Diabetes, hypertension, respiratory syndrome common among policemen PANAJI: hey are people who are guarding the citizens of the state and have to be on their toes every time. Yes, we are talking about the men in uniform – the policemen. When it comes to the health, they are human beings and suffer from the same illness like others do. Like the trend everywhere, the cops – though needed to be fit every time, are now also suffering from the illness like diabetes, hypertension and respiratory syndromes. Goan Times recently visited the Police Head Quarters, Panaji to find out the various ailments related to the police personnel and the medical

Dr. Dattaprasad Nagvenkar briefed us about the various sicknesses and the medical aid provided to the policemen throughout Goa at all police stations. Majority of the policemen, he says, suffered from Upper Respiratory Tract Infections (URTI) while the age group above forty years suffered from hypertension, diabetics and chronic illness. The paper found out that for about 5000-odd police personnel there are basically just two doctors looking after the police medical officers unit. Both the medical officers make it a point to visit the all the police stations once in a month. There are routine checkups done for the police as well as their families by

cases are referred to GMC for further treatment. Dr. Nagvenkar said, “As far as the medicines are concerned, 99 % of the basic medical facilities are made available to us whenever required. Also the medicines are of very good quality especially for the treatment of hypertension, diabetics etc. Only very severe and critical cases are being referred to GMC.” Though there was good medical aid being given to the policemen, yet Goan Times found out that the Police Medical Dispensary lacked a lab technician with the required infrastructure for investigation of checks ups like cholesterol test, urine test, blood test, kidney test and other higher investigations. Regarding the sick leaves Dr. Nagvekar said “on an average we provide the patient with 3-5 days leave and we call them for follow up and

The government provides them with 15 sick leaves in a year.” He further says, “According to the feasibility, once in a year the complete medical investigation is done for all the policemen, who have crossed the age of 40 years.” The medical officers take good care of the police personnel, home guard and civil defence by providing them with necessary medical aids. ARGAO: It is known as the commercial capital of Goa but Margao is one area which has been left behind big time when it comes to the development of the city. This is the case despite its MLA Digambar Kamat being the chief minister of the state for almost five years. Leave other issues, let us concentrate only on the basic thing like the bus stand – which is in a miserable condition. The Margao KTC bus stand located in the heart of the city needs urgent renovation, reconstruction, proper planning and maintenance. water is flooded everywhere. Unlike most of the bus stands which have good hygienic canteen facility the passengers of the Margao bus stand have to depend on the nearby stalls. Even the staff canteen is maintained in an unhygienic environment. Several cases of pick pocketing have been witnessed, yet there is no security on the bus stand. There is no proper parking space for the auto rickshaws and taxis. Basically the nature of the business of the shops run under the ‘Deen Dayal Yojna’ is defined, but

Goan Times found out that they have extended their business and misused by lending it for rent. What really seems to be horrifying is the fact that the Sulabh toilets are in a pathetic condition. As a result people urinate in the open space adjacent to the toilet, making the area dirty and a breeding ground for flies and mosquitoes. Goan Times found out that the urinals were charged, so most of the conductors and locals found it easy to urinate in the open space without paying anything. The Sulabh Toilet in charge says, “Though we don’t charge the KTC conductors yet they urinate outside. The place should be urgently cleaned and covered with tiles and boards should be put up to avoid such kind of act.” Presently, due to the increase in the number of buses and

routes, the bus stand cannot accommodate the overload. Now a days, the buses are overcrowded and there is lot of rush due to the pass and parcel system. The number of passengers plying through shuttle service has also increased and you see the long queue waiting for the tickets. To manage the space for all these activities becomes difficult during the peak hours. One of the local passenger Sheena Rodrigues complained by saying, “There is no check on the intake capacity of the local buses and we find it very difficult to travel. Many people urinate in the open space near the toilet and the make the place dirty and nobody is bothered to take action against them.” Speaking to Goan Times, the Depot manager of Margao KTC bus stand C.A. Periera said, “We are looking forward for a nice renovated bus stand for the public and the government has to decide upon it quickly.” When asked about the action being taken against

vercrowding of buses is an everyday scenario. No matter how many new buses have been introduced yet the conductors keep packing passengers like sardines in a can. It is mentioned inside the buses 11 standing yet the number of people standing is countless. Due to overcrowding of buses at times it even leads to accidents. There are special seats reserved for ladies, senior citizens, handicaps but these seats are not given importance nor are the reservations adhered to what so ever. Goa’s major population use buses for commuting and yet nothing has been done to make their travelling safe and secure. When will the government react to the plight of the commuters? And for how long are the people supposed to risk their lives? It is either now or never safety measure needed to be taken at the earliest

“Old enough to rape but not to be punished”

T

he other day I woke up to the shocking news that the sixth accused in the Delhi gang-rape case-allegedly the most violent of the six assailants, was declared a minor by the Juvenile Justice Board. What was most shocking was that the Board went by the school records and rejected the Delhi police’s plea to conduct a bone ossification test to determine the age and ascertain the juvenility of the accused. One is all too aware of the manipulations that undergo in the school records during admission. What this means is that since the accused is a minor, he cannot be sentenced to more than three years in a special home. Once he becomes an adult (which is in a few month’s time) he cannot remain there or be sent to jail for adults. Hence he could walk free by June when he becomes an adult. That’s shocking to say the least. This will probably encourage more minors to commit such a heinous crime with the knowledge that they cannot be touched by “the long hands of the law”. Incidentally according to statistics more juveniles were apprehended on the charges of rape, molestation and abduction of girls than for murder, attempt to murder and homicide. The data compiled by the National Crime Records Bureau (NCRB) of the 30,766 juveniles apprehended in 2011 as many as 25050 juveniles were held on charges of rape (1231), molestation (628) and kidnapping and abduction of girls (646). If the minor involved in the Delhi gang-rape is not tried as an adult it will be a great disfavour to the memory of the Delhi braveheart. There is a lot of discussion all over the country as to whether juveniles who commit heinous crimes like rape and murder should be booked under the Juvenile Justice Act or if they should be tried as adults. In this respect it must be said that what is required is a gradation among the juveniles as per the age. A seven-year old minor should not be clubbed with a seventeen-year old when it comes to booking a minor for a crime as the mental growth of the two juveniles will have a difference of ten years. Another aspect that needs to be taken into aspect while dealing with juveniles is the severity of the

crime. A case of rape and/or murder is a much severe case than a case of shop-lifting incident. And what happens if an adult commits a serious crime but has been medically proved that he has the brain of a minor? Will he also be tried under the Juvenile Justice Act for the crime committed? One suggestion would be that if the rapist has been proven to be HIV positive then he should be tried for both rape and murder as the victim will obviously be infected by the HIV virus and face a slow and agonizing death from AIDS. Hence a culprit who is apprehended in an attemptto rape case should also be subjected to harsh punishment. Mandatory registration of rapists is necessary. Even eve-teasing should be considered as a serious offence. As many rape cases begin with a simple-looking eveeasing incident. Police need to stop being insensitive so that the victims are not reluctant to report rape cases at the police stations. Police need to know that women do not ask to be raped by the way they dress. Given the fact that her death has shaken the conscience of an entire nation a memorial should be put up at the capital city in memory of all those who have been victims of rape. The Home Minister Sushil Kumar Shinde said that that the law against rape will be revamped and discussion with Law Ministry will be held on the question of giving death penalty in the “rarest of rare cases” of rape. Now what does the term “rarest of rare cases” actually mean? Will only cases such as rape of a tree-year old girl or a seventy-five year old woman come under the ambit of the

“rarest of rare cases”? Will that imply that other cases of rape are accepted by the society as they are not considered as “rarest of rare cases”? It must be said that as far as the victim is concerned every case of rape is the rarest–of-rare cases and needs to be treated as such by the law as and when it is enacted. Incidentally the “rarest of-the-rare” condition is also applied while imposing a sentence in a murder case. There seems to be a lot of ambiguity about this term which can be interpreted differently. There was a suggestion that the names of all rapists should be made available on the police websites. This way those who want to employ people can check on their background. It must be said that not all people have excess to the internet. A better alternative would be to have the word “Rapist” branded on the skin of the arm of those convicted for rape with a hot metal. Besides making it easy for the public to

point out a rapist, it will in a way will also deter other would-berapists from carrying out the dastardly act. In a path-breaking order a trial court has reportedly decided to try an HIV positive man for attempt to murder (Section 307) after he allegedly raped a minor infecting her with lifethreatening disease knowing fully well that it can cause death of the person. The court observed that there is no special legislation to deal with such a situation of accused transmitting life-threatening disease to another person intentionally which is likely to cause death of the person. Under the given circumstance the court was of the opinion that such a person who is accused of rape is also liable to be charged under section 307 (attempt to murder). This seems an appropriate step as the victim not only has to go through the mental ordeal and social stigma but also faces the risk of death.

“EVERY RUN COUNTS”

M

onths after the ban on mining operations in the state Union Agriculture Minister and the Nationalist Congress Party Supremo Sharad Pawar visited the state to hear the grievances of the mining-affected people in Goa. Or did he? Pawar met a group of 150-odd mining-affected people at Azad Maidan on Monday and assured them that their concerns would be put before the Centre. He reportedly told the gathering that while the NCP had maintained that the party supports legal mining in the state, there was also a need to protect the environment. Pawar also promised he will take the initiative to lead a delegation of mining-dependent stakeholders from Goa, including representatives of truck drivers, barge owners and other mining-dependent, to meet Prime Minister Manmohan Singh soon. This, he claims, will ensure that the case before the Supreme Court can be presented in the right perspective. He said that politics needed to be kept aside in this issue as it concerned the livelihood of affected people. What is pertinent to note here is that more than anything, with this meeting Mr Pawar has kicked-off his campaign for the forthcoming Loksabha elections 2014, which could be preponed. In all probabilities, the NCP will contest the North Goa seat, as per Cong-NCP alliance pact. Now, what needs to be noted is that, despite being on a private visit, Pawar – whose party was whitewashed in the last assembly polls, took-off some time and met the mining affected people. Knowing very well that the mining affected people could form a large chunk of voters and his party can benefit tremendously if this master-stroke works. As it is the NCP has a handful of MPs in the parliament and despite his party contesting just one seat in Goa, Pawar knows very well – even one can be handy. After all, he has been the president of the BCCI and the ICC, which govern cricket, and knows “Every Run Counts”. However, the voters and the mining affected people must know that none of the political parties be it Congress, NCP or the BJP is really interested in solving their grievances and it is their vested interests, which is bringing them here. Neither can they do much as the case is before the Apex Court now. Statements made by Chief Minister Manohar Parrikar too have no value until the Supreme Court vacates the order. It is more likely that with Loksabha election in close sight the political bigwigs would just try to blame each other for the crisis.

We must get a real Lokayukta!

he Jan-lokpal and Lokayukta Movement is based on the experience that ‘autonomous institutions independent of government control are necessary to combat corruption as corruption is creature of government.’ The Lokayukta proposed to be appointed under the Goa Lokayukta Act 2011 is powerless due to lack of autonomy and because Goa Lokayukta’s recommendations are merely advisory and not binding on government. Therefore the need to appoint a Lokayukta modeled on the Uttarakhand pattern is of utmost importance. It may be recalled that the ruling Bhartiya Janata Party had given to India Against Corruption (IAC) Goa Unit a written pre-poll commitment that if it came to power it would ensure that The Goa Lokayukta Act 2011 will be in tune with the Lokayukta Act as enacted in the State of Uttarakhand. It was expected that by way of implementing said promise, Goa legislative Assembly would pass a amendment to The Goa Lokayukta Act 2011 for purpose of incorporating relevant provisions of the Uttarakhand Lokayukta Bill 2011. The Chief Minister however told the delegation of IAC Goa and made a public announcement through media that amendments to Goa Lokayukta Act 2011 will be carried out only six month after appointment of Lokayukta. The people of Goa were given the impression that any legislative amendment prior to appointment of Lokayukta will have the impact of delaying appointment of Lokayukta. Despite the fact that the Lokayukta is not appointed, now surprisingly the Chief Minister has taken a ‘U’ turn by introducing in the legislative assembly “The Goa Lokayukta (First Amendment) Bill 2013. The said Goa Amendment bill 2013 instead of incorporating good features of the, infact defeats the purpose of insistence on Uttarakhand Bill. The Goa Amendment Bill provides that if the declaration made by Lokayukta is not accepted by the competent authority within a period of three months from the date of receipt of the report it shall be deemed to have been rejected by the competent authority. On the other hand the Uttarakhand Bill gives power to its Lokayukata to approach High Court for seeking appropriate directions to be given to the public authority in the event of public authority rejecting Lokayukta’s recommendation and / or if the public authority does not comply with Lokayukta’s recommendation within 15 days. It is suggested that for the good of Goa, Goa’s Lokayukta should

be given the above power and also be conferred the following important powers of Uttarakhand Lokayukta : • To recommend cancellation or modification of a lease, license, permission, contract or agreement, if it was obtained by corrupt means. • To recommend blacklisting of a firm, company, contractor or any other person, involved in an act of corruption. • If during any investigation under Lokayukta act, the Lokayukta is satisfied that any preventive action is necessary in public interest to prevent the ongoing incidence of corruption, it may make any recommendation to the public authority concerned to stay the implementation or enforcement of any decision or take any such action as is recommended by the Lokayukta.

• To issue appropriate directions including transfer or suspension of government servant, if during the course of investigation into a complaint, the Lokayukta feels that continuance of a government servant in particular position could adversely affect the course of investigations or that the said government servant is likely to destroy or tamper with the evidence or influence the witnesses or is likely to continue with corruption. • To direct appropriate authorities (at any stage of investigation under Lokayukta Act) by an interim order to take such action as is necessary, to prevent the public servant from secreting or transferring the assets allegedly acquired by public servant by corrupt means. • Provide like the Uttarakhand Bill that if the Investigating Officer finds any property or asset which appears to have been acquired by the corrupt acts of an accused person, it shall make an order of attachment of those assets. The Special Court will pass an order for the confiscation of all such assets and properties. In addition to above further incidental and consequential suitable amendments should be made keeping in mind the following desimilarities between Goa Lokayukta Act 2011 and Uttarakhand Bill:• The Goa Lokayukta is at mercy of the Police as it does not have a strong separate investigation or

prosecution wing and does not have the power to appoint Director of Prosecution. The Uttarakhand Bill specifically states that Lokayukta will have a separate investigation and prosecution wing and shall also have power to appoint Director of Prosecution. • Uttarakhand Lokayukta is empowered to make an annual assessment of the number of special courts required for completion of cases within prescribed time and to make a recommendation to the government for creating a specific number of special courts. The said recommendation is binding on the government. The Goa Lokayukta Act is silent in this regards. • The Uttarakhand Bill provides that ‘sanctions under Sections 19(1) and 19(2) of the Prevention of Corruption Act, 1988 and under Section 197 of Code of Criminal Procedure (Cr. PC) shall be deemed to have been granted once these have been granted by Lokayukta. In contrast, the proviso to Section 17 of the Goa Lokayukta Act 2011 mandates that ‘if prior sanction of any authority is required under any law for the time being in force for prosecution against public functionary, then such prior sanction shall be obtained from such authority before initiation of such prosecution.’ • The Uttarakhand Lokayukta is empowered to prepare its budget and send the same to government, and after government sanction to incur its expenditure as per financial rules of the government (or rules framed by Lokayukta) without any further administrative or financial approval from any government agency to incur expenditure. The Goa Lokayukta does not have such financial autonomy. • Uttarakhand Lokayukta is empowered to select and appoint a Secretary to the Lokayukta who shall enjoy the status and rank of Principal Secretary in the Government. On the other hand Goa Lokayukta Act provides that if appointment of Secretary is made by Lokayukta by direct recruitment, the Goa Public Service Commission shall be consulted. Cutting across party lines the politicians in Goa are only interested in delaying tactics. Therefore people of Goa must once again unite and press for their just demands. We must ensure that we get a real Lokayukta and not a paper tiger. Adv. Ajay, who is based in Mumbai, divides his time between big television shows like Kaun Banega Crorepati, Koffee with Karan, Mastermind, etc. and documentary films. Some of the films he worked on include the award winning “Q2P”, “Chinese Restaurants”, “Bombay Eunuch” and “Slumdog Millionaire”. He also works with some of India's leading artists on video installations.

For him reality TV and documenting reality are as far apart as an aardvark is from Antarctica. “But the most significant difference for me is the motivation. In the mainstream commercial set-up, the motivation is usually profit, but documentary allows for a varied motivations that go beyond commercial reasons,” he says. According to him a good place to shoot is the one which helps you tell a story. “I like the sea and spend a lot of time there. The ever-changing light on the water, the sand and in the sky enthralls me. There's a film I am working on in Jerusalem. It is about the remarkable friendship between a Palestinian Arab taxi driver and a Jewish American professor,” he adds. He loves films of Ingmar Bergman, Tarkovsky, Lars Von Trier, Abbas Kiarostami, Nuri Bilge Ceylan, Ranjan Palit, Gurudutt, Amar Kanwar, etc. Ajay is a man who doesn’t have a routine day planned out. Every day is different for

him. It varies from day to day. He kick starts his day mostly at around 7:00 am – 7:30 am and then it depends on what the day has in stored for him. His lunch, dinner, recreation and family time all depends on how much of time his work and other priorities demand for him. So one can say that his time table for the day changes as per the work he has to complete in that particular day. He is a film-maker on a quest to put forth emotions through his visuals. He comes from a generation of film-makers who have inherited this idea that documentaries are going to change the world.

he All India Chess Federation (AICF) has been able to produce champions like Vishwanathan Anand, Manuel Aaron, Dibyendu Barua and Parimarjan Negi,

in Indian Chess, who have effectively made a mark in the world forum. When it comes to Goa we are not lagging behind though, Bhakti Kulkarni, Anurag,

Mhamal, Ivana Furtado and a few other chess enthusiasts are making Goa proud in the game. Goan chessmen have brought chess back into the limelight with wins now and then. The outcome of playing Chess is the most unaccountable in the world. Everything is in a state of flux, and this includes the world of chess. Anurag, Mhamal ranks third in India in the U-18 Rank and has the FIDE master standing at 2401 at the moment whereas Bhakti Kulkarni is a Women’s Grand Master ranking 55 among females in Asia and standing at 2231 FIDE rating currently. Bhakti Kulkarni, a queen in the sport of chess, says “The chess scenario in Goa is great. Our players are

But according to me there are a lot of problems at the association level and are slowly getting sighted with the passing time which need to be payed heed to and rectified during the course of time”. It looks like some section of people want to keep the Goa State Chess Association (GSCA) in their hands and ruin the upcoming future of chess in Goa. At the end of the day the players should not suffer so perhaps maybe they need to be supported directly. A great future awaits the Goan chess fraternity as there are a huge upsurge of talented Goan chess players who are making their presence felt across the national scene. But it’s the people in authority understand the seriousness of the sport and stop making the sport suffer at the cost of fulfilling their own personal motives.

Life is like a game of Chess, changing with each move. All that matters on the Chessboard is good moves and it’s time the people in authority make good moves. It’s high time the people in authority make choices not for themselves but for the betterment of this sport.

T

hough this article is born 8000 metres above sea level while in transit in an airplane, but it deals with a very important law dealing with the Land. The Goa Daman and Diu Land Revenue Code 1968, as passed by the then Goa Daman and Diu Legislative Assembly came into force as a Law on 31st July 1969, after it received the assent of the President of India. The said law was primarily passed to consolidate and amend the Law relating to the Land and Land Revenue matters in the then Union Territory of Goa Daman and Diu. The G.D.D. Land Revenue Code 1968, when it came into existence was mainly for the sake of categorizing and imposing land taxes for revenue collection by the Government. However from the time of its inception, it has been slowly and steadily gaining immense practical importance in the realm of economic activity and has become a very significant Law in today’s life. When I say this, all shall agree with me as the stated law deals with getting one’s name in the land rights of a property purchased by him, development of property, construction of houses and complexes by obtaining Sanads, matters concerning decisions on disputes of property rights, business, and in an active state, also concerning livelihood and even shelter of people as the very commercial activity for livelihood or sometimes construction of one’s dwelling house is dependent on the nature of zone that a land is classified, which list is merely illustrative. However there are certain glaring shortcomings of this law, or rather to put it in a simple phrase, the law is not in tune with the present times and thus needs reforms. It is a widely accepted unwritten rule, that society keeps on changing i.e. it is dynamic in nature and the law concerning a society thus, cannot be static. It is essential for a healthy society that the law keeps pace with the changing society. The G.D.D. Land Revenue Code 1968, is in dire need of reforms to keep pace with the Society as it exists today. Certain areas that need to be highlighted are: (i) The “To the letter implementation” approach of provisions of the G.D.D. Land Revenue Code 1968 is leading to immense hardships to public at large especially in mutation matters. There is thus a need to simplify the Mutation process in view of the Public at large. (ii) Though the Authorities under the said Land Revenue Code carry on as ‘Courts’, they

are often seen to be working with some Administrative rather than a Judicial/Quasi judicial mindset with general tendency to direct the parties to get orders from Civil Courts in areas which rightly and if necessary, by clear legislation should have been handled by them. (iii) It is illogical that a Degree in Law is not made mandatory for holding the posts of Dy. Collectors, Addl. Collectors, etc., who besides being Magistrates, happen to be the sole Adjudicating Authorities in the various statutory proceedings under the Land Revenue Code. It is said that, “Eyes cannot see what the mind does not know”. The resultant absurdity of the situation can very well be seen in certain cases, in the form of non admissibility of evidence, not giving other party opportunity to be heard, ordering parties who had produced all title documents in a partition case to obtain a declaratory Decree about his title from a Civil Court after some opposite party just alleged having title in the property without producing title documents or even making out a prima facie case, no reasoned decisions as mandated by law, etc. (iv) The Record of Rights entries in Goa have no cross reference to the rights of the parties and particular lands mentioned in the Survey. This is a penalty we Goans are paying for the overzealous and hasty compilation of survey records when the infamous survey was first carried out in Goa in 1971 without any verification of title or prescription of deterrent penalties for false declarations while entering names of holders in the occupants’ column. The heavy cost and the difficulty in getting mutation done on this account has resulted in many people not applying for mutations at all and hence many properties in the survey records still show the names of the ancient owners. The inability of the authorities/ Govt. to properly appreciate the gravity of the situation and allocate sufficient funds to sincerely take up the work of indexing of the Registration records with effect from 1-111965, the date of coming into force in Goa, of the Registration Act of 1908 further magnifies the problem year by year.

Without indexes, the citizens are without any means to ascertain and safeguard against getting cheated before purchasing a land by perusing indexes to see if particular properties have been dealt with in the past. Even Legal Luminaries in Goa shall find it impossible to complete their title search due to this situation; while the title certificates issued by certain legal practitioners are often found to mention that “due searches have been made in the records and indexes”, which is not possible as indexes do not exist after 31-10-1965.

By Adv. Brijesh PS Sardessai Based on this background, some specific points that I wish to put forth are as follows:1. Need to simplify prohibitively difficult Mutation Procedures (u/Land Revenue Code): (a) The Talathis do not immediately (and suo moto) enter in the mutation registers all transfers, etc. of immovable properties reported (in form XIII) by the Registration offices, (required under sec 97(1) of LRC r/w. secs 96 & 102), but wait for the parties to apply first. This is not statutorily approved and it deprives people of opportunity to see at one place all the dealings with the particular land. The entry could be made even ‘provisionally’ in the existing Remarks column (or by opening a new column by amendment for such Form XIII report forms by Sub-Registrars). Certification for entry in the Record of Rights u/sec 97(5) could be done later when the parties choose to apply. (b) The aim in mind of the policy makers should be towards ensuring simple and non costly procedures for its citizens and remove hassles in its Laws. Mutation is a regular legal process in transfer of properties and it should desirably be made a “single window procedure”,

starting with the registration of a document and putting into place a process for avoiding the unending trips of the parties to the mutating offices. There is no reason at all for the Revenue authorities (Talathis, etc.) not to suo moto enter transfer of properties in their mutation records once they receive the intimation in Form XIII (under sec. 102 LRC) from the Sub-Registrars and then after reasonable time directly enter the same in the Record of Rights registers. The duty to identify the parties happens to be already discharged by the Sub-Registrars under their Registration Act. This should be more so when the names of the transferors in the Sales, Gifts, etc. transactions reported in Form XIII by the SubRegistrars tally with the names of occupants already existing in the Mutation records. As regards transfers by heirs whose names do not appear in the occupants’ column, the Talathis can always follow the prescribed procedure, but that too necessarily after first making entry u/sec 97(1) which is their mandatory statutory duty. There is a need to 2. (a) Sub-divided lands in a developed colony are not presently given separate survey numbers and that necessitates sending of notices to the owners as well as to all the previous purchasers of the property. This deters many from applying for mutation. Hence, at the time of approval of sub division into plots for colonies, etc., separate survey Sub. Division nos. should be suo moto given by Govt. to each sub-divided plot. (b) The Mutation offices insist on notices being sent by registered post A/D to all concerned. In cases of colonies, the total postage charges at the present rate of Rs. 25/-each run into thousands of rupees and more. This position needs a serious thought and alternate provisions need to take its place. The party should be allowed to take acknowledgements by personally handing over the notices to his neighbours and others in the colony. witness in all the cases may not be a healthy practice. This aspect definitely needs a revamp. 3. In Goa, there is no cross reference between the basic title records and the land parcels under the new survey. The old cadastral survey was in place but the survey under Indian laws was effected at a later time without reference to the ownership of lands or Land Registry numbers which under Statutory Law had final presumptive value. There appears to be no provision under the Land Revenue Code which bars the Revenue offices from verifying the identity of the property based on the boundaries and other data in title documents, the old Cadastral Survey plans and actual inspections in most of the cases. If there is hesitation on the part of the Dy. Collectors, etc., they should be assured by proper clear amendment. 4. In the partition proceedings under sec 61 of LRC, a narrow view is usually taken to stop the partition proceedings and order the parties who have already filed title deeds, to obtain a Declaratory Decree from Civil Court, even when a mere objection is filed alleging lack of title of applicant party and the objecting party not producing any title deed or similar evidence to prima facie establish its case against the partition applying party who has produced all title documents should be avoided. A mere objection letter should not be a sufficient basis to bring to a halt the process of partition unless proved beyond reasonable doubts by the party posting objections. 5. Often the Revenue Courts do not ex parte hear/dismiss applications even when the applicant/complainant remains absent consecutively as many as 4 to 5 times, leading to much harassment to the other parties. So also several times, Orders are not passed even after a passage of 6 months or so and many adjournments in between. This is an area with heavy potential for probability of corruption and there should be a limit to the number of times an applicant remains absent after which the case is to be necessarily dismissed. 6. It should also be ensured that the banks and other financial institutions actually report the equitable mortgages in respect of landed properties, to the Talathis as is mandatory under sec. 96 of the LRC. And file copies in Registration Offices for indexing- preferably in a single window manner.

Food court (Steamed fish minced with spices, combined with potatoes, shaped into cutlets and fried)

1 small piece ginger 2 green chillies 5 garlic cloves 100 gms bread crumbs 2 eggs Fresh mint leaves Salt according to taste 1 tsp turmeric powder 1 tsp red chilli powder 1 tsp fennel 1 tsp black pepper 1 bread slice Refined oil Egg white Lime juice of half a lime 1 potato, boiled 50 gms flour

Instructions

• In a pan, steam the fish in a strainer with boiled water, ginger, green chilly, garlic and cover the pan. • In a blender, mix bread crumbs, egg, egg white, garlic, ginger, green chillies, fresh mint leaves, salt, turmeric powder, red chilli powder, slice of bread, refined oil and half a lime. • In a mortar and pestle smash fennel and black pepper, add them into blender. • Add a little water and pound them together. • Add the steam fish into the blender and grind them well. • Transfer them into a bowl and add one boil potato for starch. Mix them well. • Keep it in the fridge for 10 minutes. • Add little refined oil in the pan and fry the cutlets both sides. • Serve hot.
