BUSINESS MANAGER’S REPORT With Labor Day now behind us, I hope all is well with you and your families, and you all enjoyed the summer despite the unsettled weather patterns we experienced. As we enter into the last quarter of 2021, I am pleased to inform you that we are currently enjoying one of the busiest years since the Big Dig. Also, our projections indicate that this trend will continue for the foreseeable future.

The Senate has passed this bill and we're waiting on the House to pass it as well. In addition, it will be the largest federal investment in public transit ever. This will also connect prevailing wages and labor standards to the jobs created, which will help drive a strong and just economic recovery. Many of these jobs will be employment for the Operating Engineers across the nation and the members of Local 4.

Recently the surge in COVID-19 cases, hospitalizations, and deaths across the nation due to the Delta variant has prompted me to, again, make some important but necessary decisions. The objective of these decisions is to help curb the spread of this deadly virus and ultimately save the health and the lives of Local 4 employees, members, and their families. This important seminar will showcase financial security and personal healthcare. It will also include lunch, new and exciting raffle prizes, a stadium tour, and a chance to meet with some of the New England Patriot alumni. This year’s program will also include activities for our children. On Saturday, December 4, we will be hosting our Local 4 Children’s Hospital Annual Blood Drive at the Engineers Training Center in Canton. The gift of blood is the gift of life. As we move into the fall season, the work in the Boston area is very robust. If you are out of work and looking, please call, and we will try our best to get you out. That being said, please help us help you and have all your licenses and certifications up to date. Here is a look at some of the ongoing work in my area. Marr Crane is working at Conley Terminal in South Boston installing the three new container cranes on the dock for Massport. They facilitated the unloading and mobilization off the barges. D.W. White is still ongoing on the new berth out there as well. McCourt is doing infrastructure work at Conley Terminal. For all three of these jobs, a TWIC card is needed to get on the property. There is a lot more work to come at that site. Turner’s Amazon job in the Seaport is moving right along. Metro Glass and BrightView are busy along with Marr’s three hoist operators. AA Will is driving the sheet for the second building now and will start slurry walls and dig out soon. JMA’s Whiskey Priest job is still moving along; G&C is doing the concrete and Marr is in the process of setting up the hoist. The Suffolk 400 Summer Street job, with Boss

For the first time in a while, we are adding to the ranks of the Field Engineers with transfers and a member from the non-union ranks. The Training Center, with the help of Training Coordinator Mike Carey, is working on some training programs for Field Engineers to bring them up to some current systems. It has been hard for the Engineers to keep up at times and hopefully this will help. With the amount of work out there, please be more safety conscious, I have had several small accidents happen within the shop environments and on the road, we all want to go home so again take notice. Brothers and Sisters, As always, let me begin by offering my sincere wishes of safety and health for you and your families. I hope you enjoyed the summer months! As we move into fall, here’s what’s been going on since my last report. Organized Labor continues to chip away in Augusta legislatively. Below are some victories from the last session I was happy to be involved in with the Building Trades. When I last reported on LD. 336, “An Act to Encourage Research to Support the Maine Offshore Wind Industry,” I did not have the Governor’s signature yet. This was eventually signed into law. LD. 336 mandates that when requiring the negotiation of, or directing an investor-owned transmission and distribution utility to enter into, a long-term contract with an entity for capacity, energy, or renewable energy credits associated with the development of a floating offshore wind research array project, or obligating funds pursuant to such a contract, the Public Utilities Commission shall require the use of a Project Labor Agreement, to be negotiated and executed by the entity seeking the long-term contract. LD. 469 has been debated for over 20 years. It’s not a heavy lift to require OSHA 10 here in Maine, but they had a real problem with it. It makes you wonder why that is the case. LD. 469 mandates that any and all construction workers have OSHA 10 training on state "public works" projects. In the Maine statute, “public works” is defined as projects receiving any state funding and amounting to a cost of at least

LD. 648 reserves Maine Apprenticeship Program funding for quality apprenticeship programs, stemming the flow of state funds to low-road apprenticeships. This law sets standards for approval of funds for registered apprenticeships for programs that compensate workers at a beginning wage of at least 1.25 times the Maine minimum wage and culminate at least 1.5 times the Maine minimum wage upon successful completion to journey-workers status. LD. 1733 mandates that as a condition of awarding $20M of federal funds allocated to the Maine State Housing Authority for existing financing programs to a developer to expand affordable housing options, that the Maine State Housing Authority shall require that developer to enter into a pre-hire, collectivelybargained Project Labor Agreement with the workers who will build the affordable housing. A Project Labor Agreement must apply to all workers who build affordable housing, including those employed by a contractor and all subcontractors of the developer. A Project Labor Agreement must protect the collective bargaining rights of the workers involved in building affordable housing. LD. 1733 also provides approximately $15M of federal funding via the Maine Department of Labor and the Governor’s Energy Office to explore and expand registered apprenticeship and pre-apprenticeship activities in the state of Maine. As the saying goes, “If you’re not at the table, you’re on it.” We’ve been on it for far too long and will continue to introduce better conditions for the men and women of Local 4. • CMP Clean Energy Connect Project continues to provide opportunities. If you’re available and interested in getting on the project, please let me know. NCI sends weekly requests for operators and more contractors will be coming on. • Malcolm Drilling is set to begin foundation work for the new international bridge between Madawaska and Edmundston. The new bridge

will cross the St. John River at approximately a 45-degree angle and be upstream from the existing bridge. • Westbrook, Maine - LMC’s pipeline expansion is getting close to completion. • Maine Medical Center, Portland, ME - Maxim will have two tower cranes by November for Prime. Marguerite Concrete is onsite. • Naval Shipyard, Kittery, ME - Whiting Turner will have Hub Foundation as well as Marguerite Concrete as subs to construct waterfront support field shop operations for naval submarine work at PNS. Marguerite has also secured the concrete work for the new 60M Tower on Federal Street in Portland. • Miron Construction entered into a project agreement at LP Houlton, Maine. This is a $150M expansion of the Louisiana Pacific Mill. • Badger Daylighting who has been busy in Southern Maine has now begun operations in the Bangor area to capture that market. • SPS, Kittery, ME: Chris Carey and I had the opportunity to be with Congressman Jared Golden and SPS Leadership underneath the Piscataqua River Bridge in Kittery for a press conference about the $1T infrastructure package that passed the U.S. Senate. This legislation would provide Maine and New Hampshire with tens of millions of dollars for road and bridge repair. It also should be noted that SPS, with the help of Local 4, is 6 weeks ahead of schedule on the Piscataqua Bridge rehab project! This is allowing paving to be completed before the winter. In conclusion, congratulations to the graduating apprentice class of 2021. Well done, and best of luck to you all! Local 4 served as the host for IUOE Northeastern States Conference 2021. I hope that you all have had a wonderful summer. As we move into fall, I would like to start by congratulating the graduating apprenticeship class of 2021. You committed to a four-year program that required a lot of your time and effort, but as you will see, your hard work will pay off. I wish you all a long and prosperous career with Local 4. The Golf Committee has put together another great Local 4 outing. Thank you, Business Manager Bill McLaughlin, David Shea, and David Fantini, for all of the thought and effort that went into this year’s charitable golf outing. It was great to see everyone and spend some time outside of work getting together.

With the Metropolitan Boston Building Trades Council and some of the organizers from other trades, we have formed a committee to start up a program called Spotio. The Metropolitan Boston Building Trades Council created and funded the program, but we will begin using it throughout our jurisdiction. It will allow us to input shared information about open shop jobs so that we can build up a database that shows who is doing the work. We can see the owners of the project, the project managers, general contractors, and sub contractors on the job. We are at the beginning stages of this but it is something that we are heavily involved in, and I believe will become a very useful tool.

The last piece of legislation that I will mention affects a project that is not in our jurisdiction but is important to us because it sets a precedence for public PLAs in Massachusetts under this Governor. Governor Baker previously said that he would never support a public PLA and he stuck to his word for the Holyoke Soldiers Home Rebuild. The Senate and the House passed a bill that would provide $400 million for the Holyoke Soldiers home to be rebuilt. In that bill, there was language that included a PLA. Baker vetoed the PLA amendment, so the House and Senate had to go back and override that veto. This was an important bill because it highlighted the importance of a public PLA and that it can and should be used for projects in the future.

Project Spotlight

BUILDING THE NEW AMAZON LOGISTICS FACILITY IN NORTH ANDOVER, MA Local 4 Operating Engineers are hard at work in North Andover at the Amazon Logistics Facility site. After existing buildings on the property were demolished, a new 3.8 million square foot warehouse is being constructed. This project is an integral aspect of Amazon’s expansion through Massachusetts and the Greater Boston Area. Five Local 4 contractors are currently working on the new facility. Former buildings at the North Andover site have been partially demolished, and JDC Demolition played a vital role in this process. D.W. White, S&F Concrete, and American Crane are also involved, tackling steelwork, dirt work, and

developing concrete. Brox Industries has also been awarded all on site paving and is currently on the job. We are proud of our members for their participation in this notable undertaking. Around 50 Local 4 members are currently working at the job site. The facility is scheduled for completion in August of 2022 and will also feature expanded parking, solar fields, and new landscaping on 110 acres of land.

We are hopeful to have a more conventional school year this year with apprentices back to in-person classes. It will be great to have the new apprentices together and experience the camaraderie of Local 4. Thank you to Business Manager Bill McLaughlin for his leadership through this difficult and constantly changing pandemic. I would like to bring to your attention that NCCCO has decided to move away from its shorter recertification testing. The new testing format will be longer and essentially the same as the written testing done to receive a given endorsement. This change will be instituted on December 1, 2021.

Greetings Brothers and Sisters, As we move into the fall months, I hope you and your families had an enjoyable and prosperous summer. I would like to thank Business Manager Bill McLaughlin and his team for their hard work in restoring our Body Meetings at Florian Hall. It was great to see everyone again. Hopefully, as vaccination rates climb, we will be able to continue them and hear about the exciting things being done by our great union. On the topic of safety, I would like to spend some time reviewing the Excavator Manual that is provided by DigSafe. The manual is provided free by DigSafe and is available to order on their website. We also have copies at the training center. It is a convenient reference for anyone involved in excavations. DigSafe serves as a link between the excavator and the utility companies. They are a call center and do not mark any lines. The utilities or a private contractor who works for the utilities mark their own lines. DigSafe is a free service available to anyone. You may reach them by calling 811 or 888-DIG-SAFE. They are open Monday through Friday from 6 a.m. to 6 p.m. You must call DigSafe 72 hours before you begin any excavation in Massachusetts, Maine, and New Hampshire. In Massachusetts and Maine, you must call regardless of where the excavation is. In New Hampshire, you must call when working within 100 feet of underground utilities. This includes private property. DO NOT rely on the old mark or faulty information. Mark out the area that you plan to excavate with white paint, flags, or stakes. Include the name or initials of your company. In Massachusetts, if the excavation starts within 30 days the ticket is valid indefinitely. Respect The Marks!! You are responsible for maintaining the marks placed by member utility companies on your site. Hold a pre-excavation meeting and walk all employees through the site and not the location of all the utility markings. Pay special attention to any change in direction that the underground facilities take. If your excavation causes the disturbance of the markings,

establish offset marks in order to maintain a reference point for those facilities. Don’t put spoil piles on top of markings. Avoid driving machinery over stakes and flags. If marks have faded or been compromised, contact DigSafe to request a remark. Once again, I would like to wish you a safe and prosperous fall season. Boston Children's Hospital provides donations to pediatric patients who need them. In the midst of a pandemic, donations are needed more than ever. Many blood drives were rescheduled or canceled, greatly reducing the amount of available blood. Did you know that one adult donation can be utilized for up to four children?
