The ICC and the Philippines: Time to Withdraw THE INTERNATIONAL Criminal Court has declared its intention to focus upon the Philippines. The ICC chief prosecutor has said she is “deeply concerned” about alleged human rights abuses in the

country. What she did not add is that much of the world is deeply concerned about both the credibility of, and the many abuses within, the ICC. The picture of the ICC that has emerged in recent years is of a cor-

rupt institution with many questions to answer. It is also the case that many countries, especially within Africa, believe they already have the answer to these queries. Continue on page 7

SOME P59 million worth of projects are set to begin in Sulu and most of the fund will go for the construction of a two-storey school building and the fencing of another school in the province.

Miracle Crusade Tuguegarao Choir took part in the 16th anniversary of the victorious Talipao Mindanao Peace Mission in Manila. The anniversary remembered how Jesus Miracle Crusade founder, Evangelist Pastor Wilde E. Almeda, led a brave team of prayer warriors inside an Abu Sayyaf stronghold in Sulu province in southern Philippines in 2000 to convince the rebels to release the 21 Sipadan hostages and eventually share God’s word with them after the notorious group agreed to free the foreigners. Through fasting and prayers, the impossible mission was made possible by God’s grace. The anniversary gathering was filled with living testimonies of God’s signs, wonders and miracles of some of the selected brethren among millions of followers in the country and other parts of the world.

After the crusade, the brethren from Tuguegarao travelled back for over 12 hours and got welcomed by the aftermath of Super Typhoon Lawin, but amidst the circumstance, the brethren remained grateful to the Almighty for keeping everyone safe. Zero casualties were announced in Tuguegarao and that is more than enough for material things can be brought back a hundred folds. In fact, we received a message from members of the Jesus Miracle Crusade in Canada that they will be providing relief goods for the typhoon victims. They said undeniably, God’s providence is upon those who believe and walk in God’s righteousness. and Saidul Idul. President Rodrigo Duterte and Malaysian Prime Minister Datuk Seri Najib Tun Razak agreed to deepen collaboration in stemming the kidnapping incidents in the SuluSulawesi Seas. Just early in November, Abu Sayyaf rebels killed a woman, Sabine Merz, 56, and snatched her German companion Jurgen Kantner, 70, after attacking their yacht off Sabah, just several nautical miles from the southern province of Tawi-Tawi also in the Muslim autonomous region. The woman was naked when found in the boat could had been raped. A shotgun was also found near her body. The Western Mindanao Command tagged Abu Sayyaf subleader Muamar Askali after he phoned a media organization in Zamboanga City to say that they are holding Kantner. Askali also demanded P500 million for Kantner’s safe release. In April 2014, Askali’s group also kidnapped two German yachters - Stefan Viktor Okonek, 71, and Henrike Diesen, 55, while heading to Sabah from a holiday in the Philippines. Askali originally demanded from Germany – on top of the P250 million ran-

soms - to cease all support to U.S. coalition campaign against ISIS which is fighting for Islamic caliphate in Syria and Iraq. The Abu Sayyaf had threatened to kill the German couple if the military launches a combat operation against the notorious group tied to the ISIS. The duo was freed six months later after the German government paid the ransoms delivered by Filipino security officials. The Abu Sayyaf is still holding more a dozen Malaysian, Indonesian and Vietnamese sailors kidnapped this year in Sabah and Basilan. The Abu Sayyaf group, formed by Ustadz Abdurajak Abubakar Janjalani in 1992, continues to recruit members to fight the government in their attempt to set up a strict Islamic state in Mindanao. It now has hundreds of members in the Muslim autonomous region and the military failed to stop the growing influence and violent campaigns of the rebel group because it did not sustain the combat operations needed to wipe out the Abu Sayyaf in the restive region. ARMM’s 27th anniversary celebration highlights the region’s history, struggle COTABATO CITY – The Autonomous Region in Muslim Mindanao (ARMM) marks its 27th founding anniversary with a month-long celebration highlighting the history and struggle of the Moro people in the region. Governor Mujiv Hataman noted that the 27 long years of ARMM could not be attributed to the efforts of the regional

government in leading its constituents, but to the people in the ARMM who manifest the success of the region. “Ang araw na ito ay hindi lamang pagdiriwang ng ating anibersaryo, kung hindi pag-alala rin sa ating kasaysayan sa loob ng 27 taon,” Gov. Hataman said. The anniversary celebration officially opened on November 19 at the region’s seat here. It started

ARMM guv nominates Moro appellate court justice to Supreme Court COTABATO CITY – With the Supreme Court Justice Jose Perez set to retire on December 14, ARMM Governor Mujiv Hataman has endorsed Court of Appeals Associate Justice Japar Dimaampao to occupy a seat in the highest court of the land. Hataman has sent a letter to the Judicial Bar Council to nominate Dimaampao, citing the latter’s achievements and track record as a law practitioner. “Justice Dimaampao is publicly known as a highly respected justice especially in the Muslim community. As a Bangsamoro himself, Justice Dimaampao carries with him the aspiration to uplift the lives and pursue the rights of his fellow Muslims,” Hataman writes. Sworn in at the age of 40 in 2004, Dimaampao is the youngest magistrate

to be appointed to the Appellate Court. A proud Bangsamoro, Dimaampao holds the distinction of being the first and only Muslim senior state prosecutor. He is a known luminary in Shari’a Law in the Philippines, and holds a position as a professional lecturer of the Department of Shari’a Law and Jurispr udence of the Philippine Judicial Academy of the Supreme Court. Apart from being an associate justice in the Court of Appeals, Dimaampao is also an educator. He teaches Taxation, Commercial Law, and Civil Law in at least three law schools in Metro Manila. He also conducts Bar Review classes all over the country. This isn’t the first time for Dimaampao to be nominated for a place in

the Supreme Court bench, with endorsements dating back to 2010. The nomination is in line with the Organic Law for the ARMM, also known as Republic Act No. 9054, which states that “it shall be the policy of the central government or national government that, whenever feasible, at least one justice in the Supreme Court and two justices in the Court of Appeals shall come from qualified jurists of the autonomous region. The said law also gives the ARMM Regional Governor recommendatory powers, after consultations with the ARMM Regional Assembly and other concerned sectors, through which he may submit names to the JBC for consideration prior to the nomination a new Supreme Court justice. Hataman said. In light of the sudden burial of the late President Ferdinand Marcos on November 18, Gov. Hataman, during his speech, took the time to ask for a minute of silence to show solidarity with the victims of Martial Law. History, he said, will not be forgotten. “Tayong lahat ay parte ng kasaysayan, at tagumpay ito ng ang ating mga kababayan,”Gov. Hataman said.

Keynote speaker Maj. Gen. Carlito Galvez inspired the regional government to continue its reforms. The Hataman administration, he said, has significantly transformed the ARMM from war-torn lands to a worldclass region. He specifically noted that President Rodrigo Duterte, during his visit, was surprised with the regional government’s top-of-theline facilities and had only good impressions of ARMM employees. President Duterte also mentioned how his visit was gracefully handled. Through Maj. Gen. Galvez, the Philippine Armed Forces reinforced its commitment in support of the reforms in the region especially in terms of the security challenges in Sulu

and Tawi-Tawi. During the program, Gov. Hataman led the distribution of 13 units of non-motorized bancas to fisherfolk from Maguindanao; 14 passports processed for free, and Moro film festival citations. Sheron Dayoc, director of Moro independent films ‘Halaw,’ ‘Crescent Rising,’ and ‘Women of Weeping River,’ and the films’ actors were given citations during the opening program. The films were shown during last week’s Moro film festival. The governor also forwarded a message of unity and called for solidarity in the midst of societal challenges and issues that continue to divide the Filipino people. (Bureau of Public Information)

The ICC and the Philippines: Time to Withdraw Continued fr om page1 from It took Africa just over a decade to conclude that the International Criminal Court, established in 2002 by the Rome Statute, is simply unfit for purpose. That certainly is the conclusion of the South African government. It has declared its intention to withdraw from the ICC and it will be followed by several other African states, including Burundi and The Gambia. The institution many African states, and other countries such as the Philippines, signed up to post 1998, a court that promised to pursue injustice without fear or favor, is not the one they see before them today. The international community was sold a false bill of goods. The ICC’s claims to international jurisdiction and judicial independence are institutionally flawed and the Court’s reputation has been irretrievably damaged by its racism, blatant doublestandards, hypocrisy, corruption and serious judicial irregularities. While the ICC presents itself as the world’s court this is simply not the case. Its members represent just over one quarter of the world’s population: China, Russia, the United States, India, Pakistan and Indonesia are just some of the many countries that have remained outside of the Court’s jurisdiction. A court is also only as credible as its independence. Far from being an independent and impartial court, the ICC’s own statute grants special “prosecutorial” rights of referral and deferral to the Security Council – by default its five permanent members (three of which are not even ICC members). Political interference in the legal process was thus made part of the Court’s founding terms of reference. The Court is also inextricably tied to the European Union which provides over two-thirds of its funding. The expression “He who pays the piper calls the tune” could not be more appropriate. The fact that the big five ICC funders are former colonial masters also sits uneasily with a developing world suspicious of recolonization by questionable legal diktat. The EU is additionally guilty of blatant political and economic blackmail in tying aid for developing countries to ICC membership. Africa is also correct when it points out that the ICC is self-evidently a racist court, in that it treats one race of people differently to all others. Instead of impartially enforcing the Rome Statute, the Europeans have chosen to focus the Court exclusively

on Africa. African heads of state have spoken of "race hunting". Despite having received almost 9,000 formal complaints about alleged war crimes in at least 139 countries, the ICC has chosen to indict 36 black Africans in eight African countries. In so doing the ICC has ignored all European or Western human rights abuses in conflicts such as those in Afghanistan and Iraq or human rights abuses by Western client states. It is now looking at the Philippines. The ICC has emerged very much as a Europeanfunded and directed instrument of European foreign policy. Broader western hypocrisy is all too evident. The United States has forcefully pointed out that the ICC is a kangaroo court, a travesty of justice open to political influence and that no American citizen will ever come before it. Washington is nonetheless very happy, for its own political reasons, to demand that black Africans and non-Americans appear before it. Double standards and politics aside, the ICC has shown itself to be irretrievably dysfunctional. The court’s proceedings thus far have often been questionable where not simply farcical. Its judges – some of whom have never been lawyers, let alone judges – are the result of grubbily corrupt vote-trading among member states. Far from securing the best legal minds in the world this produces mediocrity. At least one elected “judge” had neither law degree nor legal experience but her country had contributed handsomely to the ICC budget. The Court has produced witnesses who recanted their testimony the moment they got into the witness box, admitting that they were coached by non-governmental organisations as to what false statements to make. Dozens of other “witnesses” have similarly disavowed their “evidence”. Most recently the ICC prosecutor had to admit that one of its own star witnesses in its case against Kenyan VicePresident Ruto was “a thoroughly unreliable and incredible” witness. And then there has also been the ICC prosecutor who was not only seemingly unaware of the legal concept of presumption of innocence but also threatened to criminalize third-parties who might argue a presumption of innocence on the part of those indicted – and as yet unconvicted – by the Court. A clearer case of Alice in Wonderland justice, along

the lines of “sentence first, verdict afterwards”, is difficult to find. There has been prosecutorial misconduct, not least of which hiding exculpatory evidence, which should have ended any fair trial because they would have compromised the integrity of any legal process. The ICC’s first trial proceeded erratically because of crass prosecutorial misbehavior and judicial decisions to add new charges half-way through proceedings, a move that was subsequently overturned. Simply put, the Court and the prosecutor have been making things up as they go along. The ICC claims to be “economical” and to bring “swift justice”, yet it has consumed more than a billion Euros in its 13 year existence and has only secured two questionable convictions. The ICC claims to be victimcentered yet Human Rights Watch has publicly criticized the ICC’s ambivalence towards victim communities. The ICC claims to be fighting impunity, yet it has granted de jure immunity to the United States and afforded de facto immunity and impunity to NATO member states and several serial abusers of human rights who happen to be friends of the European Union and United States. Far from bringing peace to Africa, the ICC’s doublestandards and autistic legal blundering has derailed delicate peace processes across the continent – thereby prolonging devastating civil wars. The court is responsible for the death, injury and displacement of many thousands of Africans. The ICC’s involvement in Uganda, for example, destroyed peace talks in that country, intensifying the conflict which then spread into three neighboring countries.” The reality is that the ICC is an inept, corrupt, political court that does not have the welfare of its members at heart, only the furtherance of Western, and especially European, foreign policy and its own bureaucratic imperative – to exist, to employ more Europeans and North Americans and where possible to continue to increase its budget – all at the expense of African lives. Any belief that it will produce anything positive in the Philippines is unfounded. The sooner the Philippines withdraws from the ICC, the better. Sharks, rays now being protected in Cebu CEBU CITY - Mayor Tomas Osmeña has signed an executive order towards the protection of shark and ray species. This after hundreds of people joined the festive "shark" parade calling for the city’s commitment to protect shark species. The environment group Greenpeace has praised Cebu's commitment and said the whole island of Cebu now has local ordinances that seek to protect sharks. Cebu's local government units, along with environmentalists, scientists and interest groups, are now calling for the protection of sharks and other marine species at a national level through the creation of interconnected ocean sanctuaries. "The decision of Mayor Tomas Osmeña is important as it turns the whole of Cebu into a shark and ray sanctuary. This is a very welcome development, as we just concluded the country’s 2nd Shark Summit, where an agreement was made toward the protection of all shark and ray species." "But our gains in Cebu and the implementation of the Convention on International Trade in Endangered Species of Wild Fauna and Flora listing will only work if we take this to the national level," said Vince Cinches, Oceans Campaigner of Greenpeace Southeast Asia and co-founder of Save Sharks Network of the Philippines. Cinches said the national government needs to hasten the revision and passage of Senate Bill 905 that seeks to protect all shark and ray species found within the country’s Exclusive Economic Zone. Greenpeace, together with Save Philippine Seas, Marine Wildlife Watch of the Philippines, also held recently the 2nd Shark Summit in Dumaguete City in Negors Oriental recently and it builds on the successful listing of

thresher, mobula and silky sharks for protection under Appendix II of the Conference of Parties to the Convention on the International Trade in Endangered Species of Wild Fauna and Flora. The listing doubled to 20% the proportion of sharks targeted by the fin trade that are now regulated internationally and this also means that the species are automatically protected in the Philippines under Section 102 of the Implementing Rules and Regulations of the Philippine Fisheries Code. Bimbo Fernandez, Osmeña's executive assistant on Special Concerns, and also a former Undersecretary of the Department of Interior and Local Government, said that despite Cebu being a highly urbanized city, the local government always put the protection of key marine habitats within our jurisdiction as a priority. "We strongly believe that market intervention is crucial to the overall efforts of protecting sharks, rays and the marine environment, and we call on our national counterparts to legislate a bill to sustainably manage shark and ray species, so that all our efforts will not go down the drain. Cebu City agrees that we need to go beyond protecting species listed in Convention on International Trade in Endangered Species of Wild Fauna and Flora.” Greenpeace said Cebu City hosts the biggest fish market in the region where catch from other parts of the country are being landed. And also hosts the country’s first and, currently, only shark and ray sanctuary. "Cebu is the only province in the Philippines that bans the catching, selling, possession and trading of all shark species and its derivatives," it said. Monad Shoal, near the Island of Malapascua in Cebu’s Daanbantayan municipality, is the only place in the world where thresher sharks could be viewed with certainty on a daily basis.

Threshers have become the main feature of the SCUBA dive tourism industry in Malapascua, which accounts for most of Daanbantayan’s economy, securing the livelihood of many in the municipality and its neighboring communities. “We, from the municipal fishing communities welcome this decision, as our livelihood and food is heavily dependent on the health of the seas, we haven’t seen them for years and we admit to hunting them down for food, as we are being robbed of the most important species every time commercial fishing operators cast their nets down in our waters. If we protect these sharks, we are also protecting our fishing grounds and the future of our community,” said Teody Navea of Sanlakas, which represent fisherfolk from various coastal communities in Cebu.” Dr. Alessandro Ponzo, of the Large Marine Vertebrates Research Institute Philippines, said "for us in the scientific community, the decision of Cebu City government is historical as Shark and Ray Science points to an unprecedented decline of these species" He said despite progress made in science, there is a dearth of knowledge in shark and ray species diversity, habitat, biology and threats in the country. "Interestingly, new species are being discovered during expeditions and market surveys. Rare species are even documented in Philippine waters, such as the megamouth shark the country having the third highest number of reports worldwide, and the critically endangered sawfish." "We need to have science to inform in the best possible ways for shark management. We need to move forward as a country together if we want to reverse this trend, if there are problems along the way, we can always fix it,” Ponzo said. (By Rachelle Nessia.
