► Andrus Intellectual Property Law: Gary A. Essmann (intellectual property litigation; patent law and litigation; trademark law, 1995) received a Civic Achievement Award issued by the Waukesha County Sheriff's Department. George H. Solveson (litigation – patent, 2012) was elected as a fellow of the Wisconsin Law Foundation, an honorary legal society. ► Axley Brynelson: Carl A. Sinderbrand (construction and environmental litigation, 2007) helped secure a ruling in favor of the residents of Pleasant Lake against the Department of Natural Resources, in what Milwaukee’s Journal Sentinel called “a major victory for environmentalists.” The judge ruled that the DNR failed to take into consideration the environmental impact of a large dairy farm’s plan to install a high-capacity well near Pleasant Lake when the agency reviewed the proposal.

► Cafferty Law Office: Patrick K. Cafferty (criminal defense: non-white-collar, 2013) won a reduction of eight years to the sentence of his client, who was convicted on a felony murder charge and sentenced to 30 years in prison in 2008. ► Cannon & Dunphy: Mark L. Thomsen (plaintiffs’ personal injury litigation, 2005) represented Milwaukee Police Chief Ed Flynn before the Milwaukee Fire and Police Commission panel in the inquiry into Flynn’s firing of an officer. The panel unanimously upheld Police Chief Flynn’s decision, saying that the officer had violated police protocol in patting down and subsequently fatally shooting a mentally ill man. ► Cullen Weston Pines & Bach: Tamara Packard (appellate practice; employment law – individuals; litigation ‒ labor and employment, 2011) was part of a team that prepared Dane County to issue marriage licenses to same-sex couples in the event of a federal court ruling striking down the Wisconsin’s ban on same-sex marriage. Lester A. Pines (non-white-collar and white-collar criminal defense; employment law – individuals, 2003) and Susan Crawford assisted attorneys from Planned Parenthood and the ACLU Reproductive Rights Project in winning a permanent injunction against a Wisconsin state law, passed in 2011, that was found to have “imposed unconstitutional burdens on the right of Wisconsin women to access abortion services.” ► Davis & Kueltau: Robert W. Burns (employment law – management; labor law – management, 2010) was interviewed on Green Bay’s CBS TV5 about the effect the right-to-work bill in Wisconsin would have on companies and union members. Kathy L. Nusslock (commercial and labor and employment litigation, 2015) was appointed chief operating officer. ► Gimbel, Reilly, Guerin & Brown: Franklyn “Frank” Gimbel (criminal defense: whitecollar, 1983) was interviewed in Milwaukee Magazine. ► Godfrey & Kahn: Mike B. Wittenwyler (administrative / regulatory law; corporate compliance law, 2013) testified before the Joint Committee on Elections about Wisconsin’s campaign finance law.

► Habush Habush & Rottier: Robert L. Habush (plaintiffs’ medical malpractice law, personal injury and product liability litigation, 1983) was the subject of a biography written by Milwaukee author Kurt Chandler and published by the American Bar Association.

Anthony A. Tomaselli (litigation – intellectual property; litigation – patent, 2013) obtained a $44.1 million verdict in favor of Ultratec Inc. and CapTel LLC regarding a patent on captioned telephone technology for the hearingimpaired. Katherine M. Perhach (bankruptcy and creditor debtor rights / insolvency and reorganization law and litigation; eminent domain and condemnation law; mortgage banking foreclosure law; litigation – banking and finance; litigation – real estate, 2010) presented at the “Third Annual Barristers for Babies” March of Dimes event. John A. Rothstein (commercial litigation, litigation – real estate; litigation – trusts and estates, 2005) was named chair of the Fiduciary, Trust and Probate Litigation Subgroup.

► Law Office of Marin J. Greenberg: Martin J. Greenberg (sports law, 2009) was quoted in The New York Times about the strain put on college football coaches, saying, “They are asked to do just about everything under the guise of being the football coach.” Mr. Greenberg has represented many coaches over his 25 years in practice and says that they are “worth every penny.” ► Meissner Tierney Fisher & Nichols: Thomas J. Nichols (tax law, 2007) co-authored an op-ed piece on national tax reform titled “Tax Reform Should Go Right Down Main Street” for The Wall Street Journal. ► Michael Best & Friedrich: The Wisconsin Law Journal honored José A. Olivieri (immigration law; education law; administrative / regulatory law; labor law–management; employment law– management, 2003) at its 2015 Leaders in the Law dinner. At the second Wills for Veterans event, Michael Best & Friedrich partnered with Marquette Law School students to draft nearly 100 estate planning documents pro-bono for Milwaukee-area veterans. ► Morgan Legal Group: Geoffrey R. Morgan (banking and finance law; corporate law; securities / capital markets law; securities regulation; corporate governance law; corporate compliance law, 2007) founded boutique firm Morgan Legal Group after more than 20 years at Michael Best. ► Murphy Desmond: Glorily A. Lopez (immigration law, 2007) hosts the radio talk show, Inmigración al Día, on La Movida 1480 AM twice monthly, on which she answers calls and texts with questions regarding immigration. ► Ogletree, Deakins, Nash, Smoak & Stewart: The labor and employment law firm opened an office in Milwaukee, adding a number of attorneys formerly of Krukowski & Costello, including Kevin J. Loeffler (employment law – individuals, 2013). ► O'Neil, Cannon, Hollman, DeJong & Laing: Grant C. Killoran (litigation – health care, 2015) was elected one of five delegates to the American Bar Association House of Delegates by the State Bar of Wisconsin. ► Quarles & Brady: John T. Barry (tax law and litigation, 2009), Bernard J. Kearney III (real estate law, 2012), David P. Olson (employee benefits [ERISA] law, 2009), Elizabeth A. Orelup (corporate law; commercial finance law, 2007), and Peter A. Peterson (appellate practice; commercial litigation; product liability litigation – defendants, 2014) was elected President of the Milwaukee Bar Association (MBA). ► Ruder Ware: G. Lane Ware (business litigation; corporate M&A and securities law; commercial litigation; corporate law, 1993-1994) passed away at age 75 after a battle with acute myeloid leukemia. He was president of Ruder Ware for 27 years until he retired at the end of 2013, after 48 years in the profession. ► Stafford Rosenbaum: Christopher B. Hughes (real estate law; land use and zoning law; municipal law, 2008) was re-elected board of directors chair and managing partner. Barbara A. Neider (commercial litigation; ethics and professional responsibility law, 2007) and Meg E. Vergeront (employee benefits [ERISA] law; civil rights law; litigation – labor and employment; employment law – management, 2010) were part of a team that represented Novartis Pharmaceuticals Corporation in a deal with the Wisconsin Department of Justice regarding the state’s claims that the drug manufacturer had artificially inflated costs of brand name prescription drugs, causing Wisconsin’s Medicaid program to reimburse pharmacies for more money than necessary. ► Whyte Hirschboeck Dudek: Daniel J. Miske (commercial litigation; litigation – real estate, 2012) was elected to the firm’s board of directors. The firm opened a Waukesha County office, expanding its corporate and environmental teams; Timothy A. Nettesheim (tax law, 1995), and Donald P. Gallo (environmental law and litigation, 2010) formerly of Reinhart Boerner Van Deuren, joined the firm to lead the team.

BY MAGGIE BURCH ■ Seventeen years ago, Michelle Behnke stepped away from the legal career she had known, working at a mid-sized law firm in Madison then serving as in-house counsel to CUNA Mutual Group, and started her own firm with the hopes of creating a work-life balance that would allow her to give as much time and attention to her family as she gives her clients. Now—and for the past 17 years—Behnke helps her clients do the same: venture out and expand a business or start a new one, lending her business knowledge and real estate law expertise to help them reach their goals. Michelle Behnke & Associates consists only of Behnke, one associate, and her assistant. Clients praise Behnke for the close personal attention she gives them. Behnke says of her approach, “My personal touch, along with my wealth of experience, allows clients access to a high level of experience in a personalized setting.” Behnke’s real estate practice focuses mostly on commercial transactions, from the acquisition of new land to a company that’s opening a new franchise leasing existing space. Three of Behnke’s more well-known, Wisconsin-based clients are Welton Enterprises, Southern Wisconsin Foods, and Valley King of Wisconsin, and Behnke likens the work she does for these clients to serving as in-house counsel: They seek out her legal skills as well as her business judgment. “Being able to work with clients long-term and to understand the whole of their business, and then to consult and guide them, is the core of what I love about practicing law,” Behnke says. “We’re not just putting a band-aid on when something goes wrong. I want to help guide my clients to anticipate and prepare for issues so they don’t hit bumps in the road.” In addition to her clients, Behnke is also passionate about the community service and professional organizations she has been involved in. Early on in her career, she served on the Madison Community Housing Foundation board of directors and established a first-time home-buyer loan program that helped people attain home-ownership, an accomplishment that has been proven to benefit families as well as communities. She is also active in the State Bar of Wisconsin and the American Bar Association, having previously served as president and on the board of governors, respectively. Behnke said a career highlight for her was being admitted to the American College of Real Estate Lawyers (ACREL) in 2005, a distinguished invitation that is only extended to the best in the practice field.

AN UNEASY UNION

As Wisconsin becomes the 25th right-to-work state, the future of unions is uncertain. But should labor be sorry to see them go?

he Badger State is known for many things—cheese curds, Harley Davidson, the Green Bay Packers. Now, Wisconsinites can add another item to their list of achievements: On March 9, 2015, Wisconsin became the 25th state to adopt a so-called “right-to-work” law, and in doing so, could be the tipping point in a heated national debate. Scott Walker, the 45th governor of the state in which the Republican party was founded and a 2016 presidential hopeful, passed legislation that will ban 12 | W I S C O N S I N

compulsory union membership or what are known as “union security clauses” from new and renewed labor agreements with privately held companies, effective immediately. As it stands in states without right-to-work laws, it can be a requirement for employment that a person pay union dues, or fees in lieu of union dues, whether or not they want to participate in their union. Take away the mandate, cut a hole in the pockets of the unions. “A union’s income is dues, and they can only put so much time and resources into business development and expansion,” says Bernard J. “Bud” Bobber, vice chair of Foley & Lardner’s

national labor and employment practice. “In a right-to-work state, unions face the prospect of going to all that effort to organize and finding half or more individuals choose not to pay dues.” That is a pretty unsustainable business atmosphere…and it’s one that is spreading. Despite being largely controversial, right-to-work is picking up speed in the United States, particularly in the labor-heavy Rust Belt. Oklahoma passed right-towork in 2001, and, after more than a decade gap, three states approved similar laws within four years: Indiana, Michigan, and Wisconsin in 2012, 2013, and 2015, respectively. “Legislators look at this and say, ‘If you can pass this in these strong union states…’ ” says Scott Beightol chairman

of Michael Best & Friedrich and director of the Employment Law Alliance. “You’ll see a domino effect in New Mexico, Colorado, Missouri. These are places looking at this now.” In Kentucky—where passage of state legislation seemed unlikely, according to Beightol—10 counties passed right-to-work under home-rule provisions in their state constitution, revealing a growing trend at the most granular levels. “There are a lot of different motivations to enact these laws,” said Michael Aldana, partner in the labor and employment group of Quarles & Brady. Benefits like bypassing what some consider overly generous benefits packages culled by unions for employees and economic growth perceived as tied to right-to-


work legislation. “Businesses like right-to-work states,” says Bobber. “They prefer to not have a legal obligation to deal with a union—unions add a layer of bureaucracy and inefficiency at a time of high rate of change, and thus it is really hard for a business to be nimble. You want to react to marketplace changes, competitors, and the like, and it creates drag if you mandatorily have to bargain in good faith for every important change.” “There are studies that show there is a net gain in jobs in states that enact right-to-work laws,” Aldana says, although he acknowledges that there are studies to the contrary as well. Economist Thomas Holmes’s research released in 2000 stated that growth in manufacturing employment was 26 points higher in rightto-work states than their counterparts, but this could point to the attractiveness of whole pro-business packages rather than the direct benefits of right-to-work laws. Beightol, who counsels companies in the site selection process, notes that right-to-work is a preference for companies considering opening a new plant or expanding a current facility. But though the correlation between business growth and right-to-work laws might be debatable, the effect this legislation has on labor unions is clear-cut: It’s all about the money.

Opponents loudly decry right-to-work legislation as political maneuvering, pro-corporation and, above all, unfairly damaging to unions’ ability to generate funding. The thinking is, most laborers, facing the choice of something for nothing or something for…fees, will choose the freebie. This “free

rider” debate is at the heart of the union argument against right-to-work. “A collective is only as valuable as the size of the group,” says Beightol of possible free-rider majorities at union employers. “What if it turns out to be 80 percent free riders? That will be a change: Do they want to be exclusive reps for a bargaining unit or members only?” Wisconsin state’s AFL-CIO and the state’s chapters of International Association of Machinists and United Steelworkers have already filed a suit alleging the new law is unconstitutional, but similar suits in Indiana did not stand and the Indiana Supreme Court unanimously struck down the challenge to right-to-work in December 2014. Though constitutional challenges to right-to-work have failed by-and-large, it isn’t all doom and gloom for labor now. In 2011, the Economic Policy Institute found that wages, rates of employer-sponsored health insurance, and companysponsored pensions were lower in right-to-work states. And though proponents of right-to-work question the relevancy of unions in a postOSHA, post-Title 7, 401k world, Wisconsin’s own Scott Walker is leading a trend to reduce worker’s compensation benefits in the state that had the first constitutionally recognized worker’s compensation law, established in 1911. “A major concern with the proposed new legislation is the inefficiency of splitting the functions of worker’s compensation in Wisconsin among different agencies,” says Aaron Halstead, an attorney in the labor and employment groups of Hawkes Quindel. “But even more so, it would eliminate judicial oversight in compensation agreements, meaning no one checking: ‘Is this fair?’ ” And, on Hawkes Quindel’s blog, Halstead wrote: “Governor Walker’s budget bill proposes wideranging changes in the statute which are nearly universally viewed as unnecessary.” “Maybe now unions will be highly motivated to demonstrate their value,” Bud

Bobber says. “They have to earn that business.” Between that and a new “you’ve got nothing to lose” sales pitch, there is a possibility that an unintended consequence of right-to-work is more, rather than less, unionization. And with new so-called “quickie election rules,” labor has an opportunity to get in, stir the pot, and seal the deal—fast. “A union might be able to get a sufficient show

of interest and have a ‘quickie’ election conducted before a company has the opportunity to mobilize and effectively present a campaign against Union representation,” says Aldana. Will unions go members only, shine up their bill of goods to lure new support (And if you aren’t satisfied, it is no cost to you!), or die on the vine as funds run dry?
