Municipalities (with the exception of Philadelphia) are permitted to levy a maximum rate of $52 a year on people engaged in an occupation within the municipality (residents and non-residents). The law exempts people making less than $12,000 a year from having to pay it, has guidelines for people working in multiple municipalities during a year, and what municipalities must use the money for (25% must go to emergency services like police, fire protection, and ambulance services, and other uses are spelled out). Unlike 2004, when all municipalities were given the ability to increase the LST (at the time the tax was known as the Occupational Privilege Tax), the proposed Act 47 reforms would affect only municipalities in distressed status, and only for as long as they remain in distressed status. They will be allowed to raise it to a maximum $156 per year with court approval. A distressed municipality that opts to raise the LST would be required to increase the income exemption to $15,600 and would have to forego any attempt to boost its wage tax while in distressed status. Pittsburgh is in Act 47, but as of now the City would be barred from raising the LST because the proposed law says the permission “... does not apply to a municipality, which, on the effective date of this subsection, is not authorized to petition the court of common pleas for the imposition of an earned income tax on non-residents.” This language hearkens back to Act 222, which prohibits Pittsburgh from asking for a higher earned income tax rate under Act 47 so long as the ICA (Intergovernmental Cooperation Authority) is in existence. The City levies the LST at the maximum $52 rate now and collects around $14 million. That means approximately 270,000 people - both residents and non-residents - work and pay the tax in the City. Thus, at a yearly tax of $156 and no change in the number of people employed who are earning the slightly higher required minimum in the City would net the City an additional $28 million annually. Quotes from Pittsburgh’s local officials and staff as well as members of the legislative delegation representing the City are not happy with the LST exclusion. Why should Pittsburgh be treated differently from any other distressed municipality, they ask? And, after all, one could argue that the original idea for raising what was then the Occupational Privilege Tax from $10 to $145 was made in the first recovery plan for Pittsburgh back in 2004, so it would seem to be a singular rebuke to refuse Pittsburgh permission to impose the higher LST tax rate. Of course, the City’s advocates want a higher LST as it would represent a substantial commuter tax since a sizable number of the employees in Pittsburgh live outside the City, probably about half. Hence, the commuting workers would pay a large share of the increase in LST tax revenue. These advocates claim and have claimed for many years that non-resident workers and visitors do not pay enough in taxes to cover the cost of the services they use while in the City. Could that claim be true? We have never seen a thorough in depth, independent study that demonstrates it to be true. This is a study the Mayor and Council should commission. If it can be demonstrated rigorously and defensibly that non-residents are not paying enough in taxes to cover the services they use, the study would be a powerful tool to use to lobby Harrisburg for more City taxing authority to collect revenue from out-of-towners. However, such evidence might prove difficult to find in light of the money and benefits the City receives from taxes levied on non-residents. Directly, non-residents are paying a hefty parking tax. Before the August 1 price increases, the parking tax provided the City with $50 million in revenue. It is safe to estimate that out-of-towners are paying half of the amount and very likely more than half. County residents and visitors to the County are paying the RAD sales tax, the revenue from which disproportionately benefits the City through the support of museums, entertainment amenities, new professional sports stadiums as well as direct sharing of revenue. From the Rivers Casino the City gets about $10 million as a host fee and $7.5 million to help pay for the new Penguins arena. The County hotel tax is a principal source of funding for the new convention center. The City collects an amusement tax, paid heavily by non-residents. Moreover, visitors and commuters spend a lot of money in Pittsburgh that supports businesses who in turn pay substantial amounts of taxes to the City. Pittsburgh owes it to these non-residents to explain the costs of services they use before they ask for even more money from them. In addition, the state allowed for specific changes to Pittsburgh’s tax structure at the time of the 2004 LST increase including the institution of a payroll preparation tax to eliminate the mercantile and business privilege taxes, a facility usage fee on performers using publicly funded facilities, the shift of a quarter of a percentage point of the earned income tax from the school district to the City, and ended the City’s payment of $4 million in RAD funds to the schools as a replacement for the personal property tax. The primary question facing legislators is; will the state consider allowing Pittsburgh to use the higher LST rate if it reduced other taxes to maintain revenue neutrality? Seems like a strange compromise, and one that, if given the choice, the City probably would not accept simply because the boost in the LST would last only until the City exited Act 47. Ironically, if the state had accepted the recommendations of Pittsburgh’s Act 47 team when they said the City should be removed from distressed status any statutory revisions to the LST would be of no effect on Pittsburgh. If the ICA is terminated and the City remains in Act 47, then the prohibitions contained in Act 222 about the earned income tax would go away, and thus so too would the prohibition on Pittsburgh considering a higher LST - or to impose an earned income tax on non-residents working in the City. But most importantly, it is worth noting again how far Pittsburgh spending per capita is above the spending of well managed cities. Thus, before any talk of higher taxes or more taxing authority is proposed to the Legislature, the City needs to deal with its spending problem by lowering outlays for several years. Act 47 coordinators ought to be aggressively working to find spending reduction possibilities such as outsourcing, possibly with the County as well as with private firms. This is especially true because of the pension situation. Always seeking to raise revenues is not a sustainable solution unless the revenues come through economic and tax base growth in the City and not new taxes or higher rates on existing taxes. City schools are desperate for cash as well and higher tax rates for them seem inevitable. ARACK OBAMA PLEDGED to radically transform America when he took office. He didn't stop at America. President Obama's greatest legacy may be the radical reshaping of the global map. Fast forward three years. Here's

where we stand. Given Europe's failure to stand up to Russian aggression in Crimea, Russia's borders have expanded to include Eastern Ukraine, northern Kazakhstan and larger portions of Moldova. As of 2014, Russia had consolidated its hold on Transnistria, the Eastern region of Moldova, which is heavily Russian; Russia had annexed Crimea; Russia had placed troops inside Eastern Ukraine. But it didn't stop there. Russia began squeezing Georgia again, and pro-Russian regimes are consolidating their power in Kazakhstan and Belarus. Belarus asked the Russian government to place 15 warplanes inside the country in 2014; Kazakhstan got into a tiff with Russia over comments Putin made unsubtly suggesting a possible invasion of the country, then complied with Putin's demands when the West did nothing. Thus far, Putin has not invaded any NATO countries. But that could change, given the high Russian population in Latvia and Estonia. Meanwhile, in the Middle East, Jordan's kingdom has fallen, replaced by a radical Islamist regime. That Palestinian Arab regime has attempted to consolidate its power by forming an alliance with Hamas in Judea, Samaria, and Gaza. In Lebanon, the Iranians and Syrians have effectively annexed southern Lebanon. Israel's only quiet border is now its southern border with Egypt. In Syria, Bashar Assad has retained a measure of power by essentially conceding territory to ISIS in the eastern part of the country; after a halfhearted intervention against ISIS, the international community went quiet as ISIS formed its soughtafter caliphate in eastern Syria and northern Iraq. In response, Iran essentially invaded southern Iraq, and Turkey launched covert action against the Kurds in order to prevent the formation of a broader Kurdistan encompassing parts of Turkish territory. With the withdrawal of the United States and its allies from Afghanistan, Pakistan has once again made its presence felt. The Taliban have effectively taken control of large swaths of territory, with the help of the Pakistani regime, which has shifted leadership

AST WEEK, A GRAND JURY INDICTED the Georgia man whose toddler died of heatstroke after being left in the SUV for seven hours in June. Justin Ross Harris, 33, faces charges of murder, child cruelty and sexual exploitation of a

child (not his son, a 16-year-old girl he sexted that same day, according to police). Harris could face the death penalty if convicted. He could also become this generation's Ronald O'Bryan, the man put to death for poisoning his son with Pixy Stix on Halloween in 1974. The connection? Consider this: Police say Harris had researched hot car deaths online, as well as child-free living. Presumably, the case will be made that he planned to make his son's death look like an accident. Hyperthermia has gotten so much attention in the media that it now seems almost common. Though about 30 to 40 kids die this way each year -- or literally one in a million children younger than 10 -- if you watch TV, it feels as if it's happening right and left. Harris may -- only (SET ITAL) may (END ITAL) -have thought: Who's going to question just one more? Which brings us to O'Bryan: In January 1974, O'Bryan took out an insurance policy on both of his children. He took out an additional policy a month before Halloween and yet another policy just a few days before the holiday. What's more, a chemist who testified in court said O'Bryan had been asking him about cyanide. Add to this the fact that O'Bryan was in debt and allegedly about to be fired and the fact that he said the stranger who had given out the poisoned Pixy Stix only stuck his arm out the door and no one ever saw his face.

HOW THE HAMPTONS HAVE CHANGED: The socalled hot Hamptons of Long Island, which used to belong to me in the ‘60s, ‘70s, even ‘80s, are now impossible for mere non-rich, non-climbing, “normal” non-fashionable people. I often go when invited and observe, have fun being a houseguest and refuse to be nostalgic. In their setting on the tip of Long Island and the Atlantic Ocean, the Hamptons are incomparable and as beautiful in their way as the South of France used to be. But recently, I discovered another facet of the ubiquitous Hamptons. I have always been a devout Lay’s potato chip lover. This has nothing to do with the Hamptons but does remind me that once the food expert

It took the jury less than an hour to convict him. He was put to death by lethal injection. O'Bryan appears to have believed that so many kids get poisoned on Halloween that no one would question one more. But the actual number of kids killed by a stranger's candy on Halloween was -- and remains -- zero. If a jury decides that Harris deliberately left his son to die after researching toddler heatstroke, it could be another case of a dad's believing that a certain much-discussed type of child tragedy is so common that one more would be just a sad statistic. But the fact is hyperthermia is not that common, thank goodness. In fact, far more children die after being taken out of cars, in parking lots. We are just so obsessed by the idea that any child waiting in a car is in immediate danger that we have lost all perspective. Of course, Harris is innocent until proven guilty, so I don't want to belabor the point. And in fact, if you looked at all the crazy things I Google on a daily basis, you would take me for a pedophile with a squirrel fetish and chocolate chip cookie obsession. An online trail is not a smoking gun. What's more, throwing in the "sexual exploitation of a child" charge as if it had anything to do with the hyperthermia case smacks of damning the guy with the charges. If I were

When we are fed a steady diet of rare child tragedies in the media, they stop looking rare to all of us -- parents and cops, judges and juries, evildoers and the innocent.

“IS MY HUSBAND in your skinny, chicken-like arms? Don’t you get it? He likes women to be a mess, that’s why he’s still with me!” So snarled Elizabeth Taylor to Susannah York in 1972’s epic marital comedy - melodrama “X, Y and Zee,” in which much of the action seems to be Elizabeth changing her clothes. This one was directed by Brian Hutton, who had previously helmed “King Creole” one of Elvis Presley’s early and quite excellent films. Hutton died on Aug. 19 at the age of 79. He had long left the film industry and was working in real estate. His true legacy to film - whether he liked it or not - were his two films with Taylor, the aforementioned “X, Y and Zee” and the elegant, excellent thriller “Night Watch.” These were two of La Liz’s most entertaining films of her 1970s period of movie-making. “Zee” could be called a color version of “Who’s Afraid of Virginia Woolf” on acid. Her co-stars just stood back and let this hurricane of blue eye shadow hit the camera lens. “Night Watch” though subdued, still allowed the star to indulge in a lot of what her fans adored - big hair, big jewels, giant emotions. Both Hutton’s Taylor films were only modestly successful, but garnered excellent notices for Taylor. Pauline Kael raved over Zee: “For the first time, Elizabeth Taylor really seems to be having fun onscreen.” Hutton made only two more movies after “Night Watch,” but he’ll be remembered for having captured Elvis at his young, beautiful peak and Miss Taylor at the pinnacle of her High Rococo period - hot pants and lots of great suitcase-packing scenes.

"What if I told you naked photos of me were downloaded from my phone and are now circulating without my permission?" "How old are you, sir?" "Fifty-one. And a half." "Then I'd say, 'Ewwwww.'" Are you telling me that these photos exist? And that they were stolen?" "I don't think, so. To both questions." "Then please stop wasting the bureau's time, sir. Our docket's a little full. We're investigating possible civil rights violations in Ferguson, Missouri and we're searching for terrorism suspects worldwide, so if you'll excuse me..." "Jennifer Lawrence," I cut in. "What about her?" "The actress. I understand the FBI is investigating the theft of naked photos of Jennifer Lawrence from her phone. And Kate Upton, the model." "So?" When I answered, I realized it was the same female agent. She assured me that well known individuals such as Lawrence are not given preferential treatment. It just appears that way. "You guys give them higher priority," she said, referring to the media's fascination with covering celebrities. She added that victims of the crime that befell Lawrence, Upton and other celebrities are typically young and female, but hacking into somebody's phone is a crime, no matter who the phone belongs to and what is taken. For all other inquiries regarding the Jennifer Lawrence case, she referred me to the bureau's LA office. I saw no need to call the West Coast, for I am not interested in whatJennifer Lawrence does in the privacy of her own home and can only wish prison time on sick individuals who feel private photos are public domain. But there's something comforting about knowing that, although I will never have a body like Jennifer Lawrence's, the United States Department of Justice won't treat me any differently.

Q. I’VE BEEN through quite a bit of therapy, and I believe it is important for me to be honest with my feelings at work. The other day I told a coworker he was hurting my feelings, and he just got mad. Isn’t the point of mental health to know how you feel? Is there a way to talk about my feelings that doesn’t make my situation worse? A. The way to talk about your feelings without making a situation worse is to use your feelings internally to figure out what you want - then limit yourself to sharing your specific request. Telling a coworker that he made you sad, mad or scared will just make him hear that you think that he is a bad and mean person. Feelings are designed to be our inner compass that highlights what we want out in the world. Sometimes our feelings require us to see and then change our own behavior. Sometimes our feelings require us to ask for help from other people. Both examining our own behavior and asking others for help are uncomfortable experi-

ences. We like to think that what we are doing is just fine and that we don’t need any help from anyone. However, the workplace is a real team effort. If we are to achieve productivity, profitability and results our company hired us for, we’ve got to have high-level skills in collaboration and interdependency. Let’s say you come to work and find you are angry at a coworker who provided inaccurate numbers for a report you are writing. Sure, you could tell him he made you mad. You could also accuse him of nefarious intentions like sabotaging your job. You could also just let him know that if the numbers he provides are inaccurate, you’ll have to explain why to your boss and you’d prefer not to credit him with the incorrect data. People at work don’t change because we are upset. They care a lot about getting what they want but care little about our feelings. Beyond the fact that feelings are not influential, stating our feelings is usually alienating to others.

Somewhere during the experimental 1960s, society seemed to decide that letting it all hang out was a good recipe for a high-quality life. However, at work you are better off letting your inner reactions hang in and being quite strategic about exactly what you hang out in words and actions. My corporate clients tell me this interpersonal habit has even improved their love lives, friendships and parenting because it focuses them on asking for what they want, not telling others how they feel about what they are not liking. Try going home and asking your significant other for what you want rather than complaining about what you don’t like. I’ll bet you see an immediate uptick in cooperation from those who matter most. If you can simply acknowledge and contain even your most intense emotional reactions internally, you can then consider the best course of action. You can use intense reactions as gasoline in the fuel tank to drive your career where you want it to go. Some people simply open their mouth at work and let fly with whatever they’re feeling. If you are a professional who can filter these emotions through the cool layer of your head, you’ll get the best of both worlds. Q. I often end up saying things I regret at work. Is there any trick to give myself a moment to think before I open my mouth and make an enemy? A. Yes, repeat back in your own words what the other person is saying. The person is front of you will feel validated and calmed and you give yourself a moment to reflect on how to react.
