do so. If the police find that the discharge was accidental, or not illegal pursuant to the statute, they will note that information in the report. Tenants are relying on these reports to argue that the discharge was not illegal and that they cannot be evicted under A.R.S. §33-1368(A)(2). Simply because a discharge of a firearm may not be illegal, however, does not prevent a landlord from immediately terminating the lease of tenant who discharges a firearm on property. A.R.S. § 33-1368(A)(2) also states that the landlord may move for an immediate eviction based on a “…breach of the lease agreement that otherwise jeopardizes the health, safety and welfare of the landlord, the landlord’s agent or another tenant…” (emphasis added). This section of the

statute allows a landlord to immediately terminate a lease agreement if the tenant’s conduct jeopardizes the health, safety and welfare of the landlord or another tenant. So, while the discharge of a firearm may not be technically illegal under A.R.S. § 13-3107, it undoubtedly poses a risk to the health, safety and welfare of the landlord and other tenants in a multi-housing setting. Accordingly, should a tenant present evidence at a hearing or at trial indicating that the discharge of the firearm was not illegal, the landlord may still move forward with immediate termination because the conduct jeopardizes the health, safety and welfare of the landlord and other tenants.
