Ten Things to Know About Your Divorce Divorce can be a very emotional and stressful time period. Often, people want to share all of their stories with the court. It is better to share all of this information with your attorney so he or she can better decide which stories are pertinent to your case. Indiana is a no fault divorce state, meaning no matter what the other party did, those facts will not affect whether you get divorced. Courts want to hear the facts that are going to determine custody, parenting time, child support, and property distribution. All family law matters can be settled in mediation and without having to go to Court. Mediation is a process where a third party mediator assists negotiation of a settlement agreement. The mediator does not make any decisions. This is the parties’ opportunity to create their own plan, as opposed to a court making the decisions. If the parties reach a settlement agreement, the agreement is filed with the Court. If the Court approves the agreement, it will be entered as an order.

Custody and parenting time are decided on the best interests of the children. There are several factors the court takes into consideration when determining custody and parenting time. However, it is important to note that only in extreme circumstances will a parent not have any parenting time. This is a very confusing time for children, and it is both parents job to make this as smooth of a transition for them as possible. It is not in your child’s best interest to discuss any part of the case with them or to speak ill of the other parent to or in front of them. Once you have filed for divorce, it is important to review and revise your estate planning documents. If a divorce is pending and a spouse passes, the surviving spouse may still inherit under an existing will. Additionally, if your ex-spouse is still listed as a beneficiary on a retirement plan, that spouse may still inherit outside the will. It will be important to consult with an attorney about your options.

SPOTLIGHT Karen Caprino-Burg knows a thing or two about life balance and being prepared for change. Her story shows that determination, continued action, and passion are key ingredients to long-term, sustainable success. Early in her fast-paced corporate career, Karen found herself raising a daughter as a single mother, while carefully navigating her way up the corporate ladder. For fifteen years, she oversaw the design development and facilities management of corporate offices for her employers. It was her mother’s sudden diagnosis with breast cancer that first changed the course of her life. That diagnosis coupled with a strong desire to go back to school to finish her undergraduate degree, led Karen to the University of Louisville and ultimately into medical school. While attending medical school, during the weekend of the Kentucky Derby, Karen’s life took another major turn. It was there she met her husband, Mark. Moving to Springfield, Illinois to be with Mark, she shifted her graduate work to Human Developmental Counseling. Marriage brought a whole new adventure… a blended family of five children… and all the busy-ness and financial pressure that comes with supporting a large family. Karen and Mark shared a desire for business ownership in order to create time and financial freedom which led them to open three franchise restaurants, with Karen overseeing the day-to-day management of them. Their dream for a better life soon fizzled as they realized that they were working more than ever and accumulating thousands of dollars in debt. It didn’t take long to realize that the businesses would never bring the kind of freedom they were seeking. The Power is Within You Have you ever experienced a crisis and felt like you had no control in the outcome of the dilemma? Well you always have choices no matter what the circumstances but the power is in seeing that you get to decide how to deal with the problem. And often times when you make the decision to stay empowered you take yourself out of the victim role and take charge and grow from it. As you read this you may be saying to yourself that you have absolutely no control in your situation. Perhaps your spouse has asked you for a divorce, you are sick, your house has burned to the ground, however even in those circumstances, you invariably get to decide if you are going to see any good that could come out of it. This may seem unrealistic to be so positive about an unfortunate situation. When you stay empowered and positive, three things occur. 1. You feel better about the situation and so you don't feel the devastation that naturally occurs when things get tough. 2. You deal with things differently and are more likely to attract the people into your life that can help get you through the crisis. 3. You begin to accept the dilemma as a part of life and work through things more naturally. Imagine that your spouse has asked for a divorce and you unequivocally are against it. It may feel like you are at his mercy. But the truth of the matter is you can feel your feelings, seek out support, decide that you are going to handle the separation with grace and dignity. This will likely give you more options. You will be able to notice your own strengths, you will have more confidence, you will be more fun to be around, and you will be in a better position to access people, places, and things that will afford you more opportunities. You never need to feel imprisoned by your situation. Let me give you a personal

example. I recently had an eye condition that appeared to be your Carol Juergensen Sheets basic conjunctivitis. I received treatment for it and after 3 weeks of it getting worse....I went to my wonderful eye doctor who said I had an ulcer on my cornea. He immediately referred me to a cornea specialist that indicated that my prognosis was poor. He said there were relatively no treatments and I might be heading for blindness. I decided to keep a positive attitude, utilize visualization where I would imagine the ulcer getting smaller and smaller, and stay in gratitude for my good eye that allowed me to see. One week later the ulcer was healed although my vision has been greatly affected. My doctor says that there is nothing that can be done today although I know there are amazing things that are occurring with medical research. As I wait for potential treatments, I am personally going to imagine that I can heal my eye with every visualization. I have decided that I will be the poster child for this medical dilemma and I will look forward to the opportunities that this medical crisis will bring. How We Develop Problems We were born into specific environments and to parents that had many life experiences. Some of those experiences created problems. Our parents developed certain defense mechanisms to learn to cope with those problems. As a child we learned some of those same coping mechanisms which became a frame of reference later in life. Everything we were exposed to from the moment of birth was recorded by the subconscious mind including the feelings and reactions, positive or negative, to each event. We operated within the world and experienced our own problems based on how we saw it and how we internalized it. While still having that frame of reference from our parents in terms of coping mechanisms, we develop our own unique ones based on each event we experience. These problems

created memories which produced pain; it didn’t feel good so we find ways to cope or escape through food, alcohol, smoking, drugs, etc. We become escape-aholics. Once we “escape” we then experience guilt and shame that produces more pain and it becomes a vicious cycle. Through Faster EFT and Hypnosis we can learn to stop the vicious cycle. These modalities will enable us to get back to the emotional roots of the events and change the way our mind and body reacts to the memories of them that created the escape and thus set us free. Think of a strong tree with a deep root system. If the roots were to be removed from the tree, the tree would die. Through Faster EFT and Hypnosis the emotional roots of problems can be removed and the manifested “escape” alleviated.

Are You an Effective Communicator? What’s more frustrating than speaking without being heard? We’ve all been there before, confiding in a friend as she fondles her cell phone, pitching an idea to a co-worker as he interrupts with his own idea, telling your spouse about your day as his eyes glaze over.... apparently focusing on something much more important than you. There is a difference between hearing and listening - listening is hard work, and it takes a great deal of concentration. No wonder our friends and family and co-workers can be lousy at it. But what about you -- are you a good listener? You may be that colleague or spouse or friend who never really listens and not even know it! See if you have any of these poor listening habits below, or better yet, thicken your skin and ask a friend. Distracting yourself. Sending one little text as your co-worker is talking sends an enormous message to her: You're not listening. And that hurts. Yes, perhaps you're hearing the other person, or you think you're getting the gist -- you're a multi-tasker after all -- but are you really concentrating on what she said? Focusing on a text message, or your email, or that dog over there or the shopping list you need to make is telling the speaker that those things are more important than what she is saying! Interrupting. This bad habit is three things: Self-explanatory, rude and a sign that you're not listening. Topping the speaker's story. Imagine you're excitedly telling a friend about a Washington, D.C., vacation you're planning, when he decides to cut in: "I lived there for three years and have toured the White House a couple dozen times, and really prefer the National Mall, though all the tourists typically opt for the Lincoln Memorial, which... blah, blah, blah" There's certainly nothing wrong with engaging in a conversation, but cutting into the speaker's story to talk about yourself is a sign you weren't digesting his or her message. Problem finding. Someone with this habit thinks, "I'm listening, but only enough to find a problem and fix it for you!" Sometimes this person is so skilled in the habit that he or she will find problems that aren't even there. "Oh, the trip to Washington is this month?

Why would you go there in that awful summer heat? And don't even think about cooling down in the air-conditioned museums, they're too crowded." Becoming defensive. If you're the topic of discussion, you might hear criticism that may or may not be there. And so we get defensive. When we're defending, we're not listening. Think about the last meeting, conversation or encounter you had. Did you display any of the above habits? Whether or not you did, know that everyone can improve his or her listening skills. And that's exactly what listening is: an important skill used in marriage, friendship, parenthood, management and just about every kind of relationship. Without listening skills, we're poor communicators. Think about the last miscommunication you had, or the last time something didn't go your way, and now think: How much of that had to do with not fully listening? Here's how to practice becoming a better listener: Break those habits. Now that you're aware of poor listening habits, identify when you do them -- and stop. SOLER up. Squarely face the speaker; Open up your posture by uncrossing your arms; Lean in; Make Eye contact; Relax. Paraphrase. Just like how good waiters repeat your order back to you, good listeners restate what they're hearing. Realize when you're not listening and fix it. No one is a perfect listener. If you find your attention has drifted and you weren't actively listening, be honest with whoever is talking. Communicate that yes, you're interested, but that you got a bit off track, so please repeat that last part. Remember, there is a very good reason we have two ears and one mouth, we should listen twice as much as we talk to be an effective communicator!
