TRUSTS & ESTATES 101: Why one financial advisor is making it his mission to challenge what people think they know about estate planning Interview aired on AZ Midday with Destry Jetton

J - You bet, and it’s about a different mindset for each one of them. So I created a seminar series called Trusts & Beyond. And we do this seminar four times a month in some of the Scottsdale restaurants, we also do it at our beautiful facility over on 90th and Bahia. And we talk about estate planning and trust planning in a way that is uncommon in the industry. We really talk about it from the bottom up. The administrative side… why they build the documents the way that they do, how to administer them, how to really understand what the document is all about - and that’s really what we’re about--- education. D - Why did you decide to do this seminar?

D - Now this affects so many people, well, pretty much everyone, right…. Is going to face retirement at some point. Tell us about NetVEST Financial and what you do.... J - Well NetVEST Financial LLC has been in business since 1996 when I founded the company. We’re first and foremost a financial advisory firm, so our financial advisors manage assets -- stocks, bonds, mutual funds, life insurance, annuities, etc. We’re an independent branch of LPL Financial*, which is the nation’s largest independent firm out there. And one of our differentiating features is that we also have a special focus on estate planning. Not just in retirement planning but in estate planning, so it’s not only about getting there. It’s about what to do while you’re there and what to do after you’re no longer there. D - Every step counts. *As reported in Financial Planning Magazine, June 1996-2016, based on total revenue.

J - Well because we have found in the past that people do not realize what’s really in their trust documents. And how to make sure they’re funded properly and that they should really be in control of it and no one else should be in control of it. And then we begin to see what their asset arrangements are and then we begin to see the problems out there. And that’s what’s really important-- to help people find out what the problems are in asset growth, asset management, and estate planning as a whole-- to help them resolve those issues.

People do not realize what’s really in their trust documents. D - Well a lot of people think “Okay, I’ve got a Will, I’ve got a Trust, I’m set.” And that’s why you say, come to the seminar because that’s not all there is to it… J – Exactly. A will means “you will go to probate.” It’s really simple to remember. And a trust means that you’ve got a complex structure that you need to understand inside and out so you’re not caught in a trap at those inevitable moments in time that are going to occur.


D - What would you say are the biggest misconceptions or problems that you encounter when you give people a complementary analysis, because I know that’s something you do at NetVEST. J - Sure, you bet. I want people to come after the seminar presentation, sit down with us one-on-one. But the two big things that we find that are problematic is just what you said, “I’m set - I have a trust …” oh no you’re not. You have to understand what the structure is. You wouldn’t form a corporation without understanding how to run it, you shouldn’t form a trust without understanding how to run it. And the second most obvious problem that we see out there is how people have been sold particular products out there from an investment standpoint that are very, very problematic. Immediate annuities and particularly index annuities are causing grave problems in people’s investment plan by creating a control mechanism over the client’s money.

D – So people go to the seminar and learn about trusts, about wills, and get an analysis of what they have and find out “Okay, this is what NetVEST can do for me.” Why do you tell people out there that it’s important to get that complimentary analysis after going to the seminar? J - Well because in the world of estate planning, it really needs to be thought about from the financial side first. In other words, how do you know your trust is even going to do what you think it’s going to do if someone hasn’t really analyzed the financial aspect at all? It’s got to be from the outside looking in and not from the inside looking out. You’ve got to look at all the pieces: how do all the pieces fit into the estate, where are they going to go today, where are they going to go at the first death, where are they going to go at the second death, how are they going to be distributed to the final beneficiaries? Is it important to make sure all of your beneficiaries receive all of the assets? Not necessarily, there are some advantages that you can have by keeping your assets in trust. So after you get an educational overview at the seminar, it’s really important to have a meeting to get indepth about your personal situation.

I

’ve always loved to read, and as far back as I can remember, my mother had always read to me at night before going to bed. As I got older, I continued this tradition, staying up to the first break of daylight on weekends devouring book after book. After finishing up a good novel, my thoughts would spin everywhere and I often found myself starting my own stories in my head based on what I had read—an intro or a new ending or plot twist.

However, I never thought to put those thoughts on paper until I took my first creative writing class in high school. That’s when the magic happened. I can still recall the feeling of pure bliss and excitement I had after finishing my first short story—a mystery/ romance piece. There was just something so beautiful about the way the words flowed together on paper and how I could manipulate them to change the whole feel of the story if I wanted to. It was a moment that ignited a spark of passion in me that has yet to fade. Every time I write something, whether it be a magazine article or story, I am still in awe of how truly fulfilling creating something all my own is.

A LOCAL SCOTTSDALE ARTIST INSPIRES PEOPLE TO SEE THE ‘FUN IN THE MUNDANE’ ARTICLE ALISON STANTON

J

oye DeGoede was just 10 years old when she won her first coloring contest and had some of her artwork commissioned. In an effort to channel their daughter’s creative ambitions—and probably redirect DeGoede’s penchant for carving into mirrors and painting on walls—her parents enrolled her in private art lessons. As DeGoede grew up and entered the working world, she never lost her passion for painting. She began working as an art teacher for private and public school systems, but always found time for her own projects. 18

“When I was working full time, I would create on my off hours. There were many late nights and early mornings. What is funny is that it never seemed to be ‘work,’ just pure bliss,” she says. In 2012, DeGoede quit her job of 18 years and became a self-employed artist. “I decided to take the jump into being a full-time, self-employed artist. I wanted to have time to paint all day in my studio,” she says. Since then, the Scottsdale resident has stayed quite busy following her penchant for painting. In fact, DeGoede says she continues to learn and find something new to love about art every day. “Every step on my path as an artist has new lessons. Right now, one of those new lessons is being the head artist in residence at the Sonoran Arts League Gallery at el Pedregal,” she says. DeGoede, who works primarily with oil paints, but also uses pen and ink, pastels, graphite pencils and colored pencils, says her work falls into the “representational realism/surrealism” category. “What I mean is my work juxtaposes reality with fantasy, inspiring the viewer to see the fun in the mundane and the vast opportunities for joy in our everyday world. I love painting the surrealistic mixture of animals imitating human habits and in their natural habitat. I incorporate the technical skills with a fun story,” she says. This playful depiction of animals acting as humans—which DeGoede calls the “JoyEful Party Animals” series—inspired DeGoede to take an “unanticipated, fun turn” with her work. “I was very serious about my subject matter in the past,” she says, adding that she used to paint very traditional subjects like landscapes, still life, florals, architecture and portraits of pets and people, including Arizona’s past Governor, Jan Brewer. “All that changed when I was searching for my ‘artistic voice,” she says. After enjoying cocktails with her “fun Aunt Joye,” DeGoede’s namesake, and a fan of scotch and rabbits, DeGoede painted a little rabbit and a glass of scotch for her beloved aunt. “I titled him ‘Hop Scotch,’ and when I posted him on my website and social media, he sold before I could send it to her.” “Hop Scotch” sold so well that DeGoede decided to try painting other animals with their “drinks.” After this, the “JoyEful Party Animals” series was born. “People are passionate about their animals and beverage of choice. I have people bringing me their favorite bottles of alcohol, drinking glasses, and their pets to paint,” she says, adding that during a 10-month period in 2016 she painted and sold over 65 “JoyEful Party Animals.” DeGoede has now compiled many of the images into a book titled “The JoyEful Party Animals – The Celebration Begins.” Thinking about her artwork, DeGoede says she hopes her work will cause people to slow down for awhile and to see everyday life from a different viewpoint—and smile. “I love making people smile and laugh. His passion continued as he attended Scottsdale Culinary Institute. At 22 years old, he opened his first restaurant, Joey’s California Bistro, in San Diego. Now, with seven restaurant concepts tucked under his chef’s hat, Chef Joey continues to create amazing cuisine which, indeed, runs in the Maggiore blood. CULINARY ROMANCE

Love was in the air the night Chef Joey met his charming wife, Cristina, while they were both attending a wedding with their


respective dates. It wasn’t long after that they began dating, and within months, he proposed at a family event surrounded by 200 relatives. It was a match made in heaven’s kitchen, as both come from Sicilian families in the restaurant industry. Eighteen years and three beautiful children—Giuliana, Tomaso and Melina— later, they have definitely found the right ingredients for blending business with family. “Cristina is my right hand; she oversees the restaurant operations, including the wonderful design. And, Flora Tersigni, CEO of Maggiore Culinary Concepts, is my left hand. Together we make an incredible team,” shares Chef Joey. BLOODY MARY BAR

There are so many amazing items listed on the menu that I recommend you arrive hungry, as you’ll want to try a few. I sampled a delicious Carnitas Hash of braised pork, Hash potatoes, two eggs, avocado slices and fried onion rings. The pancake flight is another great choice, with four oversized pancakes: lemon, carrot, s’mores and Oreo. They’re so flavorful that I found I didn’t even need syrup. Another treat was the homemade buttermilk biscuits, and the yummy cannoli donuts. And my Hash Frittata was incredible. Other favorites include Breakfast Lasagna, Eggs Benedict, Scrambler’s, Waffles and Breakfast Bruschetta. You’ll also need to enjoy a flight of Mimosas; which flavors change daily. Not to be out done, the lunch menu offers some tasty sandwich choices like a salmon BLT, a cubano made with roasted pork and black forest ham, and the brisket pastrami. There are also a few unique burgers choices, which include the bacon and eggs burger, the quinoa burger and the notorious burger. No detail has been overlooked by this talented husband and wife duo either, who add DJ background music on weekends, providing an even more pleasurable experience. W

hen Indiana Jones first hit movie theaters back in 1981, he introduced archeology to a generation that has now become leaders in the field. For a kid in Ohio, however, he found his inspiration not just in the adventures of Dr. Jones, but also in his fedora, and with that, crafted a one-of-a-kind career in which he has few peers. “When I was twelve years old I wanted a good Indiana Jones hat,” says Eric Watson, owner and hat maker at Watson’s Hat Shop in Cave Creek. “I couldn’t afford a nice one, so I always ended up with a cheap hat, which pretty quickly lost its shape or just fell apart, and remember thinking that there was no way that these were the hats they were using in the movies.”

After researching traditional hat making at the library, Watson started having his mom take him to antique stores, where he would look for old hats to fix up, taking the time to examine their details. Through his research, he learned that beaver fur felt was the best material for hat making, and taught himself how to tell the difference by the touch and feel of the material. He then spent the better part of his teenage years collecting and restoring those hats to their original beauty. After achieving degrees in Aviation Technology and International Studies, as well as obtaining his commercial pilots license, Watson found himself fresh out of college, with little work experience and in the heart of a recession.


With few other prospects on the horizon, Watson told his wife that he wanted to learn to make traditional, custom hats. He dug out whatever materials he had left from his father’s garage and found one solitary, old hat maker who would take his phone calls and offer a couple of tidbits to get him pointed in the right direction. After honing his skills and finding a storefront, Watson’s Hat Shop opened in 2012. “From the felt to the liners, hatbands, leathers and buckles, all the way down to the thread, every single raw material we use is made here in the United States, and we’re very proud of that,” says Watson. Pride also emanates from the craftsmanship and tradition that are trademarks of every one of Watson’s hats. Most of the equipment used comes from one of Boston’s oldest hat shops, which operated from 18601989, and scores of antique crown irons and hat blocks scatter the shelves. Even after all these years, a medieval-looking contraption called a conformateur is still the best way to transcribe the shape of a customer’s head, and Watson’s 1890s Paris model is as accurate today as it was over 120 years ago. In addition to creating new hats, the shop still does hat restorations, some of which prove to be just as rewarding as making one from scratch. Watson tells the story of a customer whose father had recently passed away. He was a local police officer, and she was hoping that Watson could refit his officer’s cap to fit her. Watson did, and when she placed it down on her head for the first time, she was so overwhelmed with emotion that tears started streaming down her cheeks. “I have always said that this, in its own way, is Eric’s ministry,” says his mother, Dawn, who also works at the shop. “If you’re not doing something that impacts other people, brings some joy to the world, then what’s the point?” Watson's Hat Shop is located in Stagecoach Village in historic downtown Cave Creek. F

or someone who has built such a successful following in the local art scene, it’s hard to believe that Bela Fidel originally didn’t plan on being an artist, having had dreams of becoming a writer before she discovered painting in oils. “Early on in the sixties, on a whim, I started playing with oils and continued ‘playing’ for a couple of years until I decided to take formal classes. In Brazil, I studied diligently for five or more years while painting non-stop, never thinking that painting would become a lifelong passion,” she explains. “After 10 years of painting regularly, I realized that this was what I wanted to do, this was what I needed, and that this was an integral part of who I was. I have never looked back.” In truth, Fidel has not had much time to look back. “I’m always busy looking ahead, trying different mediums, aiming higher and higher, demanding more and more of myself. My curiosity seems to have no end and it cannot be lassoed in: it eggs me on and on, relentlessly.” Born in Brazil, Fidel studied in Jerusalem and in the U.S. Her education and background are multifaceted: she has a B.A. in English and Spanish Languages and Literatures from the Hebrew University in Jerusalem and also studied makeup artistry in Los Angeles. She’s worked as a translator in many languages, a secretary, a makeup artist, and is now a full-time artist and art teacher out of her studio in North Scottsdale. “At the risk of using a cliché, my studio is my retreat, my sanctuary, my battlefield—depending on the day,” she says. “It is where I face my angels and demons, where I get to know myself. It is where I get hurt and where I heal; where I learn humility, patience, persistence, as well as despondency, despair and many other existential challenges. I believe, though, that it is this emotional rollercoaster that enables me to deepen my work, bring meaning to it and touch other people’s hearts.” In recent years, Fidel has earned several accolades for her work, including Honorary Mentions from the Holocaust Museum and the West Valley Arts Council; a first prize in Mixed Media from the Arizona Art Alliance; and a third prize from the Arizona Art Alliance at an exhibit that took place at Vision Gallery last April. Fidel is known best for her work with oils and mixed media. She also uses and teaches the encaustic technique, which involves using hot wax and a heat source with a variety of artistic mediums. cottsdale artist and designer Ruby Farias can take anyone’s little black dress and pair of high heeled shoes and paint them with an elegant gold trim to refashion a modest outfit into a chic, one-ofa-kind ensemble. She can breathe life into a plain pair of sneakers with the fabric paint she creates herself, or transform a wall flower into a sassy diva who stands out in the crowd with her unique embellished gowns. Farias’s designs attract attention from all over with their exceptional style and flair. Even something simple like her black, high heeled ankle boots— hand-painted with red fringe along the top and delicate swirls along the toe— are a statement piece. “Once you wear one of my designs and see the attention that you get, it builds you up, makes you feel good and builds confidence,” she says. “I understand who the person is before I begin,” says Farias. “I create just for you.” Her clients may come to her with a color scheme in mind or an event they want to dress for, but she prefers to sit in the driver’s seat when it comes to design. “Clients will go through my portfolio to give themselves ideas, and for me to get a better understanding of their likes. Then I will move on the vibe I get from the client to create something new for them,” says Farias. Her clients typically meet with Farias in her home. Some bring their own garment or accessory for her to work with, while others want assistance. “I have my own little space where I work and can fit someone into something I have. I’ve done shopping for clients and have gone shopping with clients if they want something specific,” says Farias.


A MOTHER’S GIFT

Farias is from a large family and is no stranger to hand-me-downs, but as a child remembers watching her mother make special dresses just for her. As she got older, she started following in her mother’s footsteps. When she was in seventh grade, she designed her first pair of bell-bottoms. They were complete with a hand-embroidered smiley face at the bottom of the pant leg, foretelling her work today. Farias modeled and was very much interested in the fashion industry when she was in her late teens and early twenties, but eventually traded the starving artist lifestyle for a more dependable career in the banking industry. She was in that industry for 28 years before having her artistic breakthrough. When the economy took a dive in 2001, there was an acquisition of banks and everyone, including Farias, lost their jobs and had to re-apply. “My daughter was two-and-a-half. I was very much a career woman,” says Farias. “With my daughter at home, I was trying to figure out something fun to do. I went to the store and bought some paints, brushes and canvas – ‘Mommy’s going to teach you how to paint,’ I said. Painting again reignited my passion and made me feel alive. It was at that time I wondered how I could have ever put that brush down.” Farias left her corporate job to stay home with her daughter and follow her passion. By 2014 she was painting on clothing, merging her two favorite things: fashion and art. Today, she has a deep love for giving back and donates her work to a variety of fundraising events. alentine’s Day is the perfect time to spoil your sweetie with a delicious dessert, and nothing says I Love You more than a sweet homemade treat. Although this recipe may taste decadent and difficult, it’s actually incred-

ibly easy to make; so even non-cooks can quickly impress a special love. Oozing with moist, molten chocolate centers, these beautiful red velvet cupcakes are visually stunning and delicious. This updated version of the classic red velvet cake makes it look like you’ve worked all day in the kitchen, but is simple to create. Use a heart-shaped cake mold for an added Valentine touch of love. Impressive and very romantic!

CHOCOLATE FILLED RED VELVET BUTTERMILK CUPCAKES CUPCAKE INGREDIENTS:

FILLING INGREDIENTS:

1 cup all-purpose flour

1 cup semi-sweet chocolate chips

3 teaspoons cocoa powder

1/3 cup heavy whipping cream

½ teaspoon salt

1 tablespoon unsalted butter

¾ cup granulated sugar ¼ cup unsalted butter, softened

12 ounces reduced-fat cream cheese (Neufchatel), room temperature

1 tablespoon red food coloring

3 tablespoons low-fat Greek yogurt (plain)

1 teaspoon vanilla extract

2/3 cup confectioner’s sugar

½ cup buttermilk

1 teaspoon vanilla extract

½ teaspoon vinegar ½ teaspoon baking soda 34

Combine chocolate, cream and butter in small saucepan. Stir over low heat until chocolate melts. Remove from heat; pour mixture into small bowl. Cool for 20 minutes. Cover and freeze for about an hour, or until mixture is thickened to a fudge consistency. Divide into 12 equal portions (or 24 if making mini cupcakes) and roll into balls. Place balls on baking pan and freeze until ready to use. INSTRUCTIONS (CUPCAKES):

mini-muffin pans (12-cavity each) with cupcake liners (or one standard 12-cavity cupcake tin) and set aside. In a small bowl, sift together flour, cocoa and salt; then set aside. In a large mixing bowl, combine butter and sugar; then beat on medium until light and well-mixed, about 2 minutes. Turn mixer to low; add egg, red food coloring and vanilla. Then, add a small portion of flour (about a third), alternating with portions of buttermilk, mixing slightly after each addition. Gently stir in baking soda and vinegar. Divide half the batter among the cupcake tins. Then, place a chocolate ball in the center of each cupcake. Top evenly with remaining batter. Bake until tops spring back when touched lightly (do not overbake), about 13-17 minutes. Serve warm, or let cool completely, then frost. Store covered in airtight container for up to three days. INSTRUCTIONS (FROSTING):

In a large mixing bowl, stir together cream cheese and powdered sugar. Beat with electric mixer on medium speed, until frosting becomes smooth and thick. Stir in vanilla. Spread frosting on cooled cupcakes. Refrigerate any leftover cupcakes and frosting. Yield: 24 mini cupcakes. Calories (per cupcake): 68; Fat: 1.9g; Protein: .9g Cost Per Serving: $.11. T

hough patients surely have noticed that Carefree Smile in Cave Creek is under new ownership, Dr. Sam Swainhart wants everyone to know that little else has changed. Longtime local dentist Dr. Peter Finocchiaro announced his retirement last summer, and in hopes of continuing the legacy of exceptional cosmetic and general dentistry at Carefree Smile that has been over two decades in the making, he sold it to Dr. Swainhart, who feels blessed to have the opportunity to start his practice at the well-established location. Raised in a small Kentucky suburb just outside of Cincinnati, he is excited to now serve his community in much of the same way he remembers his dentist growing up back home. “The dentist in the community became like a family friend, and we have great memories at the practice with the dentist

and his staff. That dentist and his family practice lead me to pursue dentistry,” says Dr. Swainhart. That pursuit led him to a scholarship with the US Army, which allowed him to attend the University of Kentucky College of Dentistry. Upon graduation, he served as a Captain in the US Army Dental Corps, where in addition to general dentistry, Dr. Swainhart also received training as a forensic dental officer. Forensic cases took priority, none more so than following the tragic events at Fort Hood in April of 2014, when a shooting spree took the lives of four people and left another fourteen injured. Dr. Swainhart was called upon to help provide identification of the shooter and the victims, for which he received the Army Achievement Medal and Army Commendation Medal for his service.

“What made this case unique was that the Fort Hood Commanding General was literally standing right outside the door waiting to pass the identification up the chain of command,” says Dr. Swainhart. “Never had I been a part of such a high profile and active investigation.” Helping others is a passion that runs in the Swainhart family, as his wife, Ashley, is finishing up her surgical training in Plastic Surgery at the Mayo Clinic. Together they have done mission work that has taken them to remote locations in Mexico, Brazil and Haiti, where on one trip alone Dr. Swainhart recalls performing over 250tooth extractions for patients, who in most cases, had to walk many miles to the clinic in an effort to receive care. The Swainharts are both excited to now call Arizona home and look forward to continuing both of their respective careers here in the Valley. Dr. Swainhart is also confident that he has found a home at Carefree Smile, where he and his staff are committed to continuing the tradition of providing the highest level of care possible while still maintaining a laid back environment where patients feel like part of the family. “We will always take time to listen to, laugh with, and get to know our patients,” explains Dr. Swainhart. “Each day I meet patients that have come from all across the country. Many from the Midwest, places like Chicago, Wisconsin, and Minnesota. Many patients come from the East Coast as well.
